Minutes of the annual meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City;
on April 4, 1955•
President Bach called the meeting.to order at 2:00 O clock P. M., the
following members being present: President Bach, Aldermen Moody, Schroeder,
Schwanke, Tingley and Whiting; Alderman Anderson arAved at•4:40 P. M. Absent:
None.
After opening the meeting President Bach introduced the new members of
the Council, Alderman Paul J. Schwanke and Alderman Albert J. Tingley. He then
stated that he wished to extend a cordial welcome to the new Alderman to the
Rochester official family and hoped that they would find the work instructive and
interesting. He then announced that he had prepared a list of Council Committees
and requested the Clerk to read the list of names to serve on the various
committees:

President Bach then introduced Mayor Claude H. McQuAilan who also
welcomed the two new Council members. He stated that he felt the members of the
Council should consider some of the smaller problems as well as; the larger ones
during the next fiscal year, for example the matter of truck traffic in the
residential and hospital zones, the parking of cars on one side of.certain streets
and numerous other problems. He further suggested that the Council make some
provision for a Civil Defense Director. He then stated his appreciation of the
cooperation he had received from the other members of the governing body and then
requested the Clerk to read his appointments to the following Boards:

(Alderman Schroeder moved that the Mayors appointments be approved. Alderman
Moody seconded the motion and all voted in favor thereof.
Alderman Whiting introduced the following resolution wh-1ch was read
and upon -motion by Moody, second by Schroeder, that the said resolution be adopted
as read, and all goting in favor thereof, President Bach declared the said
resolution duly passed and adopted:
"WHEREAS, It is deemed expedient and necessary that the
Common Council of the City of Rochester, Minnesota,, adopt rules
of order for the conduct of its business, and
WHEREAS, A copy of Robert's Rules of Order (Revised) of the
1915 Copyright, is before the Common Counci-1,
SO THEREFORE, Be it resolved by the Common Council of the
City of. Rochester, Minnesota:
That the said Robert's Rules of Order be adopted by this
Common Council as rules of order for the conduct of its business."
Alderman Whiting introduced the following resolution which w-as read
and upon motion by Schroeder, second by Schwanke, that the said resolution be
adopted as read, and all voting in favor thereof, President Bach declared the
said resolution duly passed and adopted:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the said Common Council of the City -of Rochester,
Minnesota, hereby adopts the following rules and regulations
for the order. of business of said Common -Council:
1. Roll Call. The roll call of -the Common Council
shall be had and taken in its alphabetical order according
to .the names of the members, except that the name of the
President of the Common Council shall - be called first at
the. first roll call of -each meeting and -then after that,
at that meeting, his name shall be called a -ad vote taken
after the. expression of each of - the other members of the
said Common Council, or when a 5/7 vote -is required.
2. Reading and approval of the minutes of the proceeding
meeting.
3. At first meeting, the appointment of officers and
committees.
4. Public hearings,
5. Reading of petitions and communications.
6. Reports of committees. All reports of committees
shall hereafter be made in writing, unless ordered otherwise
by said Common Council.
7. Unfinished business
S. Resolutions and ordinances.
9. Bills and claims.

President Bach then stated that the next order of business would be
the approval of the minutes of the meeting of March 29, 1955 and upon motion by
Schroeder, second by Moody, the minutes of the meeting of March 29, 1955 were
approved.
President Bach stated that the next order of business would be the
reading of applications and appointment of City Officers.
The application of F. R. Finch for reappointment to the office of City
Clerk was read and upon motion by Whiting, second by Tingley, F. R. Finch was
appointed as City Clerk for the ensuing official year.
The application of R. V. Ehrick for reappointment to the office of
City Attorney was read and upon motion by Moody, second by Schroeder, R. V.

