Record of Official Proceedings of the Common Council of the City. of Rochester, Minn., March 26, 1956 I Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on March 26, 1956. President Bach called the meeting to order at 7:30 P. M., the following members being present: President Bach, Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley, Whiting. Absent: None. Upon motion by Schroeder, second by Schwanke, the minutes of the meeting of March 19, 1956 were approved. The recommendation of the Board of Zoning that the petition of Emil Reiter to have a part of Lot 65, School Section 36 (305 East Center Street) changed • from a residential to a commercial zone be granted was read and upon motion by Schroeder, second by Anderson, the recommendation was approved and the City Clerk publish was instructed to/a notice of a public hearing to be held at 7:30 P. m. on April 9, 1956. The recommendation of the_ Board of Zoning that the petition of Dale D. Arbuckle to have Lot 22, Block 15, Northern Addition changed from residential to commercial zone he granted was read and upon motion by Anderson, second by Moody, the recommendation was approved and the City Clerk was instructed to publish a notice of a public hearing to be held at 7:30-P. m. on April 9, 1956. The recommendation of the Board of Zoning that the petition of Herman Dornack Dornack and Geo. H. Ayshford to have Lots 14,*15 and 16, Block 36, Northern Addition (on llth Street N.E. between Bdwy..and lst Avenue N. E.) changed from a residential to a commercial zone be granted was read and upon motion by Schroeder, second by Moody, the recommendation was approved and the City Clerk was instructed to publish a notice of a public hearing to be held at 7:30 P. m. on April 9, 1956. The recommendation of the Board of Zoning that the petition of Ambrose P. Barry to have Lots 1 and 2, Block 1, Dashow's Sub -Division changed from a residential to a commercial zone and Lot 3, Block 1, Dashow's Sub -Division changed* from a residential to a multiple dwelling zone be granted was read and upon motion. • by Schwanke, second by Tingley, the recommendation was approved and the City Clerk was instructed to publish a notice of a public hearing to be held at 7:30 P. M. on April 9, 1956. The recommendation of the Street & Alley Committee and the City Engineer that the bid of Marti Motors Inc. for furnishing one wheel -tractor with hydraulic loader for use in the City Engineer's Department, be accepted at the bid price of $2,222.18 and that checks be returned to the unsuccessful bidder, was read and upon motion by Schwanke, second by Anderson, the recommendation was accepted. Sickels Company for furnishing the Season's supply of asphalt emulsion for use in the City Engineer's Department, be accepted at the unit prices bid and checks be returned to the unsuccessful bidders,:was .read and upon motion by Schroeder, second by Schwanke, the recommendation was accepted. The recommendation of the Street & Alley Committee and the City Engineer that the bid of Rochester Ready -.Mix, Inc. for furnishing the season's supply of ready mixed concrete for use in the City Engineer's Department be accepted at the unit prices bid and checks be returned to the unsuccessful bidders, was read and upon motion by Whiting, second by Schroeder, the recommendation was accepted. The recommendation of the Street & Alley Committee and the City Engineer that the bid of Rochester Sand & Gravel Company for furnishing the season's supply of plant -mixed bituminous mixture for use in the City Engineer's Department, be accepted at the unit prices bid and checks be returned to the unsuccessful bidders, was read and upon motion by Schroeder, second -by Whiting, the recommendation was accepted. The recommendation of the Street & Alley Committee and the City Engineer that the following bids be accepted for furnishing the season's supply of road oil and cutback asphalt for use in the City Engineers Department was read and upon motion by Schwanke,.second by Anderson, the recommendation was approved. Yd. at Quarry The recommendation of the Street & Alley Committee and the City Engineer G 0 Record of Official Proceedings of the Common Council of the City -of Rochester, Minn., March 26, 1956 that the bid of Borchert Ingersoll, Inc. for furnishing one pulverizer -mixer for use in the 0ity Engineer's Department, be accepted at the bid price of $4,610,00 and that checks be returned to the unsuccessful bidders, was read and upon motion by Tingley, second by Schwanke, the recommendation was accepted. I A letter from the Planning and Zoning Commission notifying the Common Council of their approval and support of the redrafting of a workable ordinance providing that certain areas of each new annexation to the City be set aside for parks and schools was read and the same was ordered.placed on file. The following letter from the Planning and Zoning Commission was read, no action was taken: • "Honorable Claude H. McQuillan, Mayor and The Common Council of Rochester Gentlemen: At a meeting of the Planning Commission held March 219t, e discussion was had, as to the desirability of having more topographical maps made. From this discussion it came out that it was the unanimous opinion of the Planning Commission that they recommend to the Common Council that they enter into a contract with Hurd & Co. to obtain maps of specified. areas as outlined by Tom Moore. This contract would be for $6g4o.o0; however, Hurd & Co. have offered to do the whole area at one time and prorate the cost to the City at a cost of $2,000.00 