Minutes of a meeting of the Common Council of the City of Rochester,
Minnesota, held in the. Council Chambers in the City Hall, in said City, on
August 15, 1955•
President Bach called the meeting to order at 7:30 o'clock P. M., the
following members being present: President Bach, Aldermen Anderson, Moody,
Schwanke, Tingley and Whiting. Absent: Alderman Schroeder.
Upon motion by Moody, second by Whiting, the minutes of the meetings of
July 29th and August 1st, 1955 were approved.
President Bach stated this as being the time and place set for receiving
and opening bids for construction of a curb and gutter on 7th Avenue Southwest
•
from Memorial Parkway to U. S. Trunk Highway No. 52 and on lla Street Southwest
from 7th Avenue Southwest to the west line of Parkside Addition. The bids of
'
Doyle Conner Company in the amount of $9,927.90 and C. M. Boutelle & Sons in the
amount of $10,130.50 were each received and opened and upon motion by Anderson,
second by Moody, the.same were referred to the Street & Alley Committee and the
City Engineer for tabulation and report.
Mr. Robert Bluhm of 1315 Second Avenue Northwest was present and
inquired what had been done with the petition presented last winter to have the
alley running west from 2nd Avenue Northwest, north of 13th Street Northwest
improved. Upon motion by Whiting, second by Anderson, the matter was referred
to the Street & Alley Committee for further investigation.
Mr. Edward Capelle of 703 - 3rd Avenue Southeast was present and
stated that the sewer on 6z Street Southeast plugs up right next to 3rd Avenue
Southeast causing the basements to flood. Upon motion by Whiting, second by
Moody, the matter was referred to the Sewer Committee and City Engineer for
investigation.
Mr. Robert Petersdorf was present and inquired as to when street signs
Could be put up in Parkside Sub -Division. He was informed that the street signs
had just arrived and should be up in about a month.
The matter of granting a franchise to Peoples Natural Gas Company was
then discussed. Mr. Bert Alexander was present and requested that the Council
study the ordinance further as he did not think the taxpayers were benefiting in
any way by passing it. Mr. Howard Smith was also present and suggested that more
provisions be added to the ordinance, namely that they furnish gas in quantities
needed and furnish same impartially. Mr. Robert J. Thompson of 619 - 4th Street
Houthwest was present and stated he felt the gas company had done a good job and
urged passage of the ordinance. Mr. Joe Robbins, Manager of Peoples Natural Gas
Company, outlined some of the future plans of the company. Mayor McQuillan
stated that he could see nothing wrong with the franchise and urged its passage.
Mr. Robert Petersdorf spoke and said they were not opposed to granting the

franchise but thought the rate structure was too high. Mr. Harold Kamm, Manager
of Industrial Opportunities, Inc. also stated he could see aoliobjection to
granting the franchise.
An Ordinance granting to the Northern Natural Gas Company., a Corporatiol
(Operating as Peoples Natural Gas Division), its successors and assigns, a non-
exclusive franchise to produce and manufacture and to use the streets, alleys,
and other public places for the transmission, dis.tribution and sale of gas and
prescribing: the terms and conditions of such franchise, was given its third and
final reading.
A motion_ was made, by Schwanke, second by Whiting, that the ordinance be

adopted asread, and upon roll call and all present voting in favor thereof,
President Bach declared the said ordinance duly passed and adopted.
A letter from the Minnesota Highway Department transmitting two copies
of a plan for the resurfacing of T. H.- 63 from 6th Street S. W. to 4th Street
N. W. and also two estimates of the cost of the work, one estimate based on the
State -paying the center 30 feet and the other estimate based on the State paying
for 49 feet in the center and 75% of the remainder, was read. Mr. C. A. Swanson,
District Engineer of Minnesota Highway Department, was present and explained
the basis for -the estimates as presented: Mr. Max Durand, Business Manager for
Local Labor Union, was present and urged that the Council revert to parallel
parking on Broadway. President Bach stated that he thought angle parking should
be left on Broadway and that the merchants on Broadway also preferred angle
parking.. Mayor MCQuillan stated that he was opposed to parallel parking and
never did feel that Broadway should be a public highway.. He further stated that
he felt the people of the City should express their opinions and recommended that
if necessary an election be held. After discussing the matter further a motion
was made by Whiting, second by Schwanke, that the City Engineer get information
on the occupancy of the parking stalls on Broadway and report back to the Council
at a. later date. All present voted in favor of themotion.
Mayor MCQuillan stated that the Airport Commission and Airport Company
would like to have.a meeting with the entire Council. Tuesday night, August.16th,
at 7:30 0.' clock was set for the meeting.
The City Engineer's Preliminary Estimate for construction of a curb and
gutter on 7th Avenue Southwest f rom.Memorial Parkway to T. H. #52 in the amount of
$5,823.50 and construction of a curb and gutter on 112 Street Southwest from 7th
Avenue to the west line of Parkside Addition in the amount of $4,370.50 was read
and President Bach ordered the same placed on file.
The following resolution adopted by the Public Utility Board was read
and Present Bach ordered the same placed on file:

"Be it and it.is hereby resolved by the Public Utility
Board that the Common Council of the said City be and is

hereby requested to direct the Mayor and City Clerk to execute
a 'RELEASE OF ALL CLAIMS' in the matter of Carl H. Christenson,
as a -result of damage to City property, upon payment of the
amount of ONE HUNDRED TWELVE DOLLARS AND FIFTY CENTS."
The following resolution adopued by the Commissioners of the Sinking
Fund was read and upon motion by Anderson, second by Moody, the resolution was
approved:
"Be it resolved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of $247,734- 38 be and the said sum is hereby
appropriated from the Sinking Fund of the City of Rochester,
Minnesota, and ordered paid to the First National Bank of
Rochester, Minnesota, for the purchase of $250, 000,00 - 2% II. S.
'treasury Notes, due August 15, 1957-
Principal - $250,000.00 at 990.9375 $247,734.39
Accrued Interest . . . . . . . . . . . none
Premium. . . . . . . . . . . . . . . . . none
The above investments are purchased for the Electric Department
Depreciation Reserve of the Public Utility Department."
A letter from the State of Minnesota, Water Pollution Control Commission,
transmitting approved• copies of plans submitted, for sewerage facilities in the
City of Rochester was read and President Bach ordered the same placed on file.
A letter from the Board of Park Commissioner stating the reasons why
the construction of the band shell had costed more than originally anticipated
and enclosing an. --Additional bill in the amount of $44.10 to the Botsford Lumber
Company was read and upon motion by -Whiting, second by Anderson, the bill idas
approved and the letter was ordered placed on file.
A letter from the Board of Park Commissioners showing the disbursements
charged against the dredging fund to date and requesting that the Council allot
another $1,000.00 for dredging work in Silver Lake was read and upon motion by
Whiting, second by Moody,•their request was granted.
The request of the Board of Public Health & Welfare that the Council
approve the employment of Mr. Gerald I.. Goldschmidt, effective August 8, 1955,
as general sanitarian in the health department at the beginning salary of $328.50
per month, which is 90% of base salary, was read and upon motion by Whiting,
second by Anderson, the -appointment was approved.

The following letter from A. M. .Nelson, Assistant Chief of Police, was
"Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
The P. T. A. of . Holmes School, Carl J. Briese, Supt. of the Juvenile
Division and Chief James J. Macken, Jr., respectfully request that
parking be prohibited on the south side of East Center Street from
10 Avenue to 11 Avenue, in front of the Holmes School, to prevent
accidents and children being injured by coming off the school
grounds and dashing out between parked cars.
This can be accomplikhed in two - ways - setting up signs
restricting parking in that particular block from 8 A.M., to 4 P.M.,
Monday thru Friday, or by painting the curb yellow. The former
would enable residents in that area to use that space for parking
after school has been dismissed.

