Minutes of the annual meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall in said City,
on April 2, 1956.
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley, Whiting.
Upon motion by Schroeder, second by Moody, the minutes of the fheeting of
March 29, 1956 were approved and the minutes of the meeting of March 26, 1956 were
approved with the addition of the motion on the following resolution, which was
ommitted.
'Resolution appropriating $305.50 from the S & A Fund; $5,903.55
from the P.I.R. Fund and $35.254.07 from the Sewer Fund and
ordering payment made to 'the Park Department $305, 50; the Sinking
Fund of the City of .Rochester, $35, 254.07 and the General Fund
of the City of Rochester $5,903:55• Upon motion by Tingley,
second by Whiting, resolution adopted.
President Bach then stated that he had prepared a list of the Council
Committees for the coming year and requested the Clerk to read the list of names
to serve on the various committees:

P-resident Bach then called on Mayor McQuillan who stated that he felt
the City of -Rochester was increasing in all aspects and recommended that the
Council and Mayor do everything possible to aid in the development of our City.
He presented an annual report prepared by the City of Norfolf, Virginka
anal recommended that the Council give thought to publishing one sibilar to it. He
He thanked the Council for their past cooperation and hoped the same would cons in
in the.coming year. He stated he did not have his appointments to the various
boards ready but would present same at the next meeting.
Alderman Tingley introduced the following resolution which was read and
upon.motion by Schroeder, second by Schwanke, that the said resolution be adopted
as. read, and all voting in favor thereof, President Bach declared the said
resolution duly passed and adopted.
"WHEREAS, It is deemed expedient and necessary that the Common
Council of the City of Rochester, Minnesota, adopt rules of order
for the conduct of .its business, and
WHEREAS, A copy of Robert's Rules of Order (revised) of the
1915 Copyright, is before the Common Council,
SO THEREFORE, Be it resolved by.the..Couimon Council of the City
of Rochester, Minnesota:
That the said Robert's Rules of'`Orde'r be adopted by this Common
Council as rules of order for the conduct of its business. n

Alderman Tingley introduced the following resolution whth was read and
.upon motion by Anderson, second by Tingley, that the said resolution be -adopted as
read, and all voting in favor thereof, President Bach declared the same duly
passed and .adopted:
'Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the said Common Council of the City of Rochester, Minnesota,
hereby adopts the following rules and regulations for the order of
business of said Common Council:
1. Roll Call. The roll call of the Common Council shall be
had and taken in its alphabetical order according to the
names of the members, except that the name of the President
of the Common Council shall be called first at the first roll
call of each meeting and then after that, at that meeting,
his name shall be called and vote taken after the expression
•
of each of the other members of the said Common Council, or
when a 5/7 vote is required.
2. ' Reading and approval of the minutes of the preceding meeting.
3. At first meeting, the appointment of officers and committees.
4. Public Hearings. '
5. Reading of 'petitions and communications.
6. Reports of committees. All reports of committees shall
hereafter be made in writing, unless ordered otherwise by'said
Common Council.
7. Unfinished business
S. Resolutions and ordinances.
9. Bills and claims.
10. Adjournment.
The application of Elfreda Reiter .for appointment to the office of City
Clerk was read and upon motion by Moody, second by Tingley, Elfreda Reiter was
appointed as City Clerk for the ensuing official year.
The application of R. V.' _Ehrick for reappointment to the office of City
Attorney was read and upon motion by Schwanke,' second by Anderson. R. V. Ehrick
was appointed *as 'City Attorney for the ensuing official year.
'The application of C.' A. Armstrong for reappointment to the office of
City Engineer wasread and upon motion by Whiting, second by Tingley, C. A.
Armstrong was appointed as City Engineer for the ensuing official year.
The application of Garnet Spring for reappointment to the office of City
Building Inq:ector was read and upon motion by Schwanke, second by Anderson,
Garnet Spring was appointed as Building Inspector for the ensuing official year.
The application of Paul Plantz for reappointment to the office of

