Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, on September 19, 1955•
President Bach called the meeting to order at 7:30 oiclock P. M., the
following members being present.: President Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley and Whiting. Absent: None.
Upon motion by Moody, second by Tingley, the minutes of the meetings
held on September 6th and September Sth, 1955 were approved.
President Bach stated this as being the time and place set for a contin-
uation of the second hearing on the construction of a sanitary ,sewer in 3rd Avenue
Northwest_ from 14th Street Northwest to a point 76 feet, north of the south line of
Outlot h, Northern Addition. There was no one present wishing to be heard. The
following letter from the City Engineer was then read:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
The estimated cost of an 911 Sanitary Sewer in 3 Ave. N.. W. from
14th Street to a point 76, north of the south line of Outlot h in
Northern Addition is $9,650.00.
The construction cost on this project will be high because of
the many curves in the street, narrow roadway, and a considerable
amount of rock in the trenching. On the basis of the above cost
the assessment would be $4.70 per front foot if distributed a ually
to all the frontages on both sides of 3 Ave., which totals 20N
feet including the 460 feet of Thompson property on the east side.
It is advisable to determine the assessment basis before ordering
the work.
This is a difficult and costly project. It will occassion the
rather high unit foot cost, plus a severe limitation of traffic
while the ditch is open.

After further discussion on the matter a motion was made by Alderman Whiting,
second by Alderman Schwanke, referring the same to the Sewer Committee and the Cits,
Engineer with instructions to get an interpretation from the City Attorney in
regard to the assessment means and to investigate and study the matter further and

report back to the Common Council. All voted in favor of the motion.
President Bach stated this as being the time and place set for receiving)
and opening bids on the following projects:
Bids for paving Mayo Park Bridge approaches and 3rd Avenue Southeast from
3rd to 4th Street Southeast. The bid of Doyle Conner in the amount of $29,469.20
was received and opened and upon motion by Schwanke, second byAnderson, the same
was referred to the Street & Alley Committee and the City Engineer for tabulation
and report.
Bids for the construction of a water main in the extension of 9th Street
Southeast to a point 267 feet east of 9th Avenue Southeast. The bid of Carlisle
Fraser in the amount of $1,939.40 was received and opened and upon motion by

Whiting, second by Anderson, the same was referred to the Water Committee and the
City Engineer for tabulation and report.
Mrs. W. C. Faber of 703 First Street Southwest was present at the meeting
and requested that the Council give her a reserved space at the side of her 'rooming
house for persons staying there to load and unload. Upon motion by Schroeder,
second by Tingley, the same was referred to the Police Committee with power to act.
Mr. Norman Kuyath was again present and inquired as to whether a decision
had been reached in allowing him to build a house on a lot, which has less than
4,000 feet, located just east of 410 - 9th Street Northwest. He also showed the
Council a proposed plan of the house he planned to construct. Upon motion by

Whiting, second by Tingley, his request was referred to the Zoning Board.
Mr. Glenn Bundy, representing the Olmsted Community Ambulance Service,
was present and inquired if -a decision had been reached in making some arrangement
for them to take over the police ambulance calls. He was informed that the Police
Committee would have their report on the matter at the next meeting.
Mr.. Carl Hooper, Chariman of the First Aid Committee of the Olmsted
County Red Cross, was present and sugges-ted- that Section 2 of an Ordinance
regulating public and private ambulances be changed to read, 'that every
ambulance shall carry minimum equipment as prescribed by the Health Officer".
Upon by Schroeder, second by Whiting, the matter was referred to the Police
.motion
Committee and the City Attorney.
Mr. Haven Hodge was present and requested that the storm sewer be
extended from 3rd Avenue to 2nd Avenue on 4th Street Southeast. Upon motion by
Schroeder, second by Whiting., the matter was referred to the Sewer Committee and
the City Engineer for report and recommendation.
Mr. George Pougiales, representing Fullerton Lumber Company, was
present and inquired if anything had been done ordering a hearing on improvements
in the Fullerton Elford Addition. The following report by the City Engineer was
read and ordered placed on file:

