Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the.Council Chambers, in the City Hall in said Cityl
on January 3. 1956.
President Bach called the meeting to order at 2:00 o1clock.P. H., the
following members being present: President Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley and Whiting. Absent: None,
Upon motion by Moody, second by Anderson, the minutes of the meeting
of December 19, 1955 were approved.
The request of Naegele Sign Company for permission to fabricate and
erect a canopy over the door -way entrance of the Olmsted County Bank & Trust
Gompany, 11 - �nd Street S. W., canopy shall be 111-1011 x 111 x 1911 and' shall
project from the face of'the building 7-211, was read and the same was ordered
placed on file and the City Clerk was instructed to prepare a resolution granting�
the request.
The following recommendation of the City Engineer was read:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
In the matter of the petition for vacating 9 Street
Northwest, west of 13 Avenue Northwest in Gooding's Addition,
I report the following:
le The street is not necessary for traffic.
2. Basements, however, should be provided for power
lines, and for storm sewers as follows:
(a) For electric power line, the west 4 feet of
the street being vacated; and the west 4 feet of
Lot 2-Replat of Blocks 4 & lo of Goodings Addition.
(b) For storm sewer.- the south 10 feet of the
street being vacated.
?lease note that the west 4 feet of Lot 2 qbove is beyond
the limits of the street in question, and easement must be
-acquired from the owners,

A motion was made by Alderman Schroeder, second by Alderman Whiting, that the
rec,ommendation be approved, that the City Clerk be instructed to prepare a
resolution ordering a hearing on the vacation of the said street and that the Cit;
Attorney be instructed to contact petitioners for the easements. All voted in
favor of the motion,
The report of the City Weighmaster for the month of December, 1955
showing fees collected for loads weighed in the amount of $69.45 was read and
President Bach referred the same to the Finance Committee.
The reports for the month of December, 1955 of the Building Inspector
showing fees collected for building permits issued $96.0o; of -the Electrical
Inspector showing fees collected for electrical permits issued $116.25; of the
Plumbing Inspector showing fees collected for plumbing permits issued $747-75; of

the Heating Inspector showing fees collected for heating permits issued $664,25;
and fees collected for sign permits in the amount of $14.94 were each read and
President Bach referred the same to the Finance Committee,
-The report of the Clerk of Municipal Court for the week ending
December 23, 1955 showing total�criminal fines and costs collected $1,584.44 and
cifil fees collected $3e45 was read and-h6ving be en approved by the City Attorney,
President Bach ordered the same placed on file,
The application of Littrup Nielson for a license to connect with
sewers and drains was read and upon motion by Anderson, second by Moody, the
license was granted,
The license bond of Littrup Nielson in the amount of $1,000,00 with the
Western Surety Company as surety -was read and upon motion by Whiting, second by
Tingley, the bond was approved, the surety thereon accepted and the bond was
ordered placed on file.
A letter from Carl F. Petersen making application for a public hearing
of necessity for the granting of two more taxi licenses to the Vet's Cab Company
of Rochester, Minnesota was read. Mr. Petersen was present and urged that the
Council have another hearing.- A motion was then made by Alderman Whiting that
the request be denied, his motion was declared lost for want of a second.
Alderman Anderson then moved that -the request be and a.hearing be set
granted
for February 6, 1956 at 7:30 o'clock P. M. Alderman Moody seconded the motion
and upon roll call, Aldermen Anderson, Moody, Schroeder, Tingley and President
Bach voted in favor of the motion and Aldermen Schwanke and Whiting voted 11noll,
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:
Resolution authorizing the Building Inspector to issue a permit for
the construction of a canopy at 11. -.2nd Street Southwest, the Olmsted County
Bank & Trust Company. Upon motion by Anderson, second by Moody, resolution
adopted.
Resolution granting one public dance permit to Leo J. Smith. Upon
motion by Moody, second by Schroeder, resolution adopted*
Resolut�ion appropriating $299.9S from the General Fund, $261-39 from
the S & A Fund, $7,430-00 from the Fire Protection Fund,.$5,25 from the Sewer
Fund and $336-37 from the Police Protection Fund and ordering payment made to
H, Dornack & Son, 004.13; Universal Motors, Inc., $336-37; Alvin E. Benike,
$261-30 and Public Utility Fund, $7,430-00. Upon motion by Schroeder, second by
Schwanke, resolution adopted.
Resolution appro priating $7,409.12 from the Permanent Improvement
Revolving Fund.and ordering payment made to Carlisle G. Fraser. Upon motion by
Schwanke, second by Tingley, resolution adopted.
Resolution appropriating $635,96 from the General Fund, $505-39 from

the Street-& Alley Fnnd; $1.25 from the Sewer Fund, $33,o64.19 from the Bridge
Fund and ordering payment made to Alvin E, Benike, $622.94; Firestone Stores,
$519.66 and CapStal Engineering & Construction Company, $33,o64.19. Upon motion
by Tingley, seco�d by Whiting, resolution adopted.
Resolution I appropriating $1,259-36 from the Park Improvement Fund and
ordering payment made to First,Xational Bank, $536,93 and Mayo Civic Auditorium
Revolving Fund, $722.43. Upon motion by Whiting, second by Anderson, resolution
adopted,
The request of the Board of Park Commissioners that they be granted
permission to enter into contract with John Weis & Son, low bidder, for material
and construction of a picnic pavilion and shelter building at West Silver Lake
Park, was again read. Mr. William Van R00%:, Superintend.net of Parks, was present
and stated that all bids were in accordance with plans and spebifications and
that this building was very much needed. The City Clerk was instructed to draft
a resolution authorizing the Board of Park Commissioners to enter Into contract
with the said John Weis & Son.
President Bach declared a recess at 3:4o P. M. The meeting was called
to order again at 4:00 P. M.
Alderman Whiting introduced a resolution authorizing and directing the
Mayor and City Clerk to enter into an agreement with Carlisle G. Fraser for
construction of a trunk line sanitary sewer in Sections 22, 23:and 27, Townshi

