M., the following members being present; President Bach, Aldermen Moody, Schroeder, Schwanke, Tingley and Whiting. Absent: Alderman Anderson. Upon motion by Moody., second by Schroeder, the minutes of the meetings of June 20th and June 22nd, 1955 were approved. President Bach stated this as being the time and place set for the following hearings. - First hearing on the widening of 6th Avenue Southwest from 2nd Street Southwest to a.point 111 feet south of the south line of 2nd Street Southwest. There was no one present wishing to be heard. First hearing on the .construction of. a -curb and -gutter on I12 Street Southwest from 7th Avenue Southwest to the west line of Parkside Subdivision. There was no one present wishing to be heard. First hearing on the construction of a curb and gutter on 7th Avenue Southwest from Memorial Parkway to U. S. Trunk Highway No. 52. There was no one present wishing to be heard. Second hearing on the construction of a sanitary sewer on the east side of 15th Avenue Southwest from 7th Street Southwest to the south line of Dresbach's Addition. There was no one present wishing to be heard. Second hearing on the grading, base construction and'bituminous surfaci of the extension of 102 Street Southeast in front of Lots 7, 8 and 9, Block 5 and Lots 4, 5 and 6, Block 6, Sunnyside Addition. There was no one present wishing to) be heard. Second hearing on the construction of a. sanitary sewer and service connections on 9th Avenue Southwest; 11J Street Southwest; 112 Street Southwest and Memorial Parkway in Baihlyls First Addition. Th-ere was no one present wishing+ to be heard. Second hearing on the construction of a sanitary sewer and service connections in 15th Avenue Northeast and 15th Street Northeast in Woodland Addition There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiving) and opening bids for the following projects: Bids for the construction of a.storm sewer in 9th Avenue Southwest; 11'i Street Southwest; 112 Street Southwest and Memorial Parkway in Baihlyls First Addition.. No bids were received. A letter signed by Raymond E. garvel and William E., Suk to withdraw their request to withdraw their petition for storm sewer for the Baihlyls 1st Addition, as submitted on June 22nd, 1955 was read and upon motion by Whiting, second by Schroeder, their request was accepted. The bids of Leon Joyce for base construction and bituminous surfacing in Baihlyl s First Addition in .the amount of $17, 353.60 and the bid of Leon Joyce for grading in Baihly's First Addition in the amount of. $$,052.OQ were each received and opened and upon motion by Schroeder, second by Moody, the same were referred to the Street & Alley Committee aryl the City Engineer. - Bids for grading, surfacing and curb and gutter on 15th Avenue Southwest from 7th Street Southwest to the south line of Dresbach's Addition. The bid of Leon Joyce in the amount of $3,990.75 for grading and the bids of Doyle Conner in the amount of $3, 093. 77 and C. M. Boutelle in the amount of $3,134. 60 for curb and gutter were each received and opened and up§n motion by Schroeder, second by Schwanke, the -same were referred to the Street & Alley Committee and the City Engineer. Bids for construction of a sanitary, sewer on the east side of 15th Avenue Southwest from 7th Street Southwest to the south line of Dresbach's Addition. No bids were received. Bids for the furnishing of an accounting machine for use in the City Clerk's office. The bid of The National Cash Register Company in the amount of $4,465.00 was received and opened and upon motion by Schroeder, second by Moody, the same was .referred ,to the Finance Committee and the City Clerk. A letter from the City Engineer transmitting through the City Clerk's office to the Council a request from Mr. F. A. Bigelow for damages to the_ south side of his house at 1203 - 13th Avenue Northwest caused by oil specks from wind drift was read and upon motion by Schroeder, second by Tingley, the same was referred to the City Attorney. • The following letter from the Planning & Zoning Commission w.as read and President Bach ordered the same placed on file: "Mayor Claude H. McQuillan and Members of the Common Council Rochester, Minnesota Gentlemen: At a meeting of the Planning and Zoning Commission held on Wednesday, June 15th, it was brought to