HomeMy WebLinkAbout10-17-1955IF 554 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., October 17, 1955 • Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,, on October 17, 1955• A motion was made by Alderman Schroeder, second by Alderman Moody, that Alderman Anderson be appointed as President pro tem. All present voted in favor of the motion. President pro tem Anderson called the meeting to order at 7:30 o'clock P. M., the following members being present: Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley and Whiting. Absent: President Bach. Upon motion by Moody, second by Schroeder, the minutes of the meetings of October 3rd, October 4th, and October loth, 1955 were approved. President pro tem Anderson stated this as being the time and place set for the following hearings: Hearing on the levying of special assessments for construction of a curb and gutter in Peck's Third Addition. There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a curb and gutter on 14th Avenue Northeast from 7th to 9th Street Northeast. There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a curb and gutter in Graham Court (south side) from Durant Court to 15th Avenue South- east. There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a sanitary sewer, water main, service connections, grading, base construction and bituminous surfacing in Peck's Fifth Addition. There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a sanitary sewer in 14th Street Northwest from 3rd to 5th Avenue Northwest. There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a sanitary sewer, water main and service connections in Bielenberg & Giese Third Addition. There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a water main in Woodland Addition (15th Avenue and 15th Street Northeast). There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a storm sewer in Pa.rkside Addition. There was no one present wishing to be heard. Hearing on the levying of special assessments for construction of a storm sewer lateral in Block 4, Parkside Addition. There was no one present wishing to be heard. 'there was no one present wishing to be heard. Hearing on an appeal from the decision of the Building Inspector in the matter of the request of Norman Kuyath to construct a house on less than 5,000 square feet, the said property being the East 90 feet of Lot 5, Block 4, Northern Addition. Alderman Tingley then introduced a resolution that the appeal of Norman Kuyath be granted and the application of the provisions of the Zoning Ordinance be varied to permit the said. Norman Kuyath to build a one family dwelling, of the dimensions of 24 fett x 30 feet, on the East eight feet of Lot'5, Block 4, Norther Addition in accordance with the plans submitted to the Common Council, which was read. A motion was then made by Alderman Tingley, second by Alderman Whiting, tha the said resolution be adopted as read, and all voting in favor thereof, President pro tem Anderson declared the said resolution duly passed and adopted, The following letter was read: "Honorable Council City of Rochester Rochester, Minnesota Gentlemen: For over six months we have tried to get the cooperation of the Mayor and the City Engineer in taking care of the water drainage on 13 Ave. and 15 St. N. E. There have been phone calls and written complaints at the office of the City Engineer. The Mayor and the City Engineer have been out to look the situation over. So far we have had only promises. We the undersigned property owners, are going to appear as a group at your next council meeting on Monday Oct. 17. Sincerely, Air. &: Mrs. M. E. Fitzgerald 1432 - 12 Ave. N. E. Mr. & Mrs. M. H. The above property owners were present at the meeting and requested that the Council take some steps toward correcting this situation. After hearing those present a motion was made by Schwanke, second by Moody, referring the matter to the Street & Alley Committee and the City .Engineer. All voted in favor of the motion. Mr. Joseph Mackey presented a drawing of lands described _as the East 135 feet of the West 267 feet of the South 131.31 feet of the North 164-31 feet of Lot 91, Auditor's Plat "All and requested permission to sub -divide this land into three lots than 50 feet as required by ordinance, the said lots. to face on 9th 0 5 5 6 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., October 17, 1959 Street Southeast. A motion was made by Schroeder, second by Moody, that Mr. Mackey's request be referred to the Planning Commission. All voted in favor of the motion. A letter from Carl Slight, Secretary for American War Dads, requesting permission to sell marigold tags for their annual tag day on the street of Rochester on Saturday, October 22, 1955 was read and upon motion by Whiting, second by Schwanke, the requested permission was