of the City of Rochester, Minn., November 21, 1955 •
Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, on November 21, 1955.
A•motion was made by Alderman Moody, second by Alderman Tingley, that
Alderman Anderson be appointed as President pro tem. All present voted in favor
of the motion.
President pro tem Anderson called the meeting to order at 7:30 o'clock
P. M., the following members being present: Aldermen Anderson, Moody, Schwanke
and Tingley. Absent: President Bach and Aldermen Schroeder and Whiting.
President pro tem Anderson stated this as being the time and place set

for the following hearings:
Hearing on the levying of special assessments for construction of a water
main in 9th Street Southeast east of 9th Avenue Southeast. There was no one
present wishing to be heard.
Hearing on the levying of special assessments for paving 3rd Avenue
Southeast from 3rd to 4th Street Southeast. There -was no one present wishing to
be heard.
Hearing on the levying of special assessments for grading and surfacing
of streets in Baihly's First Addition. There was no one present wishing to be
heard.
Hearing on the proposed change of zoning of Lot 3; Block 10, Sunnyside
,Addition from a residential zone to a commercial zone. Mr. Clarence Harders
spoke for residents in that area, stating that they were not in favor of the
proposed change of zoning. Mr. B. W. Vogel, owner of the said Lot, was also
present and urged that his request be granted. After hearing those present a
motion was made by Alderman Schwanke, second by Alderman Tingley, that the
hearing be continued until the next regular meeting of the Council on December 5,
1955 at •7:30 P. M. All present voted in favor of the motion.
Hearing on an appeal from the decision of the Buildi-ng Inspector in

the matter of permission to build a garage at 1111 - 12th-Avenue Northwest, said
garage to be built 15 feet ahead -of the rear of the house line. Upon motion by
Tingley, second by Schwanke, the City Attorney was instructed to prepare a
resolution -varying the provisions of the said Ordinance to grant the said request.
All present voted in favor of themotion.
Continued hearing on the construction of a trunk line sanitary sewer
from the present Sewage Disposal Plant to -the newly annexed Fullerton-Elford
Addition. Mr. George Pougiales, Attorney representing the Fullerton Company, was
present and urged that the - project be proceeded with. A motion was then made by
Schwanke, second by Tingley, that the hearing be terminated and all present voted
in favor of the motion.

Upon motion by Moody, second by Tingley, the minutes of the meetings of
November 7th and 15th, 1955 were approved.
Mr. Joseph Mackey presented a plat of three lots on 9th Street Southeast
to be known as Mackey's First Sub -Division. Upon motion by Schwanke, second by
Moody, the plat was accepted.
The following recommendation of the Airport Commission was read and
President pro tem Anderson ordered the same placed on file:

Dear Sirs:
This committee has received .proposals from and interviewed
representatives of three .firms offering Architectural & Engineering
Services for the proposed New Airport.
1. Toltz, King & Day St. Paul, Minn
2. Tippetts-Abbett-McCarthy
Stratton New. York, N. Y.
3. Ellerbe & Co. and
K. M. McGhie . Rochester
(A joint venture of the
two separate firms.)
All firms were interrogated as to their staff, qualifications,
experience, fees, and availibity of services.
It appeared that each of the firms were qualified for the work
on the basis of staff, experience and qualifications.
The basic fees appear to be the same on all proposals. The
item of subsistence and travel of a firm not locally based could
be a considerable amount over a locally -based service.
It is the recommendation of this committee that Ellerbe & Co.
and K. M. McGhie, Rochester, Minnesota, be engaged as Consulting
Engineers for the Site Selection and Preliminary Planning -of the
Proposed_ Rochester Airport,.on a cost-plus basis.
The cost plus basis is recommended for the Preliminary Planning
and Site Selection because the indefinite demands of time and
services that may be required on this phase cannot be estimated at
this time.
We, further recommend, that contract be negotiated on a cost
plus basis for these services if the selection of this firm is
approved by the Council.

