Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on November 7, 1955.
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley, and Whiting. Absent: None.
Upon motion by Moody, second by Schroeder, the minutes of the meeting of
October 17, 1955 were approved.

on the levying of special assessments for construction of a sanitary sewer, water
main, sewer connections and storm sewer in Baihly's First Addition. There was no
one present wishing to be heard.
President Bach stated this as being the time and place set for a hearing
on the levying of special assessments for the construction of a. curb and gutter on
6th Avenue Southeast from llth to 12th Street Southeast. A group of residents on
6th Avenue Southeast were present and protested the payment of $1.50 per foot for
grading which was included in their assessment. They stated that they had submitted
a petition for this work last fall and were under the impression the policy of
charging $1.50 per foot for grading did not apply to them. Mayor McQuillan stated

that he felt these people had a legitinia.te complaint which should be considered
carefully by the Council. C. A. Armstrong, City Engineer, stated that the residents
had been notified of the policy adopted by the Council and that hearings had been
held but no one had appeared and objected.
President Bach stated this as being the time and place set for a con-
tinued hearing on construction of a trunk line sanitary sewer from the present
Sewage Disposal Plant to the newly annexed Fullerton-Elford Addition. C. A.
Armstrong, City Engineer, requested that the hearing be again continued and upon
motion by Whiting, second by Tingley; the hearing was continued until the meeting
at 7:30 o'clock P. M. on November 21, 1955.
Air. Joseph Mackey was present and inquired as to what had been decided
about his request to divide property on 9th Street Southeast into lots of less
than 50 feet. The following recommendation of the Planning & Zoning Commission
was read:

Gentlemen:
At the regular meeting on October 19, 1955, of the
Planning and Zoning Commission, it was recommended that
Mr. Joe Mackey be allowed to subdivide the 135 foot frontage
on 9th St.' S. E. into lots of less than 50 feet. Most of
the lots in the immediate vicinity are approximately 45
feet in width and therefore it was felt that his division

would be in keeping with the immediate vicinity.

A motion was theamade by Alderman Schroeder, second by Alderman Whiting, that the
recommendation of the. Planning and Zoning Commission be accepted and Mr. Mackey
be instructed to prepare and execute a proper plat. All voted in favor of'the
motion.
Mr. Gordon Johnson, Secretary of the Olmsted County Holstein Association,
was present and stated that they were having their State Convention here in
Rochester on March 17th, 1955 and requested that they be allowed to use the
arena of the auditorium, free of charge, for their banquet. Upon motion by

Schroeder, second by Whiting, their request was referred to the Board of Park
Commissioners and the Finance Committee. All voted in favor of the motion.
Fair. Norman -Kuyath was again_ present in regard to building a house on the
East 80 feet of Lot 5, Block 4, Northern Addition, on less than 4000 square feet
as required by ordinance, for which the council had granted himpermission by
passing a resolution at the la.st council meeting. Mayor McQuillan stated that he
felt the resolution was not in order as Mr. Ku.yath did not own the property and -
furthermore that such a resolution was to be adopted only in case of due hardship.
After discussing the matter a motion was made by Alderman Schwanke, second by
Alderman Moody, instructing the City Attorney to prepare a resolution rescinding
the resolution adopted by the Common Council on October 17, 1955, that the appeal
of Norman- Kuya.th be granted and the application of the provision of the Zoning
Ordinance be varied: to permit the construction of a one family dwelling on the
East 80 feet of Lot 5, Block 4, Northern Addition. Upon roll call allvoted in
favor of the motion, except Alderman Whiting who voted "no".
A letter from Rochester United Nations Association thanking the Council
for the use of the Council Chambers on the evenings of September 29 and October 26
was read and President Bach ordered the same placed on file.
A communication from Mrs, Thuet, Social Chairman of Hawthorne School,
inviting the Council to visit their school Thursday, 1:30 to 3:10 P. M., was read
and President Bach ordered the same placed on file.
The Mayorls appointment of Mr. James H. Klindworth of 1115 - 7th Avenue
Northwest, to the Zoning Board, his term to expire the second Monday in April, 19
was read and upon motion -by -Whiting, second by Anderson, the appointment was
confirmed.
The request of Naegle Sign Company for permission to hang a Street Banner
for the Rochester Junior Chamber of Commerce advertising their ''Turkey Shoots' on
November 12th and 13th, from the'Dayton Building to the Woolworth Building, was
read and upon motion by Tingley, second by Whiting, the matter was referred to the
Police Committee, the Chief of Police and Building Inspector, with power to act.
The following letter was read and President Bach ordered the same placed
on file:
"To the Common Council