granted. A petition signed by Clarence R. Thompson to have two certain streets in Cascade Mill Reservation and described as followed vacated was -read: (a) All that part of Cascade Street (now second Avenue Northwest) • north of Cascade Creek, in Cascade Mill Reservation, Northern Addition to the City of Rochester, according to recorded plat thereof on file in the office of the Register of Deeds in and for Olmsted County, Minnesota and (b) A strip of land four (4) rods wide, two (2) rods on each side of the following described line: Beginning at a point on the west side of Cascade Street in Northern Addition to the City of Rochester, south twenty-six and three -fourths degrees, east two hundred ninety seven feet from the angle made by the intersection of the west line of said Cascade Street and the east line of Oronoco Street (now Third Avenue Northwest) in the Mill Reservation in said Addition, thence north seventy-one and three fourths degrees, west two hundred thirty-two feet, intersecting the east line of said Oronoco Street one hundred fifty feet southwesterly from the aforesaid angle. Alderman Whiting moved that the petition be filed of record and the City Clerk be instructed to give notice as prescribed by Charter. Alderman Schwanke seconded the motion and all voted in favor thereof. The following resolutiorl adopted by the Public Utility Board was read and President pro tem ordered the same placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with R. E. BURMEISTER ELECTRIC COMPANY for the furnishing, in accordance with specifications, of 9 •- 100 KVA Subway Transformers, the total im6uni of the said contract to be EIGHT THOUSAND EIGHT HUNDRED THIRTY THREE DOLLARS AND FIFTY CENTS ($S, 933. 50), the said R. E. BURMEISTER Electric Company being the lowest responsible bidder; and to enter into.a contract with the STERLING ELECTRIC COMPANY for the furnishing, in accordance with specifications, of .- 50 KVA Distribution Transformers 3 • 6 -37a KVA Distribution Transformers • .20 - 25 KVA Distribution Transformers 2 - 10KVA Distribution Transformers the total -amount, of the said contract to be TEN THOUSAND TWO HUNDRED ELEVEN DOLLARS (�10,211.00) and the said Sterling Electric Company being the lowest. responsible bidder." The following report from the Public Utility Department was read and upon motion by Schwanke, second by Tingley, the report was accepted and the request of Raymond: Karvel for permission to drill an sand point was denied: "Mr. Fred Finch City Clerk Rochester, Minnesota Dear Sir: Concerning your communication and a copy of a letter from Raymond Karvel, requesting permission to drill a sand point in the base- ment of his home for air conditioning purposes, was presented to the Public Utility Board last evening, • Record of Official Proceedings of the Common Council of the City of Rochester; ' Minn., October 17, 1955 557 1 • 1 C� The Public Utility Board wishes to express it's opposition to this request because it feels that the Water Department has' made water available for this purpose and can see no- necessity for creating a second source. LENTFER, Secretary" A notice from the Railroad and Warehouse Commission granting the appli- cation in the matter of the application of the Chicago Great Western Railway Company for permission to discontinue passenger trains numbers 5 and 6 operating daily between Minneapolis, Minnesota and Kansas City, Missouri on Saturdays.only, the same to become effective October 22, 1955, was read and President pro tem ordered the same placed on file. The request of the City Engineer that the Council consider assigning thel Community Room to the use of his department to take care of the inadequate and overcrowded conditions in the drafting room (Room 12) in the basement of the City Hall was read and upon motion by Schroeder, second by Tingley, the same was referred to the Public Grounds Committee for consideration and report. The following recommendation of the Sewer Committee was read and upon motion by Schwanke, second by Schroeder, the recommendation was approved and the City Clerk was instructed to prepare the requested resolution: "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: We recommend that the City Clerk be instructed to prepare a resolution authorizing the City Engineer to prepare surveys, plans, and specifications for the constr- uction of Section +2 of the proposed N.W.-S.11.