Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall in said City,
on October 3, 1955-
President Bach called the -meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach-, Aldermen Moody, Schwanke, Tingley
and Whiting. Absent: Aldermen Schroeder and Anderson.
Upon motion by Moody, second by Tingley, the minutes of the meetings of
September 19th and September 29th, 1955 were approved.
President Bach stated this as being the - time and place set for a hearing
on the construction of a trunk line sanitary sewer from the present Sewage
Disposal Plant to the newly annexed Fullerton Elford Addition, pursuant to M.S.A.
1i29.011 to 429.111 as amended. The following letter from the City Engineer was
read and ordered placed on file:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Dear Sirs:
The newly proposed (F. H. A. ) plan for the proposed Fullerton-
Elford Additions has not been developed and approved to the point
where the manholes, intersections of laterals, and surface grades
along the Trunk Line sewer can be -determined.
We find it impossible to complete the sewer plan until the
street and sanitary sewer system of the adjacent land is determined.
I request that the hearings on the Trunk -Line sewer be continued
until the primary street and sewer pattern of the addition is
fixed.

A motion was then made by Alderman Whiting, second by Alderman Moody, that the
said hearing be continued until the meeting of November 7, 1955. All present
voted in favor of the motion.
President Bach stated this as being the time and place set for receiving
and opening bids for the construction of a bridge on 7th Street Northeast over the
Zumbro River. The following bids were received and upon motion by Whiting, second
by Schwanke, the same were referred to the Street & Alley Committee and the City
Engineer for tabulation and recommendation; Capital Engineering & Construction
Company, $214,065. 35; L. M. Feller Company, $219, 593.25; Pederson Bros. Inc.,
$229, 501. 70; Industrial Construction Company, $239, 245.15.
President Bach stated this as being the time and place set for receiving
and opening bids for the construction of a Fire Sub Station to be located on 2nd
Street Southwest. The following bids were received and opened and upon motion by
Whiting, second by Moody, the same were referred to Daniel M. Robbins, Architect,
the Fire Chief and the Fire Committee for tabulation and study:
For General Construction - C. C. Pagenhart, $93,700.00; Alvin E. Benike,
$97,450.00 and Donald A. Ranthum, $99,310.00.
For Electrical Work - H & H Electric Company, $7,.732.00; Adair Electric Company,
$9,300.00 and. Squires Electric Company, $8,281.00.

Order No. 25040 issued by M. J. Hoffman, Commissioner of Highways, ordering
that the route designated as a detour for Trunk Highway No. 296 in the City of
Rochester, County of Olmsted, by order No. 23501, was released September 30, 1954 ar
therefore said route will rever t to its original status was read and President
Bach ordered the same placed on file.
A letter from the Minnesota Department of Health with a report of their
Munidipal Water Supply Section covering plans on water main on 9th Street Southeast
from a connection with the existing main on 9th Avenue Southeast easterly about 307
feet was read and President Bach ordered the same placed on file.
A letter from Church of St. Pius X stating that their parish is planning
a series of Bingo games on Sunday nights was read and President Bach ordered the
same placed on file,
A letter from the Camera Center at 202 South Broadway asking permission to
use a public address system from the hours of 9:30 a. m. to 10:00 p. m., Monday,
October 24th, at Second Broadway; permission to block up to six parking meters
extending East from the popcorn stand on Second Street just off Broadway from 6 p.
to 10 p.m. and permission for a small band to play music from the aforementioned
truck between the hours of 7 p/ m. to 10 p.m. in connection with a free prize
drawing at 9 p. m. was read. Mr. George Menshik, Manager of the Camera Center, was
present and urged that the Council grant the requested permission. Upon motion by
Whiting, second by Moody, action was deferred until the matter could be considered
by the full Council.
A letter from Mr. C. C. Ludwig, Executive Secretary of the League of
Minnesota Municipalities, recommending that the City direct membership in the
American Municipal Association, the annual fee being $100.00, was read and Presid
Bach ordered the same placed on file.
A lett4r from the American Municipal Association extending an invitation
to the officials of the City of Rochester to attend the 32nd annual American
Municipal Congress to be held in Miami, Florida, November 27-30, was read and the
same was ordered placed on file.
A petition, signed by 28 residents in Northwest Rochester, to have the
9:15 Northwest bus changed back to 9:00 o'clock was read and upon motion by Whitin
second by Tingley, this petition was referred to the Police Committee, the said
Police Committee to confer with the Rochester Bus Company to see if the change
can be made. All present voted in favor of the motion.
A letter from Raymond E. Karvel soliciting permission to drive a sand poin