The application of C. A. Armstrong for reappointment to the office of
City Engineer was read and upon motion by Schroeder, second by Schwanke, C. A.
Armstrong was appointed as City Engineer for. the ensuing official year.
The applications of Garnet Spring for reappointment as Building
Inspector, Paul T. Plantz for reappointment. as Electrical Inspector, Charles H.
Dornack for reappointment as Plumbing Inspector and William Burrows for re-
appointment as Heating Inspector were each read. A motion was made by Whiting,
second by Schroeder, that action on the applications be deferred for one week.
The application of W. J. Barden for reappointment as assistant. to the
City Treasurer was read and upon motion by Schroeder, second by Moody, W.J. Eardex
was appointed as assistant to the City Treasurer for the ensuing official year.
The application of Agnes Decker for.reappointment as'secretary to the
Building, Electrical, Plumbing and Heating Inspectors was read and upon motion by
Whiting, second by Moody,,Agnes Decker was appointed as secretary to the Building,
Electrical, Plumbing and Heating Inspectors for the ensuing official year.
The application.of Flora C. Anderson for reappointment, as stenographer
for the Chief of Police and Juvenile Office was read and upon motion by Moody,
second by Schroeder, Flora C. Anderson was appointed as stenographer for the
Chief of Police and Juvenile Office for the ensuing official year.
The application of C. A. Cottingham for reappointment as City Weighmast(
was read and upon motion by Schroeder, second by Schwanke, C. A. Cottingham was
appointed as City Weighmaster for the ensuing official year.
The application of Emil J. Aufenthie for reappointment as City Pound
Master was read and upon motion by Moody, second by Whiting, Emil J. Aufenthie
was appointed as City Pound Master for the ensuing official year.
The application of Frank W. Everett for reappointment to the office of
Fire Warden for the City of Rochester was read and upon motion by Moody, second
by Tingley, Frank W. Everett was appointed as Fire Warden for the City of
Rochester for the ensuing official year.
The application of Ivan.Boyd.for reappointment as Assistant Custodian
of the City Hall and also for reappointment as custodian of the voting machines
was read and upon motion by Tingley, second by Whiting, Ivan Boyd was appointed
as Assistant Custodian of the City Hall and custodian of the voting machines for
the ensuing official year.
The application of Harold .Weisener for reappointment as Assistant
Custodian of the City Hall was read and upon motion by Schwanke,-second by
Tingley, Harold Weisener was appointed as Assistant Custodian of the City Hall
for the ensuing official year.
The application of Merlin Mewhorter, Jr. for reappointment as Assistant
Custodian of the City Hall was read and upon motion by Schroeder, second by Moody,

The application of James A. Waters for reappointment as Chief
Maintenance Man in the Parking Meter Department was read and upon motion by
Schroeder, second by Whiting, James A. Waters was appointed as Chief Maintenance
Man in the Parking Meter Maintenance Department for the ensuing. official year,
The application of Joseph Healey for .reappointment as Assistant
Maintenance Man in the Parking Meter.Department was read and upon motion by
Schwanke, second_by Tingley, Joseph Healey was appointed as Assistant Main-
tenance Man.in the Parking Meter Maintenance Department for the ensuing
official year.
The application of Mark D. Blanchard for reappointment as City Painter
was read and upon motion by Moody, second by.Schroeder, Mark•R. Blanchard was
appointed as City Painter for the ensuing official year,,
President Bach then stated that the next order of business would be
hearings and bids to be opened on the following projects:
First hearing on the construction 'of a curb and gutter on 9th Avenue
Southeast from 9th Street to loth Street Southeast. -Mr. Richard White of 918 -
9th Avenue Southeast was present and protested the additional charge of $1.50
per front foot for roadway construction. He stated that he felt the cost should
be taken care of by general taxation as had, been previously done. Mr. Howard
Smith also protested the additional charge. A petition signed by 18 residents
on 9th Avenue Southeast opposing the construction of a curb and gutter on 9th
Avenue Southeast between 9th and loth Street Southeast if the extra charge
for roadway construction is to be assessed was read and ordered placed on file.
First hearing on the construction of a curb and gutter on 14th Avenue
Northeast.f rom 7th to 9th Street Northeast. Mr. Richard Cleeremans was present
and urged that the project be done.
First hearing on the construction of a curb and gutter on 12th Avenue
Southeast from 4th to 6th Street.Southeast, Mr. Joseph Mackey was present and
protested the construction of the said curb and gutter. Mr. Sylvester Kegler
was present and urged that.the Council go ahead with the project.
First hearing on the construction of a curb and gutter on llth Street
Northwest from 2nd to 4th Avenue Northwest. Mayor McQuillan requested that the
hearing be continued until the evening meeting when some of the property owners
wished to appear,
First hearing on the construction of a curb and gutter on lath Avenue
Southeast from 6th to 8th Street Southeast. Mrs. Daniel O'Brien was present
and inquired as to whether or not she had to pay for the full amount of the