Gentlemen:
Engineer's Preliminary Report on Proposed Sanitary Trunk Line
Sewer thru Sections 27, 22 and 23, Cascade Township inconnection
with the development of the Fullerton and Elford Tracts.
In accordance with Section 3 Subdivision 1 of the State Statute
covering Special Assessments, I submit the following report on

the above project:
1. The Construction of a Trunk Sanitary Sewer to connect
the Fullerton and Elford tracts in the N.E.® sec. 27 and the
O.E.1 Sec. 22 in Cascade Township with the existing trunk line
sewer in Section 24 is feasible provided easements are secured
thru the intervening lands.
2. A survey and preliminary plan has been made, providing
for pipe sizes, grades and proposed alignment.

4. It is recommended that this sewer be constructed as proposed
that- is: -constructed to serve Fullerton and Elford. tracts, with
future extensions made for other areas as they are annexed.
5. The completion of construction plans is contingent upon
adoption of the plat of the Fullerton-Elford Subdivisions because
the actual street and lot arrangement will determine the location
of the manholes and wye-branches on the trunk line.

Alderman Whiting introduced a resolution ordering a hearing on the con-

struction of a trunk line sanitary sewer from the present Sewage Disposal Plant
to the newly annexed Fullerton-Elford- addition, which was read. upon motion by
Whiting, second by Schroeder, and upon roll call and all voting in favor thereof,
President Bach declared the said resolvtion duly passed and adopted.
Alderman Whiting introduced the following resolution,„ which was read and
upon motion by Tingley, second by Anderson, that the said resolution be adopted as
read'and upon roll and all voting in favor thereof, President Bach declared t#e
said resolution duly passed and adopted:
"BE IT RESOLVED, by the Common Council of the City of Rochester
that the offer of the trustees of the Rochester Cemetery Association,
as contained in that •certain resolution adopted by the said Trustees
on August 23, 1955, to sell to the city of Rochester for the sum of
$30,000.00, all land owned by the Association north of the following
described line:
Commencing on the east boundary of land owned" by the
Rochester Cemetery Association at a point which is fifty
(50) feet south of the northwest corner of Outi'ot one (1)
Riess' Second Addition to the city of Rochester, thence
running south 99 degrees 10 minutes west for a distance
of two hundred and fifty (,250) feet; thence running south
72 degrees west - for a distance of one hundred and nine (109)
feet; thence running north 72 degrees 30 minutes west for
a distance of twelve hundred (1200) feet, more or less, to
the west boundary of the Rochester Cemetery Association
property.
is hereby accepted on the terms and conditions stated therein.
A copy of said resolution is attached hereto and incorporated
herein by reference.
Be it further resolved that the City Engineer is hereby instructed
to survey, establish and mark the south boundary line of said tract of
land in accordance with provisions of the aforesaid resolution adopted
by the Trustees of The Rochester Cemetery Association and , at such
time as this boundary is marked, to notify the Trustees of the
Rochester Cemetery Association and the Common Council so that mutual
agreement on this line can be reached.
Be it further resolved that after mutual agreement:is reached
between Thr Coehster Cemtery Association and the Common Council on
the boundaries of the property to be conveyed, payment therefor shall
be made to the Rochester Cemetery Association within 30 days after
receipt of an abstract, showing good and marketable title in the
association and upon delivery of a property executed warranty deed."

Alderman Whiting introduced a resolution amending the resolution adopted
by the Common Council on September 20, 1954 and approved by theMayor on
September 21, 1954, establishing parking and parking meter regul•a.tia•ns and pro-
visions pursuant to Ordinance No. 971, by adding the following to Paragraph (4)
TRUCK LOADING ZONES, (W. on 1st Avenue Southwest on the east side of the street,
twenty-five (25) feet, more or less, in front of the premise known as 420 - 1st
Avenue Southwest), which was read. Upon motion by Schwanke, second by Moody,
that the said resolution be adopted as read, and all voting in favor thereof,
President Bach declared the said resolution duly passed and adopted.
The City Engineer's preliminary estimate of cost for construction of a

