Minutes of an adjourned regular meeting of the Common Council of the
City of Rochest'e'r,' Minnesota, held in the Council Chambers in the City Hall in
said City, on February 20,' 1956.
Alderman Whiting moved that Alderman Anderson act as President pro tem.
Alderman.Moody, seconded the motion and upon roll call, all voted in favor thereof.
President pro tem Anderson called the meeting to order at 7:30 o'clock
P.M., the following members being present: Aldermen Moody, Schroeder, Schwanke,
Tingley, Whiting and President pro tem Anderson. Absent: President Bach.
Upon motion by Moody, second by Tingley, the minutes of the meeting of
February 13, 1956 were approved.

President pro tem Anderson stated this as being the time and place set
for the following hearings:
First hearing on construction of a curb and gutter on 15ZA Avenue N. W.
from 14th to 16th Street N. W. and on the north side of 14th Street N. W. and the
south side of 16th Street N. W. from a block west of 151 Avenue N. W. in
Bielenberg & Giese 3rd Addition. There was no one present wishing to'be heard.
First hearing; on construction of a curb and gutter on Sth Avenue S. W.
from Memorial Parkway to 111 Street Southwest. There was no one present wishing
to be heard.
First hearing on construction of a curb and gutter on 9th Avenue N. E.
and 17th Street N. E. in Peck's 4th Addition. There was no one present wishing
to be heard.
First hearing on construction of a curb and gutter on llth Avenue and
15th Street Northeast in Peck's 5th Addition. There was no one present wishing
to be heard.
First hearing on construction of a curb and gutter on 13th Avenue N. W.
from loth to 14th Street Northwest. There was no one present wishing to be heard.
First hearing on construction of a sanitary sewer and sanitary sewer and
water service connections in 14th Avenue Northeast and'15th Street Northeast in

Jefferson Slopes Second Addition. There was no one present wishing to be heard.
First hearing on grading, base construction and bituminous surfacing
on 14th Avenue Northeast and 15th Street Northeast in Jefferson Slopes Second
Addition. There was no one present wishing to be heard.
A plat of Lemke Subdivision, signed by Crenlo, Inc., Inez and Ernest
W. Buske, Mathilda H. Wenzel, Emil -A. and Esther E. Evjen, Alton and Louise E.
Shfefelbine, Peter B. and Lura A. Krueger, Andrew A. and Marie A. Mayer and
George H. and Clara H. Lemke, and described as follows was presented:
"The south 973 feet of the East 5 acres of the Southeast * of
the Southwest J of Section 26, Township 107 North, Range 14 West;
also beginning.at a point on the west line of Outlot No. 1 of