Upon motion by Whiting, second by- Schwanke•, the request was approved and' the City
Attorney•was instructed to prepare a resolution establishing no parking from 9 a.
to 4 p.m., Monday through Friday as requested.
The following recommendation of the Police Committee and the Chief of
Police was read -and upon motion by Tingley, second by Anderson, the recommendation,
was approved:
"Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersigned Members of the Police Committee of the Common
Council, -and the Chief of Police, do hereby recommend that,
(1) 'Yield to Pedestrian' signs be placed at the north end of the
Mayo Park Bridge to facilitate the safe crossing of pedestrians at
this point, until a more accurate determination of necessary and
proper controls at this point can be made. You are also advised
that the City Engineer is contacting the State of Minnesota
requesting the cost of a study of this intersection and also 14th
Avenue and 14th Street Northeast. This study would determine the
kind and type of traffic controls that might be necessary at
these points.
(2) The request of Dr. Raymond L. Brown, 920 - 2nd Street
Southwest, Chiropractor, for a patient loading zone, be not granted.
(3) The Juvenile Bureau of the Police Department be authorized to
purchase 5,000 bicycle license plates from the Waupan Prison in
Wisconsin and that the City Attorney amend the Ordinance regulating
bicycles so that the fee for bicycle license plates is 500. This
fee will defray the cost of the plates and the administrative
expenses involved in the licensing. It is further recommended that
the bicycle ordinance be amended to take care of the dispostion
of bicycles picked up by the Police Department and not claimed.
(4) The request of the Rochester Bread Company fora permit to use
a loudspeaker be not granted. This request is being denied because'
of the pending noise abatement program.
(5) The request of the Postal Department for space for a pick up
box on the east side of the Post Office at a similar location to
that of one in existence on the West side of the Post Office be
granted and that the City Attorney prepare the necessary resolution
to effect this improvement.
(6) The Police Department be authorized to purchase badges and cap
pieces for the uniformed division of the Police Department from Carl
Entenmann and Sons, 146 West 18th Street, Los Angeles 15, California.

The claim. of Wm. Hanson in the amount of $9. 50 for damage to his car was
read and upon motion by Whiting, second by Tingley, the same was referred to the
City Attorney.
Mayor McQuillan presented a letter addressed to him from Philip A.
Beardsley, District Manager, Social Security Administration, requesting office
space in the City Hall for two days each week. A motion was made by Whiting,
second by Moody, that the Mayor be instructed to arrange office space for the
Social Security Administration in the basement of the City Hall.
A petition requesting to withdraw the petition for sanitary sewer in the
East side of 15th Avenue Southwest from 7th Street S. W. to the south line of

Dresbach's Addition signed by Donald D. Russell, Gene Bemel, R. W. Johnson, Leon
Shapiro and E. J. Armit was read and the same was ordered placed on file.
The recommendation of the Street & Alley Committee that the bid of
Doyle Conner Company be accepted at the unit prices bid for construction of a
curb and gutter on 7th Avenue S. W. from Memorial Parkway to T. H. #52 and lla
Street S. W. from 7th Avenue to west line of Parkside Addition, and that checks
be returned to the unsuccessful bidders, was read and upon motion by Schwanke,
second by Moody, the recommendation was approved.
The recommendation of the Sewer Committee that the project for constr-
uction of sanitary sewer in the east side of 15th Avenue S. W.. from 7th Street
,
S. W. to the south line of Dresbach's Addition be abandoned, and the resolution
Of July 5th authorizing its construction be rescinded, was read and upon motion
by Moody, second by Anderson, the recommendation was approved and the City
Attorney was instructed to prepare a resolution abandoning the said project.
The recommendation of the Street & Alley Committee that the plans for
construction of a bridge on 7th Street Northeast over the Zumbro River be
approved and the City advertise for bids to be received on October 3, 195 was
read and upon motion by Anderamn, second by Moody, the recommendation was
approved.
The recommendation of the Lighting Committee that the application of
Miss Priscilla Wagoner to move the street lingt on 1st Street Southwest, east,
adjacent to the stop and go light be granted, the said work to be done under the
supervision of the City Engineer and the Superintendent of Distribution at the
Light Plant and the entire expense to be borne by Miss Wagoner, twas read and upon
motion by Moody, second by Anderson, the recommendation was approved.
The recommendation of the Lighting Committee that the application for a
street light in the middle of the block on 7th Avenue between 3rd and 4th Street
Southwest is not warranted was read and upon motion by Tingley, second by
Whitings the recommendation was approved.