107 West, Range 14 North, Olmsted County, which was read. Upon motion by
Anderson, second by Moody, that the said resolution be adopted as read and all
voting,in favor thereof, President Bach declared the said resolution duly passed
and adopted.
Alderman Whiting introduced a resolution authorizing, the Board of Park
Commissioners to enter into contract with John Weis & Son for the construction of

Moody, second by Schroeder, that the said resolution be adopted as read and all
voting in favor thereof, President Bach declared the said resolution duly passed

I The following letter from the Church of Sts Pius X was read: ,
."Honorable Mayor and Members of the City.Council.

Gentlemen:' r —
Relative to Section 716 of the Rochester Building Code
which has "to do With parapet walls on two story buildings, we
were denied,a permit to go ahead with construction :on the
St. Pius X grade School project because_ther� are no parapet
walls on , the plans.
I am making this appeal to the Board of Appeals for your
kind consideration to waive this section of the code in this
pariicular*'case that we might be given a permit to proceed
with.the work on the school without,parapet walls.,
This building is located outside of the fire zone and
not in close proximity to any other building other than our

own church.- The national code does not call for a parapet wall
on a building of like structure and if this type of wall is demanded
it will cause a -considerable delay in the opening of school and
much increase in cost of the project to the members of this
congregation*

Mr. Eugene V. Schaefer, Architect for the said school, was present with a
delegation from Church of St. Pius X, and stated that he felt parapet walls
were not necessary in this instance. After hearing those present and discussing
the matter, Alderman Schroeder moved that the appeal of the Church of St. Pius X
from the decision of the Building Inspector denying a building permit to the said
Church of St. Pius X for the construction of a grade school In Block 7, Gooding's
Addition, in the City of Rochester unless the plans and specifications are made to
conform to the provisions of Section 716 of the Building Code (Ordinance No- 599)
cancerning parapet walls, is granted and the decision'of the -Building Inspector
reversed on the grounds that under the circumstances surrounding the construction
of this school the mode of construction proposed is more desirable than that
required by the Building Code. Be it further resolved that the Building
Inspector is hereby authorized and directed to issue a building permit author-
izing the construction of said grade school without exterior parapet walls but
with a parapet wall over and constituting an extension of interior fire walls.
Alderman Anderson seconded the motion and upon roll call,all voted in favor
thereof, except Al&erman Schwanke "no".

second by Moody, the same were approved and the Mayor and City Clerk were author-
ize& and directed to draw warrants upon the City Treasurer and make payments
accordingly:

An Ordinance amending the Zoning Ordinance (No- 558) changing Lot 3.
Block 10, Sunnyside Addition to a commercial district, was given its third and
final reading.
Upon motion by Whiting, second by Tingley, that the'said ordinance be

adopted a's read, and upon roll call and Aldermen Moody, Tingley, -Whiting and
President Bach voting in favor thereof, and Aldermen Ander.son, Schroeder and
Schwanke, voting- "no", President Bach declared the said ordinance duly passed
and adopted.
Alderman Schwanke brought up the matter -of the request of the City -
Engineer to move his department from their present basement room to the so-called
community room. C. A. Armstrong stated that he would like to have the use -of -the
entire community -room. -After discussing the matter, Alderman Whiting moved that
the,request of the City Engineer� that he be'given the community room for the
use of the City Engineer's Department in exhhange for the room now occupied -
by them in the basementbe-granted, effective as of March 1, 1956, and that the
custodian notify the'tenants that the Council has found this action necessary
in order to properly house the governmental units. Alderman Schroeder seconded -
the motion and all voted in favor thereof. :
I. - - Alderman Schwanke stated that he had noted that there was,going to be a
National Air Raid Warning -and that the City of Rochester was not participating.
Stanley F, Drips, C ivil Defense Director, stated that the City of Rochester has
no warning system but -that in 1952 Federal and State funds were available for
about-3/4 of the cost of such -a systemi He -was going to investigate -if the said
funds were -still available. -
Mayor McQuillan stated that he had received -numerous complaints about
the removal of snow from the sidewalks in front of vacant'lots and buildings and
in partiuclar the approaches to the East Center Street bridge. He further stated
that he felt -that as long as the City Engineer was responsible for the removal
of,snow he should be -given the authority to remove it.
Mayor Mc(;uillan informed the Council that -Governor Orville Freeman and
a group of other -State Officials.would-be at a meeting in the Mayo Civic
Auditorium on,January 11, 1956,-for a report to the people of the first
congressional.distriet,.and that the -members of the Council were invited to attend.
James J. Macken, Jr., Chief of Police, inquired as to what the Council
intgaded to do in the matter.of giving City -employees eleven holidays instead of
six.- He stated that the Police Department were'setting,up vacation schedules -
.for the year.and would like to know so.as to include the said holidays if
granted. After discussing the matter, Alderman Schr oeder mo ved that the City
Attorney be instructed to prepare a resolution'amending Subsection 6 of*Section
.A,.of the Employment Policy to provide that the holidays within the means of this
agreement include all legal holidays specified by State Law.. Alderman Whiting
seconded the motion and upon roll call all voted in favor thereof, except
Alderman Schwanke and President Bach, who voted "no".
Upon motion by Tingley, second by Anderson, the meeting was adjourned