it conditioning their home -was read: A motion was made by Moody, second by
ingley, that the matter -be delayed until later in the meeting when the full
Council would be present.
A letter from John L. Becker, addressed to the Mayor, stating that he
ad previously written to the Council in regard to the water line freezing in
front of his property at 516 - 10th Avenue Northeast after the street in front
of his place had been graded, and wanting to know if any action had been taken
by the Council. A motion was made by Alderman Schwanke, second by Alderman
Whiting, referring the matter to the Slater Committee.
The request of the Board of Public Health & Welfare for permission to
mploy Miss Diane Wahl, R. N. as a public health nurse effective October 3, 1955
t the salary of $325.00 per month was read and upon motion by Whiting, second by
chwanke, their request was granted.
A Channel Change Easement by the Mayo Association granting unto the City
of Rochester, the right to enter upon a portion of Lots 34 and 35 in Auditor's
?lat "All was read and upon motion by Whiting, second by Moody, the channel change
easement was accepted and the City Clerk was instructed to have same filed in the
office of the Register of Deeds. All present voted in favor of themotion.
The report of the City Treasurer for the month of August, 1955 was read
nd President Bach ordered the same placed on file.
The reports for the Clerk of Municipal Court for the week ending
eptember 23, 1955 showing total criminal fines and costs collected $1,775.00 and
ivil fees received $1.55 and for the week ending September 30, 1955 showing
otal criminal fines and costs collected $1,566.00 and civil fees received
26.40 were each read and having been approved by the City Attorney, President
ach ordered the same placed on file.
The report of the City Weighmaster for the month of September, 1955
howing fees collected for loads weighed in the amount of $76.25 was read and
resident Bach referred the same to the Finance Committee.
The reports for, the month of September, 1955 of the Building Inspector
howing fees collected for building permits issued $755.00; of the Electrical
nspector shwoing fees collected for electrical permits issued $140.75; of the
lumbing Inspector showing fees collected for plumbing permits issued $161.50;
f the Heating Inspector showing fees collected for heating permits issued
124.50 and fees collected for sign permits $29.10 were each read and President
ach referred the same to the Finance Committee.
The applications of Herman E. Boebke for license to sell soft drinks.-;
ind license to sell cigarettes at 9 North Broadway were each read and upon motion
by Schwanke, second by Tingley, the licenses were granted.