Rochester, Minnesota,
Gentlemen:
At a special meeting of the Board of Education, held in the Coffman
Building at 5:00 P. m. on Wednesday, September 21, 1955, the follow-
ing resolution was unanimously adopted:
"BE IT RESOLVED, by the Board of Education of School District Number
Eight (8) in Olmsted County, Minnesota, being the school district
included in the Limits of the City of Rochester, Olmsted County,
Minnesota, that there be and is hereby levied upon all taxable
property in said. district a special school tax for:
Maintenance $1,136,200.00
Capital Outlay 188, 500.00
Debt Service 381,500.00

or a grand total of one million, seven hundred six thousand, two
hundred dollars ($1,706,200.00) for the use of said district, and
the C19ark of said Board of Education is hereby instructed to notify

request their approval of the said levy in accordance with the
provisions of the City Charter.'
The purpose for which said sum is levied is as per copy attached.

A resolution authorizing the City.Engineer to publish notice regarding
vetoed by the Mayor
construction of sidewalks on 12th Avenue Southeast from 4th Street to Mayo Run
was read together with the following veto message of the Mayor:
"Members of the Common Council
City of Rochester
Rochester, Minnesota
Gentlemen:
I am returning herewith the resolution passed by your honorable body
on the 3rd day of October ordering sidewalk on the west side of 12th
Ave. Southeast from 4th Street to Mayo Run.
I have vetoed this resolution because of the extreme hardship it
would work on several of the owners of the adjacent property who'
would be assessed for the improvement:
These people have been assessed for curb and gutter and are now faced
with the problem of raising money to pay those assessments. Fur®her
improvements to be paid for by these people could force the property
owners to lose their property and I do not believe the necessity for
the improvement would warrant such extreme sacrifice.

A motion was then made by Alderman Whiting, second by Alderman Tingley, that the
said resolution be adopted as read, and upon roll call and all voting in favor
thereof, except Alderman Anderson who voted "no", President Bach declared the
said resolution duly passed and adopted.

A letter from Viktor 0. Wilson, City Health Officer, that the request
of Raymond E. Karvel f-or a permit to construct a well for air conditioning
purposes be denied was read and the same was ordered placed on file.
The request of First Presbyterian Church for a no parking sign on 5th
Avenue adjoining the church property, to be effective from 5:00 A. M. to 12:30
P. M. on Sunday only, was read and upon motion by Schwanke, second by Schroeder,
their request.was referred to the Police Committee -and the Chief of Police.
The request of Alice A. and Gust M. Lyke for a loading and unloading
cone at their nursing home located at 619'West Center Street was read and upon
motion by Schroeder, second by Whiting, their request was referred to the,Police
Committee and the Chief 6f Police.

Northwest, 16th Avenue Northwest, 162 Avenue Northwest and on the north side of
14th Street Northwest and on the south side of 16th Street Northwest in Bielenberg
& Giese Third Addition were each read and upon motion by Whiting, second by
Schwanke, the same were referred to the Street & Alley Committee and the City
Engineer.
A full and final release of all claims signed by Hubert R. Estes was real
together with a cliam in the amount of $200.00 for full settlement of all claims
against the City for damages arising out of a full sustained by the claimant on
6th Avenue Southwest on March 5, 1955. A motion was made by Schroeder, second by
Moody, that the claim be allowed. All voted in favor of the motion.
The claim of James A. Fister in the amount of $20.00 for damage to his
car caused by hot tar being sprayed on it by a City vehicle was read and upon
motion by Schwanke, second by Schroeder,

