President Bach called the meeting to order at 7:30 P. m. , the following members being present: President Bach, Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley and Whiting. Absent; None. Upon motion by Moody, second by Whiting, the minutes of the meetings of April 9th and.April loth, 1956 were approved. President Bach stated this as being the time and place set for the following hearings: Continued hearing on the proposed change of zoning of Lots 14, 15 and 16, Block 36, Northern Addition (on llth Street Northeast between Broadway and 1st, Avenue and owned by Ayshford and Dornack) from a residential to a commercial zone., There was no one present,wishing to be heard. A motion was made by Tingley, seconi by Whiting, that the recommendation of the Zoning Board granting the zoning change be approved and 'the City.Attorney was instructed to amend the Zoning Ordinance to include the requested change. All voted in favor of the motion. Hearing on the construction of a water main from the intersection of 16th Street and 162 Avenue Northwest in a nortEherly direction to and into the newly annexed Fullerton Elford property. There was no one present wishing to be heard. First hearing on the construction of a curb and gutter on 6th Street Southeast from the bridge to loth Avenue Southeast. There was no one present wishing to be heard. First hearing on the construction of 'a sanitary sewer and water main on 1st Street Northeast from llth to 13th Avenue Northeast to serve Lots 1 through 7, of Harden's Replat of Outlot 1, Stebbins Addition. There was no one present wishing to be heard. First hearing on grading, base construction and bituminous surfacing on 1st Street Northeast from llth to 13th Avenue Northeast to serve Lots 1 through 7, of Harden's Replat of Outlot 1, Stebbins Addition. There was no one present ,rishing to be heard. First hearing on construction of a water main in 14th Avenue Northeast and 15th Street Northeast in Jefferson Slopes 2nd Addition. There was no one present wishing to be heard. First hearing on construction of a water main in 3rd Avenue Northeast, 4th Avenue Northeast and lgth Street Northeast in Greenway Sub -Division. There was no one present wishing to be heard. Second hearing on the widening and paving of 4th Street Southeast from Broadway to 6th Avenue Southeast. There was no one present wishing to be heard.. A letter from the State of Minnesota, Department of Highways, transmitting -a Record of Official Proceedings of the Common Council 40 of the City of Rochester, Minn., April 16 1956 fully executed copy of the agreement between this Department and the City of Rochester relative to improvements to be made by the State on Trunk Highway No.296 and reading in part as follows, was read and ordered placed on file: "The agreement' provides that the City shall deposit with the State the sum of $33,374.35, the estimated amount of the City's share of the costs of this project. An invoice for this amount will be sent to you before work is started on this project and it is requested that payment be made accordingly. Your attention is called to Section 10 of the agreement which - provides that in the event it appears that the State'3 share of the cost of work being performed by the City (S.P. 5513-10) will exceed the estimated amount that the City shall so notify this Department. Such notification must be made prior to the performance of such additional work in order that we may encumber additional funds that may be deemed necessary and approved. You are also advised that payments by the State and by the City • must be handled as separate transactions instead of the State's obligation to the City being considered as a credit to the City against its obligation to the State." President Bach stated this. as being the time and place set for receiving and opening bids for the following: Proposals for being designated as City Depositories for the year 1956- 1957. Proposals from the First National Bank for appointment and designation as depository for $600,000.00 of funds belonging to the City of Rochester, Olmsted County Bank & Trust Company for appointment and designation as depository for $400,000.00 of funds belonging to the City of Rochester and Northwestern National Bank for appointment .and designation as depository for $300,000.00 of funds belong- •ing to the City of Rochester were each read and President Bach ordered the same placed on file. Proposals for being designated as the official newspaper for the City of Rochester for the year 1956-1957. The proposal of the Rochester Post Bulletin to publish the official printing for the official year commencing April 2, 1956 in the Rochester Post Bulletin was read. A motion was made by.Tingley, second by Schwanke, designating the Rochester Post Bulletin as the official newspaper for the City of Rochester. All voted in favor of the motion. Bids for construction of a