abutting curb and gutter on her property, her lot being triangular and having a
frontage of 207 feet.

Southeast from 12th to 13th Avenue Southeast. There was no one present wishing
to be heard.
First hearing on the construction of a curb and gutter on 6th Street
Southeast from the bridge to loth Avenue Southeast. There was no one present
wishing to be heard.
First hearing on the construction of a- curb and gutter on 6th Avenue
Southeast from llth to 12th Street Southeast. There was no one present wishing to
be heard.
First bmaring on the construction of a curb and gutter on 2nd Street
Northeast from llth to 14th Avenue Northeast. One lady inguked Af the City would
take the tree out of their boulevard, she was informed that it would be a part of
the project.
Second hearing on the construction of a storm sewer lateral to drain the
interior of Block 4, Park -side Sub -Division.

Bids for the construction of a sanitary sewer, watermain-and sewer and
water connections in Peck's Fifth Addition. The bids of Carlisle G. Fraser in the
amount of $3,187. SO for sanit-ary sewer, $3, 70g.20 for water main and $2, 422, 80
for sewer and water connections and Acton Construction Company in the amount of
$3.,662.80 for sanitary sewer, $4,109.90 for water main and $2,664.00 for sewer and
water connections were each received and opened and upon motion by Schroeder,
second by Moody, the same were referred to the Sewer and Water Committees and the
City Engineer for tabulation and report.
Bids for grading, base construction and bituminous surfacing on llth
Avenue Northeast and 15th Street Northeast in Peck's Fifth Addition. The bids of
Leon Joyce in the amount of $2,203.00 for grading and $3,693. 50 for base constr-
uction and bituminous surfacing and Robhester Sand & Gravel Company in the amount
of $3,843.95 for base construction and bituminous surfacing. were each received and
opened and upon motion by Schroeder, second by Schwanke, the same were referred to
the Street & Alley Committee and.the City Engineer for tabulation and report.
Hearing on the proposed change of zoning of the west 59 feet of the
north 791 feet of the east 91 feet of Lot 17 and the west 50 feet of the south 55-gl
feet of the east 91 feet of Lot 21, Block 6, A. W. Butzky's Addition (1118 - lot
Street S.W.) from a residential to a multiple dwelling zone. There was no one
present wishing to be heard. Upon motion by Tingley, second by Whiting, the City
Attorney was instructed to amend the Zoning Ordinance to include the above
requested change.
Hearing on the proposed change of zoning of Lot 1, Block 1; Lot 1, Block
2;-%-Lot 26, Block 2; Lot 1, Block 3 and Lot 26, Block 3 in Bielenberg & Giese Third
Addition from a residential to a multiple dwelling zone and the south 350 feet of

