Minutes -of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers in the City Hall, .in said
City, on May 16, •1955-,
Tha meeting was called to order at 7:30 o'-clack P. M. and upon motion
by Whiting, second Moody,- Alderman Schroeder was appointed President pro t,em and
upon roll call all members of.the Council were present, except President Bach
and Alderman AzAerson.
President pro tem Schroeder stated this as being the time and place
set for .the, following hearings:
. First hearing on the paving of Mayo Park Bridge approaches and 3rd Avenue
Southeast from 3rd to 4th Street Southeast. Mrs. .Laura Russell was -present and
asked .for, information on the project. -President. pro ten Schroeder asked if she
thought.the project was needed and she stated that she did not. Mr. Chester
Johnson inquired as to how aide and what the cost of the paving would be .to the
property owners. He also presented a petition requesting a•new.appraisal by a
competent Board of Appraisers of the property involved in the proposed paving of-
3rd-Avenue Southeast between 3rd and 4th Street Southeast. This petition was -

Second hearing on the grading, surfacing and construction of a curb and
gutter on 15th Avenue S. W. from 7th Street S. W. to the south line of Dresbach's
Addition. Mr. Leon Shapiro inquired as to whether or not the sanitary sewer would
be installed. He was told that a sewer to serve the lots in Dresbach's Addition
would require a long trunk line extension and that plans had not been made for
such an extension. He was asked to attend an informal meeting of the Street &
Alley Committee at 4:00 P. M. on Wednesday.
Second hearing on grading, surfacing and construction of a curb and
gutter on 14th Avenue Southwest from 7th to 9th Street Southwest. There was no
one present wishing to be heard.
After the hearings, Mayor McQuillan brought tip the matter of the bus
strike,,stating that same had become a stalemate and that it was in.the public
interest to have the buses operate as soon as possible. He then asked that the
owners, drivers and riders each be heard at this time. Mr. Arthur Swan, represent-
ing the Rochester Bus Line explained the position of the Rochester Bus Line, Inc.
in detail, indicating that the bus line was not making a profit at the present
time. Mr. Max Durand, representing the bus drivers, then spoke in their interest
and explained the demands they were making. After hearing Mr. Durand and Mayor
McQuillan again, Mr. Swan stated that the Bus Company would be glad to out the.

service down to a sound operating basis if agreeable with the Council and the
Railroad and Warehouse Commission. A show of hands at this time indicated that
the plan would be agreeable with the riders. It was then agreed that the
representatives of the Bus Company and the representative of the drivers meet
with the Common Council on the following day at 3:00 P. M. in the Council Chambers
to consider -the curtailment of bus service on runs which are now made at a loss or
no profit.
Petitions for construction of a sanitary sewer, water main, service
connections, grading, base construction and bituminous surfacing in llth Avenue
Southeast,-12th Avenue Southeast, 13th Avenue Southeast and 82 Stree.t Southeast in
South Home Addition were each read and upon motion by Whiting, second by Moody,
the same were referred to -the Street & Alley Committee, the Sewer, Committee, the
Water Committee and the City Engineer.
A petition for grading, base construction and bituminous surfacing of
extension of 101 Street Southeast in front of Lots 49 5, and 6 in Block 6 and
Lots 7, S, 9, in Block 5, in Sunnyside Addition was read and upon motion by
Whiting, second by Moody,_the same was referred to the Street & Alley Committee.
A plat of land to be known as South. Home Addition and described as
follows was presented and upon motion by Moody, second by Tingley, the plat was
accepted: "The west 627 feet of Lot 31, Auditor's Plat "A"
except the south 954.99 feet thereof."
The petition of Peter Krueger for a sanitary sewer at 1321 - 3rd Avenue
Northwest and the lot just north of his house was read and upon motion by Schwanke!
second by Tingley, the same was referred to the Sewer Committee.
The following preliminary estimates submitted by the City Engineer were
each read and President pro tem Schroeder ordered the same placed on file;
Grading, base construction and bituminous surfacing on 14th Avenue
Southwest from 7th to 9th Street Southwest in the amount of $3;715.50;
Curb and gutter on 14th Avenue Southwest from 7th to 9th Street
Southwest in the amount of $3,343.05;
Grading and surfacing on 15th Avenue Southwest from 7th Street Southwest
to the south line of Dresbach's Addition in the amount of $4,122.25; and
Curb and gutter on 15th Avenue Southwest from 7th Street Southwest to
the south line of Dresbach!s Addition in the amount of $2,851.60:
The two following resolutions adopted by the Public Utility Board were
each read and the same were ordered placed on file:
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of the
said City be and is hereby requested to authorize the said Board to
enter into a contract with WOODHOUSE BROTHERS of this City for the
installation of new roofing' over the turbine room section of the"
North Broadway Generating Plant in accordance with specifications
on file; the total amount of the said contract to be THIRTY FOUR
HUNDRED SEVENTY FIVE DOLLARS ($3, 475j.00) and the said Woodhouse
Brothers being the lowest responsible bidder.".
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council ofthe
said City be and is hereby requested to authorize the said Board to
enter into a contract for REPOINTING THE WEST ELEVATION. OF THE NORTH
BROADWAY GENERATING PLANT with the STERLING WATERPROOFING COMPANY of

