Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in.said City,
on December 5, 1955•
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present:. President Bach, Alderman Anderson, Moody,
Schroeder, Schwanke, Tingley, Whiting. Absent: None.
Upon motion by Moody, second by Tingley, the minutes of the meetings
of November 21st and November 23rd, 1955 were approved.
President Bach stated this as being the time and place set for a
hearing on the petition for vacation of two certain streets in Cascade Mill
Reservation, Northern Addition, Rochester, Minnesota. There was no one present
wishing to be heard.
A statement of Engineering Servicss, Certificate of Final Acceptance,
and construction report.and monthly estimate on State Aid Project No.'5501-07
at the Rochester Airport were each read and upon motion by Schroeder, second by
Moody, the same were referred to the City Engineer..
A petition to vacate 9th Street Northwest lying west of 13th Avenue
Northwest, comprising a tract 67.56 feet Northerly and Southerly and
approximately 117.73 feet Easterly and Westerly, signed by Stanley C. Mohn and
Haven H. Hodge was read and upon motion by Schroeder, second by Schwanke, the
petition was referred to the Public Utility Board,
Mr. Robert Campbell, Chairman of the Christmas Activities Committee
of the Chamber of Commerce, was present and stated that the Chamber of Commerce
had originally planned to.place a Christmas tree outside of City Hall but had
run out of funds and suggested that the Council either move the one out of the
lobby or place another one out there. Upon motion by Whiting, second by
Schroeder, the matter was referred to the Public Grounds Committee with, power
to act. All voted in favor of the motion.
Mr. Stanley F. Drips, representing the Central Area Improvement
Association, and stated that their organization would like to have the Council
consider putting benches and trees in the downtown area.
A letter from the Board of Public Health & Welfare requesting approval
of the appointment of Mr. Samuel B. Allen as assistant milk sanitarian, effective
December 12, 1955 at a beginning salary of $342.00 per month, which is 90% of
base salary, was read and upon motion by Whiting, second by Moody, the appointment
was approved.
A letter from the Board of Public Health & Welfare requesting approval
of the employment of Mr. Robert C. Daly, as bacterioligist on the health
department staff, effective December 12, 1955 at a beginning salary of $301.50
per month, which is 90% of base salary, was read and upon motion by Moody,

The following recommendation of the Police Committee was read and upon
motion by Tingley, second by Whiting, the recommendation was approved:
"Hon. Mayor -and Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersigned Members of the Police Committee, and the
Chief of Police, do hereby recommend that the request of the
Presbyterian Church for limited restricted parking on 5 Avenue
Southwest, adjacent to their property, o.n Sundays only, from
5:00 a.m., to 12:30 p.m., be granted and that the City Attorney
prepare the necessary resolution to make this change effective.
We -further recommend that a loading zone be established at
413 South Broadway in front of the premises presenter known
as Curtin's T V Sales and Service, and that the City Attorney
prepare the necessary resolution to make this change effective.
We further recommend that the request of Alice and Gust Lyke,
Operators of a Nursing Home at 619 West Center, fora loading
zone, be denied.
We further recommend that the request of Russel Hoven, 121 - 3
Avenue N.W.', Vacuum Cleaner Salesman, for a loading zone, be
denied.
We further recommend that the request of the Northrop School
P.T.A. for restricted parking on school days from 5:00 A. M.,
to 4:00 P. M. , on the East side of 2 Avenue Northwest, and on
the North side of S Street Northwest, both adjacent to the
School, be granted and that the City Attor ney.prepare the
necessary resolution to make this change effective.

The following recommendation of the Steering Committee on Parking and
Traffic was read and upon motion by Schroeder, second by Whiting, the recommendat
was approved and the City Attorney was instructed to draft the necessary changes.
All voted in favor of the motion, except Alderman Schwanke, who voted "no".