A letter from the Band and Music Committee regarding the increase in Mr.
Harold Cookers salary in the amount of $93.34 was read and upon motion by Tingley,
second by 'Schwanke, the same was tabled until the next meeting.,
The request of Howard A. Anderson, M. D. for permission to extend the
sewer on Plummer Lane approxia.mtely 75 feet in order to serve his property was read
and upon motion by Schroeder, second by Moody, his request was granted.
A letter from C. A. Armstrong, City Engineer, indicating that Arthur
Thompson had 13 ddays vacation due him at the time of his deaht' and requesting
that the City Clerk be authorized to make the said payment.was. read andupon motion
by Schroeder, second by Schwanke, the same was approved and theCity Clerk was
instructed to make the said payment.
The following resolution adopted by the Commissioners of the Sinking
Fund was read and upon motion by Schroeder, second by Anderson, the same was
approved:
"Be it resolved by the Commissioners of the Sinking Fund of the
City of Rochester, Minnesota:
That the sum of $99,961.96 be and the said sum is hereby appro-
priated from the Sinking Fund of the City of Rochester, Minnesota,
and ordered paid to the First National Bank of Rochester, Minnesota,
for the purchase of $100, 000.00 - 2% U. S. Treasury Notes, due
August 15, 19 57.

Lot 27, Auditor's Plat "A" was read and upon motion by Tingley, second by Schwanke,

to have Lot 3, Block 10, Sunnyside Addition changed from a residential to a
comm?rcial zone be granted was read and upon motion by Schroeder, second by Whiting,
the recommendation Vas approved and the City Clerk was instructed to publish a
notice of a public hearing to be held on November 21, 1955 at 7:30 o'clock P.-M.
The recommendation of the Board of Zoning that the petition of Knute
Olson and Edna*Harden to have all of Outlot 1 and Lot 3, Block 1, Stebbins
Addition changed from a residential to a multiple dwelling zone be not granted
was read and upon motion by Schwanke, second by Schroeder, the recommendation was
approved.
The recommendation of the Board of Zoning that the appeal from the
decision of the Building Inspector of Gerald A. Kingsley for permission to build
a garage at 1111 - 12th Avenue Northwest, said garage to be built 15 feet ahead
of the rear of his house line, be granted was read and upon motion by Schwanke,
second by Schroeder, the recommendation was approved and the City Clerk was
instructed to publish a notice of a public hearing to be held -on November 21,
1955 at 7:30 o'clock P. M.
The recommendation of the Police Committee that the petition for change
of service on the Northwest bus to 9:00 a. m. be'denied was read and upon motion
by Schroeder, second by Tingley, the recommendation was approved.
The - reque.st.iof Raymond E. Karvel .for a street light at the end of 1141
Street Southwest, which is dead end street' and a turn around point for that area,
was read. A motion was made by Schroeder, second by Schwanke, instructing the
Public Utility Department to install proper street lights in Baihly's First
Addition. All voted in favor of the motion.
The report of the City Weighmaster foi- the month of October, 1955
showing fees collected for loads weighed in the amount of $74.70 was read and
President Bach referred the same to the'Finance Committee.
The reports for the month of October, 1955 of the Building Inspector
showing fees collected for building permits . issued $599.00; of the Electrical
Inspector showing fees collected for electrical hermits issued $157.75; of the
Heating Inspector showing fees collected for heating permits issued $614.25; of
the Plumbing Inspector showing fees collected for plumbing permits issued
$391.00; and fees collected for sign permits issued $3.76 were each read and
President referred the same to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ended
October 21, 1955 showing total criminal fines and costs, collected $1,456.00 and
civil fees received .$14. 25; for the creek ended October 29, 1955 showing total
criminal fines and costs collected $1,972.72 and civil fees received $7.10 and
for the week ended November 4, 1955 showing total criminal fines and costd
collected $1,699.00 and civil fees received $10.95 were each read and having