Northern Addition which is 222 feet south of the Northwest corner
of said Outlot, thence East parallel with the north line of said
Outlot a distance of 116.0 feet, thence south 96.5 feet; thence
west 58.0 feet, thence south to the center line of 14"th Street
Northwest, thence west 58 feet to the west line of Outlot No. 1,
thence north to the place of beginning; also the west 200.0 feet
of the north 222.0 feet of Outlot No. 1; also the west 180.0 feet
of the souttL 2acres of Outlot No. 2 Northern Addition; also
beginning at a point on the west line of Outlot No, 2 Northern
Addition which is 23.9 feet south of the Northwest corner of said
Outlot, thence south along the lot line a distance of 47.39 feet,
thence east a distance of 33.0 feet, thence northwesterly a distance
of 57.85 feet to the place of beginning."
Also a letter from the Planning and Zoning Commission recommending that the plat
be accepted for residential purposes and approving the general`street layout and
the recommendation of the City Engineer that he had examined the plat and found
that it meets the requirements of City Ordinances and recommending the approval
of this plat, were each read. Alderman Whiting then moved that the plat be
approved and accepted. Alderman Moody seconded the motion and all voted in favor
thereof.
A petition signed by Haven H. Hodge of Mohn and Hodge Realtors, to have
the following described property to be known as Geisinger Valley Addition
annexed to the City of Rochester was read:
"Commencing at the Southwest corner of the East one-half of the
Southeast one -quarter of Section 25 in Township 107, North of
range 14 West of the fifth principal meridan and running thence
north along the west line of said East one-half of the Southeast
one quarter a distance of 226.8 feet to the center of State Aid
Road number 2 also known as Fourteenth Street Northeast for a
place of beginning, running thence north along said West line a
distance o-f 486.'1 Feet, thence due -east at a right angle to said
West line a distance of 250 feet, thence due South a distance of
291.83 feet to the center of said Fourteenth Street Northeast,
thence south 52091 west a distance of 316.61 feet to the place
of beginning. It
A letter from the Planning and Zoning Commission recommending the annexation of
the Addition of Geisinger Valley and stating that if conforms to the general stree
pattern in that area was read. A plat of the said land was also presented. C. A.
Armstrong, City Engineer, inquired as to what arrangement had been made for the
temporary use of Lot 9 by the City. Mr. Hodge was present and stated that he was
just waiting fo find out the proper method of handling the dedication of or giving
an easement for the said lot. A motion was then made by Alderman Schroeder that
the plat be approved, with whatever arrangaments are necessary involving the use
of said Lot 9, and the City Attorney was instructed to draft an ordinance annexing i
the said land. Alderman Tingley seconded the motion and all voted in favor of the
motion.
The request of Mrs. J. 1-1. Janes, Chairman of the Y-Teen Committee of the
Y.W.C.A., for permission to sell taffy on the streets of Rochester on the day of
their annual taffy sale, March 24, 1956, was read and upon motion by Schroeder,
second by Tingley, their request was granted.

Police Department of the City of Rochester was read and upon motion by Schroeder,
second by Schwanke, the- same was ordered placed on file.
A letter from the Board of Public Health & Welfare requesting apgvval
of the employment of Mr. Forest •Smi•th as custodian at the Public Health Center,
effective Feb. 16, 19'56 at the beginning salary of $246.60 per month which is
90% of base salary of $274.00 per month was read and upon motion,by Schroeder,
second by Whiting, their request- was approved.
A petition signed by 15 property owners.requesting that the service
road between 5th and 6th Street Southwest on the east side of the highway be
dropped from the proposed highway project was read and upon motion by Schroeder,

second by Moody, the same was referred to the Street & Alley Committee.
A letter from the Minnesota Benefit Association requesting that the
Council allocate some time at one of the Council meetings in the near future
to hear one of their representatives was read and upon motion by Schroeder•,second
by Whiting, the City Clerk was instructed to notify them that the Council did not
feel anything would be gained by hearing their representative and were not interested
in their proposition at this time.
A petition signed by Doyle Conner to have Lot 12, Block 11, Elliott's
Rbt-Subdivision of Blocks 6 and 11 of Cummings Addition changed from a residential
to a commercial zone was read together with a statement of acquiescence signed by
five residents in that area. Upon motion by Schroeder, second by Schwanke, the
same was referred to the Board of Zoning.
A report by Frank W. Everett, Fire Chief, that he had examined the gas -
tanks owned by Kris Nielson at 235 - 12th Street Northwest and that Mr. Nielson
did not have permission to install these tanks but in a short time was going to
move the tanks out to his block factory, where he is building a new home, was read.
A motion was made by Alderman Whiting instrucing the Building Inspector to take
whatever action necessary to compel Mr. Nielson to remove the gas and diesel tanks
which are in violation of existing ordinances. Alderman Schroeder seconded the

motion and all voted in favor thereof.
Change order No. 1 given to Squires Electric Company for additional
electrical work at the North Hall Relighting at Mayo Civic Auditorium in the
amount of $490.00 was read and upon motion by Schroeder, second by Schwanke, the
same was approved.
A letter from Joe Gores requesting that the cost of all improvements
constructed in Jefferson Slopes Second Addition be assessed in such a manner that
each lot shall bear an equal share of the total cost was read. Alderman Whiting
moved that the request of Mr. Gores be given consideration, and that in the event
there is a reasonable basis for determining that each lot was benefited equally,
then the assessments will be spread equally. Alderman Schroeder seconded the
motion and all voted in favor thereof, except Alderman Moody, who voted "noel.

