Minutes of an adjorrued regrlar meeting of the Common Council of the
Common Council of the City of Rochester, Minnesota, held in the Council Chambers
in the City Hall in said City, on April 11, 1955.
President Bach called the meeting to order at 7:30 o'clock P. M.,.the
following members being present: President Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley and Whiting. Absent:. None.
Upon motion by Schroeder, second by Moody, the minutes of the meeting
of April 4, 1955 were approved.
President Bach stated this as being the time and place set for the
second hearing on the construction of a storm sewer in 7th Avenue Southwest, 8th
•
Avenue Southwest, Memorial Parkway and 11i Street Southwest in Parkside Sub -
Division. There was no one present wishing to be heard.
The following preliminary estimates submitted by the City Engineer were
each read and President Bach ordered the same placed on file:
Preliminary estimate for construction of .sanitary sewer and water
service connections in'Bielenberg & Giese Third Addition*in the
amount of $9,360.00;
Preliminary estimate for construction of a water main in Bielenberg
& Giese Third Addition in the amount of $28,265.20;
Preliminary estimate for construction of a sanitary sewer in
Bielenberg & Giese Third Addition in the amount of $15,281,204
Preliminary estimate for construction of a storm sewer'lateral
to drain Block 4, Parkside Addition in the amount of $7.06.204
Preliminary estimate for construction of a storm sewer in 7th
Avenue Southwest, 8th Avenue Southwest, Memorial Parkway and
112•Street Southwest in Parkside Subdivision in the'amount of
$44,188.80; and
Preliminary estimate for construction of the portion of the Northwest
and Southwest Sanitary Sewer Relief Line from the Trunk Line Sewer
In place in the Mill Reservation of Northern Addition on the -west
side of Cascade Creek to 14th Street Northwest at 3rd Avenue
Northwest -in the amount of $17, 234.40.
The recommendation of the Street & Alley Committee that the ten ('10)•
applications for Concrete Contractors Licenses (Alvin E. Beniko, E. J. Vonch,
Ernest C. Schacht, Leland -Fay, Stephan B. Woodward, Edward Mahoney, Earl F.
Cooke & Son, 0. A. Stocke, The Kruse Company and Robert J. Smith) 'as 'submitted
on April-4th be granted was read and upon motion by Tingley, second by Whiting,
the recommendation was approved.

A request by Mrs. Karl H. Postier, Chairman of the Y-Teen Committee
of the Y. W. C. A., to conduct their annual taffy sale on Saturday, April 16th
was read and upon motion by Schroeder, second by Schwanke, their request was
granted.
The appointments by the City Clerk of Miss Elfreda Reiter as Deputy
City Clerk and Clerk of Registration, Mrs. Geraldine Bielenberg as Bookkeeping
Machine Operator, Stenographer and Clerk of Registration and Miss Darlene
Folkert as Clerk Typist and Clerk of Registration were read and upon motion by
Moody, second by Schroeder, the appointments were approved.
The appointment by the City Attorney of Miss Lois Ringenberg as
Secretary to the City Attorney was read and upon motion by Schroeder, second by
Moody, the appointment was approved.

The Mayor's appointment of Mr. Louis Hemker as Assistant Weed Inspector
was read and upon motion by Schroeder, second by Anderson, the appointment was
approved.
The Mayor's appointment of Mr. Stanley Drips as Civil Defense Director
was read and upon motion by Schroeder, second by S;chwanke;:, the appointment was
approved.
Communications from Mr. & Mrs. Burnett Ives to have their name withdrawn
from the Petition for construction of a curb and gutter on 13th Avenue S. E. from
6th to 9th St. S. E.; Clarence C. Morse to have his name withdrawn from the petits
for construction of curb and gutter on 6th Avenue Southeast from llth to 12th St.
S. E.; Grace Arend to have her name withdrawn from the petition for construction
of curb and gutter on 9th Avenue S. E.; Mrs. Myrltle Mellin to have her name
withdrawn from the petition for curb and gutter on 12th Avenue Southeast; and
Harold L. Wheeler, John C. Tulare, J. Alfred Peterson and Florence Aufenthie to

