Minutes of a regular meeting of the Common Council of the City of Rochesj
Minnesota, held in the Council Chambers in the City Hall, in said City, on June 6,
1955.
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley and Whiting. Absent: None.
Upon motion by Moody, second by Schwanke, the minutes of the meeting of
May 23, 1955 were approved.
President Bach stated this as being the time and place set for the secon�-
hearing oh the paving of Mayo Park Bridge approaches and 3rd Avenue Southeast from
3rd to 4th Street Southeast. Mr. Chester Johnson was preseat and inquired as to
what settlement the Council was going to make. Mr. Louis Capelle and Mrs. Laura
Russell were also present and spoke on the matter. No action was taken and the
hearing was continued.
President Bach stated this as being the time and place set for receiving!
and opening the following bids:
Bids for furnishing two patrol cars to replace two 1953 Fordor, Mainlines
Ford Sedans, for use in the police department. The b-id of Universal Motors, Inc.
in the amount of $2,735.00 for two patrol cars,.one standard and one automatic
transmission, was received and opened. Upon motion by Schroeder, second by
Schwanke, the same was referred to the Police Committee and the Chief of Police
for recommendation and report.
Bids for the construction and repairing of concrete sidewalks and curb
and gutter at specified locations. The bid of H. T. Earle & Son in the amount of
$7,96c.00 was rec.eived and opened and upon motion by Schwanke, second by Anderson,
the same was referred to the Street & Alley Committee and the City Engineer for
tabulation and report.
Bids for grading and surfacing of 14th Avenue Southwest from 7th to 9th
Street Southwest. The bid of Leon Joyce in the amount of $3, 604.10 was received
and opened and upon motion by Schroeder, second by Moody, the ,same was referred tol
the Street & Alley Committee and the City Engineer for tabulation. and report.
Bids for the construction of a curb and gutter on loth Avenue Southwest
from 7th to 9th Street Southwest. The bids of Doyle Conner Company in the amount
of $3,641.00 and C. M. Boutelle & Sons in the amount of $3,686.10 were each
received and opened and upon motion by Tingley, second by Schwanke, the same were
-referred to the Street & Alley Committee and the City Engineer for tabulation and
report.
Bids for the construction of a curb and gutter on 6th Avenue Southeast
from llth to 12th Street Southeast. The bids of C. M. Boutelle in the amount of
$4,093.95 and Doyle Conner Company in the amount of $4,199.50 for concrete work an

Leon Joyce in the amount of $2,675.50 for street repair work were each received
and opened and upon motion by Anderson, second by Schroeder, the same were
referred to the Street & Alley Committee and the City Engineer.
Bids for construction of a curb and gutter on 14th Avenue Northeast from
7th to 9th Street Northeast. The bids of C. M. Boutelle in the amount of
$5,274.70 and Doyle Conner Company in the amount of $5,547.70.were each received
and opened and upon motion by Tingley, second by Schroeder, the same were
referred to the Street & Alley Committee and the City Engineer for tabulation
and report.
President Bach stated this as being the time and place set for a hearing
on the proposed change of zoning of the property described as Lot 5, Block 22,
Northern Addition (719 North Broadway) and Lot 6, Block 22, Northern Addition
(721 North Broadway) from a residential to a commercial zone. There was no one
present wishing to be heard. Upon motion by Tingley, second by Anderson, the City
Attorney was instructed to amend the Zoning Ordinance to include the requested
change.
The following recommendation was read:

A committee from Trinity Lutheran Church was again present and offered to trade
Parcel #1 for Parcel #3 if the City would spend approximately $1,000.00 for
straightening the creek. After discussing the matter further a motion was made
by Whiting, second by Schwanke, that the Alderman at Large be instructed to
arrange a meeting between the Council and the Board of Park Commissioners to
consider the recommendation of the Appraisal Committee.
Mr. J. H. Fisher, Manager of the Clayton Hotel, was present and