A letter from the Board of Park Commissioners stating that it was the
unanimous opinion of the Board that an amendment be provided whereby no part of
the
Rochester Park System
be sold
without
a. vote_of
the
people
and
suggesting that
the
Charter Commission be
informed
of such
a request
was
read.
Mr.
Van Hook,
Superintendent of 'Parks, was present and stated that he thought the Park Board
made such a request to forestall any chance to convert some the present parks
into cash. Upon motion by Whiting, second by Moody, the matter *as tabled until
a meeting with the, Park Board could be arranged. All voted in favor of the motion,
A notice of claim of injury of Irma Tucker, 306 North River Street,
Austin, Minnesota in the amount of $7, 500.00 was read and upon motion by Tingley,
second by Whiting, the same was referred to the City Attorney.
A letter from the City Engineer submitting the list and descriptions of
sixteen parcels of unannexed land which are entirley surrounded by the existing
City Limits was read and an index map showing location and owner of each parcel of
land'was presented to the Council. After examing the map a motion was made by
Alderman Scnwankeinstructing the City Attorney to institute proper procedure and
prepare the necessary instruments to accomplish annexing the said lands. Alderman
Whiting seconded the motion and all voted in favor thereof.
A letter from the Planning and Zoning Commission transmitting a pre-
liminary draft of "Requirements governing the submission of plats or subdivisions
to the City of Rochester, Minnesota" was read. No action was taken and the City
Clerk was requested to make copies of the proposed requirements and mail to the
Aldermeng for study.
The recommendation of the Police Committee and the Chief of Police
that the City re -open negotiations with the Railroads for a crossing signal at
11 Avenue Northwest at the railraod crossing, was read and upon motion -by Moody,
second by Schroeder, the same was referred to the Mayor and the City Attorney.
The recommendations of the Sewer and Water Committee that sanitary sewer)
and water service connections be constructed in Greenway Subdivision; of theSewer
Committee that sanitary sewer be constructed in Greenway Subdivision; of the Sewer)
Committee that strom sewer be constructed in Greenway Subdivision; and of the
Street & Alley Committee that grading, base construction and bituminous surfacing
hh done in Greenway Subdivision were each read and upon motion by Whiting, second
by Schroeder, the recommendations were approved.
The recommendation of the Street & Alley Committee that the City adverti4e
for bids to be opened March 19, 1956 for the season's supply of crushed rod; sand,
gravel and pea gravel; ready mixed concrete; road oil and cutback asphalts;
asphalt emulsion and plant mixed bituminous mixture, for use in the City Engineer,
Department was read and upon motion by Schwanke, second by Moody, the recommend-
ation was approved.

