President Bach called the meeting to order at 7:30 o'clock P. M., the following members being present: President Bach, Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley and Whiting. Absent: None. President Bach stated this as being the time and place set for the second hearings on the following projects: Second hearing on the construction of a curb and gutter on 2nd Street Northeast from llth-to 14-th Avenue Northeast. There was no one present wishing • _ to be heard. The requests of Floyd E. Wilkins and Mary E. Wood to have their names withdrawn from the petition were each read and ordered placed on file. Second hearing on the construction of a curb and gutter on loth Avenue Northeast from 7th to 9th Street Northeast. There was no one present wishing to be heard. Second hearing on the construction of a curb and gutter on 13th Avenue Southeast from 6th to Sth Street Southeast. Mr. Daniel O'Brien of 622 - 13th Avenue Southeast was again present. He stated that he had a triangular lot with a 207 foot frontage and felt that having the curb and gutter constructed at this time would work a hardship on him. Second hearing on the construction of a curb and gutter on 6th Avenue Southeast from llth to 12th Street Southeast. There was no one present wishing to be heard. Second hearing on the construction of a curb and gutter on 6th Street Southeast from 12th to 13th Avenue Southeast. A communication signed by six property owners in that area to have their names withdrawn from the petition was read. A motion was made by Schroeder, second by Anderson, that the hearings be continued until the next meeting. Second hearing on the construction of a curb and gutter on 12th Avenue Southeast from 4th to 6th Street Southeast. There was no one present wishing to be • heard. President Bach stated this as being the time and place set for receiving and opening bids for the following projects: Bids for construction of a storm sewer lateral in Block 4. Parkside Subdivision. The bids of Carlisle G. Fraser in the amount of $742.00; Acton Construction Company in the amount of $779.20; Barbarossa & Sons, Inc. in the amount of $792.90 and Wolff Construction Company in the..amount of $900.00 were each received and opened and upon motion by Schroeder, second by Moody, the same were referred to the Sewer Committee and City Engineer for tabulation and report. Acton Construction Company in the amount of $49,647.80 and Wolff Construction Company.in the amount of $49,770.80 were each received and opened and upon motion by Schwanke, second by Anderson, the same were referred to the Sewer Committee and the City Engineer for tabulation and report. Bids for -construction of a curb and gutter on the south side -of -Graham Court Southeast in Block 3, Homestead Addition, vest .of 15th Avenue Southeast, - The -bids of C., M. Boutelle & Sons in the amount of $3,199.00; Thorsen Cons•tructio Co., Inc. in the amount of $3,369.74; and H. T. Earle & Son in the amount of $3,285.50 were each received and opened and upon motion by Whiting, second by Anderson, the same was referred to the Street & Alley Committee.and the City Engineer for tabulation. and report. The bids of Carlisle G. Fraser in the amount of $10,499.90; Acton Construction Co. in • the amount of $11, 466:00;. Wolff Construction Company in the amount of $11, 232.00 and Barbarossa & Sons Inc. in the amount of $11,•154.00.were each read and upon motion by Anderson, second by Schwanke, the same were referred to the Sewer and Water Committees and the City Engineer for tabulation and report. Bids for construction of a sanitary sewer in 14th Street Northwest from 3rd to 5th Avenue Northwest. The bids of Carlisle G. Fraser in the amount of $7,626.72; Barbarossa & Sons, Inc. in the amount of $9,199,50; Acton Construction Co., in the amount of $9, 454.20 and Wolff Construction Company in the amount of $9, 500#60 were each remeive.d and opened and upon motion by Whit i•ng,- second by Schroeder, the came were referred -to -the Sewer -Committee and the City Engineer for tabulation and report. Bids for grading, base construction and bituminous surfacing in Bielenberg & Giese Third Addition. No bids were received. A letter signed by Henry J. Giese, John Bielenberg and William Bielenberg asking permission to have all bids for the above grading withdrawn and to contract their own grading privately, which will be done according to City of Rochester specifications, was read and upon motion by Schroeder, second by Moody,. the same. was referred to the Street & Alley Committee and the City Engineer. The following recommendation of the Steering Committee -on Parking and • Traffic was read: "Mayor C. H. McQuillan Alderman at Large A. M. Bach, and Members of the Common Council City of Rochester, Minnesota Gentlemen: It is respectfully recommended by .the Steering Committee on Parking and Traffic that Ordinance Number 971 and the accompanying Resolution passed on December 20, 1954 which regulates parking and parking" meters be amended as concerns the parking time "limit of certain areas now in Parking Zone B. It is recommemded that all