Electrical Inspector was read and upon motion by Moody, second by Schroeder, Paul
Plants was appointed as City Electrical Inspector for the ensulOng official year.
The application of Wm. L. Burrows for reappointment to the office of
City Heating Inspector was read and upon motion by Whiting, second by Tingley,
Wm. L. Burrows was appointed as Heating Inspector for the ensuing official year.
The application of Charles H. Dornack. for reappointment to the office of
Plumbing Inspector was read and upon motion by Anderson, second .by Schwanke,
Charles H. Dornack was appointed as City Plumbing Inspector for the ensuing
official year.
The application of W. J. Barden for reappointment as assistant to the
City Treasurer was read and upon motion by Tingley, second by Moody, W. J. Barden

was appointed as the Assistamt to the City Treasurer for the ensuing official year.
The application of Marvel M. Kyle for reappointment to the office of
secretary to the Building, Electrical, Plumbing and Heating Inspectors was read
upon motion by Schwanke, second by Schroeder, Marvel M. Kyle was appointed as
secretary to the Building, Electrical, Plumbing and Heating Inspectors for the
ensuing official year.
The application of Flora C. Anderson for reappointment` as secretary for
the Chief of Police and Juvenile Division was read and upon motion by Schroeder,
second by. Tingley, Flora C. Anderson was appointed as secretary for the Chief of
Police and Juvenile Division for the ensuing official year.
The application of C. A. Cotting ham for reappointment to the office of
City Weighmaster was read and upon motion by_Anderson, second by Moody, C. A.
Cottingham was appointed as City Weighmaster for the" ensuing official year.
The .application of Emil J. Aufenthie for reappointment as City Pound
Master was read and upon motion by Schwanke, second by Tingley, Emil J. Aufenthie.

The application of. Frank W. Everett for reappointment to, the office of
Fire Warden was read and upon motion by Anderson, second by Schwanke, Frank W.
Everett was appointed as Fire Warden for the ensuing official year.
The application of Ivan Boyd for reappointment as.Assistant Custodian of
the City Hall and as custodian of the voting machines was read and upon motion by
Moody, second by Tingley, Ivan Boyd was appointed as Assistant Custodian of the
City Hall and as Custodian of the voting machines for the ensuing official year,
The. application of Harold Weis.ene.r for reappointment as Assistant
Custodian of the City Hall was. read and upon motion by Schroeder, second by
Schwanke, Harold Weisener was appointed as Assistant Custodian of the City Hall
for the ensuing official year.
The application of Merlin Mewhorter, Jr. for reappointment as Assistant
Custodian of the City Hall was read and upon motion by Tingley, second by
Anderson, Merlin Mewhorter, Jr. was appointed as Assistant Custodian of the City
Hall for the ensuing official year.,
The application of James Waters for reappointment as Parking Meter
Maintenance man was read and upon motion by Anderson, second by Moody, James
Waters was appointed as Parking Meter Maintenance Man for the ensuing official yea
The application of Joseph M. Healey for reappointment as Assistant in the
Parking Meter Maintenance Department was read and upon motion .by Tingley, second
by Anderson, Joseph Healey was appointed as Assistant in the Parking Meter
Maintenance Department for the ensuing official year,

read and upon motion by Moody, second by Schwanke, Mark Blanchard was appointed as

The application of Mark P. Gravley for appointment to the position of
Chief Parking Lot Attendant was read and upon motion by Schwanke, second by
Schroeder, the same was referred to the City -Engineer..-
President Bach stated this as being the time and place set for the
following hearings:
First hearing on the widening and paving of 4th Street Southeast from
Broadway to 6th Avenue Southeast. There was no one present wishing to be heard.
Second hearing on construction of a sanitary sewer, sanitary sewer and
water service connections and storm sewer in 3rd Avenue. Northeast, 4th Avenue
Northeast, and 18th Street Northeast in Greenway Sub -Division. There was no one

present -wishing to be heard.
- . Second hearing on grading, base construction and bituminous surfacing
on 3rd .Avenue Northeast, 4th Avenue Northeast, and 18th Street Northeast in
Greenway Sub -Division. -There was no one present wishing to -be heard.
.A letter from the Rochester Junior Chamber of Commerce for permission
to conduct a bingo game in conjunction with their 19th annual Gypsy Frolic on
May 12, 1956 in the Mayo Civic Auditorium was -read and President Bach ordered the
same. placed on file.
A le-tter from Harold E. Kamm, M anager of Industrial Opportunities, Inc.
praising the Council for establishing a "Planning Departments' was read and
President Bach ordered the same placed on file.
A letter from G. Howard Spaeth, Commissioner of Taxation, notifying the
Council of the annual meeting for the instruction of assessors and a member of
each local board, to be held at 10:00 A. M. on April 4, 1954 was read. President
Bach appointed Alderman Moody -to attend the meeting.
An announcement from- the University of Minnesota, Center for "atin-
nation Study, of a seminar for purchasing agents to be held on April 17 and 18,
1956 was read and President Bach ordered the same placed on file.
A notice from the League of Minnesota Municipalities of a meeting of