Block 4, Bielenberg & Giese Third Addition from a residential to a commercial zone.
There was no one present wishing to be heard. Upon motion by Tingley, second by
Whiting, the City Attorney was instructed to amend the Zoning Ordinance to include
the above requested change.
Hearing on the proposed change of zoning of Lots 2 and 3, Block 2,
D. P. Maddens Addition from a residential to a commercial zone. There was no one
present wishing to be heard. Upon motion by Whiting, second by Schroeder, the
City Attorney was instructed to amend -the Zoning Ordinance to include the above
requested change.
Proposals for doing of the official printing and advertising for the
City of Rochester. The proposal of the Rochester Post Bulletin to publish the
official printing and advertising for the City of Rochester at the rate established
by the statutes of the State of Minnesota for legal publications was read. Mayor
McQuillan stated that the Charter specified that all legal printing was to be
do.ne at I of the legal rate. After further discussion, Alderman Whiting moved
that the Rochester Post Bulletin be designated as the official newspaper of the
City of Rochester. Alderman Schroeder seconded the motion and all voted in favor
thereof.
Proposals for being designated as City Depositories. No proposals were
received at this.meeting.
The request of the Rochester Junior Chamber of Commerce for an appro-
priation from the Music Fund to offset the expense of the music at their annual
Gypsy Frolic to be held on May 7th was read. A motion was made by Schroeder,
second by Schwanke, that the City make available the sum of $199.50 for band or
bands to play music during the period of the Gypsy Frolic. All voted in favor
of the motion.
The following opinion of the City Attorney addressed to the City Clerk
-was read and upon motion by Whiting, second by Schroeder, the same was approved
and ordered placed on file:
"In response to your inquiry, the provision of Section 293 of the
Charter of the City of Rochester giving .additional compensation
to the chairman of the Street and Alley Committee, the Finance
Committee and the Sewer Committee was eliminated by the amendment
of that Section adopted by the voters of the City of Rochester
at the Special Election held on September 14, 1954.
Therefore, from this date forward no.additional compensation
shall be paid to the chairmen of those committees."
A communication from M. W. Price, City Assessor, calling the Council°s
attention to Senate File 1231 and its Companion House File 1413 pertaining to the
Office of County Assessor and abolishing the offices of local Assessors except
in cities of the first class was read. Alderman Tingley moved that the Common
Council go on record as opposing the adoption of Senate File 1231 and Companion
House File No. 1413. This motion is based on opposition to the principal of
state and county control of City Assessors. He further moved that a copy of

this motion be forwarded to Senator Walter Burdick and Representative Leo D.
Madden by the City Clerk. Alderman Schwanke seconded the motion and all voted in
favor thereof.
The following letter from the Board of Public Health; & Welfare was read:
"The Honorable Mayor and Members
of the Common Council
Rochester, Minnesota
Gentlemen:
A group of recommendations relating to garbage and refuse
disposal was submitted to you by the Board of Public Health and
Welfare on August 7, 1953. The fourth recommendation dealt with
combined collection of garbage and rubbish which quoted in part
as follows: "In so far as practical, this system should be
uniform, complete and mandatory. From a health standpoint the
manner of storage and collection may be more important than the
final method of disposal. Moreover, combined collection of
garbage and refuse can be provided at less expense to Rochester
citizens than two separate collection systems." The stated con-
siderations in the conversion to a combined system of collection
may be summarized as follows:
1. Limits on type and volume of refuse will have to be set
to exclude construction wastes and industrial wastes.
2. Storage of garbage and refuse will have to be controlled.
3. Place of pick-up, whether street curb or rear of house, is
of considerable financial importance. (Subsequently, members of
the Council expressed a preference for rear of the house pick-up.)
4. For most efficient and sanitary collection, the modern
"Packer" type truck should be provided.
5. A purposeful plan should be made to avoid undue hardship
for private refuse haulers.
In order to introduce this combined collection program in
accordance with the above principles, the Board no*w proposes that
(1) we convert the present collection equipment to refuse packing
type truck bodies and (.2) provide the combined service to the
approximate 3,300 residences now being served by the city garbage
collection service..
We propose to obtain four new trucks with 13 cu. yd. capacity
refuse packing bodies to replace the k cu. yd. non -packing garbage
trucks which are 10-1.7 years old and in need of replacement. With
three men per truck, both garbage and rubbish could be collected
twice weekly in ae.cordance.with the present schedule, at a monthly
.fee of $1.50 which would adequately provide for labor, maintenance
and depreciation.
We hereby request that the four collection vehicles, at a total
estimated cost of $32,000 be purchased at this time. -This expendi-
ture could be re.paid, for the most part, at the time of sale of the
city farm property.
.In contemplating the purchase of these trucks it is also necess-
ary to contemplate ordinance authorization of function and establish-
ment of collection fees. In the beginning of this service the Board
contemplates extending it only to its present residential customers.
A change in fees is necessary to cover the cost of the increased
service. We believe these are the two major points n4eding consid-
eration in an ordinance change at this time.
We will be pleased to meet' with the Council at this time to
discuss this plan"and the possibilities of placing it in operation.