Western Surety Company as surety and Carlisle G. Fraser in the., amount of $1, 939. 40
with the Federal Insurance Company as surety were each read and the same were
referred to the Mayor for his approval.
Upon motion by Whiting, second by Tingley, a recess was called at 3:40
P. M.
The meeting was called to order at 4:10 P. M. Alderman Schroeder was
.now present at the meeting.
The recommendation of the Street & Alley Committee and the City Engineer
that the two low bids (Capital Engineering Co. and L. M. Feller Co.) be held until
October 17, for investigation of references of. the low bidder, for construction of
a bridge on 7th Street Northeast over the Zumbro River, and that the checks be
returned to the other bidders, was read and upon motion by Schwanke, second by
Schroeder, the recommendation was approved.
The recommendation of the Police Committee and. the Chief of Police that
the request of the Calvary. Evangelical Free Church for permission to erect a sign
at 6 Avenue and 12 Street S. E. be not granted as the City has no authority to
permit erection of signs on State Highway Right -Of -Way, as this would be in
violation of the State Law and further recommend that the request be referred to
the Building Inspector for appropriate action was read and upon motion by Whiting,
second by Moody, the recommendation was approved.
The recommendation of the Police Committee and the Chief of Police that
the request of Mrs. W. C. Faber for a passenger loading zone at 703 First Street
S. W. has been granted on a temporary basis for the period that her ailing
relatives reside there was read and upon motion by Moody, second by Tingley, the
report was accepted.
The recommendation of the Lighting Committee that three: street lights be
installed on 72 Avenue Northeast in the 1600 block was read and upon motion by
Schwanke, second by Moody, the recommendation was approved and the City Clerk was
instructed to notify the Public Utility Department of the action taken.
The recommendation of the Board of Zoning that the petition of T. H.
Johansen to have Lots 3 and 4. Block 4, Ireland's Addition changed from a residen-
Vial to a commercial zone be not granted was read and upon motion by Schwanke,
second by Whiting, the same was referred to the Council as a committee of the whole
to view the property before taking action.
The recommendation of the Board of Zoning that an appeal from the
decision of the Building Inspector in the matter of the request of Norman guyath tc
construct a house on less than 5, 000 square feet, the said property being located
just east of 410 - 9th Street Northwest, be granted was read and upon motion by
Whiting, second by Tingley, the recommendation was approved and the City Clerk was
instructed to publish a notice of hearing on the matter to be held at 7:30 o'clock

The recommendation of the Street & Alley Committee that a sidewalk be
ordered built on the east side of 3rd Avenue Northeast in front of the following

Upon motion by Schwanke, second by Tingley, the above recommendation was approved.
The recommendation of the Sewer Committee that a sanitary sewer be
constructed in •3rd Avenue -Nor-thwest .from 14th Street Northwest to a point 76 ft.
north of the south line of Outlot 4, Northern Addition and that the entire cost
of the project be assessed equally to the frontage abutting the sewer, but that
the assessment against the north 46o feet of the Cascade Mill Reservation owned
by C. R. Thompson be deferred, and collected as connection charges on a per front
foot basis when, and if, this property connects to the sewer in 3rd Avenue Northwest,
was read and upon motion by Schwanke, second by Whiting, the recommendation was
accepted.
The following recommendation of the Police Committee was read and upon
motion by Moody, second by Schroeder, the said recommendation was accepted:

Gentlemen:
It is hereby recommended by the Police -Commit -tee, with
respect to the recent inquiry by Mr. Glenn Bundy, representing
the Olmsted Community Ambulance Service, concerning the dis-
position of emergency ambulance calls received by the Police
Department:
1. That the Police ambulance be maintained in
serviceable condition, and continue to be -
available for emergency service to the people
of Rochester.
2. That hereafter, upon receipt by the Police Department
of a request for emergency ambulance service, the
same shall be transmitted to a private ambulance
service if such private service is immediately available;
otherwise the Police Department shall respond to the
call with the Police Ambulance.
3. That in transmitting calls for emergency ambulance service,
the Police shall call whichever private ambulance service
is requested by the caller, and, in the event none is
specified, shall -call whichever private ambulance service
is most readily available.

The recommendation of the Planning and Zoning Commission re the
proposed street layout for the Dr. Anderson and Mrs. W. A. Plummer property was
read but action on s ame was delayed until later in the meeting when the full
Council would be present.

The following resolutions whre each introduced and read and President
Bach declared the same duly passed and adopted:
Resolution authorizing the City Engineer to publish notice regarding
construction of sidewalks on the east side of 3rd Avenue Northeast in front of
301 - 16th Street Northeast and 1606, 1610 and 1626 - 3rd Avenue Northeast. Upon
motion by Moody, second by Schroeder, resolution adopted.
Resolution authorizing the City Engineer to publish notice regarding

An Ordinance regulating public and private ambulances operate.d in the
City of Roche-ster;• providing for minimum equipment of such ambulances and first
,aid service therein; prohibiting operation without a•license, and providing
penalties for violation thereof, was given its first reading.
Upon motion by Schwanke, second -by Moody, and upon •rol•l call and all
(voting i-n favor thereof, the rules were suspended and the ordinance was given
fits second reading.