this City; the total amount of the said contract to
be THIRTY TWO HUNDRED DOLLARS ($3,200.00) and the
said Sterling Waterproofing Company being the lowest
responsible bidder."
The three following letters from Mr. O. W. Haling were each read and the
same were ordered placed on file:
"To Honorable Mayor and Members of the
Council,'City of Rochester
I recently submitted a offer to buy land from the City of
Rochester which offer I wish to revise as follows:
All land owned by the city west of the road in the former
Weih place, beginning 2 rods north of the center line of the road
leading to the buildings in this property.
It is also agreeable to enter a clause in purchase agreement
limiting the city from liability to any fencing, or damage claims

due to conditions at the disposal plant.
I will pay the sum of $117.50 per acre for above described
property.

"To Honorable Mayor and Members of, the
Common Council, City of Rochester
I am desirous of renting the land the City owns west of the
disposal plant and west of road beginning 2 rods north of the road
leading to the farm buildings, for which I will pay the City $7.00
per acre per year for a period of 5 years, and will stand the
expense of fencing and clearing said land to extent authorizes: by
the public grounds committee.

"Mr. McQuillan
Dear Sir:
• Enclosed is a firm offer to lease or buy the city land at
the disposal plant. If this offer is enough better to warrant it
I suggest you veto the current action for that reason, and inform
Mr. Armstrong to head off any fencing attempt until this is
cleared. If -not I believe Jensen & Gibbs will have this fenced
and it will be to late to do anything.

A claim by Mr. I. G. Teigen in the amount of $12.50 for damages to his
basement was road and upon motion by Schwanke, second by Moody, the same was
referred to the City Attorney,
The Mayors appointment of the following to the Rochester Police`
Department was read and upon motion by Tingley, second by Moody, the appointmenst
were approved, . effective June 6, 1955:

The application of Norbert A. Huiting for -reappointment as Machine
Operator at the City Dumping Grounds was read and upon motion by Whiting;. :second
by Tingley, the same was referred to the Street & Alley Committee and the Council
as a committee of the whole.
The request of Frank W. Everett, Chief of Fire Department, for permission
to send two firemen and himsel to attend the Minnesota -St -ate Fire Department
Associations, 80th annual convention to be held at Lake City, Minnesota on
June 13, 14 and 15 was read and upon motion by Moody,. second by Tingley, his

request was granted.
The claim of -Ethel M. Howald for personal injury in the amount of
$1,000,00 was read and President pro tem Schroeder 'ordered the same placed on