curb and gutter on llth Avenue Northeast and 15th Street Northeast in Peck's 5th Addition. The bids of. C. M. Boutelle & Sons in • the amount of $4,283.09 and Doyle Conner Company in the amount of $4,359.90 were i - each received and opened and upon motion by Anderson, second by Schroeder, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report. Bids for construction of a curb and gutter on 9th Avenue Northeast and 17th Street Northeast in Peck's Fourth Addition. The bids of C. M. Boutelle & Sons in the amount of $2,299.49 and Doyle Conner Company. in the amount of $2,344.40 were each received and opened and upon motion by Anderson, second by Schwanke, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report. Boutelle & Sons in the amount of $3, �41.30` Upon motion by Schro-eder., second by Moody, the same were referred to the Street & Alley Committee and the City Engine for tabulation and report. Bids for construction of a curb and gutter on 13th Avenue Northwest, fr.o loth. to 14th Street Northwest. The bids of Doyle Conner Company in the amount of $7, 436. 54 and C. M. Boutelle in the amount of $7, 495. 94 were each received and opened and upon motion by Schroeder, second by Tingley, the same were referred to :the Street & Alley C.ommittee and the City Engineer for tabulation and report. Bids for construction of a curb and gutter in Bielenberg & Giese's Third Addition. The bids of H. T. Earle Sr. in the amount of $7, 274.79 and Doyle - Conner Company in the amount of $7, 281.81 were each received and opened and upon motion by Whiting, second by Anderson, the same were referred to the Street & Alley Committee and the City Engineer. Bids for construction of sanitary sewer and sanitary .sewer and water service connections in Jefferson Slopes 2nd Addition. The bids of Carlisle G. Fraser in the amount of $2,059,90 for sanitary sewer and $1,316.00 for sanitary sewer and water service concoctions were each received and opened and upon motion by Whiting, second by Tingley, the same were referred to the Sewer and Water Committees and the, City Engineer for tabulation and report. Bids for construction of sanitary sewer, -storm sewer and sanitary sewer and water service connections in Greenway Sub -Division. The bids of Carlisle G. Fraser in the amount of $5,432.30 for sanitary sewer, $1,249.00 for -storm sewer and $2,100.00 for sanitary sewer and water service connections were each received and opened and upon motion by Schwanke, second by Anderson, the same were referrer to the Sewer and Water Committees and the City Engineer for tabulation and report. Bids for grading, base construction and bituminous surfacing in Greenwa Sub -Division. No bids were received. Bids for grading, base construction and bituminous surfacing in Jefferso Slopes 2nd Addition. No bids were received. The following resolution adopted by the Sinking Fund- Commission was read and upon motion by Whiting, second by Tingley, the action of the Sinking Fund Commission was approved: "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $100,334.02 be and the said sum is hereby appropriated from the Sinking Fund of the City of Rochester, Minnesota, and ordered paid to the First National Bank of Rochester, Minnesota for the purchase of $100,000.00 U. S. Treasury Notes - 2 7/9% due June 15, 1959. (Principal, $99, 250.00; Interest, $1, 084.02) . Be it further resolved: That the said $100,000.00 2 7/8% U. S. Treasury Notes maturing June 15, 1959.be purchased for the Electric Department Depreciation Reserve." 0 Record of Official Proceedings of the Common Council 42 of the City of Rochester, Minn., April 16, 1956 A letter from Richard W. Cleeremans, General Chairman of the Uunior Chamber of Commerce Gypsy Frolic, requesting that the Council appropriate $199.00 from -the Special Music Fund to defray expenses for music and entertainment at the Frolic was read and upon motion by Schr.oed.er, second by Whiting, tho amount of $199.00 was appropriated from the Band Fund and ordered paid to -the Gypsy Frolic. The Mayor's appointment of Dr. Matthew F. Eust,erman, 7301 - 2nd Street S. W., to the Board of Public Health & Welfare, his term to expire the second Monday of April, 1958 was read and upon motion by Sehwanke, second by Whiting, the appointment was approved. , The request of the Rochester Yellow ,Cab Corporation for renewal of their present taxicab franchise was read and upon motion by Whiting, second by Anderson, the same was referred to the Council as a Committee of the Whole for study. A ],ette,r from the Board of Park Commis.sio.ners requesting permission to enter into contract with the lowest bidder.on the change -over of the lights at Soldiers Field, on the softball diamond, the bid being $4,683.00, with extras for luminary lights (4) of $264.00,(the Board having approved this low bid was read and upon motion by Whiting, second by Schroeder, the•requested permission