Alderman Whiting moved that the matter be referred to the Council as a Committee of
the whole and the President of the Council be instructed to schedule a meeting with
the Board of Public Health & Welfare as soon as possible. Alderman Schroeder
seconded the motion and all voted in favor thereof.
A request from the Public Health & Welfare Department for substitution

of recommendations made in their budget request of September 20, 1954 when salary

recommendations were made for all personnel of the health department except the
health officer and psychiatrist, for whom recommendations.were made in our letter
dated October 25, 1954. The requested salaries read as follows:

President Bach ordered the request placed on file.

A letter from the Olmsted County Community Council requesting that the
City Council appoint one of their members to serve on this Council. Alderman
Moody was requested to represent the Council which he agreed to do.
A communication from Gamehaven Area Council of Boy Scouts of America
signed by William Holmes requesting a date to meet with the City. Council was
read and the same was referred to the City Attorney.
The following letter from the City Engineer was read: .
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
Your approval is requested on the General Plan for Proposed
5th Street Northwest widening from T. H. 52 to 8 Avenue Northwest.
Approval of the General Plan would constitute (1) acknow-
ledgment of the need for this improvement., (2) approval of the
general. location (3) approval of the general features of constr-
uction; primary lane street, with limited access and service
.roads where abutting land use requires. (4) Authorization to
proceed with detailed plans (5) authorisation to initiate steps
to secure necessary reight-of-way.
The accompanying plan includes only the section from T.H.
52 to 8 Avenue Northwest. This section alone will provide a
much -needed service, but is, only the first part of a Thru street
from T. 9, 52 to Broadway and 2 Avenue. Northeast. The location
of this 2nd section has not been determined. It is under study
by this department and the Planning Board,

Alderman Whiting moved that the Council give approval on the general plan for
widening on 5th Street Northwest from T. H. 52 to 8 Avenue Northwest, including
approval of the five suggested steps as listed in the City Engineers letter
above. Alderman Tingley seconded the motion. After further discussion Alderman
Tingley withdrew his'second and Alderman Whiting withdrew his,motion.
A motion was then made by Alderman Whiting that Alderman Schroeder,
as a committee of one, arrange a meeting between -the Council and the Planning
Board, at the earliest possible time, to discuss this proposed improvement of
widening 5th Street Northwest from T. H. No. 52 to 8th Avenue Northwest. Alderman
Schwanke seconded the motion and -all voted in favor thereof.
A letter from the Minnesota Department of Health transmitting a copy of
a report of our Municipal Water Supply Section covering an examination of plans

