Minutes of an adjourned regular meeting of the Commor. Council of the City'
-of Rochester, Minnesota, held in the Council Chambers, in the City Fall, in said
City, on June 20, -1955.
President Bach called the meeting to order at 7: 30 , o' clock P. M. , the
.following.members being present: President Bach, Aldermen Anderson, Moody,
Schwanke, Tingley and Whiting. Absent: Alderman Schroeder.
Upon motion by Moody, second by Anderson, the minutes of the meeting of
June 6, 1955 were approved,
Mr. E. B. Ballou, Chairman of, -,he Music and Band Committee, and requester
that bleachers be moved from Mayo Field to Soldiers Field for a contest of drum
corps and bands to be held during.the.American Legion State -Convention on August 6.
The estimated expense. of setting up the bleachers and taking same down and return-
ing them to Mayo Field is approximately $I+00.00. A motion was made by Anderson,
second by Moody, that an amount not to exceed $400.00 be appropriated from the
General Fund and ordered paid to the Park Improvement Fund f or the expense- of
moving the said bleachers. All present voted in favor of the motion.
Mr. Joe Robbins, Manager of Peoples Natural Gas Company, was present and
.requested that the Council consider renewal of their present franchise for handli
natural gas in the City of Rochester. A motion was made by Moody, second by
Whiting, that the matter be held up for study and investigation later this evening.
All present voted in favor of the motion.
Mr. Ray Karvel and Mr. William Suk, owners of Ba.ihly's First Addition,
were present and inquired as to whether the assessments for construction of a
storm sewer would be on the same basis as charged in Pa.rkside Addition. A motion
was made by -Whiting, second by Anderson, that the matter be referred to the Sewer
Committee and the City Engineer for study and recommendation. All -present voted
in favor of the motion.
President Bach stated this as being the time and place set for the
following hearings:.
First hearing on the construction of a sanitary sewer on the east side
of 15th Avenue Southwest from 7th Avenue Southwest to the south line of Dresbach's
Addition. There was no one present wishing to be heard.
First hearing on the grading, base construction and bituminous surfacing
of the extension of 10- Street Southeast in front of Lot s 7, S and 9, Block 5 and
Lots 4, 5 and 6, Block 6, Sunnyside Addition. There was no one present wishing to
be heard.
Second hearing on construction of.a storm sewer in 9th Avenge Southwest,
112 Street Southwest, 112 Street Southwest and Memorial Parkway in Baihly's First
Addition. There was no one present wishing to be heard.

on 9th Avenue Southwest, 1141 Street Southwest, 111 Street Southwest and Memorial
Parkway in Baihlyls First Addition. There was no one present wishing to be heard.
Second hearing on construction of a storm sewer to 15th Avenue Northeast
in Woodland Addition. There was no one present wishing to be heard.
Second hearing on the grading, base construction and bituminous
surfacing on 15th Avenue Northeast in Woodland Addition. There was no one
present wishing to be heard.
President Bach stated this as being the time.and place set for receiving
and opening bids for furnishing all labor, materials and equipment necessary for
the bituminous seal coat at the Rochester Airport. The bids of H. J. Dunn
Blacktop Surfacing Co. in the amount of $15, 7.00.00; Jay W. Craig Company in the
amount of 15, 677. 50 and Leon Joyce in the amount of $13, 970.00 were each
received and opened and upon motion by Anderson, second by Schwanke, the same
were referred to the Airport Commission and the City Engineer for. tabulation and
report.
Mr. Frank Benjamin of 330 - 19th Avenue Southwest was present at the
meeting and again inquired as to what the Council intended to do in regard to
damages to his property caused by the installation of improvements in the streets.
A motion was made by Whiting, second by Tingley, that the matter be referred to
the Council as a Committee of the Whole, to view the property in question as soon
as possible and report at a future meeting. All present voted in favor of the
motion.
Mr. Edwin Zeislke and Air. Harold Luther, representing the Trinity
Lutheran Church, were again present and inquired as to whether any decision had
been made on the exchange of lands for the opening of 5th Street N. If. It was
recommended to them that they take the matter up further with the Park Board.
Mr. C. A. Swanson and Mr. M. E. Hermanson, of the Minnesota State
Highway Department, were present and asked the City to participate in the
channel improvement of Bear Creek below 12th Street Southeast.- They also
presented a proposed plan of the improvement. They were informed that the City
would participate providing the State would share the expense of the bridge
lengthening at llth Avenue Southeast.
Mr. F. H. Greening of 532 - 2nd Street Southwest appeared at the Council
meeting and complained that patrons at his rooming house had no place to park
their cars, due to the fact that a traffic signal is located on the corner of
2nd Street and 6th Avenue Southwest and "no parking" signs have been placed on
the East side of 6th Avenue Southwest. A motion was made by Whiting, second by
Tingley, that the City Attorney be instructed to draw up a resolution amending
the parking resolution to.remove the "no parking" signs on 6th Avenue Southwest