those areas now assigned to Zone B which has a parking time limit of 30 minutes be assigned to Zone C which has a parking time limit of one hour. Further, that Subsection (d) (2) be amended to read the same as Subsection (d) (1) or six minutes for 10. All of these meters accept pennies, nickels and dimes. R. MacDonald was present and stated that he felt the one-half hour parking meters should be changed to one hour parking. A motion was made by Whiting, second by Tingley, that the City Attorney be instructed to amend the Ordinance an resolution -to include the requested changes. All voted in favor of the motion. An order by the Railroad and Warehouse Commission of, the State of Minnesota that the Rochester Bus Line, Inc. be granted an extension of its present routes as follows was read and President Bach ordered the same placed on file: "North Broadway & Carroll -extend present route from loth St. :d. E. and 7th Ave. N. E. east to Sth Ave. N.E., north on Sth Ave. N.E. to 16th St. N.E., west on 16th St. N.E. to 7th Ave. N.E. and present route; 7th Ave. and 6th St. S.W.-extend present route from 7th Ave. S.W. and loth St. S.W: south to llth St. S.W. , west on llth St. S.W. to Sth Ave. S.W., north on. Sth Ave. S.W. to present route." A petition for construction of a curb and gutter on 14th Avenue N.E. from 7th to 9th Street Northeast was read and the same was referred to the Street & Alley Committee and the City Engineer. A letter from C. M. Boutelle with a quit claim deed attached for land to be used as a public street was read and upon motion by Moody, second by Schwanke, the same was referred to the Street & Alley Committee and the City Engi nee r. was read: The following communication from Trinity Evangelical Lutheran Church "The.Honorable-Common Council City of Rochester, Minnesota Re: Proposed Widening 5th St. N. W. Gentlemen: As you know our church is supported by a congregation of over 2000 souls, and that we maintain a Christian elementary day school. We have outgrown our present school with an enrollment of 190 children. Currently we are contemplating a new elementary school building, to be built jointly with Redeemer Lutheran Church and Grace Lutheran Church. We have secured an option to purchase a tract of land of approximately 72 acres extending south of 5th St. X. W.,-to and beyond Cascade Creek, and between Sth and 9th Avenues N. W. This option will expire June let. The proposed widening of 5th St. N.W., will take approximately 1 1/3 acres from this tract of land. The final purchase of this land must be contingent upon the action by the Common Council in regard to this proposed widening. At our regular monthly meeting of voting members last evening the following resolution was adopted after a review of the entire situation was presented by the Committee. 'Resolved to urgently request the Honorable Common Council of the City of Rochester to make a final decision regarding the proposed widening of 5th St. N.W. , by or before June let, 1955; and further, To request favorable action on this project; and further, To offer to trade approximately 1 1/3 acres of our land required for thiswidening for land of equal value in the tract directly west of our land, which is presently owned by the City; and further, To offer to deed to the City areas along Cascade Creek for the purpose of flood control; and further To request the Common Council to determine the feasibility of establishing a pedestrian andbicycle path from 5th St. 11. W., along the extension of Sth Ave. N.W. , and over and across the railroad right of way and across Cook Park to 7th St. N. W.' We respectfully request that you will take the necessary action so that we may proceed with our planning to keep up with the growth and progress of our,City. Zielske, Secretary" Also others interested in a location for a new Lutheran Parochial School were present at the meeting, however, Mr. Edwin E. Zielske was the only one heard at this time. He was advised that the Council would reach some decision in the near future regarding the proposed opening and widening of 5th Street Northwest, The following application for Ia'permit to use a sanitary sewer recently installed on 3rd Street Southwest was read: "Honorable Mayor and Members'of'the Common Council Gentlemen: I hereby wish to make application for a permit to use the sanitary sewer recently installed on Third St. S. W. The property is known as the Castle Trailer Court. However there is a rod of -land between the court and the street, which I have negotiated to buy, the deal to go thru Thur. next. By acquiring this rod, I will be able to drop back east plenty far to give plenty of elevation. The use of city sewer would take care of approximately 20 spaces, not including the water from the laundry. This I am sure would be benefit to the community as advised by the county and state boards of health. Thank you in advance. Steve Finn" Mr. Steve Finn was also present and heard on the matter. A motion was made by Schroeder, second by Moody, that the matter be referred to the Street & Alley Committee and -the City Engineer for investigation