A letter from the Seventh-Day Adventist Churches requesting permission t
play a loud speaker from the top of a car in the evenings from Thanksgiving to
Christmas was read. Alderman Schwanke moved that the City Clerk be instructed to
notify the Seventh Day Adventist Churches that the Council has no objection to
playing Christams carols on their own property but frowns on using a loud speaker
on a car.
Alderman Moody seconded the motion and all present voted in favor thereof.1
A letter from Mrs. Harold Geerdes, Committee Member of the Trinity Twoso
Manger -Scene -Committee, requesting permission t6 play Christmas Carols and Hymns
on the church lawn from December 19 to January 1 was read. A motion was made by
Alderman Schwanke, second by Alderman Moody, that permission be,granted, subject
to the control of the Police Department as to volume. All present voted in favor
of themotion.

A letter from the Board of Public Health & Welfare recommending that the

ees for garbage collection be established applicable to the billing period
beginning October 1, 1955 as follows, was read:
Residential garbage collection shall consist of two pickups per
week and shall be billed and paid for at twenty centa.,per week
(200).
Commercial garbage collection -shall consist of six pickups per
week of garbage stored in cans of maximum size of thirty (30)
gallons and shall be billed and paid for at. a weekly fee computed
as follows: where ten (10) gallons or less of garbage accumulates
per day, the rate per can per visit shall be fifteen cents (150);
where more than ten (10) gallons of garbage accumulates per day,
the rates per can per visit shall be thirty cents (300) for the
first can and twenty cents (200) for the second can and for,each
succeeding can or parts thereof.
Upon motion by Schwanke, second by Tingley, the City Clerk was instructed to
notify the Board to have a member of their Board appear at the next council
meeting to explain the proposed rate structure. All present voted in favor of
the motion.
A letter from .the A. F. of L. Labor Temple Association requesting per-
mission to conduct a bingo game at -the A. F. of L. Social Hall, each Monday
evening commencing at 5:00 P, M. was read and.President pro tem Anderson ordered
the same placed on file,
The application of Norbert Hutting to be placed back on the yearly
basis as machine operator at the City Dump was read and upon motion by Schwanke,.
second.by Tingley, the same was referred to the Street & Alley Committee and the
City Engineer,
The claim of James H. Smart for damage to his car caused by sand and
gravel being sprayed on the side of his car was read and upon motion by Schwanke,
second by Moody, the same was referred to the.City Attorney and the City Engineer.
A claim in the amount of $20.00 for damage to a car owned by Marigold
Dairies, Inc., caused by road tar or oil sprayed on the car, was read and upon
motion by Tingley, second by Schwanke,. the same was referred to the City Attorney
and the City Engineer.
A letter from the Rochester Public Schools stating that if and when the
Rochester Airport is moved the Board will wish to acquire the necessary ground from
the airport area, if possible, for a second senior high school, was read and
President pro tem Anderson ordered the same placed on file.
A letter from the Board of Public Health & Welfare transmitting a
tentative draft of an ordinance proposed to establish a sanitary district within
the City of Rochester for the purpose of studying and demonstrating combined
garbage and refuse collection was read and the same was tabled until the next
meet ing.
A notice from the Railroad and Warehouse Commission setting a hearing
in the matter of the application of Jefferson Transportation Company for an
increase in fares was read and President pro tem Anderson ordered the same placed

A letter from James J. Macken, Jr. stating that the matters referred to
the Police Committee on November 7, 1955 would be reported on at -the meeting of
December 5, 1955 was read and President pro tem Anderson ordered the same placed
on f ile.
A Demand for revocation of Building Permit No. 9000 was .read and upon
motion by Schwanke, second by Tingley, the same was referred to the City Attorney.
The report of the City Treasurer for the month of October, 1955 was read
and President pro tem Anderson ordered the same placed on file.
The reports of the Clerk of Municipal Court for the week ending November
10, 1955 showing total criminal fines and costs collected $19271.00 and civil fees
received $1.40 and for the week ending November 19, 1955 showing total criminal
fines and costs collected $1,247.00 and civil fees received $2.85 were each read
and having been approved by the City Attorney, President pro tem Anderson ordered
the same placed on.file.
The applications of Mrs. Dale B. Burnham for license to sell cigarettes
and soft drinks were each read and upon motion by Tingley, second by Schwanke, the
licenses were granted.
A letter from the Northrop P.T.A. requesting the Council to have "No
Parking" from 5:00 A. M. to 4:00 P. M. signs put upon the east side of the school
on 2nd Avenue and the same signs put up on the north side of 9th Street from 2nd
Avenue to the school driveway was read and upon motion by Tingley, second by
Schwanke, the -Tequest was referred to the Police Committee and the Chief of Police.
The City Engineer presented plans for a sanitary sewer trunk line in
Sections 22, 23 and 27, Township 107 North, Range 14 West (Fullerton-Elford Additioi
and President pro tem Anderson ordered the same placed on file.
The following resolutions . were each introduced and read and President pro
tem Anderson declared the same duly passed and adopted:
Resolution levying special assessments for grading, base construction and
bituminous surfacing of streets in Baihly's First Addition. Upon motion by Moody,
second by Schwanke, resolution adopted.
Resolution levying special assessments for paving of 3rd Avenue Southeastll
from 3rd to 4th Street Southeast. Upon motion by Schwanke, second by Tingley,
resolution adopted.
Resolution levying special assessments for the construction of a water maf
extension in 9th Street Southeast from 9th Avenue Southeast to 267 feet East. Upon(I
motion by Tingley, second by Moody, resolution adopted.
Resolution ordering examination of books and records for fiscal year
April 1, 1955 to April 1, 1956. Upon.,motion by Moody, second by Schwanke,
resolution adopted.