Gentlemen:
It is respectfully recommended by the Steering Committee
on Parking and Traf-fic that the Resolution regulating parking
and parking meters passed on December 20, 1954 be amended as
follows:
1. Under Section (S) Limited Parking Zones, Subsection
4 Zone D. item c should be amended to read "On First
Avenue Southeast from Second Street Southeast to
East Center St."
2. Under. Section (9) Limited Parking Zones, Subsection 4
Zone D omit item P.
3. Under Section (8) Limited Parking Zones, Subsection 6
Zone F add items s and t as follows:
s. On First Avenue N.E. from East Center St.
1st St.
t. On First Street N.E. from North Broadway

These changes are being recommended in hopes of
increasing the use of these parking spaces. The parking meter
maintenance men and the Chief of Police have been consulted

concerning these recommendations and are in accord with them.

The following petition signed by 46 property, owners in that vicinity,
was read and upon motion by Schroeder, second by Moody, the same was referred
to the Survey Committee and the Building Inspector:
"Whereas the Rochester Ready Mix Concrete Co. Inc. operates a
business at 412 2nd Ave. N.W* which operation creates a public
nuisance affecting the comfortable enjoyment of life for all
the residents within many blocks of this place of business, Now
therefore the undersigned do hereby petition the Honorable
Common Council of the City of Rochester to remove and abate this
nuisance."
The application for transfer of 3.2 "on sale" license No. 957 and
3.2 "off sale," license No. 1629 from Harold & Harry Rathbun, to Calvin Rogstad
was read and upon motion by Schwanke, second by Schroeder, the same was referred
to the Chief of Police.
The applications of Calvin Rogstad and Ross Krueger for license to
sell cigarettes at retail were each read and upon motion by Anderson, second by
Schwanke, the licenses were granted.
The applications of Calvin Rogstad and Ross Krueger for license to
sell soft drinks were each,read and upon motion by Schwanke, second by Anderson,
the licenses were granted.
The report of the City Weighmaster for the month of November, 1955
showing fees collected for loads weighed in the amount of $73.40 was read and
President Bach referred the same to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ending
November 25, 1955 showing totalcriminal fines and costs collected $1,093.00
and civil fees received $9.90 and for the week ending December 2, 1955 showing
total criminal fines and costs collected $1,077.60 and civil fees received
$6.90 were each read and having been approved by the City Attorney, President
Bach ordered.the same placed on file.
The application of the Kahler Hotel for a permit to hold a public
dance was read and upon motion by Schwanke, second by Schroeder, the same was
tabled until later in the meeting.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:
Resolution vacating two -streets in Cascade Mill Reservation, Northern
Addition to the City of Rochester,- Minnesota. Upon motion by Schwanke, second
by Tlingley, resolution adopted.

A request signed by Carl F. Peterson of the Vets Cab Company for two
more taxi licenses was read. Mr. Carl F. Peterson was present and stated that he
had .
now/additional evidence to show that he needed more taxi cabs., After discussing
the matter a motion was made by Alderman Schwanke, second by Alderman Anderson,
that the hearing on the necessity for additional taxicabs be reopened and held on
the 19th..day of December, 1955 at 7:30 o'clock P. M. and that the City Clerk give
public notice of such meeting as required by the ordinance. All voted in favor
of the motion.
The application of, the Kahler Hotel for a permit to hold a public dance
was again read. R. V. Ehrick, City Attorney, stated that in his opinion public
dances were prohibited in buildings where liquor is sold, according to State Law
and the. -City Ordinance. A motion was then made by Alderman Schwanke, second by
Alderman Moody, that the City Clerk be instructed to return the application of th
Kahler Hotel with the advise that it violates the State..Law and City Ordinance.
All voted in favor of the motion.
A resolution varying the Zoning Ordinance with respect to Lot 2, Block
Gooding"s Addition (request of Gerald A. Kingsley for an appeal from the decision
of the Building Inspector in the matter of permission to build a garage on the
premises above described 15 feet ahead or in front of the rear line of the main
building on said premises.) was read. A motion was made by Schwanke, second by
Tingley, that the said resolution be adopted as read and all voted in favor thereo
except Aldermen Anderson and Whiting, who voted "no".
A motion was then made by Alderman Schroeder, second by Alderman Moody,
to reconsider the resolution varying the Zoning Ordinance with respect to Lot 2,
Block 6, Gooding's Addition and upon roll call voted in favor of reconsidering the
said resolution, except Alderman Tingley and President Bach, who voted "no".
The motion that the resolution varying the Zoning Ordinance with
respect to,Lot 2, Block 6, Gooding's Addition be adopted as read was again voted