was granted. A letter. from the Minnesota Railroad and Warehouse Commission stating that their Inspector in charge of vehicle scale testing units would be coming through Rochester and would inspect the 100,000 pound Howe motor truck scale if so desired was read and upon motion by Whiting,second by Moody, the City Clerk was instructed to notify them that they would like the scale inspected. A bill presented.by Even Roheim of 727-15th Avenue Southwest in the amount of $65,00 for ,thawing out a frozen water main in front of his property was read and upon motion by Schroeder, second by Anderson, the same was referred to the Water Committee. A letter from Irving L. Eckholdt, Judge of Municipal Court, appointing Maxine Duell as Deputy Clerk for Municipal Court was read and upon motion by Whiting, second by Schwanke, the same was referred to the Mayor to check with the Judge to clafify the said appointment. A letter from Ruth M. Tauer stating that she had petitioned to have Lots 1 and 4. Block 45, Morse & Sargeants Addition, 6th Avenue and 4th Street S. E., changed from a residential to a commercial zone and that the zoning board had recommended that Lot-1 be changed to commercial but that t:he Council had turned down the petition without a hearing and that was what she requested now, was read and upon motion by Tingley, second by Schwa•nke,- the same was referred to the Zoning Board. All voted in favor of the motion except Alderman Schroeder, who voted "no". E. between First Ave. and Third Ave. hereby petition for sidewalk on the South side of loth St. N. E. from 1st Ave. to Silver Lake Drive. Reason for the petition is to have sidewalk that will connect with that that is already in on the "South side of 14th 'St. . and reduce amount of traffic on our side of the Street. This will also make for safer walking conditions in as much as people will not have to cross the street twice to remain on sidewalk. Signed: W. L. Wheeler - 219 - 14th St. N. E. LeWheeler was present and urged that the sidewalk be constructed on the south aide of the street to reduce traffic on their side of th'e street and also so people would not have to cross the street twice in order to walk on sidewalk. A motion was made by Whiting, second by Tingley, referring the' matter!to the Street & Alley Committee and the City Engineer. Mr. Ed Minnick was present and stated that he would like to get a permit to pickup wet and dry garbage in the residential district of,the City. He said he was in the process of buying a rubbish route and would like to be able to pick up both the dry and wet rubbish. A motion was made by Alderman Schroeder, second by Alderman Schwanke, referring his request to the Board of Public Health & Welfare and the City Clerk was instructed to notify the said Board that the Council had talked to Mr. Minnick and referred him to them. All voted'in favor of the motion. The request of Bert and Ellen Leitzen that they be granted permission to do their own grading, base construction and bituminous surfacing on 14th, 15th and 16th Streets Northeast and 4th Avenue Northeast in Leitzen's Fourth Addition was read and upon motion by Tingley, second by Whiting, the same was referred to the Street & Alley Committee and the City Engineer. A petition for the construction of a curb and gutter on Sth Avenue Northwest from 14th Street Northwest to the north end of 9th Avenue Northwest was read and upon motion by Whiting, second by Tingley, the same was referred to the Street & Alley Committee and the City Engineer. Petitions for construction of a storm sewer, sanitary sewer, water maix and sanitary sewer and water service connections in 14th, 15th and 16th Streets Northeast and 4th Avenue Northeast in Leitzen's Fourth Addition were each read and upon motion by Tingley, second by Moody, the same were referred to the Sewer, Water Committees and the City Engineer. The recommendation of the Street & Alley Committee that the request for vacating the alley running east -west along the north side., of Block 1, Dashowl Subdivision between 1st and 2nd Avenue Northeast be not granted was read and upon motion by Tingley, second by Anderson, the recommendation was approved. The recommendation of the Street & Alley Committee_,that bids be 0 44 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 16, 19 56 received for extension of footbridge at llth Avenue Southeast .over Bear Creek and removal of old bridge on loth Street Southeast over Bear .Creek wad.read and upon motion by Moody, second by Tingley, the recommendation was approved and the City Clerk was instradted to prepare a resolution ordering the said bids. The following recommendation of the Street & Alley Committee and the City Engineer was 'read: "Hono'rable •Mayor & Common Council City of Rochester, Minnesota Gentlemen: We recommend that the Council take immediate steps to arrange with the State Highway Department for the