the Highway Tax Distribution Commission to be held on March 26, 1956 was read and
President Bach ordered the same placed on file.-
A le tter from Tom 0. Moore, Planning and Traffic Engineer, stating that
the cost of the proposed mapping program, which had -been suggested at the previous
meeting by the Planning and Zoning Commission, would be reduced to $5,550.00 if
payment were to be made within 30 days after completion, was read and upon motion
by Schroeder, second by Moody, the same was referred to the Survey Committee.
The recommendation of the Street & Alley Committee and the City Engineer
that the following job classifications be established and authorized in the City
Engineers s Office .section during the ensuing city year was read and upon motion by
Schwanke, second by Schroeder, the recommendation was accepted!

Upon motion by Schwanke, second by Schroeder, the City Attorney was
instructed to prepare an ordinance amending the ordinance creating a planning and
zoning commission for the physical devel9pment and welfare of the City of Rocheste.
Minnesota (No. 718) establishing the position of Planning Director. All voted in
favor of the motion.

committee to study sick leave and compensation of City employees.and review the
work policy in general.
Mr. Haven Hodge was present and inquired if any report had been made
on the matter of being able to get a water supply up to the property now known as
the old Richman farm. Alderman Whiting, a member of the Public UtSlity Board,
reported that their Board did,not feel they could undertake this until a more
definite survey had been made as to how many in that vicinity wished to use same
and also an estimate of the cost was made. After discussing the matter further,
Alderman Whiting moved that it be the concensus of this Council -to instruct the
Survey Committee to take up this matter with the Planning Director and the Plannir
and Zoning Commission and further recommended that this be one of the first
projects of the. Planning Director. Alderman Schroeder seconded the motion and al]
voted in favor thereof.
An Ordinance amending an ordinance entitled, '-'An ordinance for the
purpose of promoting health, safety, order, convenience and general welfare by
regulating the. use of land, the location, size, use and height o:5 biildings, and
the arrangement of buildings on lots, and t-he density of population.within the
City of Rochester, Minnesota, all in accordance with a comprehensive plan (change
Rochester Dairy property on 3rd Avenue S.E. from residential to commercial zone),
was given its first reading.
A motion was made by Alderman Schroeder, second by- Alderman Schwanke,
that the rules be suspended and the ordinance be given its second reading and upo
roll call and all voting in favor thereof, the rules were suspended and the
ordinance was given its second reading.
A motion was made by Alderman Moody, second by Alderman Schroeder, that
the rules be suspended and the ordinance be given its third and final reading and
upon, roll call. and all voting in favor thereof, the rules were suspended and the
-ordinance w4s given its third and final reading.
A motion was then made by Alderman• Schwanke, second, by Alderman Whiting;
that. the said Ordinance be adopted as read, and all voting in favor thereof,
President Bach declared the said ordinance duly passed and adopted.
An Ordinance annexing to the City of Rochester, Minnesota, - a part of
Section 25, Township 107, North of Range 14 West, in Olmsted County, Minnesota, to
be known and designated as Geisinger Valley Addition to Rochester, Minnesota was
given its third and final reading.
A motion was then made by Alderman Whiting, .second by Alderman.Schroedei
that the said Ordinance be adopted as read, and all voting in favor thereof,
President Bach declared the said ordinance duly passed and adopted.
C. A. Armstrong, City Engineer, stated that he could buy the pulverizer
mixer, which had. been traded in last month when the City purchased a new one, at a

Reasonable price and he could use same in his department. Upon motion by Schwanke,
second by Whiting, the matter of purchasing the said pulverizer was referred to
the Street & Alley Committee. All voted in favor of the motion,
An Ordinance prohibiting certain loud, unnecessary or unusual noises
within the limits of the City of Rochester; prohibiting the use of sound amplifi-
cation devices or apparatus for commercial purposes; providing for licensAng and
regulating the use of sound amplification devices and apparatus for non-commercial
purposes; and providing a penalty for the violation thereof, was given its third
and final reading.
A motion was made by Alderman Schwanke, second by Alderman Schroeder,

that the said ordinance be adopted as read and all voting in favor thereof,
President Bach declared the said ordinance duly.passed and adopted.
A recessrwas called at 5:30 P. M. President Bach called the meeting to
order again at 7:45 p. m.
President Bach stated that this was the date set for a continued hearing
on the annexation of certain parcels of land surrounded. by the City. The following
letter from the City Attorney was read:

In re: Annexation of lands surrounded
by the City
.Gentlemen:
You will recall that at the hearing on the proposed annexation
of certain parcels of land surrounded by the City, the following persons
owning parcels of land in Belmont Addition were present and heard either
in person or by representative and objected to the annexation of their
property on the ground that it was not "completely surrounded" as re-
quired by Statute: Donald T. Barrett, Joseph Pratt, Gershom Thompson,
John M. Berkman and Howard R. Hartman.
The property owned by these persons together with the property
of Robert M. Salassa, H. G. Bumpus, Jr. and Edwin Rundell constitute a
single unit of land outside the City comprising approximately 9.25 acres
and having a perimeter of approximately 2,955 feet. It now appears that
in the southwest corner the west line of land owned by Mr. Donald T.
Barrett is off set approximately 13,28 feet from the west line of lands
within the City directly.south of the Barrett land. Under these circum-
stances there is a small channel or opening of approximately 13.28 feet
involving this entire area.
In all probability, the statute authorizing the annexation of
lands completely surrounded by the City will be strictly construed and if

challenged, the annexation of this land would be set asside. Although,
for every practical purpose of City government, the area in question is
bompl'etely surrounded, nevertheless it is my opinion that this very small
13.28 foot channel will in all probability, be sufficient to deprive the
Common Council of its authority to annex.

Mr. Franklin Michaels, Attorney was present and represented Dr. Gershom Thompson;
Dr. J. M. Berkman, Dr. H. R.-Hartman, Dr. J. H. matt and Mr. Donald T. Barrett. He
stated,that they did not feel that this property could be annexed under the present
statutes, as long as their land was not completely surrounded, and that they would
resist if it was attempted to so annex. Dr. Gershom Thompson also spoke and said
they did not feel their land was completely surrounded and therefore were not in
favor of the annexation- Mr. Joe Str-eiff, Attorney for Kennedy Cabins, was also

present and inquired if their land was to be discussed -tonight. He was told a
separate hearing would-be held on the Kennedy Cabin property on May 7, 1956 at
2:00 p. m. After hearing those present, Alderman Whiting moved that this hearing,
which was continued from March 19, 1956 until tonight,,be closed and the Council
take the matter under advisement. Alderman Schroeder seconded the motion and all
-voted in favor thereof.
The petitions of Edna Harden that sanitary sewer and water main be con-
structed in lst Street Northeast from 13th Avenue Northeast westerly to serve
dutlot 1, Stebbins Addition and the grading, base construction and surfacing of
1st Street Northeast from llth to 13th Avenue Northeast be done were each read and
upon motion by Schroeder, second by Whiting, the same were referred to the Street
Alley Committee, the Sewer Committee, the -Water Committee and the City Engineer
for recommendation.
Mr. Rodney Young was present and inquired what had been done in the
matter of vacating the alley between 1st and-2nd Avenue Northeast near 16th Street
Northeast. He was told nothing would be done until the hearing on the change of
zoning of adjoining property was had, the said hearing being set for April 9,1956
at 7:30 p.m.
The recommendation of the Police Committee and Chief of Police that
parking be prohibited at all times on the north side of 3rd Street Southwest
between 6th and 7th Avenues and that the necessary resolution be drawn to make
this change effective was read and upon motion by Whiting, second by Tingley, the
recommendation was approved.
The recommendation of the Police Committee and Chief of Police that if
the present. angle parking on 1st Avenue Southwest on' the east side of the street
between 1st and 2nd streets is changed to parallel parking, that a truck loading
zone be established in front of the premises known as 114 First Avenue Southwest,
was read and upon motion by Anderson, second by'Whiting, the recommendation was
approved.
The recommendation of the Police Committee and the -Chief of Police that
the alley running east and west between 1st and 2nd Avenue Southwest and 2nd and
3rd Street Southwest, be designated for one-way traffic in rarest bound direction,
and that the necessary resolution to make this change effective be drafted, was
read and upon motion by Whiting, second by Schroeder, the recommendation was
approved.
The recommendation of the Police Committee and the Chief of Polide that
a temporary loading zone beestablished in front of the premises known as 624 West
Center Street, and presently being used as a rectory by St. Johns Catholic Church,
and that the need for this loading zone will be dissipated when the permanent
Rectory is completed was read and upon motion by Tingley, second by Anderson, the