Highway Department was waiting to hear from the City in regard to resurfacing
Broadway. December 9, 1955 at 7:3001clock P. M. was the date set for a hearing
on the matter.
Mr. C. A. Armstrong,.City Engineer, presented a map showing the parcels
of land surrounded by -the City which had not been annexed to the City,.and
inquired if he should continue and get legal descriptions, etc. He was instructec
to get the legal descriptions on the said parcels of land.
President Bach declared a recess at 6:00 P. M.
President Bach called the _meeting to order at 7: 30 O'clock P. M. with
all members being present.
President Bach stated this as.being the time and place set for a con-
tinued hearing on the change of zoning of.Lot 3, Block 10, Sunnyside Addition
from a residential to:a commercial zone (1149-1s.t Avenue S. E. Mr. Gus Harders
of 18 - 10a Street Soif'heast was present and stated that.he.felt as long as all
the residents in that area were opposed the property should not be changed. Mr.
Clarence Harders was also present and stated that he had found in the deeds and
recorded at the Court House that this property should be used for residential
purposes only. Mr. B. W. Vogel, owner of the property, was also present and
stated that he felt it would generally improve the area and urged that they grant
the requested change. After hearing those present and discussing the matter,
Alderman Whiting moved that Lot 3, Block 10, Sunnyside Addition be zoned as
commercial, in accordance with the recommendation of the Zoning Board, and that
the City Attorney be instructed to draft an ordinance making the recommended
change. Alderman Moody seconded the gotion and upon roll call and Aldermen
Moody, Tingley, Whiting and President Bach voting in favor of the motion and
Aldermen Anderson, Schroeder and Schwanke voting "no", the motion was carried.
Dr. L. A. Weed, President of the Board of Public Health and Welfare, was
present and read the following recommended fees for garbage collections, which
had previously been presented to the Council in a letter dated November 17, 1955:
"Residential garbage collection shall consist of two pickups per week
and shall be billed and paid for at twenty cents (200) per week.
Commercial gam collection shall consist of six pickups per week
of garbage stored in cans of maximum size of thirty (30) gallons
and shall be billed and paid for at a weekly fee computed as
follows: where ten (10) gallons or less of garbage accumlates
per day, the rate per can per visit shall be fifteen cents (150 ;
where more than ten (10) gallons of garbage accumulates per day,
the rates per can per visit shall be thirty cents (300) for the
first can and twenty eents (200) for the second can and for each
succeeding can or parts thereof."
Dr. Weed stated that the reason they were asking for.the change in rates was so
that fees collected for garbage could take care of the expense of garbage collect-
ions. After discussing the matter a motion was made by Alderman Schroeder that
the recommended increase in garbage collection rates, as proposed by the Board of
Health & Welfare in a letter dated November 17, 1955, be approved. Alderman

Schwanke seconded the motion and upon roll call all voted in favor of the motion.
Dr., L. A. Weed then requested the Council to meet informally with the
Board of Public Health & Welfare for the purpose of studying and demonstrating
combined garbage and refuse collection. Monday, December 12, 1955 at 7:30
o'clock P. -M. was the time set for the informal -meeting.
R. V. Ehrick, City Attorney, stated that he felt he could settle the
accident case of Ethel -Howald, for a fractured wrist, for the amount of $145.00,
and upon motion by Schwanke,- second by Whiting, the City Attorney was instructed
to settle -the case, if possible, for $145.00. All voted in favor of the .motion.
R. V. Ehrick, City Attorney, then reported on the matter of holidays •
as set for City employees by the City Council. He also read opinions which he
had received from the Attorney General. No further action was taken.
Upon motion.by Whiting, second by Anderson, the meeting was adjourned
until 7:30 o'clock P. M. on Friday, December 9, 1955•