our attention that the Park Department was interested in acquiring from the Cemetery Association that land which lies north of the cemetery proper and south of Silver Lake Park, less that portion which is necessary for the extension of 7th Street nobtheast. The Planning and Zoning Commission feel that this land would be a very worthwhile addition to the park systems of Rochester. Yours respectfully, PLANNING' AND ZONING COMMISSION W. W. Hendricks, Secretary" • Record of Official Proceedings of the Common Council of the .City of .Rochester, Minn., July 5, 1955 • 1 r: The three following resolutions adopted -by the Public Utility Board were each read and upon motion by Schroeder, second by Schwanke, the same wer4 ordered placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the AMERICAN CAST IRON PIPE COMPANY for the furnishing, in accordance with specifications, of 1,000 feet 4" Class 150 Cast Iron Pipe 3,000 feet 6" Class 150 Cast Iron Pipe 500 feet 8" Class 150 Cast Iron Pipe 54 Class 250 Short Pattern Fittings, the total amount of the said contract to be EIGHTY EIGHT HUNDRED FIFTEEN DOLLARS ARD ONE CENT ($8,815.01) and the said. American Cast Iron Pipe Company being the lowest responsible bidder." "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the STERLING ELECTRIC COMPANY OF Minneapolis, Minnesota for the furnishing, in accordance with specifications, of 150 - Class 3, 35 foot W. R. C. Poles 100 - Class 3, 50 foot W. R. C. Poles, the amount of the bid per pole being $32.97 and $60.40 each, respectively and the t-otal amount of the contract to be TEN THOUSAND NI14E HUNDRED SEVENTY DOLLARS AND FIFTY CENTS ($10,970.50) and the said Sterling Electric Company being one of the two lowest responsible bidders." The request of the Board of Public Health & •Welfare "for approval of the employment, effective July 18, 1955 of Miss Joyce M. Siems as a public health nurse at the beginning salary of $310.00 per month was read and upon motion by Schroeder, second by Tingley, their request was approved. The Mayor's appointment of Virgil M. Elliott, 621 - 10th Avenue S. E. to the Parking and Traffic Committee, :to replace Mr. Max Durand, who resigned, was read and upon motion by Whiting, second by Schroeder, the Mayor's appointment was approved. The application of Marvel M. Kyle for appointment as Secretary to the Building, Plumbing, Electrical and Heating Inspectors was read and upon motion by Whiting, second by .Schroeder, the appointment was made as requested. A petition for traffic control signal on 14th Street Northeast at the intersection of 14th Avenue Northeast was read and upon motion by Schroeder, second by. Gardner for leave of absence for two weeks military duty was read and upon motion by Schroeder, second by Tingley, his request was granted. The request of the Union National Bank for change of collateral for securities listed below was read and President Bach ordered the same placed on file: i IT. S. Treasury Bonds 1958 (dated 2-15-53) 22p Due 12-15-59 $100,000.00 The City Engineer's preliminary estimate for construction of ,a sanitary sewer and service connections on 9th Avenue Southwest; 112Street Southwest; 112 Street Southwest and Memorial Parkway in Baihly's First Addition in the amount of $22, 003.28 for sanitary sewer and $9, 100.00 .for service connections was read and ordered placed on file. The City Engineer's preliminary estimate for widening of pavement and construction of a curb and gutter o.n 6,th Avenue Southwest from 2nd Street S. W. to a point 110 feet south in the amount of $1, 275.00 was read and ordered placed on file. The recommendation of the Street & Alley Committee that the bid of Leon Joyce for grading of 9th Avenue Southwest; 114 Street Southwest; 112 Street Southwest and Memorial Parkway in Baihly's First Addition be accepted at_the unit prices bid and checks be returned to the unsuccessful bidders was read and upon motion by. Moody, second by Schroeder, the recommendation was approved. E. from 9th Avenue S. E. to a, point 267 feet east, be granted; subject to the submission of an acceptable replat of this location was read and upon motion by Whiting, second by Schroeder, the recommendation was tabled until after the hearing to be held on July 18, 1955- The recommendation of the Sewer Committee that the City re -advertise