4th Avenue on both sides of the street. Upon motion by Schroeder-, second by
Tingley, the matter was referred to the Police Committee and the Chief of Police.
The request of Mohn & Hodge for permission to build one house on each of
the following described lots, was read and upon motion by Schroeder, secon3 by
Whiting, the same was referred to the Board of Zoning for recommendations
11(1) The East 60 feet of the West 207 feet of the North 105 feet
of Lot 140; of Auditor's Plat "Al' of the East 1/2 and of the
S.w. 1/14 Section-1-Town-106-Range-14.
(2) The East 60 feet of the West 267 feet of the North 105 feet
of Lot 40, of the Auditors Plat "All of the East 1/2 and of
the S. W. l/14-,Section- l- Town- 10'6- Range- 1i4.
The resignation of Clement J. Feldmann as a member of the City Planning
Commission was read and upon motion by Schroeder, second by Moody, his resignation
was accepted.
The Mayor's a.ppointaent of Mr. Elmer Hrabe, 15 - 7th Avenue No as
a member of the Planning Commission, term to expire the second Monday in April,
1957 was read and upon motion by Moody, second by Schwanke, the appointment was
approved.
A letter from the Board of Public Health and Welfare stating that Mr.
S. P. Kingston, a member of the Board of Public Health 4 Welfare, had indicated
his desire to resign because of his inability to serve was read and upon motion by
Whiting, second by Schroeder, his resignation was accepted.
The Mayor's appointment of Mr. Jerry Reichert, 439 - 15th Avenue S. W.
as a member of the Rochester Board of Health and Welfare, term to expire the seco
Monday in April, 1957 was read and upon motion by Tingley, second by Moody, his
appointment was approved.

trouble with his water line freezing was read. Upon motion by: Schroeder, second
by Anderson, the matter was referred to the Water Committee and the City Engineer.
The City Engineer's preliminary estimates of cost for construction of a
curb and gutter on 114th Avenue Northeast from 7th to 9th Street Northeast in the
amount of $5, 209.15 and construction of a curb and gutter on 6th Avenue Southeast
from llth to 12th Street Southeast in the amount of $3,893.35 were each read -and
President Bach ordered the same placed on file.
The following resolution adopted by the Public Utility Board was read and
ordered placed on file:
"BE IT AND IT IS HEREBY RESOLVED, by the Public Utility Board
of the City of Rochester, Minnesota that the Honorable Common
Council be and is hereby requested to authorize the said Board
to extend the Water Main in 102 Street Southeast :for a distance
of 153' to the West and to extend the Water Main in 14th Avenue
Southwest from Sth to 9th Street Southwest 'a distance of 2761.11

iairport was read. Three sets of plans were,presented together with the
recommendation of the Airport Committee that the plans be approved and bids be
received on Minnesota Project No. 5501-07 Bituminous Seal Coat at the Rochester
Airport. Upon notion by Whiting, second by Anderson, the recommendation was
approved..
An announcement by the League of Minnesota Municipalities of the
convention program to be held at Albert Lea, Minnesota. on June g, 9 and 10, 1955
was read and President Bach'or dered the same placed on file,
A letter signed 'by property owners on 14th Street* •PTo'rthwest between
Sth and 9th Avenue opposing the installation of a sidewalk on their property
and asking the Council to postpone action at this time was read and upon motion
by Whiting, second by Schroeder, the same was referred to -the Street & Alley
Committee and the City Engineer.
A protest against the construction of an curb and gutter on 2nd Street
Northeast between 13th and 14th Avenue Northeast, signed by 12 property owners,
was read and upon motion by Whiting, second by Schwanke, the same was referred
to the Street & Alley Committee and the City Engineer.
A petition for the extension of 9th Street Southeast from 9th Avenue
Southeast to a point 267 feet east, and grading and surfacing and construction
of a sanitary sewer was read P.nd upon motion by Schwanke, second by Anderson,
the same was referred to the Street & Alley Committee and the City Engineer.
A petition for construction of a water main in the extension of 9th
Street Southeast from 9th Avenue Southeast to a point 267 feet east was read and
upon motion by Whiting, second by Schroeder, the same was referred to the Water
Committee and the City Engineer.
A request by the Rochester Lions Club for permission to hold a parade
on June llth, 1955 and erect a reviewing stand on Broadway and Second Street and
permission to erect a banner across Broadway was read. A motion was made by
Alderman Schroeder, seonded by Alderman Anderson, referring the matter to the
Police Committee, the Chief of Police and the City Attorney with power to grant
the Liens Club permission to hold a parade on June 11, 1955; to erect a reviewing
stand, to occupy notmore than 3 meter stalls on the west side of Broadway
abutting the premises of the Dayton Company and to erect a banner across Broadway
at a location to be approved by the said Police Committee, the Chief of Police
and City Attorney; this power to be exercised by the Police Committee, the Chief
of Police and City Attorney only upon` the condition that a. policy or certificate
of public liability insurance with the City as the named insured is filed with
the City Clerk, covering the activities of this parade, reviewing stand. and banner
erection and with bodily injury limits of $300,000.00 per accident and $100,000.00

per person and property damage limits of $50,000.00 per accident and $10,000.00
per person. All voted in favor of the motion.