been approved by the City Attorney, President Bach ordered the same placed on file.
The application of Lysne Construction Company for a permit to move a 12
story house, 28 x 32 from•411 First Avenue Northeast to 17 - 12th Street N. W.
over certain City streets was read and upon motion by Whiting, second by Schroeder,
the permit was granted, said house to be moved under the supervision of the Chief
of Police and the Building Inspector.
The application of Lewis Martin for a. Journeyman Plumbers License was
read and upon motion by Anderson, second by Moody, the license was granted.
The application of Federal Sign & Signal Corporation for a license to
erect and maintain signs was read and upon motion by Whiting, second by Anderson,
the license was granted.
The.a.pplications of Mrs. Stanley Decker for license to sell soft drinks
and license to sell cigarettes were each read and upon motion by Schroeder, second
by Tingley, the licenses were granted.
The license bond of Federal Sign & Signal Corporation in the amount of
$1,000.00 with the Saint Paul Mercury Indemnity Company as surety was read and upon
motion by Schwanke, second by Anderson, the bond was approved, ',the surety thereon
accepted and the same was ordered placed on file.
The contract bonds of C. C. Pagenhart in the amount of $93,700.00 with
the Seaboard Surety Company as surety; Capital Engineering & Construction Company
in the amount of $214,065:35 with the Saint Paul Mercury Indemnity Compa.ny_as
surety; Maass.Plumbing & Heating Company in the amount of $6,495.00 with the
Western Surety Company as surety; H & H Electric Company in the amount of $7,732.0C
with the Western Surety Company as surety and Edwards Sheet Metal in the amount of
$?,340.00 with the American Surety Company of New York asIsurety were each read
and President Bach referred the same to the Mayor for approval.

The request of Mohn and Hodge Realtors for an extension of the sewer
main on 9th Street Northwest between llth and 12th Avenue was read and upon motion
by Whiting, second by Schroeder, the same was referred to the Sewer Committee to
report back later in the meeting.
A letter from the Vets Cab Company making application for two more taxi
licenses to enable them to give better service to the customers who want to ride i
the Vet's Cabs may do so with the minimum delay, was read. Mr., Carl F. Petersen
of the Vet's-Cab Company was present and urged that the Council give him the two
extra licenses. Mr. Joseph Kremer of the Yellow Cab Company was also present and
stated he felt there were enough taxi cabs in the City of Rochester. R. V. Ehrick,
City Attorney, stated according to.the ordinance a public hearing would have to be
held to determine the necessity for additional taxi cabs in theCity of Rochester.
After discussingthe matter a motion was made by Schwanke, second by Moody, instr-
ucting the City Clerk to publish a notice of a public hearing to be held at 7:30
o'clock P. M. on Tuesday, November 15, 1955 to determine the necessity for
additional taxi cabs in the . City of Rochester. All voted in favor of the motion.
An Ordinance annexing to the City of Rochester, Minnesota, a part of the
Southeast quarter of Section Three, Township One Hundred Six North, Range Fourteen
West, in Olmsted County, Minnesota, was given its second reading.
Upon motion by Schroeder, second by Anderson, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
third and final reading.
Upon motion by Schroeder, second by Anderson, that the said ordinance be
adopted as read., and all voting in favor thereof, President Bach declared the said
ordinance duly passed and adopted.
An Ordinance providing for the licensing of bicycles,' regulating the
operation of Bicycles upon the public streets, sidewalks and public places, and
providing penalties for the violation thereof, was given its second reading.
Upon motion by Andersoh, second by Schroeder, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
thiid and.final reading. "
Upon motion by Anderson, second by Moody, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the said
ordinance duly passed and adopted.
An Ordinance regulating public and private ambulances operated in the
City of Rochester; providing for minimum equipment of such ambulances and fifist
aid service therein; prohibiting operation without -,at, license, and providing penalti(
`for violation thereof, was given its third and final reading.
Upon motion by Schroeder, second by Whiting, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the said

Alderman Whiting moved that the matter of moving houses into localities
be put under the Survey Committee. Alderman Schroeder seconded the motion and all
I voted in favor thereof.
C. A. Armstrong, City Engineer, stated that he would like to employ
a qualified inspector to work at the 7th Street Northeast bridge. He stated he
did not have anyone in his department but felt he could get a qualified person
to work for. $2.75 per hour and his living expenses. A motion was made by
Whiting, second by Anderson, authorizing the City Engineer to employ a qualified
inspector for the 7th Street Northeast bridge. All voted in favor of the motion.
Alderman Schroeder, Chairman of the Sewer Committee, moved that the
request of Mohn and Hodge for extension of the sewer main on 9th Street Northwest
between llth and 12th Avenue be granted, said sewer to be constructed under the
supervision of the City Engineer and to be constructed by a, duly licensed contract-
or. Alderman Tingley seconded the motion and all voted in favor thereof.
Upon motion by Schwanke, second by Anderson, the meeting was adjourned
until 7:30 o'clock P. M. on Tuesday, •November 15, 1955.