Moody, instructing the Cit-y Clerk to return Mr. Karvel-' s letter and inform him of
the existing ordinance, so that he may make proper.application. All voted is
favor of the motion.
A letter from the .Camera Center at 202 South Broadway requesting
(permission to use a public addres.s system from the hours of 9:30 a. m. to 10:00
p. -m. ;. perm.ission to block up six parki-ng meters on 2nd Street just. off Br.oadway.
from 6:00 p. m.. t.o lO:OA p. m. and permission for a small band to play mus.ic from
a truck between the hours of 7:00 p. m. and 10:00 p. m., all in connection with.
a Grand Opening celebration on Monday, October 24th, was again read and discussed.
Alderman Schroeder made a motion that his request be refused. Alderman Tingley
seconded the motion and all voted in favor thereof.
The following recommendation of the Planning and Zoning Commission was
again ,read:

RESOLUTION
BE IT RESOLVED that the Planning and Zoning. Commission
considers this proposed street to be necessary because
1). Dr. Anderson has submitted a petition to annex his
property to the City, and-
2). Mrs. W. A. Plummer is considering annexing, her
property to the City, and
3). The street would serve as access to all the properties
affected, and
4). Mrs. H. S. Plummer's house may some day become a public
place demanding public access.
The Plannding and Zoning Commission believes that its first
recommendation of running t-he -center line of the street betweenDR.-
Anderson's property and that of Mrs. H. S. Plummer's is the logical
place for the street, and that the request to move the street 6 feet
further south is impractical as it would involve the destruction of
a garage and also a'corner of Mrs. Plummer's main residence.

After discussing the matter a motion was made by Alderman Tingley, accepting the
recommendation of the Planning and Zoning Commission and instructing the City
Attorney to prepare an ordinance annexing the said Anderson property. Alderman
Moody seconded the motion and all voted in favor of themotion except Alderman
Whiting, who voted "no".
Upon motion by Tingley, second' by Whiting, the meeting was adjourned
until 7:30 o'clock P. M.
President Bach- called the meeting to order at 7: 30. o'clock P. M. and all
members of the Council were present.
The recommendation of the Board of Zoning that the petition of T. H.
Johansen to have Lots 3 and 4. Block 4, Ireland's Addition changed from residential
to a commercial zone be not granted was again read. The Council having viewed the
property, a motion was then made -by Alderman Anderson, second by Alderman Moody,
that the recommendation of the Zoning Board be accepted. All voted in favor of
the motion except Alderman Whiting, who voted "no".
The matter of constructing sidewalk on 14th Street Northeast between 1st
and 3rd Avenue was again discussed. Mr. Raymond Wagoner was present and inquired

as to when the sidewalk would be constructed and recommended that it be built on
both sides of 14th Street N. E. He was informed that a resolution had been adopte
ordering the sidewalk, and a notice had been published, and since the property
owners had not constructed the sidewalk, the City Engineer would construct same in
the near future.
A motion was made by Alderman Schwanke, second by Alderman Whiting, that
the City Engineer be instructed to prepare a list of all property not heretofore
annexed to the City, but iscompletely surrounded by
property in the City, and
present same to the Council. All voted in favor of the motion.
Mr. Glenn Bundey, of the Olmsted County Ambulance Service, was present
and -inquired as to what had been done in the matter of using private ambulances
instead of the Police ambulance. The recommendation of the Police Committee which

had been approved by the Council earlier in the meeting was read to him.
Alderman Whiting, brought up the matter of the bids on the new proposed
fire station on 2nd Street Southwest. After discussing the matter Alderman
Schroeder moved that the certified checks of the low bidders on the fire hall
be retained, that the checks of the high bidders be returned and that the letting
of the contracts be delayed for one week, until Monday, October loth at 7:30
P. M. and that at the same meeting Mr. F. R. Finch, City Clerk be prepared to
give a statement as to the status of the General Fund. Alderman Anderson
seconded the motion and all voted in favor thereof.
Upon motion by Schwanke, second by Moody, the meeting was adjourned
until 7:30 o'clock P. M.- on October 4, 1955-