a year, if they so desire, for the sum of $6200.00, including interest. This would mean a savings of $640.00 on these areas to the City, and provide a permanent record at a much earlier date, approxi- mately one year. . Very sincerely, s D ONAL D L. GRUE Donald L. Towey, Chairman of the Olmsted County Board of Commissioners, requesting the Council .to create a thirty (30) minute curb parking area west and north of the Court House, this area of curb to be on the east side of 6th Avenue Southwest between First Street and Second Street Southwest and on the south side of First Street Southwest between Fifth Avenue and Sixth Avenue Southwest, was read and upon motion by Whiting, second by Anderson, the same was referred to the Police Committee and the Chief of Police, • A Summons Complaint in the matter of Irma Tucker, plaintiff vs the City of Rochester, Minnesota, a municipal corporation, defendant was read and upon motion by Schroeder, second by Whiting, the same was referred to the City Attorney. A letter from -the State of -Minnesota, Department of Highways, trans- mitting four copies of the proposed agreement relative t.o improvements to be made on T. H. 296 was read an-d the same was ordered placed on file. The applicatio-ns of 4Irs. Bonnie Meredith for licensesto sell soft drinks, cigarettes, non -intoxicating m alt liquors "on sale" and non -intoxicating malt liquors "off sale", at 117 - 6th Street Southwest, were each read and upon -motion by Anderson, second by Schroeder, the licenses were granted. A letter signed by Robert H. Bahr and James S. Gray, owners of Cascade • Record of Official Proceedings of the Common Council 687 of the City of Rochester, Minn., March 26, 1956 1 • • Lanes, expressing their whole hearted appreciation of the fine work done by the Rochester Police Department in regards to the recent break in and robbery at their bowling lanes was read and President Bach ordered the same placed on file. President Bach then inquired if any one in the audience wished to be heard. Mr. Gilbert Wade of 310 - let Street N. W. inquired if any action was going to be taken in regard to designating 1st Street N. W. and 2nd Street N. W. as one-way east and west streets and.stated he was not in favor of making let St. N. W. a one-way street. Mr. C. W. Schroeder of 722 - 1st Street N. W.; Mr. Basil Pintaudi of 215 - 1st St. N. W. end Mr. A. J. Toddie of 1139 - 2nd Street N. W. each protested the one way streets. Mr. B. H. Drummond, representing about 15 members of the Guest Home Association living on 1st and 2nd St A?. W., also spoke and stated that they were not In favor of one way streets. After hearing those present, Alderman Schroeder moved that the hearing on one way streets be continued until the meeting of April 2, 1956 at .7:31D P. M. and the Steering Committee on Parking and Traffic be requested to be present at this meeting. Alderman Moody seconded the motion and all voted in favor thereof. Airs. Gus Lyke of 618 West Center Street was present and requested that she be granted a loading and unloading zone in front of her home where she operatef, a nursing home for aged people. Upon motion by Whiting, second by Schroeder, the matter was referred to the - Police Committee and the Chief of Police. Mr'. Haven Hodge was present and inquired as to whether it was possible for them to get water into the Northeast section known as the old Richaman farm, which they proposed to have annexed and stated he would like to have some idea as to the feasibility and cost of installing- such water facilities. Upon motion by Whiting, second by Schroeder, his inquiry was referred to the Public Utility Board for them to bring back a recommendation to the Council meeting on April 2', 1956. A letter from the Board of Public Health & Welfare asking the approval of the Council to rent floor space in the Public Health Center, to the Division of Vocational Rehabilitation was read. Upon motion by Schwanke, second by Whiting, the same was tabled until the' informal meeting with the Board of Public Health & Welfare on Wednesday evening. A letter from the Board of Public Health & Welfare recommending that a permit be granted to the Rochester Dairy Cooperative to abandon the south well at the Pioneer plant in accordance with certain recommendations was read and upon motion by Schroeder, second by Schwanke, the _same was tabled until the meeting of April 2, 1956. The recommendation of the Steering Committee on Parking and Traffic that the Street'Classification system as previously outlined b* adopted and submitting a list designating primary, secondary and residential streets was read and upon motion by'Schwanke, second by Schroeder, the said recommendation was 0 accepted and ordered placed on file. AM Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 26, 1956 The following recommendation was read and upon motion by Schwanke, second by Moody, the same was approved: "To the Honorable Mayor and Members of the Common Council City of Rochester, Minnesota Gentlemen: It is the recommendation of the special committee, appointed by the President of the Council, that a separate department be established in the City Government for the purpose of planning. it is further recommended that Mr. Tom Moore, currently employed a's an a ngineer in the Street & Alley' Department,- be tendered the appointment to the position of Engineer in charge of the Planning Department and that his annual salary be' set at $5, 600.00 per year; as a part of the employment of Mr. Moore it is further recommended that the City"pay the