the S & A Fund, $1.90 from the Fire Fund and $344.69 from the Police Protection
Fund and ordering payment made to 0 & 0 Sporting Goods, $253.39; Quality Printing
Company, $292.34; - Ruffridge- Johnson Equipment Company, $309.24 and Wm. H. Ziegler
Company, $1,129.02. Upon motion by Tingley, second by Moody, resolution adopted..
Resolution appropriating $529.06 from the General Fund, $22.48 from the
S & A Fund, $43.06 from the Fire Protection Fund, $1, 478.76 from the Sewer Fund and
$6, 590.63 from the Lighting Fund and ordering payment made to City of Rochester,
Public Utilities. • Upon motion by Moody, second by Schwanke, resolution adopted.'
Resolution appropriating $2,162.09 from the Permanent Improvement Fund
and ordering payment -made to Carlisle G. Fraser. Upon motion by Schwanke, second
by Tingley, resolution adopted.
Resolution appropriating $345.00 from the Parking' Meter Fund and $951.36
from the Police Protection Fund and ordering payment made to Gibbons Printing
Company, $449.60 and Carl Entenmann & Son, $746.76. Upon motion by Tingley,
second by Moody, resolution adopted.
Resolution appropriating $3,604.96-from the General Fund, $3,265.99 from
the S & A Fund, $533.10 from the Sewer Fund, $977.36 from the P.I.R. Fund, $60.00
from the Bridge Fund and $12.90 from the Parking Meter Fund and ordering payment
made to Ed Mahoney, $736.85; W. H. Barber Company, $237.11; Algona Equipment Co.,
$275.00; Patterson Rock Products, $1,357.54 and Street & Alley Fund, $5,847.60.
Upon motion by Moody, second by Schwanke, resolution adopted.
Resolution appropriating $5,669,05 from the General Fund and ordering
payment made to N. W: Refining Company, $1, 233. 59; Mark Hurd Aerial Survey,
$1,940.00; Standard Oil Company, $2,211.96 and Leon Joyce, $383.50. Upon motion by
Schwanke, second by Tingley, resolution adopted.
Resolution appropriating $4,129.02 from the P.I.R. Fund and ordering
payment made to Leon Joyce. Upon motion by Tingley, second by Moody, resolution
adopted.
Resolution appropriating $9,209.94 from the P.I.R. Fund and ordering
payment made to Leon Joyce. Upon motion by Moody, -second by Schwanke, resolution
adopted.
Resolution appropriating $2,913.99 from the P.I.R. Fund and ordering

Resolution ratifying and approving- the action of the Airport Committee
in selecting Ellerbe &.Company of Rochester and St. Paul, 'Minnesota and K. M-.
McGhie o.f Rochester as consulting E-ngi-neers for the Site Selection and Preliminary
Planning of. the proposed new public airport, and instructing the Airport Committee
.and City Attorney to negotiate and present a contract for -these services to the
Common Council for approval. Upon motion by Moody, and Second by Schwanke,-

Stanley Drips informed the Council that the Parking and Traffic
Committee would be making surveys in the near future, with automatic traffic
counters, to provide information for a study of a possible extension of one-way
street sytem in the.City of Rochester.
Upon motion by Schwanke, second by Moody, the meeting was adjourned.