A letter from the Board of Park Commissioners transmitting specifications
If.or remodeling the interior of North Hall lobby and the sidewalk repairs together
with a letter from Ellerbe and Company explaining the reasons'for the change in
these specifications was read and'upon motion by Schroeder, second by Tingley,
the same was referred to the Public Grounds Committee.
A request from the Board of Park Commissioners for an appropriation in
the amount of $4,000.00 for dredging of streams in the City of Rochester was read
and upon motion by Schroeder, second by Moody, the same was referred to the
Street & Alley Committee for recommendation.
The request of the Board of Park Commissioners for- an appropriation in
the amount of $1,000.00 for trimming of and removal of dangerous trees was read
and upon motion by Schwanke, second by Schroeder, the same was referred to the
Street & Alley Committee for further study and recommendation.
The following proposals for being designated as Depositories for the
City funds were each read and the same were ordered placed on file: The First
National Bank, $600,000.00; The Union National Bank, $300,000.00 and the Olmsted
County Bank & Trust Company, $250,000.00.
The reports for the month of March, 1955 of the Building Inspector
showing fees collected for building permits issued $930.00; of the Electrical
Inspector showing fees collected for electrical permits issued $153.50; of the
Plubming Inspector showing fees collected for plumbing permits issued $202.25;
of the Heating Inspector showing fees collected for heating permits issued
$123.00 and fees collected for sigh permits in the amount of $1,759.99 were each
read and President Bach referred the same to the Finance Committee.
The report of the Clerk of Municipal Court for the week ending April 9,
1955 showing total criminal fines and costs collected $1,962.50 and civil fees
received $10.35 was read and having been approved by the City Attorney, President
Bach ordered the same placed on file.
The applications of Richard Hutchinson, Edwin F. Hughes, Mayo Civic
Auditorium, A. H. Reynolds, T. A. Reimer, Warren L. Edwards, Ben Wong and
Ernest E. Drake for license to sell cigarettes were each read and upon motion by
Tingley, second by Schwanke, the licenses were granted.
The application of Edwin F. Hughes for a license to sell non -intoxicating
malt liquors "off sale" was read and upon motion by Schroeder, second by Moody,
the license was granted.
The applications of Edwin F. Hughes, A. H. Reynolds, Mayo Civic
Auditorium, T. A. Reimer, Warren L. Edwards, Ben Wong and Ernest E. Drake for
license to sell soft drinks were each read and upon motion by Moody, second by

The applications of Donald Nietz and Melvin Kolstad for Journeyman .,
Electrician's License were each read and upon motion by -Schroeder, second by
Anderson, the licenses were granted.
The application of Bernard J. Steffes for a Journeyman Plumber's License+
was read and upon motion by Schroeder, second by Schwanke, the license was granted;
The application of Dale C. Patterson for an Electrical Contractors
License was read and upon motion by Moody, second by Schroeder, the license was
granted.
The application of Dale C. Patterson for a Master Electricians License
was read and upon motion by Schroeder, second by Moody, the license was granted.
The application of Burton L. Green for a Journeyman Hot Water and Steam
Fitter's License was read and upon motion by Schwanke, second by Moody, the
license was granted.
The applications of Robert Penner, LeRoy Welke and Al.'Prier for Journey-!
man Warm Air Heating, Ventilating and Air Conditioning Worker's License were each
read and upon motion by Tingley, second by Anderson, the licenses were granted.
The applications of Rock Amusement Company for two theatre license ( thel
Empress Theatre and the Lawler Theatre); Rochester Amusement Company for two
theatre licenses ( the Chateau Theatre and the Time Theatre) and Rochester Outdoor
Theatre for one theatre license were -each read and upon motion by Tingley, second
by Schroeder, the licenses were granted.
The contract bonds of Universal Motors, Inc. in the amount of $10495.00
with the American Casualty Company of Reading Pennsylvania as surety; Rosholt /
Equipment Company in the amount of $4.250.00 with the St. Paul Mercury Indemnity
Company as surety and Carlisle G. Fraser (2) in the amounts of $6,896.00 and
$2,422.90 with the Federal Insurance Company as surety were each read and the same
were referred to the Mayor for his approval.
The license bonds of Gerald Sullivan in the amount of $1,000.00 with thel
American Surety Company of New York as surety; Dale C.-Patterson in the amount of
$1,000.00 with the State Automobile Insurance Association as surety and Peoples
Natural Gas Division of Northern Natural Gas Company in the amount of $1,000.00
with the Fidelity & Casualty Company of New York as surety were each read and upon
motion by Moody, second by Anderson, the bonds were approved,the surety thereon
accepted and the bonds were ordered placed on file.
The following official bonds were read and upon motion by Moody, second