A letter from Joe Gores submitting a plat of land -to be knot -in as Jeffersoi
Slopes Second Addition for annexation to the City of Rochester was read. Also a
recommendation from the Planning & Zoning Commission that the plat -was approved;
a recommendation from the City Engineer that he had reviewed the plat and recommend
ed its approval; and a recommendation from G. E. Marek, General Manager of Utilitie
that the plat met with their requirements were each read. Upon motion by Schroeder
second by Schwanke, the plat and recommendations were approved and'the City Attorne;
was instructed to draft an ordinance annexing the said lands.
A letter from Gerhard Betcher submitting a plat of land to be known as
Greenway Subdivision for approval of the Council was read. Also a recommendation
from the City Engineer that he had reviewed the plat and recommended its approval
and a recommendation from G. E. Marek, General Manager of Utilities, that the plat
met with their requirements were each read. Uponmotion by Schwanke, second by
Tingley, the plat and recommendat.ions o:ere approved.
The application of Berg & Heins Mobil Station for license to sell soft
drinks was read and upon motion by Schroeder, second by Whiting, the license was
granted.
The applications of Albert H. Meyer and Berg & Heins Mobil Station for
license to sell cigarettes at retail were each read and upon motion by Whiting,
second by Moody, the licenses were granted.
The applications of Lysne Construction Company for a permit to move a
house and garage from 711 .Jest Center Street to 418 --19th Avenue Southwest and for
a permit to move stiro houses from 929 - 2nd Street Southwest to outside the city
limits were each read and upon motion by Whiting, second by Schroeder, the permits
were granted, said buildings to be moved under the supervision of the Building
Inspector and the Chief of Police.
The report of the City Weighmaster for the month of May, 1955 showing
fees collected for loads weighed in the amount of $93.40 was read and President
Bach.referred the same to the Finance Committee.
The reports for the month of May, 1555 ofc;the Building Inspector showing
fees collected for building permits issued in the amount of $,387.00; of the
Electrical Inspector showing fees collected for electrical permits issued in the
amount of $286.00; *of the Plumbing Inspector showing fees collected for plumbing
permits issued in the amount of $147.00; of the Reating Inspector showing fees
collected for heating permits issued in the amount of $141.75 and fees collected
for sign permits issued in the amount of $122. 40 were each read and President Bach
referred the same to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ending May 20,
1955 showing total criminal fines and costs collected $1, 562.00 and civil fees

received $3. 20; for the week ending May 27, 1955 showing total criminal fines and

costs collected $1,664.83 and civil fees received $9.90; and for the week ended
June 3, 1955 showing total criminal fines and costs collected $1,616,00 and civil
.fee.s received $7.40 were each read and having been approved by the City Attorney,
President Bach ordered that the same be placed on file.
The official bond of James A. Waters in the amount of $2,000,00 with
the Maryland Casulaty Company as surety was read and upon motion by Schwanke,
second by Moody, the bond was approved, the surety thereon accepted and the same
was ordered placed on file.
A resolution fixing salaries for employees at the Sewage Treatment Plant
with the Mayor's veto thereon; a resolution fixing salaries for the Park Department
for 1955-1956 with the Mayor's veto thereon; a resolution fixing salaries in the .
Public Health & Welfare Department for 1955-1956 with the Mayor's veto thereon;
a resolution fixing the salary of the Assistant in the City Treasurer's office
and rescinding a resolution adopted on April 11, 1955 with the Mayor's veto thereon;
and a resolution fixing salaries of Clerk and Deputy Clerk of Municipal Court
with the Mayor's veto thereon were each read together with the following veto
message' of the Mayor:
"Honorable Members Common Council
City of .Rochester, Minnesota
Gentlemen:
I am returning five resolutions setting salaries for city employees
with my vetos attached.
First,- The salary for the Janitor of the Sewage Disposal Plant has
been reduced $690.00 a year. I feel that this is not warranted, in
view of the many years of faithful service rendered the City by the
individual performing the services at the Plant.
Second, - The salaries of the Carpenters, Property Men, Electricians,
Moving Piciures Operators, Flymen and Assistants at the Mayo Civic
Auditorium does not conform with the Union Scale as requested by the
Park Board and therefore can only result in unnecessary controversy
and trouble.
Third, - There is considerable dissatisfaction with the salaries set
up for the Collectors in the Garbage Collection Service and in my
opinion is not consistant with salaries paid for truck drivers in
other departments.
Fourth, -The salary of the assistant in the Treasurer's Office is
not fair compensation for the work and the dependability involved.
Moreover, it should not be necessary to rescind a resolution which
set this salary at $2,c)40.00 a year to pass another resolution
setting the salary at the same figure.
Fifth,• -The salary of the Clerk of Municipal Court is entirely out
of line with the work and the training required of the Clerk.