from 2nd Street Southwest up to the portion of the street that is now 36 feet
wide. All present voted in favor of the motion.

The recommendation of the Street & Alley Committee that sidewalk be not
ordered constructed on 14th Street Northwest between Sth and 9th Avenue Northwest
until such time as.it is deemed necessary that sidewalk be constructed all along
14th Street Northwest from 3rd to llth Avenue Northwest was read and upon motion
by Anderson, second by Tingley, the recommendation was approved,
The recommendation of the Street & Alley Committee that the construction
of curb and gutter on 2nd Street Northeast from 13th to 14th Avenue Northeast be
abandoned was read and upon motion by Schwanke, second by Whiting, the recommend-
ation was approved.
The recommendation of the Street & Alley Committee that the request to
extend 9th Street S. E. from 9th Avenue S. E. to a point 267 feet east be granted,
subject to the submission of an acceptable repla.t of this location, was read and
action on same was deferred until the next.meeting.
The recommendation of the Street & Alley and Sewer Committee that a
sanitary sewer, grading, base construction and bituminous surfacing be constructed
in the extension of 9th Street S. E. to a point. 267 feet East cf 9th Avenue S. E.
was read and action on same was deferred until the next meeting.
The recommendation of the Police Committee and the Chief of Police that
West Center Street, between 3rd and 4th Avenue, be zoned for three hour parking
and that meters be installed in this block and that the City Attorney draw the
necessary resolution to effect this change was read and.upon motion by Tingley,
second by Moody, the recommendation was approved.
The following recommendation of the Police Committee and the Chief of
Police was read and upon motion by Whiting, second by Moody, the recommendation
was approved:
'Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersigned Members of the Police Committee, and Chief
of Police, do hereby recommend that the following policy be
adopted in regard to liquor violations:
A warning by the Police Department for the -first violation,
provided that the violation is not aggravated, unusual, or far
reaching in consequence. Arrest after the first warning. In
the event of conviction in Court and upon notification, -the
Common Council will revoke the license of the Licensee for a
period of not less than three days.
It is further recommended that after a warning by the Police
Department if a period of five years has elapsed without
further viola.ti6n, that the first warning be erased and a
subsequent violation be treated in the first warning category.

Engineer, that the bid of Leon Joyce in the amount of $13.570.00 be accepted for
bituminous seal coat at the Rochester Municipal Airport was read and upon motion
{by Schwanke, second -by Whiting, the recommendation was approved.
The four following resolutions adopted by the Public Utility Board were
leach read and President Bach ordered the same placed on file:
"Be it and it is hereby resolved by the Public U ility Board
that the City Water Rate be changed from
CITY WATER RATE (Quarterly)
First 6,000 cubic feet at $.20 per 100 cubic feet
Next 6,000 cubic feet at .15 per 100 cubic feet
Excess at .OS per 100 cubic feet
Less a prompt payment discount of 10%
Minimum -bill - $1.50 per quarter.
TO
First 6,000 cubic feet at $.20 per 100 cubic feet
Next 6,000 cubic feet at .15 per 100 cubic feet