for bids for construction of a storm sewer in 9th Avenue Southwest; llj Street South- west; 11� Street Southwest and Memorial Parkway in Baihly's First Addition was real and upon motion by Schroeder, second by Whiting, the recommendation was approved. The recommendation of the Sewer Committee that all bids be rejected for construction of a sanitary sewer in the east side of 15th Avenue Southwest from 7th Street Southwest to the south line of Dresbach's Addition and that the City Engineer be authorized to construct the sanitary sewer by City Force Account was read and upon motion by Whiting, second by Moody, the recommendation was approved. The recommendation of the Fire Committee that the Rochester Fire Department be instructed to draw up specifications and advertise for bids to be opened July 18, 1955 for a six cylinder, four door station wagon for use in the Rochester Fire Department was read and upon motion by Schroeder, second by Schwanke, the recommendation was approved. The recommendation of the Fire Committee that the Rochester Fire Department be instructed to draw plans and specifications for a drill tower at Station 02 and advertise for bids, to be opened July 18, 1955 was read -and upon motion by Schroeder, second by Moody, the recommendation w-as approved. The recommendation of the Fire Committee that the Fire Committee of the Rochester Common Council be instructed (with power to act) to employ an Architect to prepare plans and specifications for Fire Station 43 -as per recommendations passed by the Common Council December 21, 1954 was read and upon motion was approvql `and the Fire Committee was given power to act. The recommendation of the Finance Committee than the bid of The National Cash Register Company for furnishing one accounting machine for use in the City 01•erk's office, in the amount of $4,465.00 be accepted and checks be returned- to the unsuccessful bidders was read and upon motion by Whiting, second by Schroeder, the recommendation was approved. The recommendation of the Zoning Board that the petition of Mohn & Hodge Realtors -for permission to build one house on each of the following -described lots be granted was read: (1) The East 60 feet of the West 207 feet of the North 105 feet of Lot 40, Auditor's Plat "A" (2) The East 60 feet of the West 267 feet of the North 105 feet of Lot 40, Auditor's Plat "A". • A motion was made by Whiting, second by Schroeder, that the City Clerk be instructed 450 5 ® Record of Official Proceedings of the Common Council of the City of Rochester, Minn., July 5. 1955 to publish a notice to all persons interested in the variation to the Zoning Ordinance, said hearing, to be held July 19, 1955• All voted in favor of the motion except Alderman Moody, who voted "no". The recommendation of the License Committee recommending the adoption of the Ordinance prepared by the City Attorney granting a 15 year franchise to the Northern Natural Gas Company to produce, manufacture, distribute and sell gas in the present and future territorial limits of the City of Rochester and that the Ordinance as prepared is basically the same as franchise Ordinance No. 609 with the exception of certain grammatical changes for clafification purposes was read and. upon motion by Whiting, second by Moody, the recommendation was . approved. The application of Howard W. Swa.rts t.o install sewer and street improvements at their own expense in Woodland Addition to the City of Rochester in accordance with plans and specifications furnished us -by the City of Rochester was read and upon motion by Schwanke, second by Moody, the same was referred to the Street & Alley Committee and the. City Engineer. The application of Edna M. Rubenstein for transfer of "On Sale" liquor license No. 366 from 12 South Broadway to 311 First Avenue Southwest was read and upon motion by Whiting, "second by Schwanke, the transfer was granted. The application of Jack Rubenstein for a license to operate a bowling alley (10 alleys) was read and upon moti.on by Schroeder, second by Tingley, the license was granted. The application of Jack Rubenstein for a non -intoxicating malt liquor license (on sale 3.2 beer) was read and upon motion by Tingley, second by Schwanke, the license was granted. The applications of Edna M. Rubenstein and Jack Rubenstein for license to