on water main extension in the City of Rochester was read and President Bach
ordered the same placed on file.
The report of the Civil Defense Director for the period of December 1,
1954 to April 1, 1955, showing the duties of the Director for that period, and
requesting that the Council consider the same part time basis as for 1954 was
read and President Bach ordered the same placed on file.
The report of the City Weighmaster for the month of March, 1955 showing
fees collected for loads weighed in the amount of $156.90 was read and President
Bach referred the same to the Finance Committee.
The annual report of Rochester Bus Line, Inc. was read and President
Bach ordered the same placed on file.
The report of the Clerk of Municipal Court for the week ending March 31,1
1955 showing total criminal fines and costs collected $1.578.50 and civil fees
received $.70 was read and having been approved by the City Attorney, President
Bach ordered the same placed on file.
President Bach called a recess at 5:30 P. M.
President Bach called the meeting to order at 7:30 P: M.
The recommendation of the Sewer and Water Committees that the bid of
Carlisle G. Fraser for construction of a sanitary sewer and water main in llth
Avenue Northeast in Peck's 5th Addition be accepted at the tunit prices bid and
checks be returned to the unsuccessful bidders was read and upon motion by Moody,
second by Anderson, the recommendation was approved.
The recommendation of the Sewer and Water Committees that the bid of
Carlisle G. Fraser for construction of sever and water service connections in llth
Avenue Northeast and and 5th Street.Northeast in Peck's 5th Addition be accepted

Stephan were present and urged that the Council abandon the project of constructing
a curb and gutter on llth Street -Northwest from 2nd Avenue to 4th Avenue Northwest.
After hearing those present a motion was made by Schroeder, second by Moody,
instructing the City Clerk to prepare a resolution for the next meeting abandoning
the said project.

Mr. Max Durand, representing the City Employees Union Local No. 897,
was present and inquired as to what was going to be done in regard to setting
salaries and requesting anz audience with the Council. Mr. Orville Mertz of the
Fire Department and Mr. Donald Crowe of the Police Department also requested an
audience with the Council in regard to setting salaries. They were informed
that they would be contacted as to when a meeting would be held.

Alderman Moody seconded the -motion and all voted in favor thereof. Alderman
Whiting,then withdrew his motion approving the said resolution -and Alderman

An Ordinance annexing to the City of Rochester, Minnesota, a part of
Section 25, Township 107, North of Range 14 West, in Olmsted County, Minnesota,
to be known and designated as Woodland Addition, was given its third and final
reading.
A motion was made by Schroeder, second by Moody, that the said ordinance
be adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted.
An Ordinance annexing to the City of Rochester, Minnesota, a part of
the Southeast Quarter (J) of Section Three, Town One Hundred Six, North of Range
Fourteen West, in Olmsted County, Minnesota, was given its third and final
reading.
A motion was made by Moody, second by Schroeder, that the said ordinance
be adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted.
An Ordinance providing for the formation and government of the Police
Department of the City of Rochester, Minnesota, was given its first reading.
A motion was made by Whiting, second by Schroeder, and upon roll call
and all voting in favor thereof, the rules were suspended and the ordinance was
given its second reading.
A motion was made by Schroeder, second by Moody, and upon roll call and
all voting in favor thereof, the rules were suspesled and the ordinance was given
Its third and final reading.
A motion was made by Moody, second by Anderson, that the said Ordinance
be adopted as read, and all voting in favor thereof, President Bach declared the

Mr. C. A. Armstrong, City Engineer, presented,a copy of " an.: order for
the purchase of one aerial mosiac map from Mark Hurd Aerial Surveys, Inc. in the
amount of $2,000.00. Upon motion by Whiting, second by Anderson, the Mayor and
City Clerk were instructed to execute the -said order.
The recommendation of the City Engineer that he had examined the plat
of Baihleyls First Addition and that it met the requirement of Ordinance No. 706
and he recommended its approval was read and upon motion by Moody, second.by
Schwanke, the said plat was approved and the City Clerk was instructed to sign
the said plat and have it recorded with _the Register of Deeds.
Mayor Mcquillan stated that he had received numerous complaints on the
one-half hour parking meters in the City and felt that some study should be made
to correct this if possible. Mr. Stanley Drips s-tated ,that the Planning and
Steering Commission were making a study of this at present and hoped to be able tol

report on same in the near future.
Upon motion by Anderson, second by Moody, the meeting was adjourned until