sanitary sewer in the amount of $1,379.00 and grading, base construction, and
bituminous surfacing 'in the amount of $1,042.00 for extension of 9th Street
Southeast from 9th Avenue'to a point 267 feet east was read and President Bach
ordered the same placed on file.
The City Engineer's preliminary estimate for the construction of a water -
main in the extension of 9th Street Southeast to a point 267 feet East of 9th
Avenue in the amount of $1,904.60 was read and President Bach ordered the same
placed on file.
The City Engineer's preliminary estimate for the paving of Mayo Park
Bridge South Approach and 3rd Avenue Southeast from 3rd to 4th Street Southeast
in the amount of $29,945.00 was read and President Bach ordered the same placed
on file.
The request of the Board of Public Health and Welfare for approval of
the employment of Mr. Samuel B. Allen as bacteriologist in the healih department
effective September 15, 1955 at the salary of $328.50 per month which is 90%
of base salary was read and upon motion by Schroeder, second by Anderson, their
request was approved.
A letter from the Planning and Zoning Commission invitatiog the Council
to attend a special meeting of the Planning & Zoning Commission which is being

held on Thursday, September 22, 1955, at 7:30 P. m. in the Park Board office,
Room 214, City Hall, for the purpose of hearing the comments of Mr. Flickinger,
Mr. Guth and Mr. Hamen of the Federal Housing Administration on the Fullerton-
Elford-Hutchinson development north of town was read and upon motion by Schroeder,
second by Anderson, their invitation was accepted.
The following letter from the Planning and Zoning Commission was read
and upon motion by Schroeder, second by Moody, the same was tabled until after
the meeting to be held Thursday Night, September 22, 1955:

Commission and several other interested citizens present, the
following Resolution was recommended to be presented to the
Common .Council of the City of Rochester:
RESOLUTION
WHEREAS parties present discussed. the need for a beltline to the
north of the City connecting U. S. Highway 52 to U. S. Highway 63,
and
WHEREAS the parties present felt that the Planning Commissions
should first consider the matter, and
WHEREAS the Planning Commissions, after discussion felt that
there was urgent need for such a belt line, now therefore
BE IT RESOLVED that the City Council and the County Board enter
into a joint program for establishing the location of such a high-
way. It is further recommended that the City Planning Commission
be authorized to work with the County Board and the County Planning
Commission in taking the practical steps, financial and otherwise,
necessary to accomplish this end.

The request of Calvary Evangelical Free Church for permission to erect
signs on each side of 12th Street Southeast where it is intersected by 6th Avenue
was read and upon motion by Schwanke, second by Tingley, the same was referred to
the Police Committee and the Chief of Police.
A letter from Universal Motors, Inc. stating their appreciation for the
granting of a loading zone in front of their business was read and President Bach
ordered the same placed on file.
The claim of Mr. & Mrs. L. E. Peterson of 905 - 14th Avenue S. W. in the
amount of $95.00 for damage to their lawn was read and upon motion by Anderson,
second by Schwanke, the same was referred to the Street & Alley Committee, the
City Engineer and the City Attorney.
A petition for street lights on 7,—� Avenue Northeast in the 1600 block
signed by 6 residents in that section was read and upon motion by Moody, second by
Schroeder, the same was referred to the Lighting Committee.
A petition that sidewalks be constructed on the east side of 3rd Avenue
Northeast in front of 1606, 1610 and 1626 and on the corner of 3rd Avenue and 16th
Street Northeast on the east side of 3rd Avenue N. E. at No. 301 - 16th Street
Northeast, there being a sidewalk at all the other lots with the exception of
these four places, signed by 6 residents was read and upon motion by Schwanke,
second by Moody, the same was referred to the Street & Alle`y Committee and the
people be notified that nothing can be done this year.
The request of the Kiwanis Club to hold its annual Peanut Sales Day on
September 26, 1955 was read and upon motion by Schroeder, second by Anderson, the
request was granted.
The request of Izaak Walton League for permission to have a bingo game
at the Izaak Walton League Cabin on October 1, 1955, their mulligan stew night,
was read and President Bach ordered the same placed on file.