The recommendation of the Police Committee and the Chief of Police that
the two 1953 Fordor, Mainliner, Ford Sedans, now in service in the Police Depart-
ment, be traded off and that bids be accepted for two new patrol cars was read and
upon motion by Whiting, second by Tingley, the recommendation was approved.
The recommendation of the Police Committee and the Chief of Police that
a truck be purchased for use in the meter maintenance department and that a 1950
Chevrolet 1/2 ton Panel, Serial No. 21Hp 114946, Minnesota License, Y 25-145, be
purchased from the Clements Chevrolet Company at a price of $595,00 was read and
a:-mo.tion%was:madb:1by Whiting, second by Moody, that the said truck be purchased.
All present voted in favor of the motion.
The petition of J. C. Thompson Company 'that the streets within the area
known as Cascade Mill Reservation in Northern Addition be vacated for the reason
that the streets have never been officially opened or constructed was read and
ordered placed on file. The recommendation of the Street & Alley Committee that
the request to vacate Cascade Street North of Cascade Creek and to vacate the
other street described -in "Book of Deeds 65 - on Page 24311 be approved was read
and upon motion by Moody, second by Schwanke, the recommendation was approved.
The recommendation of the Street & Alley and Sewer Committees that the
accompanying easement and agreement between Clarence R. Thompson and the City of
Rochester for sewer easement through the Mill Reservation in northern Addition
be approved and that the Mayor and City Clerk be authorized to execute the easement
was read and upon motion by Whiting, second by Schwanke, the recommendation was
approved,
Four copies of an agreement between the City of Rochester, owner of the
Rochester Airport and K. M. McGhie, Professional Engineer, were' presented and upon
motion by Schwanke, second by Whiting, the -Mayor and City Clerk, were authorized to
execute the said agreements.
The application of Warner S. Johnson for a Journeyman Warm Air Heating
Ventilating and Air Conditioning Workers' license was read and upon motion by
Whiting, second by Tingley, the license was granted,
The application of Lysne Construction Company for a permit to move a
house and garage from 211 - 4th Street S. if. to.1810 - 5th St. S. W. over certain
otreets of the City was read and upon motion by Tingley, second by Moody, the same
was referred to the Survey Committee, the Building inspector; and the Chief of
Police with power to act.

showing total criminal fines and costs collected $1,474.00 and civil fees received
$.70 was read and having been approved by the City Attorney, President .Bach
ordered the same placed on file.
The contract bonds of C. M. Boutelle & Sons in the amount of $3,199,00
with the Western Surety Company as surety and Marvin Sell in the amount of
5,020.00 with the Fidelity and Casualty Company of New York as surety were each
read and the same were referred to the Mayor for his approval.
An ordinance establishing a pedestrian crosswalk on Second Avenue South-
west was given its first reading,
Upon motion by Whiting, second by Moody, and upon roll call and all
present voting in favor thereof, the rules were suspended and the ordinance was
given its second reading.
Upon motion by Whiting, second by Moody, and upon roll call and all
present voting in favor thereof, the rules were suspended and the ordinance was
given its third and final reading.
Upon motion by Moody, second by Schwanke, that the said ordinance be
adopted as read, and all present voting in favor thereof, President pro tem
Schroeder declared the said ordinance duly passed and adopted.
The following resolutions were each introduced and read and President
pro tem Schroeder declared the same duly passed and adopted:

Resolution appropriating $540,00 from the Street & Alley Fund and

Resolution appropriating $2,666.89 from the Street & Alley -Fund and
ordering payment made to Truck Service Company. Upon motion by Tingley, second by
Vhiting, resolution adopted.
Resolution authorizing the Mayor and.City Clerk.'o execute a contract in
behalf of the City of Rochester with Kenneth M. McGhie as engineer by the State
Department of Aeronautics for construction work at the Rochester Municipal Airport.
Upon motion by Whiting, second by Moody, resolution adopted.
Resolution requesting the State Department of Aeronautics to approve
the plans and specifications for construction work at the Rochester Airport and
if same are approved authorizing the Common Council to advertise for bids for said
construction work. Upon motion by Moody, second by Schwanke, resolution adopted.

Schwanke, the same were approved and the Mayor and City Clerk were authorized and

Upon motion by Moody, second by Tingley, the meeting was adjourned