sell cigarettes were each read and upon motion by Tingley, second by Whiting, the licenses were granted. The applications of Edna M. Rubenstein and Jack Rubenstein for license to sell so"fi drinks were each read and upon motion by Schwanke, second by Tingley, the license was granted. The application for an Electrical Contractor's license df A. D. Mills was read and upon motion by Schroeder, second by Moody, the license was granted. The application of A. D. Mills for a Master Electrician's License was read and upon motion -by Whiting, second by Schwanke, the license was granted. The official bond of Lee E. Graham in the amount of $500.00 with the Saint Paul Mercury Indemnity Company as surety and the license bond of A. D. The reports f6r the month of June,.1955 of the Building Inspector shows fees collected for building permits issued. $429.00; of the Electrical Inspector showing fees collected for electrical permits issued $372.75; of. the Plumbing Inspector showing fees collected for plumbing permits issued $993.25; of the Heating Inspector showing fees collected for heating permits $906.50 and showing fees .collected for sign permits issued in. the amount of $59.63 were each read and President Bach referred the same to the Finance Committee. The report of the Clerk. of Idunicipal Court for the week ending. June 24, 1955 showing total criminal fines and costs collected $1, 995.0.0 and civil fees received $1.65 was read and having been approved by the City Attorney, President Bach ordered the same placed on file. The report of the City Weighmaster for the month of June, 1955 showing fees collected for loads neighed in the amount of $126.95 was read and President Bach referred the same to. the Finance Committee. Ellis -of 115 - 4th Avenue N. W. who stated that she had a rooming house on the East side of 4th Avenue and since there was no parking on her side of the street she was not getting any business, and requested that the Council make some change in the parking. Mayor McQuillan stated that he understood there was some thought to pushing the curb back, and he iUt the Council should take some action. C. A. Armstrong, City Engineer, stated that the East side of 4th Avenue could not be widened but that the West side could be widened about 5 or 7 feet. A motion was then made by Alderman Whiting, second by. Alderman Schroeder, instructing the City. All voted in favor of the motion. The claim.of Robert E. Rodgers for removal of a tree stump on his property at 607 - 7th Avenue S. E. was again discussed by the Council. Alderman . Whiting moved that the City Clerk be instructed to advise Mr. Rodgers that the Council would pay $90.00 to compensate for.loss of the tree and that the Council would assume no responsibility for removal of the stump. Alderman Schroeder seconded the. motion and all voted in favor, thereof. Alderman Whiting stated that he had received a call from. Mrs. C. Leslie Gray of•212_--gth Avenue Southwest requesting that the Council consider changing the "no parking" on the East side of 9th Avenue S. W. Alderman Schroeder, Chairman of the Sewer.: MXXXXXg Committee, verbally reported that the said Committee had met with Mr. Edward Ranfranz, an employee at the Sewage Treatment Plant, Mr. Walter C. Hogenson, Superintendent and Mr. C. A. Armstrong, City Engineer, in regard to the salary of the said Mr. Ranfranz and after discussing the -matter the said committee recommended that the salary of Mr. • Ranfranz remain the same as set before, $2,700.00. Upon motion by Anderson, second by Whiting, the recommendation of the Sewer Committee that the salary be left as set by resolution u-as approved. I Upon motion by Schroeder, second by Moody, and upon roll call and all voting in favor thereof, the rules were suspended and the ordinance was given its third and final reading. Upon motion by Moody, second by Schroeder, that the said ordinance be adopted as read, and all voting in favor thereof, President Bach declared the said ordinance duly passed and adopted. • Alderman Schwanke stated that the Dog Catcher had contacted him in regard to the expense and use of his truck.. A motion was made, by Schroeder, second by Whiting, that the Public Grounds Committee meet with the Dog Catcher and bring in some recommendation in regard to the use and expense of his truck.