The recommendation of the Street & Alley -Committee that curb and gutter
on 2nd Street Northeast from 11 to 13 Avenue Northeast be re -advertised for
letting at -the first meeting in September, 1955 was read and upon motion by
Schwanke, second by Whiting, the recommendation was approved.
The recommendation of the Street & Alley -Committee that the curb and
gutter on 13th Avenue Southeast from 6 to 8 Street Southeast be advertised for
bids to be opened at the first meeting in September, 1955 was read and upon
motion by Anderson, second by Moody, the recommendation was approved.
The request of Leonard Gatt je for permission to install a sewer from
the intersection of 10th Avenue and 7th Street Southeast, going east on 7th
Street, was read and upon motion by Whiting, second by Tingley, the same was
referred to the Sewer Committee and the City Engineer.

A petition for construction of a curb and gutter on Sth Avenue South-
west between Memorial Parkway and 111 Street Southwest was read and upon motion
by Whiting, second by Anddrson, the same was referred to the Street & Alley.
Committee and the City Engineer.
A letter from C. A. Armstrong, City Engineer, transmitting a copy of
Change Order #1 on project titled, "School Signals Washington School Area",.this
change order changing the location of one set of signals from loth Avenue N. W.
to Sth Avenue N. W., was read and upon motion by Whiting, second by Tingley, the
change order was approved.
A letter from C. A. Armstrong, City Engineer, submitting cost estimate
and plans prepared by Mr. Gilbert H. MacMillan, Consulting Engineer, of proposed
bridge over Zumbro River on 7th Street Northeast, was read and upon motion by
Whiting, second by Moody, the plans for the proposed bridge over Zumbro River on
7 Street Northeast as submitted by the City Engineer were approved.
The following letter from the City Attorney was read and the same was
ordered placed on file:

Re: Condemnation of
Cemetery Land
Gentlemen:
In response to your inquiry about the condemnation of
certain land now owned by the Rochester Cemetery Association
for street and park purposes, it is my opinion that the City
of Rochester, acting through its Common Council, has the
authority and the power to dondemn the particular land in
question for the purpose of providing right of way for
Seventh Street Northeast and for the purpose of providing
an addition to Silver Lake Park.

The matter of pruchasing approximately 21 acres of land from the Rochester
Cemetery Association was discussed and Alderman Whiting was authorized to request)
the Cemetery Association -to submit a written offer for the sale of the land.
The report of the City Weighmaster for the month of July, 1955 showing
fees received for loads weighed in the amount of $109.60 was read and President
Bach referred the same to the Finance Committee.
The reports of the Clerk of Municipal Court for the -week ending August 12,
1955 showing total criminal fines and costs -collected $1;104:00 and civil fees
received $6.05 and for the week ending August 5i 1955 showing total criminal finer
and costs collected $1,157,00 and civil fees received $5.05 were each read and
having been approved by the City Attorney, President Bach ordered the same placed
on file.
The report of the City Treasurer for the month of July, 1955 was read
and President Bach ordered the same placed on file.

The application of H. T. Earle Sr. for a license to construct sidewalks,
curb and gutter, etc. was read and upon motion by Whiting, second by Moody, the
license was granted.
The application of Viker & Sorenson for' a license to connect with
sewers and drains was read and upon motion by Moody,'second by Whiting, the license
I was granted.
The application of Lysne Construction Company for a permit to move a
lhouse'over certain streets in the City of Rochester was read and upon motion by
ISchwanke, second by Moody, the permit was granted, subject to the approval of the
l Fire Chief, Building Inspector and the Chief of Police.
The indemnity bond for lost order or warrant of Devoe & Raynolds Company
lin the amount of $17,97 was read and upon motion by Whiting, second by Anderson,
the bond was approved.
The -two license bands of Charles Harris each in the amount of $1,000.00
lwith the Aetna Casulaty and Surety Company as surety were read and upon motion
by Whiting, second by Moody, the bonds were approved, the surety thereon accepted,
land the same were ordered placed on files
The contract bonds of Carlisle G. Fraser in the amount of $6, 967.9 5 with
the.Federal Insurance Company as surety, H & H Electric Company in the amount of
$3,250.00 and C. M. Boutelle in the amount of $3,695.30 with the Western Surety
Company as surety were each read and the same were referred to the Mayor for his
approval.

Alderman Whiting.recommended that the Public Grounds Committee thoroughl
investigate the advisability and cost of air-conditioning the City Hall.