Resolution accepting the collateral of the First National Bank in lieu

An Ordinance amending an Ordinance entitled, "An Ordinance granting a
franchise to the hereinafter named grantee for the privilege of operating Motor
Vehicles on the streets, alleys and highways of the City of Rochester, for the
purpose of transporting passengers for hire for a period beginning thirty (30) dayi
after the official adoption and publication of this ordinance and terminating five
(5) years thereafter, upon the terms and conditions hereinafter mentioned, provid-
ing for a regulation of said service; providing the amounts to be charged Grantee
per unit for the operation of said motor vehicles; providing for the termination
of the grant; providing for public liability security; providing for the super-
vision by the Common Council of the City of Rochester, Minnesota(same being
Ordinance No. 779), was given its first reading.
Upon motion by Schroeder, second by Schwanke, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
second reading.
Upon motion by Schroeder, second by Tingley, and upon roll call and all
voting in favor thereof, the rules were suspended and the oridnance was given its
third and final reading.
Upon motion by Schroeder, second by Moody, that the said ordinance be
adopted as read and all voting in favor thereof, President Bach declared the said

An Ordinance amending an Ordinance entitled, "An Ordinance for the
purpose of promoting health, safety, order, convenience and general welfare by
regulating the use of land, the location, size, use and height of buildings, and
the arrangement of buildings on lots, and the density of population within the
City of Rochester, Minnesota, all in accordance with a comprehensive plan",
(same being Ordinance No. 559), was given its first reading.

Upon motion by Whiting, second by Anderson, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its

second reading.
Upon motion by Moody, second by Whiting, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
third and final reading.
Upon motion by Tingley, second by Schwanke, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted. -
Alderman Schwanke brought up the matter of waste paper scattered around
at the Miracle Mile and also the erosion of the west side of 16th Avenue Southwest
and Northwest which now appears should be sodded to avoid further erosion. Upon
motion by Schroeder, second by Moody, these matters were referred to the Mayor to

contact the management at Miracle Mile. -
Alderman Moody again reported on the condition and traffic on 2nd Stree
Northwest west of llth Avenue and recommended that a stop sign be placed`at the
intersection of 2nd Street Northwest and 13th Avenue Northwest. Upon motion by
Moody, second by. Anderson, the matter was referred'to the Police Committee and the
Chief of Police.
Alderman Tingley stated that he had received complaints.about the
location of the stop sign at the intersection of 15th Avenue and 2nd Street S. E.
Upon motion by Tingley, second by Moody, the matter was referred to the Police ,
Committee and the Chief of Police.
Alderman Whiting brought up the matter of the Inspection Department
being assigned to a Committee. After discussing the matter Alderman Whiting
moved that the said department be assigned to the Survey Committee. Alderman
Schroeder seconded the motion and all voted in favor thereof. _
Mr. Stanley F. Drips was present and stated that the Parking and Traffi%
Committee had tentatively set the date of April 21, 1955 for a hearing with the
public,in regard to parking on Broadway and also the 30 minute parking meters,
and requested permission to use the Council chambers for the said meeting. A
Motion was made by Schroeder, second by Moody, that the Traffic and Parking
Committee be permitted to use the Council Chambers for the said meeting. All
voted in favor of the -motion.
Upon motion by Schwanke, second by Anderson, the meeting was adjourned
until 7:30 o'clock P. M. on April 18, 1955-