Be it and it is hereby resolved that the Common Council of
the said City be and is hereby requested to authorize said rate
change."
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of
the said City be and is hereby requested to authorize the said
Board to.enter into a contract with PFEIFER AND SHULTZ for the
furnishing of engineering services and supervision of the repair
of the SILVER LAKE DAM, said contract providing that the fee of
the said Pfeifer and Shultz shall be six (6) per cent of the
total cost of the work and the supervision engineer shall be
paid at the rate of $5.00 per hour, straight time basis, plus
traveling and subsista.nce expense, said subsista.nce expense not
to exceed $10.00 per day and traveling expense not to exceed
7 cents per mile.0
"BE IT AND IT IS HEREBY RESOLVED by the Public Utility Board
of the City of Rochester, Minnesota, that the Honorable Common
Council of the said City be and is hereby requested to authorize
the said Board to install the Watermains in the Greenway Sub-
division consisting of 18 Lots on Third Avenue Northeast and
Fourth Avenue Northeast, north of 17th Street, and in 14th Street
S. E. between Third and Fourth Avenues."
"WHEREAS, at a joint meeting of the Common Council and the Public
Utility Board held on May 10, 1955, it was agreed that future
extensions of water mains would not be assessed to the abutting
properties and then these assessments refunded when the property
is connected with the water as has been the policy for several
years, but that the Public Utility Board would make all necessary
extension of water mains and pay for these extensions out of
revenue received from sale of water and present reserves. Therefore,
BE IT RESOLVED, by the Public Utility Board of the City of
Rochester, Minnesota that the following procedures be and are hereby
established for the future extension of water mains:
1. All petitions for water main installation shall be made
directly to the City Council.
2. The Public Utility -Board will determine the feasibility of
each project and will enter into a contract with the developers
of the property abutting the requested water main extensions,
requiring the developers.to guarantee a. yearly revenue to the
Water Department from each lot abutting said Water main
extension and said amount shall not be less than the minimum
water rate per year. Said years of guaranteed revenue to
start on the first of the month following completion of the
water main installation. Contracts with developers shall
provide that _payment of watermain charges for dormant property
be secured by.a lien upon the land and that no service
connection will be permitted until all accrued charges are paid.
3. -The method of procedure for the installations will be as follows:
(a) The design of the system will be the responsibility of the
Superintendent of Water and be approved by the General
'Manager of Utilities.
(b) The City Engineer after receiving the approved desing of

the extensions will prepare the plans in conjunction with his
sewer plans and secure the approval of the State Health
Department.
(c) The ,City Engineer will prepare the .bid forms and take off the
bid quantities.
(d) The specifications for the advertisement of bids for the
installation of said extension will be prepared by the City
Engineer, subject to approval of the Public Utility Board.
(e) The Public Utility Board will advertise for bids in accordance
with Charter provision but will not award contracts until
after sewer contracts have been awarded by Common Council.
(f) All extensions of water mains and contracts "therefore, shall
be approved by the Common Council in accordance with provisio
of the City Charter and Ordinance #222.
4. After *
f"ter. the award of contracts the City Engineer will stake out the
location of the proposed water mains and establish the necessary
grades.
5. The Superintendent of the Water Department shall be responsible
fox the inspection of the construction and will accrue all .
necessary data and completion of final prints.
6. The Public Utility Board will make all final settlements of I -dater
Contracts."
An Acceptance of a Gift in the amount of $395.00 signed by George A. Sel
Commissioner of Consefsvation, was read and President Bach ordered the same placed
on file.
The City Engineer's estimate of cost for grading, base construction and
bituminous surfacing on 9th Avenue Southwest, 114 Street Southwest, 112 Street
Southwest and Memorial Parkway in Baihly's First Addition in the amount of
$26,469.00 was read and President Bach ordered the same placed on file.
The City Engineer's preliminary estimate for construction of a storm sewez
in 9th Avenue Southwest, 11t Street Southwest, 111 Street Southwest and Memorial
Parkway in Baihlyi s First -Addition in the amount of $15, 244. 50 was read and
President Bach ordered the same placed on file.
Notices from the Minnesota Department of Health that Gordon F. Brumm,
LeRoy F. Johnson, Ernest C. Thorsen and Melvin F. Koch had fulfilled the requirem-
ents of the examining committee for Sewage Works Operator, Grade C and Gordon F.
Brumm and LeRoy F. Johnson had fulfilled the requirements of the examining committee
for Sewage Works Operator, Grade D were each read and President Bach ordered the
same placed on file.
The Mayor's appointment of Patrolman Hilman Vang to the detective division
and Patrolmen Harry Stai and Arnold Anderson to the juvenile division was read and
upon motion by Anderson, second by Schwanke, the appointments of Hilman Vang to the
position as detective in the detective division, and Mr. Harry Stai and I-fr. Arnold
Anderson as Assistant Juvenile Officers in the Juvenile Division were approved.
A letter from the Board of Public Health & Welfare requesting approval
of the employment of Mr. Leslie Dean Soder, `to replace Mr. Walter Zierath who
retired May 31, 1955, effective June 16, 1955 at a salary of $325.50 which is 90%
of base salary was read and upon motion by Whiting, second by Anderson, the
appointment was approved.

