of the City -of Rochester, Minn., August 17, 1955
Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, on August 17, 1955•
A motion was made by Tingley, second by Moody, that Alderman Schroeder
act as President pro tem. Upon roll call all present voted in favor thereof.
President pro tem Schroeder called the meeting to order at 7:30 o'clock
P. M., the following members being present: Aldermen Anderson, Moody, Schroeder,
Sc.hwanke, Tingley and Whiting. Absent: President Bach.
President pro tem Schroeder stated the matter of acquiring certain
lands for widening and paving of 3rd Avenue Southeast between 3rd and 4th Street
Southeast would-be considered by the members of the Council at this time.
Mr. R. V. Ehrick, City Attorney, then presented.sach of the property
owners present with a copy of .their respective contract. He read the contract
and explained same to the property owners.
Mr. Louis Capelle inquired as to what ,had been allowed for damages to
his steps and sidewalk. Upon motion by Anderson, second by Whiting, the amount
of $265.00 was allowed for damages and repair to his steps and sidewalk. All
voted in favor of the motion.
The recommendation of the Street & Alley Committee that pursuant to
negotiations with the property owners on 3rd Avenue Southeast from 3 Street to
4 Street Southeast, the assessment for the improvements to be constructed in
this location be established at $10.00. per lineal front foot .was read and upon
motion by Anderson, second by Moody, the recommendation was approved.
Alderman Moody introduced the following resolution which was read and.
upon motion by Tingley, second by Moody, that the said resolution be adopted as
pro tem Schroeder
read, and all voting in favor thereof, President Zzzk declared the said resolution
duly passed and adopted:
"BE IT RESOLVED, by the Common Council of the City of Rochester
that, pursuant to the negotiations and understanding with certain
abutting land owners on Third Avenue Southeast between Third Street
and Fourth Street, the Mayor and City Clerk are hereby directed to
execute the six (6) contracts attached hereto between the City of
Rochester and the following named persons:
1) T. M. Justus and Loretta Justus
2) Mary A. Murphy and James V. Murphy
3) George C. Demmer and Mary C. Demmer
4) Laura Jane Russell
5) The Olmsted County Building and Loan
Association and Alice C. Hampel
6) Louis C. Capelle and Cecelia M. Capelle
and to execute any and all instruments and deeds required by said
Contracts.
BE IT FURTHER RESOLVED, that the checks or drafts here.t of 6 rdy
issued by the City of Rochester pursuant to the Resolution passed
on Jwly 23, 1951, and approved by the Mayor on July 24, 1951,
awarding damages in the Second and Third Avenue Southeast
condemnation proceedings, which were not claimed and are still
in the possession of the City Clerk, be cancelled and the City
Clerk is hereby instructed to credit the amount of these unclaimed
checks to the fund from which they were drawn."
Alderman Anderson introduced a resolution appropriating $9, 556.00 from

the Permanent Improvement Fund and ordering payment made to T. M. Justs and
Loretta P. Justs, $547, 50; Mary A. Murphy and James V. Murphy, $845.00; George C.
Demmer and Mary C. Demmer, $562.50; Laura Jane Russell, $752.50; Olmsted County
Building and Loan Association and Alcie C. Hampel, $768.50; Stnaley C. Mohn,
Lavon R. Mohn, Haven H. Hodge and Jeanne M. Hodge, $3,500.00; Chester H. Johnson,
$2,025.00 and Louis C. Capelle and Cecelia M. Capelle, $555.00. A motion was mad
by Whiting, second by Anderson, that the said resolution be adopted as read, and
upon roll call and all present voting in favor thereof, President pro tem Schroe di
declared the said resolution duly passed and adopted.
Upon motion by Moody, second by Tingley, the meeting was adjourned
until 7:30 o'clock P. M. on August 23, 1955-