south side of 2nd Street Southwest be extended west from its present terminus
to the site of the proposed Fire Station No. 3 was read and upon motion by
Schroeder, second by Tingley, the recommendation was approved.
The recommendation of the Water Committee that the bid of Carlisle G.
Fraser for the construction of a water main in the extension of 9th Street
Southeast to a point 267 feet east of 9 th Avenue Southeast be accepted at the
unit prices bid and checks be returned to the unsuccessful bidders was read and
upon motion by Whiting, second by Anderson, the recommendation was approved.
The recommendation of the Police Committee and the Chief of Police
that a school type crossing signal be installed at llth Street and 7th Avenue
S. W. to better insure and guarantee the safety of those youngsters living
south of llth Street S. W. to and from Edison School and that this signal be
purchased on an emergency basis without bids was read and upon motion by
Whiting, second by Anderson, recommendation approved.
The recommendation of the Street & Alley Committee that the bid of
Doyle Conner for paving of Mayo Park Bridge south approach and 3rd Avenue
Southeast from 3rd to 4th Street Southeast be accepted at the unit prices bid
and checks bereturned to the unsuccessful bidders was read and upon motion by
Anderson, second by Moody, the recommendation was approved.
A letter from the Minnesota Highway Department submitting four copies
of a cooperative agreement between the State of Minnesota and the City of
Rochester, which covers work on S. P. 5502-09 and S. P. 5503-06, T. H. No. 14
and the Bear Creek work, was read together with a copy of the agreement. After
hearing the agreement a motion was made by Whiting, second by Schwanke, that
Aldermen Anderson and Schroeder be appointed as a committee of two, to work with
the City Engineer to secure, if possible, the easements stipulated in Section 4
of the agreement and report back to the Council•at the earliest date. All voted
in favor of the motion.
Alderman Whiting introduced a resolution authorizing the Mayor and City
Clerk to execute a cooperative agreement f or work on S. P. 5502-09 and S. P.
55-03-06, T. H. No. 14 and Bear Creek, which was read. A motion was made by
Alderman Anderson, second by Alderman Schwanke, that the resolution be adopted
on the condition that the provision in the contract with respect to the City
holding the State harmless on the State Highway part of the project be excluded.
All voted in favor of the motion.
The report of the Clerk of Municipal Court for the week ending
September 9, 1955 showing total criminal fines and costs collected $2,315.00 and
civil fees received $5.70 and for the week ending September 16, 1955 showing
total criminal fines and costs collected $1,552.55 and civil fees received $3.05
were each read and having been approved by the City Attorney, President Bach

The applications of Howard Wright for license to sell cigarettes at retail
at Waters Co.nl,ey Company and the Minit .Car Wash were. each read and upon motion by
-Schroeder, second by Schwanke, .the licenses were granted.
The application of Michael J. W.00d.s for an Electrical Contractor's.
license was read and upon motion by Schwanke, second b.y Moody, the license was
granted.
The license bond of W. J Hankee d/b/a'W. J. Hankee Company in the amount
of $1,000.00 with the St. Paul Mercury Indemnity Company as surety was read and
upon motion by Schroeder, second by Schwanke, the bond was approved, the surety
thereon accepted and the same was ordered placed on file.
The contract bonds. of H. T. Earle Sr. in the amount 'of $3, 569.40 and
C. M. Boutelle in the amount of $4,249.15 each with the Western Surety Company as
surety were each read and upon motion by Schwanke, second by Tingley, the same were
referred to the Mayor for his approval.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:
A resolution accepting the bid of Doyle Conner for paving of Mayo Park
Bridge approaches and 3rd Avenue Southeast from 3rd to 4th Street Southeast. Upon
motion by Schroeder, second by Schwanke, resolution adopted.
Resolution accepting bid of Carlisle G. Fraser for construction of a
water main in the extension of 9th Street Southeast to a point 267 feet East of
9th Avenue Southeast. Upon motion by Schwanke, second by Tingley, resolution
adopted.
Resolution appropriating $395.04 from the F, E. Williams Estate Fund and
ordering payment made to the Park Department. Upon motion by Anderson, second by
Moody, resolution adopted.
Resolution appropriating $407.64 from the General Fund; $94.07 from the
S & A Fund; $129.60.from the Fire Protection Fund; $1, 504.14 from the Sewer Fund;
$4, 110.68 from the Lighting Fund; $763.30 from the Park Improvement Fund and $1. 50
from the Parking Meter Fund and ordering payment made to City of Rochester; Public
Utilities. Upon motion by Moody, second by Schroeder, resolution adopted.
Resolution appropriating $3,221.85from the General Fund; $2,759.20 from
the S & A Fund; $551. 50 from the P.I.R. Fund; $970,15 from the Sewer Fund; $121. 50
from the -Parking Meter Fund and $82. 75 from the Police -Protection Fund, andordering