the Council set his salary for the official year without taking into consideration
the matter of the proposed traffic bureau was read. and President Bach ordered the
same placed on file.
The following resolution adopted by the Commissioners of the Sinking
Fund was read and upon motion by Whiting, second by Anderson, the same was approved:
"Be it resolved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of $22,227.50 be and the said sum is hereby
appropriated from the Sinking Fund and ordered paid to the First
National Bank of Chicago, Illinois for the July 1st, 1955
maturity of interest on 1.70% General Obligation Sewage Disposal
Plant Bonds, Nos. 196 to 2900, Inclusive (Interest- $22,227.50 and
service charges $230.75)•
Be it further resolved: That the sum of $100,000.00 be and
the said sum is hereby appropriated from the Sinking Fund and
ordered paid to the First National Bank of Chicago, Illinoi.s for
principal due July 1st, 1954 on 1.70% General O.blig ation Sewage
Disposal Plant Bonds Nos. 196 to 295, Inclusive."
The following petitions for local improvements were each read and upon
motion by Anderson, second by Schwanke, the petitions relative to water mains were
referred to the Public Utility Board; the petitions reltative to storm sewer and
sanitary sewers were referred to the Sewer Committee and the City Engineer and the
petitions relative to surfacing and street work were referred to the Street & Alley
Committee and the City Engineer:
Petition for construction of a sanitary sewer in 3rd Avenue Northeast, 4th Avenue
Northeast and 19 Street Northeast in Greenway Subdivision;
Petition for construction of a water main in 3rd Avenue Northeast, 4th Avenue
Northeast and 19 Street Northeast in Greenway Subdivision;
Petition for construction of a storm sewer in 3rd Avenue northeast, 4th Avenue
Northeast and 18 Street.Northeast in Greenway Subdivision;
Petition for grading, base construction and bituminous surfacing on 3rd Avenue
Northeast, 4th Avenue Northeast and 18 Street Northeast in Greenway Subdivision;
Petition for construction of a sanitary sewer in 14th Avenue Northeast and in
15th Street. Northeast in Jefferson Slopes Second Addition;
Petition for construction of a storm sewer in 14th Avenue Northeast and in 15th
Street Northeast in Jefferson Slopes Second Addition;
Petition for construction of a water main in 14th Avenue Northeast and in 15th

Petition for grading, base construction and bituminous surfacing on 14th Avenue

Petition for construction of a curb and gutter on 111 Street Southwest from 7th
Avenue Southwest to the west line of Parkside Subdivision.
The City Treasurer's statement of funds for the month of May, 1955 was
read and President Bach ordered the same placed on file.
The reports of the Clerk of Municipal Court for the week ending June 10,
1955 showing total criminal. fines and costs collected $1,994.00 and civil fees
received $2.50 and for the week ending June 17, 1955 showing total criminal fines
and costs collected $1,502..00 and civil fees received $2.25 were each read and
having been approved by the City Attorney, President Bach ordered the same placed
on file.
The applications of Wm. T. McCoy Post #92, A-& W Root Beer Stand and
G. E. Rucker for license to sell soft drinks were each read and upon motion by
Anderson, second by bloody, the licenses were granted.