and report. Mayor McQuillan stated that he had thirteen resolutions which had been adopted by the Council setting salaries f.or various employees in the City of Rochester. He stated that he felt there was some inequality in setting these salaries and requested the Council to reconsider and revise these salaries. A motion was made by Whiting, second by Schwanke, instructing the City Attorney to prepare a resolution rescinding the said 13 resolutions. All voted in favor of the motion. Mr. Max Durand was present - and requested that he be given a chance to be heard again when the Council reconsiders the said salaries. Mr. Robert Petersdorf was also present and requested that the Council reconsider the salary set for the City Painter. A letter from the Board of Park Commissioners transmitting a proposed schedule of salaries in the Park Department was read. Miss Alberta Chance, Manager of the Mayo Civic Auditorium, was present and requested that she be allowed to appear before the Couacil' when the said salaries are considered. White, Marian F. Hayes and Newton F. Holland for license to sell cigarettes were each read and upon motion by Whiting, second by Anderson, the licenses were granted. The applications of David E. White and Marian F. Hayes for license to sell soft drinks were each read and upon motion by Schroeder, second by Moody, the licenses were granted. The application of Marian F. Hayes for a license to sell non -intoxicating malt liquors "off sale" was read and upon motion by Moody, second by Schwanke, the license was granted. The application for transfer of "on sale" non -intoxicating malt liquor • license No, 842 from Mrs. Arnold Janssen to Marian Hayes was read and upon motion by Schroeder, second by Anderson, the transfer was granted, subject to the approval of the Chief of Police. Upon motion by Whiting, second by Anderson, the. license was granted. The applications of Edmund T. McCoy and Donald L. Grue for real estate salesman's license were read together with recommendations from the Rochester Realty Commission that the said licenses be granted. Upon motion by Whiting, second by Schroeder, the licenses were granted. -The report of the City Treasurer for the month of March, 1955 was read • and President Bach ordered the same placed on file. The contract bonds of Northwestern Refining Company in the amount of $5,115.00,with the Anchor Casualty Company as surety and Leon Joyce (2) in the amounts of $2,203.00 and $3,693.50 with the Seaborad Surety Company as surety were each read and the same were referred to the Mayor for his -approval, The official bonds of Fred R. Finch in the amount of $500.00 with the Great American Indemnity Company as surety and Garnet Spring in the amount of $500.00 with the Fidelity and Casualty Company as surety were each read and upon motion by Schroeder, second by Anderson, the bonds were approved, the surety thereon accepted and the same were ordered placed on file. President Bach called a recess at 9:15 P. M. President Bach called the meeting to order at 9:45 P. M. The recommendation of the Street & Alley Committee that the request of Local 472 Operative Plasters and Cement Finishers that applications for licenses should be read at the first regular meeting following their being filed and thereupon referred to the City Engineer for investigation and report which would be made at the next regular meeting when said application would be voted on's be approved except that the City Engineer report at the next regular or adjourned meeting was read and upon motion by Schroeder, second by Moody, the • recommendation was approved. following The/recommendation of the Street & Alley Committee was read and upon motion by Moody, second by Schroeder, the recommendation was approved: "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: On January 17, 1955, a request of the Park Board for acquisitirm of land south of the proposed 7th Street Northeast right-of-way from the Cemetery Assn. was referred to this committee. We recommend that this land be acquired for Park use if available. We further recommend that the Council authorize the Street and Alley Committee to negotiate with the Cemetery Assn. and other land owners for the right-of-way necessary for the 7th Street plan as approved by the Council, March 25,1955• Respectfully, (A.G. Concrete Curb and new sidewalk. Assessments to be in accordance with Street Improvement Assessment Policy. We, further recommend, that steps be taken to develop -the city -owned property east of 3rd Avenue at 3rd Street Southeast into off-street parking area. Respectfully, (A. G. Upon motion by Anderson, second by Moody, resolution adopted. Resolution accepting the bid of H. T. Earle & Son for construction of a curb and gutter on 13th Avenue Northwest and-15th Avenue Northwest in Bielenberg & Giese 2nd Addition. Upon motion by Moody, second by Schroeder, resolution adopted. Resolution accepting bid of Carlisle G. Fraser for construction of a storm sewer in 7th Avenue Southwest, Sth Avenue Southwest, Memorial Parkway and llj Street Southwest in Parkside Sub -Division.