members of the Council for their consideration and upon roll call and all voting
in favor of the passage of the resolution, President Bach declared the said
resolution duly passed and adopted.
President Bach announced that the resolv.tion fixing the salary of the
Assistant in the City Treasurer's Office and rescinding the resolution adopted on
April 11. 1955 would again be submitted to the members of the Council for their
consideration and upon roll call and all voting in favor of the ,passage of the
resolution, President Bach declared the said resolution_ duly passed and adopted.

President Bach announced that the resolution fixing the salaries of the
Clerk and Deputy Clerk of Municipal Court would again be submitted to the members
of the Council for their consideration and upon roll call,.Alderman Anderson and
Alderman Moody voting "no" and Alderman Schroeder, Schwanke, Tingley, Whiting and
President Bach'toting in favor of the passage of th-e resolution, President Bach
declared the said resolution duly passed and adopted.
President Bach announced that the resolution fixing salaries for the
Park -Department for 1955-1956 would again be submitted to the members of the Counci
for their consideration and upon roll call and all members of the Council voting
"no", President Bach declared the resolution not adopted.
President Bach called a recess at 5: 45 P. M.
President Bach called the meeting to order at 7:30 P.. M.
The recommendation of the Police Committee and the Chief of Police that
the bid of Universal Motors, Inc. in the amount of $2, 7,35.00, for furnishing two
patrol cars for use in the Police Department be accepted was read'a,nd upon motion
by Moody, second by Schroeder, the recommendation was approved.
A resolution orddring plans, specifications, profile and estimate of cos
and 2nd hearing on grading, surfacing, curb and gutter and sidewalk on loth Street
Northeast from Broadway to Silver Lake Drive with the Maycr's veto thereon was read

together with the following veto message -of the Mayor:
"Honorable Members Common Council
City of Rochester, Minnesota
Gentlemen:
I am returning the resolution ordering hearing on the proposed
improvement on 14th Street Northeast from Broadway to Silver
Lake Drive with my veto attached.
I cannot approve the assessment for the street grading and
surfacing, because it has been paid for at least once by the
adjoining property owners.
.Therefore, I can see no point in proceeding with the rest of
the improvement until this expense is deleted from an otherwise
very costly improvement.

Arthur Schultz and Mr. Carlos Ellis were present and protested the construction
of the project and requested that if the sidewalk was ordered built that it be
moved closer to the roadway than the plans show. After discussing the matter a
motion was -made by Whiting, second by Moody, the matter of the location of the
sidewalk was referred to the Street & Alley Committee and the City Engineer to
confer with the said property owners. All voted in favor of the motion.
The recommendation of the Street & Alley Committee that the bid of
Doyle Conner for construction of a curb and gn.tter on 14th Avenue Southwest from
7th to 9th Street Southwest be accepted at the unit prices bid and checks be
returned to the unsuccessful bidders was read and upon motion by Anderson, second
by Moody, the recommendation_ was approved.
The recommendation of the Street & Alley Committee that the bid of Leon
Joyce for grading and surfacing of 14th Avenue Southwest from 7th to 9th Street
Southwest be accepted at the unit prices bid and checks be returned to the
unsuccessful bidders wFs read and upon motion by Schwanke, second by Tingley,
the recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of C. I.I.
Boutelle for concrete work for construction of a curb and gutter on 6th Avenue
Southeast from llth to 12th Street Southeast be accepted at the knit prices bid
and checks be returned to the unsuccessful bidder and that the City Engineer's
Department be authorized to do the street repair work that the -bids for the
street repair work be rejected and the certified checks be returned to the
unsuccessful bidders was read and upon motion by Tingley, second by Moody, the
recommendation was approved.
The recommendation of the Street & Alley Committee that the bid cf C. M.
Boutelle for construction of a curb and gutter on 14th Avenue Northeast from 7th
to 9th Street Northeast be accepted at the unit prices bid and checks be returned
to the unsuccessful bidders was read and upon motion by Whiting, second by
Anderson, the recommendation.was approved.
The recommendation of the Street & Alley Committee that the bid for
repair and construction of concrete sidewalks, curb and gutter at specified
locations be rejected, and the City Engineer authorized to engage the labor and
equipment necessary to perform the necessary work and that the checks be returned
to the unsuccessful bidders was read and upon motion by Whiting, second by
Schwanke, the recommendation: was approved.
The following recommendation of the Street & Alley Committee was read
and upon motion by Anderson, second by Moody, the recommendation was approved:

Gentlemen:
The City Attorney's Report regarding the property damage
claim of Robert U. Rogers, 602 - 7th Avenue Southeast, was

referred to the Street & Alley Committee, on May 9, 1955-
It is the feeling of this committee that the stump
should be removed from Mr. Roger's yard.
We recommend that the City remove the stup, or offer
Mr. Rogers the cost of its removal, which is estimated at
$60.00.

The recommendation'of the Street & Alley Committee that Theodore Rieple
be granted permission' to extend the sanitary sewer in 5 Street Southwest from 1Sz
Avenue to Lot 5 in Riolen Addition, at his own expense, was read and upon motion by
Moody, second by Schwanke, the recommendation was approved.
The recommendation of the Street & Alley Committee that the construction
of sidewalks be not included as required initial construction in new additions and
that the city continue the present policy of planning and grading new streets to
provide for 'sidewalks was read and upon motion by Schwanke, second by Moody, the
recommendation was approved.
The following recommendation of the Street & Alley,Committee was read
and upon motion by Tingley, second by Whiting, the recommendation was approved:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
Submitted herewith is the report of the Street and
Alley Committee regarding the grade on � Avenue Northeast
in Leitzen's Subdivision.
City Council members met with Mr. Leitzen on May 25th,
1955 and reviewed the grades in the above -described location.
It was decided that the street grades as planned by the City
Engineer were approved.

The recommendation of the Street p Alley Committee that grading, base
construction and bituminous surfacing of the extension of 102 Street Southeast in
front of Lots 7, g and 9 in Block 5, and Lots 4, 5 and 6, in Block 6, Sunnyside
Addition be done was read and upon motion by Whiting, second by Anderson, the
recommendation was approved.
The following recommendation of the Street & Alley Committee was read
and upon motion by Moody, second by Schwanke, the recommendation was approved:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Re: 15 Ave. S. W.
Sanitary Sewer
Gentlemen:
We, the undersigned, recommend the construction of a
sanitary sewer in the east side of 15 Avenue Southwest from
7th Street Southwest to the'south line of Dresbach's Addition.
The petition for this improvement was referred to the
Sewer Committee on May 23, 1955. It is signed by 100% of the
recorded property owners affected by the proposed improvement.
This sewer will have no outlet and cannot serve the houses
at the present time. Construction is recommended now, so that
it can be completed prior, to the construction of .grading,

base construction, bituminous surfacing and curb and gutter
in this location.
We further recommend, (1) that the construction of this
sewer' be not construed to constitute an obligation on the
part of the City to construct the trunk line extension to
serve this area, at this time, and (2) that, when the
construction of this trunk line extension' is petitioned and
constructed, each of the lots served thereby shall be
assessed equal amounts totaling 50%% of the trunk line
extension cost.

The recommendation of the Street & Alley Committee that a sidewalk be
constructed by the property owner at Lot 2. Block 2, Huey Reynolds Addition was
read and upon motion by Anderson, second by Moody, the recommendation was
approved.
The following recommendation of the Survey Committee was read and upon
motion by Whiting; second by Tingley, the recommendation was approved:
"Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersigned ,members of the Survey Committee recommend
that the Building Inspector, City Attorney, and City Engineer in
collaberation with the Zoning Board prepare for the consideration
of the Common Council a new Zoning ordinance or a revision of the
existing Zoning ordinance incorporating the following principles
and provisions.
(1) Establishment of at least three residential districts;
one and two family dwellings; limited Multiple Dwelling
districts and Multiple Dwelling districts.
(2) Establishment of at least three Commercial districts,
( limited neighborhood shopping district, neighborhood
shopping district, and general commercial district).
(3) Establishment of at least two industrial districts
(light industrial district and heavy Indus trial".district).
(14) Elimination of so called "spot zoning".
(5) Providing a method of accomplishing a zoning change
without the necessity of amending the zoning ordinance.