The applications of Wm. T. McCoy Post m92, A & W Root Beer Stand and
G. E. Rucker for license to sel-1 cigarettes were each read and upon motion by
Moody,. second by Tingley, the licenses
were .granted.
The applications -of Robert B. Mathison, Jr-. and Arthur LeVasaeur for
Journeyman Plumbers License were e4ch read and upon motion by Anderson, second by
Whiting, the licenses were granted.
The applications of Curtis Horten and Ernest Zabel. for Journeyman Hot
Water and Steam Fitter's License were each read and upon motion by. Moody, second
by Schwanke, the licenses were granted.

The application of Lysne Const.ruction Company for a permit to move two
houses, 14' X 291, over certain stre.ets in the City was -read and upon motion by
Whiting, second by Ander.son, the permit was granted, said buildings to be moved
under the supervi•sio.n of the Chief of Police and the Building Inspector.
The official .bonds .of James R. Lehnherr-, Eugene G. Roweka:mp, Douglas A.
Kruege,r, James P. Ryan, James Priefer Paine, Fores-t D. Higgins, Lavern A.
Schuchard and Duane F. Rasmussen each in the amount of $500.00--with the Western
Surety Company as surety and the license bond of Emil J. Nietz in the amount of
$1,000.00 with the Western Surety Company as surety were each read and upon motion
by. Moody, second -by Whiting, the bonds wer'e approved, the surety thereon accepted
and the same were ordered placed on. file. - - -
The contract bonds of C. M. Boutelle (2)- in the amounts of $5,274.70 and
$4, 083- 95 with the Western Surety Company as surety; Universal Motors, Inc. in the
amount of $2, 735.00 with the American Casualty Company of Reading, Pa. as surety
and Leon Joyce in the amount of $3, 604.10 with the Seaboard Surety Company as•
surety were each read and the same were referred to the Mayor for his approval.
A letter from 0. W. Haling requesting the Council to consider his
proposal in regards to renting or buying the land the City owns west of the
disposal Plant was read together with a. letter transmitting two sealed bids for
rental or purchase of the said land. A motion was made by Whiting, second by
Schwanke, that inas much as the Council was informally committed to sell the land,
there was no land for sale and the City Clerk was instructed to return Mr. Haling's
bids unopened. All present voted in favor of the motion;
A resolution adopted by the Board of Park Commissioners amending a
resolution previoulsy adopted setting salaries for the year 1955-1956 was read. A
I -lotion was made by Whiting, second by Tingley, that the resolution be returned to
the Board of Park Commissioners to be re -drafted in accordance with instructions
from the City Attorney. All present voted in favor of the motion.
The following resolutions were each introduced and read and President Bach
declared the same duly passed and adopted:

Parking Meter Fund and ordering payment made to Magee Hale Park-O-Meter Company,
$9,909.50; Sinking Fund of the City of Rochester, $29,173.41; First National Bank
of Rochester, $75,025.00; Mark Hurd Aerial Surveys, $2,000.00 and Standard Oil
Company, $1.856.43. Upon motion by Schwanke, second by Tingley, resolution
adopted.
Resolution appropriating $2, 559.90 from the General Fund, $2, 327. 83

from the S & A Fund, $451.09 from the Fire Protection Fund, $3,392.10 from the
Sewer Fund, $101.50 from the Parking Meter Fund and $4,.701.15 from the Lighting
Fund and ordering payment made to Street & Alley Fund, $4, 463.35; City of
Rochester, P.U. , $6, 470.63; N. W. Bell Telephone Co., $467. 52 and City of
Rochester, Minnesota, $2,132.06. Upon motion by Tingley, second .by Whiting,
resolution adopted.
Resolution appropriating $353.30 from the S & A Fund, $932.67 from the
Parking Meter Fund and $356.50from the Police Protection Fund and ordering -
payment made to Brinck-Solterg, $234.00; Gopher Stamp & Die, $502.50; Herbert G.
Knopp, $452.65 and Wm. H. Ziegler Co., $353.30. Upon motion by Whiting, second
by Anderson, resolution adopted.
Resolution appropriating $2,99g.29 from the Park Improvement Fund. and
ordering payment made to Walter C. Heins Agency, $1,465.45; F. J.. Paine Company,
$440.00; Mayo Civic Auditorium Revolving Fund, $773.84 and Alpek Sheet Metal
'dorks, $319.00. Upon motion by Anderson, second by Moody, resolution adopted.
Resolution appropriating $1, 392. 25 from the. Permanent Improvement Fund
and $769.45 from the Sewer Fund and ordering payment made to First National Bank
of Chicago, $230.75; Carlisle G. Fraser, $253.70; Viker & Sorenson, $285.00 and
Marv's Construction Company, $1,392.25. Upon motion by Moody, second by Schwanke,