-Trunk-Line- Relief .Sanitary Sewer extending from 14 Street N. W. at 3rd Avenue to 11 Street N. W. at 5 Avenue; and. resolving that all the remaining funds in the Sewage Treatment Plant Construction Fund (in the amount of $19, 800.39 as of this date) be earmarked and dedicated exclusively for this project. Respectfully, (Raymond C. Schroeder Sewer Committee (Albert J. Tingley (A. G. Whiting" The recommendation of the Street & Alley Committee that the bid of the Cppital Engineering and Construction Company for the construction of a. bridge on 7th Street Northeast over the Zumbro River be accepted was read and upon motion by Schwanke, second by Tingley, the recommendation was approved. The report of the City Treasurer for the month of September, 1955 was read and President pro tem Anderson ordered the same placed on file. The reports of the Clerk of Municipal Court for the week ended October 7,1 1955 showing total criminal fines and costs collected $1,964.00 and civil fees received $14- 50 and for the week ended October 14, 1955 showing total criminal fine and. costs collected $1,670.00 and civil fees received $1.05 were each read and having been approved by the City Attorney, President pro tem Anderson ordered the same placed on file. IIAlderman Schroeder was excused at 9 :00 P. M, 558 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., October 17, 1955 • Mr. A. 0. Sparks was present and requested permission to use sound equipment on his truck used for delivering bakery goods in the residential district. He was informed there was an ordinance prohibiting use of sound equipment in the residential district. Mr. William Schacht, representing The Camera Center, was present and again requested the Council to grant permission to block off 4 to 6 parking meters on the North side of their building and permission for a band to play on a truck parked in this space, all in connection with a Grand -Opening of the Camera Center on October 24, 1955. After discussing the matter Alderman Whiting moved that the request to mark off parking spaces 'and have a. band play from 7:00 • to 9:00 on October 24, 1955 be granted. Alderman Schwanke seconded the motion and upon roll call Alderman Schwanke and Whiting voting in favor of the motion and Aldermen Moody, Tingley and President pro tem Anderson voting "no", the motion was lost. The following resolutions were each introduced and read and President pro tem Anderson declared the same duly passed and adopted: Resolution accepting bid of Capital Engineering & Construction Company for construction of a bridge on 7th Street Northeast over the Zumbro River. Upon motion by Moody, second by Schwanke, resolution adopted. Resolution authorizing the Public Utility Board to enter into contract with R. E. Burmeister Electric Company and Sterling Electric Company. Upon motion by Tingley, second by Whiting, resolution -adopted. Resolution ordering a hearing on the levying of special assessments for construction of a curb and gutter on 6th Avenue Southeast from llth to 12th Street Southeast. Upon motion by Whiting, second .by Moody, resolution adopted. Resolution ordering a hearing on the levying of special assessments for grading and surfacing on 14th Avenue Southwest from 7th to 9th Street Southwest. Upon motion by Moody, second by Tingley, resolution adopted. Resolution ordering a hearing on the levying of special assessments • for construction of a curb and gutter and gtading and surfacing on 15th Avenue Southwest in Dresbach's Addition. Upon motion by Tingley, second by Whiting, resolution adopted. Resolution ordering a hearing on the levying of special assessments for construction of a curb and gutter in Bielenberg & Giese Second Addition. Upon motion by Whiting, second by Moody, resolution adopted. An Ordinance annexing to the City of Rochester, .Minneso;,a, a part of the Southeast Quarter of Section Three, Township One Hundred Six North, Range Fourteen +Test, - in. Olmsted County, Minnesota, was given its• f irst_ reading. ,- An Ordinance providing for the licensing of bicycles, regulating the operation of.bicycles upon the public streets, sidewalks and public places, and. ,providing penalties for the.violation thereof, was given its first reading. TTpon motion by Schwanke, second.by Whiting, and upon `'roll call and all present voting in favor thereof, the rules were suspended and the • ordinance was given its second. reading. Alderman Schwanke brought up the matter of two half-s„tarved•deer running at large in Mayo Field and recommended that something be done to take - care of them. Upon motion by Whiting, second by Tingley, the matter was referred to Alderman Moody to investigate this matter. • Alderman Whiting, Chairman of the,Lighting Committee, moved that the City Clerk be instructed to direct the light department to erect two street lights on 9th Avenue Northeast in the.1700 block. Alderman Moody seconded the motion and all present voted in favor thereof. The following claims were each read and upon motion by Schwanke, second by Whiting, the same were approved and the Mayor and City Clerk were authorized and directed to draw warrants upon the City Treasurer and make payments• accordingly: From the General Fund: H.