An Ordinance establishing a pedestrian cross walk on the North approach
to Mayo Park Bridge, was given its first reading-.
Upon motion by Schroeder, second by Anderson, and upon roll ca•11 and all
voting in favor thereof, the rules were suspended and the ordinance was given its
second reading.
Upon motion by Schwanke, ,second by. Tingley, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given- its
third and final reading.
Upon motion by Moody, second by Schwanke, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the said
ordinance duly passed and adopted.
A petition for the widening -of 4th Avenue Northwest between First Street
Northwest to 3rd Street Northwest was read and upon motion by Schroeder, second by
Moody, the same was referred to the Street & Alley Committee.
A letter from the H & H Electric Company requesting that the completion
date on their contract for school traffic signals at Washington School Areas be
extended one montix-was read and upon motion by Whiting, second by Anderson, they
were given a thirty day extension.
The following claims were each read and upon motion by Anderson, second
by Schroeder, the same were approved,.with the exception of one to Foster Electric
Company in the amount of $167.57, and the Mayor and City -Clerk were authorized and
directed to draw warrants upon the City Treaswer and make payments accordingly:

The City Attorney read a brief report, prepared by him, on certain

legislation adopted by the legislature of the State of Minnesota during the 1955
Legislative Session. President Bach ordered the same placed on file.
Alderman Anderson brought up the matter of purchasing shelving and a
filing cabinet for .the City Treasurer's office and presented prices they had
received on each. A motion -was -made by Alderman Schroeder, *second. by Alderman
Whiting, empowering the Public Grounds Committee to purchase the equipment and -
shelves best suited to the need. All voted in favor of the motion,
Alderman Whiting stated that he felt some decision should be made as
to angle or parallel parking on Broadway. Alderman Whiting moved that the City
Clerk be instructed to advise the Minnesota Highway Department that the Council
elects to retain angle parking on Broadway from 6th Street S. W. to the R. R.

drew his second. Alderman Whitingis motion was then lost for want of a. second.
Mr. Frank W. Everett, Fire Chief, stated that Ordinance No. 15.5 entitled
"An Ordinance to prevent the stacking or piling of hay or straw within the City of
Rochester, Minnesota" had been repealed and he would like to recommend to the
Countil.that it be reviewed and put back in force. - Upon motion by Schroeder,
second by Schwanke, the City Attorney was. instructed to drfat the said ordinance
as requested. All voted in favor of the motion.
The matter of retaining angle parking on Broadway and the financing of
the resurfacing of same was again brought up. After further discussion on the
matter a motion was made by Alderman Schwanke, second by Alderman Whiting, that a
public hearing be held on the 4th of October at 7:30 o'clock P. M. stating that the
property owners on Broadway will be assessed $10.00 a running foot and angle
parking would be retained. Upon roll call all voted in favor of the motion except
Aldermen Anderson and Schroeder, who voted "no".
Alderman Whiting then moved that the City Clerk be instructed to notify
the Minnesota Highway Department that the Council elects to retain angle parking.
Alderman Schwanke.seconded the motion and upon roll call and Aldermen Moody,
Whiting and President Each voting in favor of the motion and Aldermen Anderson,
Schroeder, Schwanke and Tingley voting "no", the motion was lost.
Alderman Moody stated that the Chief of Police had requested permission
to attend a convention of the International Association of Police Chiefs to be held
in Philadelphia, Pa. on October 3 thru 6, 1955• Upon motion by Schwanke, second
by Tingley, the Chief of . Police was authorized to attend the said convention at
city expense. All voted in favor of the motion.
Upon motion by Anderson, second by Moody, the meeting was adjourned.