Resolution authorizing the City Engineer to publish notice regarding
construction of sidewalks. Upon motion by Schwanke, second by Tingley,
resolution adopted.
Resolution adopting specifications and estimate of cost and ordering
bids for an accounting machine for use in the City Clerkgs office. Upon motion
by Tingley,°second by Whiting, resolution adopted.
Resolution approving a resolution adopted by the Public Utility Board

An Ordinance amending an ordinance entitled, "An Ordinance regulating
traffic, the operation and parking of vehicles, the use of streets for driveway
entrances and designating arterial highways, in the City of Rochester, Minnesota",
(same being ordinance No. 69s), was given, its first' reading.
Upon motion by Tingley second by Anderson,
and upon roll call and all present voting in favor tFierea he rules were sus -
pended and An Ordinance amending an Ordinance entitled, HAn 8rdinance regulating
the parking of vehicles on the public streets and alleys, providing for the
installation, maintenance and use of parking meters,. creating a parking meter fund
and providing penalties for the violation thereof", (same being Ordinance No. 971)

Alderman Schwanke brought up the matter of a piece of land on 13th
Street ,and 2nd Avenue Northwest which is now being r.sed, more or less, for dumping
trash and garbage and recommended that the City acquire the land and use same for
other pr..rposes.

'to 7th Street Northeast, west on 7th Street to 13th Avenue
Northeast and the present route are authorized and approved.
Be it further resolved that the Minnesota Railroad and
Warehouse Commission is hereby requested to give immediate
consideration to the schedule changes and curtailments and
the route changes and extensions as set forth in Exhibits
"A" and "B" attached hereto; and that the City Clerk be
instructed to forward a copy of this resolution to the said
Commission. H.
Alderman Anderson moved that the Common Council take up the following
business at this time. Alderman Whiting seconded the motion and upon roll call
all voted in favor thereof.
A petition requesting the Council to allow a sidewalk to be constructed
on the north side only of Fourteenth Street Northeast between let Avenue and 3rd
Avenue Northeast, signed by 14 property owners, was read. A motion was made by
Whiting, second by Anderson, instructing the City Attorney to prepare a resolution
authorizing construeti_on of a sidewalk on the north side of 14th Street Northeast
from let to 3rd Avenue and rescinding a resolution previously adopted.. All voted
in favor of the motion.
1. A petition for construction of a curb and gutter on 7th Avenue Southwest)
from Memorial Parkway to U. S. Trunk Highway #52 was read and upon motion by
Anderson, second by Schwanke, the same was referred to the Street & Alley
Committee and the City Engineer.
The following resolution adopted by the Board of Park Commissioners was
read and upon motion by Anderson, second by Moody, the action of the Board of
Park Commissioners was approved:
"WHEREAS, the wages for certain job classifications of the
Park Department were omitted from the resolution adopted by the
Board of Park Commissioners on June 1, 1955.
NOW THEREFORE, be it resolved by the Board of Park Commissimers
that the wages for the year 1955-1956 for the job classifications
set forth below are hereby established in the amounts indicated:

Sound Operator $6.25 per performance."
The recommendation of the Street & Alley Committee that a curb and guttei
be constructed on 112 Street Southwest from 7th Avenue Southwest to the west line
of Parkside Subdivision was read and upon motion by Schwanke, second by Tingley,
the recommendation was approved.
The recommendation of the Street & Alley Committee that a curb and gutte
be constructed on 7th Avenue Southwest from Memorial Parkway to U. S. Trunk
Highway No. 52 was read and upon motion by Moody, second by Anderson, the
recommendation was approved.
The recommendation of the Sewer Committee that the entire costs of the
storm sewer construction for Baihly's First Addition be assessed to the lots in
Baihly Addition was read. Mr. Ray Barvel and Mr. Wm. Suk were again present and
stated that they felt they should be given the same consideration as Parkside