recommendation was approved.
The recommendation of the Police Committee and the Chief of Police that
the request of the Olmsted County Commissioners for 30 minute parking on 6th Avenue
Southwest, and on 1st Street Southwest adjacent to the court house property, be
referred to the Mayor's Committee on Traffic and Parking for study and report was
read and upon motion by Tingley, second by Moody, the recommendation was approved.
Alderman Whiting introduced the following resolution which was read:
"Be it resolved that the Common Council of the City of Rochester
speaking for the people of Rochester and for all the officers and
employeesmof the City, hereby acknowledges the great debt of
gratitude which we all owe to Mr. Fred R. Finch for the eighteen
years of devoted and productive public service which he has just

completed. For reasons of health, Mr. Finch has found it necessary
to terminate his association with the City and it is with sincere
regret that the Common Council learns of this necessity. During
his long period of service, Mr. Finch has been instrumental in
developing the City Clerk s office to its present efficent status.
fir. Finch has instituted many excellent, modern and progressive
procedures in performing the duties of the Clerk's office*
His extensive and thorough knowledge of municipal aff airs in
general and of the affairs of the City in particular have made him
an invaluable city officer,
Under his guiding hand the affairs of the office of the City
Clerk and of the Common Council have been maintained in a well.
organized, accurate and efficient manner.
The Common Council express the kindes personal wishes on the
part of all concerned with city government and wish Mr. Finch a
long and enjoyable period of retirement."
A motion was made by Alderman Schroeder, second by Alderman Tingley, that the said
resolution be adopted as read, and all voting in favor thereof, President Bach
declared -the said -resolution duly passed and adopted.
Alderman Whiting introduced a resolution declaring Council intention to
annex certain lands presently surrounded by City land,.namely land owned byEthel
G. Kennedy and Mary E. Rinke, and setting the date of May 7, 1956 at 2:00 p.m.
for a hearing, which was read. A motion was made by Alderman Schwanke, second by
Alderman Tingley, that the said resolution be adopted as read and all voting in -
favor thereof, President Bach declared the said resolution duly passed and adopted.
An Ordinance annexing certain parcels of land in Olmsted County, Minnesota
which are completely surrounded by land presently within the territorial limits of

the City of Rochester, Minnesota, all in accordance with the provisions of Section
413,143 of the Minnesota Statutes, as amended, (6 parcels) was given its first
reading.
An Ordinance amending an ordinance entitled, "An ordinance creating a
planning and zoning commission for the physical development and welfare of the
City of Rochester(establishing position of Planning Director), was given its first
reading.
A m A motion was made by Alderman Whiting, second by Alderman Schroeder, that
the rules be suspended and the ordinance be given its second reading.a nd upon roll
call and all voting in favor thereof, the rules were suspended and the ordinance
was given its second reading.

A motion was made by Alderman Schroeder, second by Alderman Moody, that
the rules be suspended and the ordnance be given its third and final reading and
upon roll call and all voting in favor thereof, the rules were suspended and the
ordinance was given its third and final reading.
A motion was then made by Alderman Tingley, second by Alderman Schroeder
that the said ordinance be adopted as read and all voting in favor thereof,
President Bach declared the said ordinance duly passed and adopted.
A motion was made by Alderman Schroeder, second by Alderman Schwanke,
that Mr. Tom 0. Moore be appointed as the Planning Director. A-11 voted. in favor
of the motion.
James J. Macken, Jr. Chief of Police stated that he had received a
request for a street light in the alley between 1st Avenue and ,,Broadway, near the
Clare Fischer Motor Company. Upon motion by Schwanke, second by Schroeder, the
matter was referred to'the Lighting Committee with power to act. All voted in
favor of the motion.
Alderman Anderson stated that two steel bunks should be purchased for
the Juvenile Office, and the approximate cost of the same would be $120.00. Upon
motion by Whiting, second by Schroeder, the Purchasing Committee was authorized
to purchase the said bunks. All voted in favor of the motion.
Upon motion by Whiting, second by Moody, the meeting was adjourned until
7:30 P. m. on April 9, 1956•