Alderman Whiting introduced the following resolution eohich was read
and upon motion by Whiting, second .by Tingley, that the oaid resolution be
adopted as read and all voting in favor thereof, - President Bach declared the
said resolution duly passed and adopted:
"C;tiEREAS, the Common Council of the City of Rochester adopted a
certain resolution on December 20, 1954, assessing the sum of two
hundred. fourteen and 74tlOO dollars (214.74) plus interest in the
sum of ten and 701100 dollars ($10.70� making a total of two. hundred
ttrrenty-five and 4 1100 dollars ($225. 44) on that certain property
owned by Eva Garbisch described as the north ore -half of Lots Five(5)
and Six (6),. Block Eighty -Three -(83), Moe and Olds'. Addition to the'
City of Rochester, to defray the cost and expense of constructing
sidewalks opposite said lots in the year 1954, and
HEpEAS, the said sum assessed as set forth above was dertified
to the County Auditor for collection with and in addition to the
taxes for the year 1954 due and payable in 1955, and
WHEREAS, the said Eva Garbisch has petitioned the Common Council
,to spread out the said assessment over a five year period in the same
manner as assessments for other local improvements and has signed an
agreement to be bound by such assessment and agreeing that such
assessment over a five year period shall be a lien on her property
until collected,
NOW THEREFOR, be it resolved by the Common Council -,of the City
of Rochester that that certain resolution adopted on December 20,
1954 as set forth above is hereby amended by striking therefrom all
reference to Eva Garbisch and the assessment on the north one-half of
Lots Five (5) and Six (6), Block Eighty-three (83), Moe and Olds'
Addition, of principal and interest totaling two hundred twenty-five
and 441100. ($225.44) as set forth above for the construction of
sidewalks opposite said lots.
Be it further resolved that the Common Council does hereby assess
and levy upon -and against the land described below the sum of money
set opposite the description of -said land.
This assessment is made to defray the entire cost and expense of
constructing sidewalk opposite the said land during the year 1954,
according to the records on file in the office of the City Clerk.
.Be it further resolved by the Common Council that aaid assessment
shall be payable in five equal annual installments, the first
installment due in the year 1955 to be paid with and in addition to
the taxes payable for that year, with interest on all deferred
installments payable at -the rate of six per cent per annum until

third and final reading.
Upon motion by Tingley, second by Whiting, that the .said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the said
ordinance duly passed and adopted.
An Ordinance amending an Ordinance entitled, "An Ordinance regulating
the parking of vehicles on the public streets and alleys, providing for the
installation, maintenance and use of parking meters, creating a parking meter fund
and providing penalties for the violation thereof", was given its second reading.
Alderman Whiting introduces a resolution amending a resolution establish-
ing parking and parking meter regulations and provisions pursuant to Ordinance No.
6719 as amended, which was read. A motion was made by Schwanke, second by Anderso
that the said resolution be adopted as read., and all voting in favor thereof,

A motion was made by Whiting, second by Schwanke, instructing the City
Clerk to request the Board of Public Health & Welfare to transfer the sum of $300..00
from the Public Health & Welfare Fund to the General Fund, the said sum having been
previously paid directly to the City, Treasurer by the Board of Public Health &
Welfare and was now included in the resolution setting the salary of the City
Treasurer.
Upon motion by Whiting, second by Tingley, the City Attorney was
instructed to review and study the forms of assessment now in use a-nd report
any recommended changes in said forms.
Upon motion by Whiting, second by Anderson, Mr. Theo Franke_ was appointed
to represent the City on a committee to informally appraise part of the cemetery
lands needed for _right of way in: connection with the 7th Str.eet Northeast project
and also appraise other lands, approximately 13 acres, between the said right of
way and the cemetery.

The City Clerk was instructed to publish a notice of/rearing on the
resurfacing of Broadway from 6th Street Southwest to 5th Street Northwest, said
hearing to be held at 7: 30 o'clock P. M. cn June 15, 1955.
