Minutes of a special meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council .Chambers, in the City, Hall, in said City
on June 27, 1955.
President Bach called the meeting to order at 5:00 o'clock P. M.,. the
following members being present: President.Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley and Whiting. Absent: None.
The call of the special meeting was -read and President Bach ordered the
same placed on file, the said meeting having been called for the purpose of con—
sidering a claim submitted by Mr. Frank Benjamin for damages to his property at
400 - 19th Avenue -Southwest caused by the construction of street improvements, and
any other business the said Common Council may deem proper.
Mr. and Mrs. Frank Benjamin were present at the meeting. President Bach
asked Alderman Whiting,-cChairman of the S.treet & Alley Committee, to report on thel
matter. He stated that each of the Aldermen had viewed the property owned by Mr.
Benjamin at 400 - 19th-Avenue Southwest and that the Councilhaddecided that a
fair and just settlement of the damage done by the City was $1, 300.00. A motion
was then made by Whiting, second by Schroeder, to offer Mr. Benjamin the sum of

$1,300.00 in compensation for damages sustained as a result of grading 19th Avenue)
Southwest and that the City Clerk be instructed to notify Mr. Benjamin of the said),
offer. Upon roll call all voted in favor of the motion. Mr. Benjamin stated that
they would have to give the matter further consideration and thought.
Alderman Schroeder moved that the Council take up the following business
at this time. Alderman Whiting seconded the motion and upon roll call all voted
in favor of the motion.
Alderman Whiting introduced a resolution ordering the first hearing on
widening of 6th Avenue Southwest from 2nd Street Southwest to a point 111 feet soul
of the south line of 2nd Street Southwest. A motion was made by Schroeder, second
by Moody, that the said resolution be adopted as read and all voting in favor
thereof, President Bach declared the said resolution duly passed and adopted.
Mr. Frank Benjamin again appeared before the Council and stated that he
had discussed it with his wife and they would be willing to settle for the sum of
$1,600.00 for damage to his property at 400 - 19th Avenue Southwest. He was
informed that the Council would consider his offer and report back at.the meeting
on July 5, 1955•
Mr. C. A. Armstrong, City Engineer, brought up the matter of construction
of a storm sewer in Baihlyls First Addition and stated that he felt storm sewers
were necessary in this addition and did not think the land could be built on
satisfagtorily unless storm sewers were put in. Alderman Schroeder, Chairman of
the Sewer Committee, verbally reported that the Sewer Committee recommended that
storm sewers be included in the development of Baihly's First Addition and unless

the storm sewers are included, they recommended that all improvements in the
project -be withheld. Upon motion by Whiting, second by Tingley, the above
recommendation of the Sewer Committee was approved-. All voted in favor of the
motion:
A motion was then made by Alderman Anderson, second by Alderman Moody,
that the Street and Alley Committee meet with Mr. Raymond garvel and Mr. William
Silk, owners of Baihly's First Addition, to further discuss the improvements in
the said Addition. All voted in favor of the motion.
Mr. Robert B. Rogers, of 602 - 7th Avenue Southeast, was present at the
meeting and stated that he did not feel that the offer of the Council to pay him
$60.00 for removal of a tree stump on his property was enough. He stated that he
had filed a claim with the City in the Amount of $200.00 and- would be- willing to
settle for one-half of that plus the $60.00 offered, making a total of $160.00. -
A motion was made by Alderman Whiting, second by Alderman Moody, that the matter
be laid on the table until the next meeting. All voted in favor of the motion.
Upon -motion by a:chwanke, second by Moody, the meeting was adjourned.