The -recommendation of the Street & Alley Committee and the City
Engineer that the City Advertise for bids to be received on March 19, 1956 for
furnishing 3 two ton dump trucks; 1 wheel tractor with hydraulic loader and one
Pulverizer Mixer for use in the City Engineer's Department was read and upon motion
bj Schroeder, second by Schwanke, the recommendation was approved.l
The matter of studying the method of assessments and the forms andpolicy
to be used was discussed and upon motion by Schwanke, second by Tingley,' the same
was referred to the City Attorney,' City Engineer and City Clerk.
The application of Olmsted County Community Hospital Auxiliary for a
license to sell cigarettes was read and upon motion by Schroeder, second by Moody,
the license was granted.
The application of Joseph J. Zemek for license to connect with sewers
and drains was read and upon motion by Moody, second by Whiting, the same was
referred to the Sewer Committee and the City Engineer.
The report of the City Treasurer for the month of January, 1956 was read
and President pro tem Anderson ordered the same placed on file.
-The reports of the Clerk of Municipal Court for the week ending
February 10, 1956 shwoi"ng total criminal fines and costs collected $1,013.00 and
civil fees received $5.90 and for the week ending February 17, 1956 showing
total criminal fines and costs collected $1,670.00 and civil fees received $5.10
were each read and having been approved by the City Attorney, President pro tem
Anderson ordered the same placed on file.
The indemnity bond for lost order or warrant and affidavit of Iforris J.
Alexander d/b/a Alexander Auto Electric in the amount of $40.27 was read and upon
motion by Whiting, second by Schroeder, the bond was approved and the City Clerk
was instructed to issue a duplicate check.
The request of Mohn and Hodge Realots for permission to do their own
construction of sanitary sewer, sanitary and water service connections and grading,
base construction and bituminous surfacing in Geisinger Valley Addition was read.
A motion was 'made by Whiting, that his request be granted, subject to the super-
vision of the City Engineer and to the filing of a contract to perform the work
and a bond thereto -to establish its solidity (contingent to the acceptance of
the plat and annexation of the land).

The petition of Mohn and Hodge Realtors that a water main be construcAed
in 15th Street Northeast, Lots 1 thru 9, Geisinger Valley Addition was read and
upon motion by Schwanke, second by Schroeder, the same was referred to the Public
utility Board.
The following claims were each read and upon motion by Schroeder,second
by Moody, the same were approved and the Mayor and City Clerk were authorized and

payment made to Schmidt Printing Company. Upon motion by Whiting, second by
Moody, resolution adopted.
Resolution appropriating $171.09 from the S & A Fund, $46.83 from the
Fire Fund, $441.90 from the Sewer Fund, $5, 526.37 from the Park Improvement Fund
and $450.00 from the Permanent Improvement Fund and ordering payment made to the
Scharf Auto Supply, $217.92; Peoples Natural Gas Co., $441.90; Mayo Civic

Resolution appropriating $3,676.95 from the General Fund and $14,477.86
from the Sewer Fund and ordering payment made to Street & Alley Fund, $1,695.00;
Sinking Fund of City of Rochester, $14,477.86 and Sewer Fund, $1,981.85. Upon
motion by Schwanke, second by Tingley, resolution adopted..
Resolution appropriating $�9A709.72 from the General, Fund' and ordering
payment made to Street & Alley Fund, $65,950.00 and Sewer Fund, $13,859.72. Upon
motion by Tingley, second by Whiting, resolution adopted.
Resolution appropriating $480.68 from the General Fund, $3.60 from the
S & A Fund, $15.84 from the Fire Fund and $6, 180.23 from the Lighting Fund and
ordering payment made to City of Rochester, Public Utilities. Upon motion by
Whiting, second by Moody, resolution adopted.
Resolution authorizing the Mayo Association to continue to maintain the
temporary housing units in Graham Addition for an additional period of five (5)
years from and after May 1, 1958. Upon motion by Schroeder, second by Moody,
resolution adopted.
Mr. C. A. Armstrong, City Engineer, brought up the matter of the contract
with Gilbert A. MacMillan and. discontinuing his supervisory capacities in connect-1
ion with the construction of the 7th Street N. E. Bridge. The City Engineer was
requested to arrange a meeting with Mr. MacMillan and the Street & Alley Committee]
Mr. C. A. Armstrong, City Engineer, also inquired whether of not the
Council was going to assess the property on 4th Street Southeast from Broadway
to 6th Avenue S. E. for the construction work contemplated this summer. No action
was taken.
Upon motion by Whiting, second by Moody, the meeting was adjourned until
7:30 o'clock P. M. on Monday, February 27, 1956.