necessary"expenses of Mr. Moore to attend • an accredited school giving special short course training in planning' work. In establishing the new department with new personnel who are not completely familiar with all of the various aspects of this work, it is recommended that the services of Ellerbe & Company be contracted for the first year. The services of Ellerbe & Company would be divided between the personal services and consultations of Mr. E. Buenger and the technical work, such as drwings and map work, be contr*acted with the Ellerbe Company. It is estimated that the cost of this combined service would not exceed $3,000.00. The Committee recognizes the urgent need for this department within the City and' feel that the department should be set up with an effective date of April 1, 1956. In order that proper relations between the planning department and the Council be continued it is further recommended that the Survey Committee of the Common Council be the Committee responsible for the activities of this department, and its coordination with the Planning Board. Tingley" Mayor McQuillan stated that a group of young boys called the "Cavaliers" would like to use the Council Chambers in the City Hall for a meeting on Saturday, March 31. Alderman Schroeder moved that they be given permission to use the Council Chambers on the said date, Alderman Tingley seconded the motion and all voted in favor thereof. Mayor McQuillan stated that the members of the Council were invited to attend a luncheon meeting at the Kahle Hotel on Thurdday. March 29, 1955 to meet • the manager of the I. B. M. Company in Rochester. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution authorizing the Mayor and City Clerk to execute an agreement with the Minnesota State Highway Department, re Trunk Highway No. 296 (hth Street S. E. from Broadway to 6th Avenue S. E.). Upon motion by Anderson, second by Moody, resolution adopted. Resolution accepting the bid of Rochester Ready Mix, Inc. for furnishing of the seasonis supply of ready mixed concrete for use in the City Engineer's Department for 1956. Upon motion. by Whiting, second by Schroeder, their reqommendation was approved. Alderman Whiting moved that the problem of participation of annexed areas in parks which is now under the hands of an appointed committee be- left with that committee, they to inform the newly appointed Survey Committee of the problem entrusted to their charge and then the Survey Committee take it over. Alderman Schroeder seconded the.motion and all voted in favor thereof. Alderman Schwanke moved that the conveyance of Lot 9, Geisinger Valley Addition to the City of Rochester by Stanley C. Mohn, etal. by warranty deed dated February 24, 1956 for public street purposes, be accepted and that the deed be recorded with the Register of Deeds. Alderman Tingley seconded the motion and all voted, in favor thereof. Alderman Anderson moved that the easement for electric transmission and distribution lines over part of 9t_h Street N. W. and Lot 2, Block 10, of the Replat of Blocks 4 and 10, Gooding's Addition to the City of Rochester conveyed • to the City of Rochester by Stanley C. Mohn, etal. by instrument dated March 19, 19.56_ be accepted and the instrument of conveyance recorded with the Register of Deeds. Alderman Schroeder seconded the motion and all voted in favor thereof. Alderman Tingley moved that the easement for storm sewer purposes over parts of 9th Street Northwest and Lots 1 and 2. Block 10, of the Replat of Blocks 4 and 10, Gooding's Addition conveyed to the City .of Rochester by Stanley C. Mohn, etal, by instrument dated March 19, 1956 be accepted and that the instrument of conveyance be recorded with the Register Deeds. Alderman of Schroeder seconded the motion and all voted in favor thereof. Alderman Moody moved that the easement for sanitary sewer purposes in the Geselle property in the Southwest i of Section twenty-three (23), Township 0 699 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 26. 1956 one hundred seven (107-North, Range fourteen (14) West in Olmsted County, Minn., assigned -bo the City of Rochester by Fullerton Lumber Company by instrument dated January 16, 1956 be -accepted and the instrument of conveyance be recorded with the Register *of Deeds. Alderman Anderson seconded the motion and all voted in favor thereof. Alderman Schroeder moved that the ea'sement for sanitary sewe'r purposes in the Elford property in the -Southeast 41 of Section twenty-two(22), Township One hundred seven (107') North, Range Fourteen (14) West, 'in Olmsted County, Minnesota, assigned by the Fullerton Lumber Company to the City of Rochester by instrument dated' January' 16, 1956 be accepted and the instrument of conveyance be recorded with the Register of Deeds. Alderman Moody seconded the motion and all voted in favor of the motion. Alderman Whiting introduced a resolution ordering the first hearing on the construction of a water main from the intersection of 16th Street and 16J Avenue Northwest within the limits of the City of Rochester in a northerly direction through lands in the SEi of Section 27, Township 107 North Range 14 West presently outside the limits of the City of Rochester, to and into the newly annexed Fullerton Elford property in the NE4 of Section 27, Township 107 North, Range 14 West, which was read. A motion was made by Alderman Schroeder, second by Alderman Anderson, that the said resolution be adopted as read and all voting in favor thereof, President Each declared the said resolution duly passed and adopted.