resurfacing of Broadway in 1956. The condition of the surface is such that it cannot be patched or maintained, and if it is not resurfaced this season, will be unfit for travel by next spring. This committee feels that every possibility for State participation with the retention of angle parking has been exhaysted, and that further delay .or negotiations along that line is futile. Ile recommend that immediate action be taken to notify the _ State Department of Highways that the City requests the resurfacing be done as soon as possible this summer, and submits to the required parking provisions. SCHWANKE City Engineer After discussing the matter, Alderman Tingley moved that the recommendation be approved, Alderman Moody seconded the motion and upon roll call all voted in favor thereof, except President Bach, who voted "no". The applications of Ray Bowers, L. J. Broich, Floyd Flom and Paul N. White for license to sell soft drinks were each read and upon motion by Schroeder, second by Schwanke, the licenses were granted. The applications of Floyd Flom, L. J. Broich, Ray Bowers, Paul N. White, Albert W. Meiners •( 5) for license to sell cigarettes were each read and upon motion by Moody, second by Anderson, the licenses were granted. The application of Joe McCoy for Journeyman Hot Water and Steam Fitter's was read�and upon motion by Schroeder, second by Anderson, the license was granted. The application of ftel Economy Engineering Company for a Hot Water and Steam Heating Contractors License was read and upon motion by Whiting, second by Tingley, the license was granted. The application of LeonH. 9Vroman for Journeyman Electrician's License was ,read and upon motion by Schroeder, second by Moody, the license was granted. The application of Ray Bowers fo'r a pool hall license (5 tables) was read and upon motion by Schwanke, second by Schroeder, the license was granted. The application of Carlisle G. Fraser for a license to connect with sewers and drains was read and upon motion by Moody, second by Tingley, the license was granted. The application of Edward J. Rock Amusement Company (Lawler Theatre) for license to operate the said moving picture shows were each read and upon motion by Schroeder, second by Moody, the licenses were granted. The license bonds of Fuel Economy Engineering Company, in the amount of $1, 000.00 with the Indemnity Insi rance Company as surety and- Carlisle G. Fraser in the amount of $1,000.00 with the Federal Insurance Company as surety were each read and upon motion by Tingley, second by Whiting, the bonds -were approved,the surety -thereon accepted and the same were ordered placed.on file. The contract bond of Leo N. Herrick & Sons in the amount of $1,993.90 with the American Casualty Company as surety was read and upon 'motion by Anderson, second by Schroeder, the same was referred to the Mayor. The indemnity bond for lost order or warrant of Mrs.,H. E. Swanson, H.E.'i Swanson Estate in the amount of $132.31 was read and upon motion by Schroeder, second by Moody, the bond was approved. The report of the Clerk of Municipal Court for the week ending April 13, 1956 showing total criminal fines and costs collected $2,001.50 and civil fees received $12.05 was read and having been approved by the City Attorney, President Bach ordered the same placed on file. Mayor Mcquillan was present and stated that there -was a plan to annex School District No. 9, which is south of the Airport, to School District No. 8, which is in the City of Rochester and.that he was very much opposed to this. He .stated that schools in the City of Rochester were already overcrowded and if one district could be annexed possibly more would do so and he did not think the taxpayers of Rochester should be burdened with these additional taxes. He f urthei stated that a petition to annex School District No. 9 was scheduled to go to the Board of County Commissioners on May 9th and that he was going to attend and oppose the said Annexation. Alderman Whiting moved that this matter be referred to the School Committee of the Council for. consultation with the Mayor and recommendation to the Council. Alderman Tingley.seconded the'motion and all voted in favor thereof. President Bach declared a recess at 10:10 p. m. The meeting was called to order at 10:30 P. m. The following resolutions were each introduced and read and President Bach ordered the same placed on file: Resolution accepting the collateral of the Olmsted County Bank & Trust Company in lieu of a Depository Bond. Upon motion by Anderson, second by Moody, resolution adopted. Resolution accepting the collateral of the Northwestern National Bank in lieu of a Depository Bondq Upon motion by Moody, second by Schroeder, resol- ution adopted. Resolution accepting the collateral of the'First National Bank in lieu of a Depository Bond. Upon motion by Schroeder, second by Schwanke, resolution adopted.
