President Bach called the meeting to order at 2:00 o'clock P. M., the following.members being present: President Bach, Aldermen Moody, Schroeder, Schwanke, Tingley, Whiting; Alderman Anderson arrived at 4:45 P. m. Upon motion by Moody, second by Schroeder, the minutes of the meeting of May 2, 1956 were approved. President Bach stated this as being the time and place set for the 2nd hearing .on construction of a water main in.14th Avenue Northeast and 15th Street Northeast in Jefferson Slopes Second Addition. There was no one present wishing to be heard. President Bach stated this as being the time and place set for the 2nd hearing on construction of a water main in ard Avenue Northeast, 4th Avenue North- east and 18th Street Northeast in Greenway Sub -Division. President Bach stated this as being the time and place set for receivin amid opening bids for the following projects: Bids for construction of a sanitary sewer in ard Avenue Northwest from 14th Street Northwest to a point 76 feet north of the south line of Outlot 4, Northern Addition. The bid of Carlisle G. Fraser in the amount of $12, 484.00 was received and opened and upon motion by Schroeder, second by Moody, the same was referred to the Sewer Committee and the City Engineer for tabulation and report. Bids for grading, base construction and bituminous surfacing on 14th Avenue Northeast and 15th Street Northeast in Jefferson Slopes•Second Addition. The bid of Leon Joyce in the amount of $5, 562.65 was received and opened and upon motion by Schroeder, second by Tingley, the same was referred to the Street& Alley Committee and the City Engineer for tabulation and report. Bids for grading, base construction and bituminous surfacing on ard Avenue Northeast, 4th Avenue Northeast and 18th Street Northeast in Greenway Sub - Division. The bid of Leon Joyce in the amount of $5,278.50 was received and opene4 and upon motion by Whiting, second by Schroeder, the same was referred to the Street & Alley Committee and the City Engineer for tabulation and report. Bids for construction of a water main in 14th Avenue Northeast and 15th Street Northeast in Jefferson Slopes Second Addition. The bid of Carlisle G. Fraser in the_amount of $1,998.45 was received and opened and upon motion by Whiting, second by Tingley, the same was referre& to the Water Committee and the City Engineer for tabulation and report. Fraser in the amount of $3,491.25 was received and opened and upon motion by Tingley, second by Whiting, the same was referred to the Water Committee and the. City Engineer for tabulation and report. Bide for extension of the footbridge at llth Avenue Southeast over Bear Creek and removal of old bridge on loth Street Southeast over Bear Creek. The bids of L. M. Feller -Company in the amount of $S, 320.00 and Capital Engineering & Construction Company $14,853.00 were each received and opened and upon motion by Whiting, second by Moody, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report. A letter signed by Max Durand, Vice President of the Minnesota State • Federation of Labor, requesting.that•the Council delay action regarding the setting of wages in the Street & Alley Department, the Park Department and the.Health Department was read and upon motion by Whiting, second by Schroeder, the same was tabled until later in the meeting. A notice from the League of Minnesota Municipalities that the annual convention would .be held in Detroit Lakes on June 13, 14 and 155, 1956 was read. A motion was made by Schroeder, second by Tingley, that all city officials be authorized to attend at city expense. A letter from K. M. McGhie, Professional Civil Engineer., submitting plans, special provisions and engineers estimate for construction of sanitary sewer, storm sewer, water main, sewer and water -service connections, grading, base and bituminous surfacing in Eltton Hills First Subdivision and requesting consideration and approval ofeame was read and upon motion by Schroeder, second by Moody, the same were referred to the Street & Alley Committee and the City Engineer. A petition signed by Louis Golod to have Lot 3, Bilmar Addition and part of Lot 33, Auditor's Plat "A" changed from a residential zone to a commercial zone was read and upon motion by Schroeder, second by Whiting, the same was referred to the Board of Zoning. A petition signed by 16 property owners for the construction of a sanitary sewer in 5th Avenue Northwest from llth to 14th Street Northwest was read and upon • motion by Whiting, second -by Schwanke, the same was referred to the Sewer•Committee and the City Engineer. .A resolution fixing salaries bf men in the City Engineerss Department vetoed by the Mayor on April 23, 1956 was again read with the Mayor's veto message. President Bach then called for a vote on the adoption of the resolution and upon roll call and all present voting "no" the Mayor's veto was sustained. A request by Lysne C eDnstruction Company for a permit to move'a house from 624 - 2nd Street Southwest to 1910.First Avenue Southeast over certain streets of the City was read and upon motion by Whiting, second by Schroeder, the permit was granted, said building to be moved under the supervision of the Building Inspector and the Chief of Police. • Record of Official Proceedings of the Common Council'' • of the City of Rochester, Minn., May 7, 1956 1 1 0 1 • G The annual report of the Board of Park Commissioners for the year ends March 31, 1956 was presented and President Bach ordered the same placed on file. The report of the Clerk of Municipal Court for the week ending May 40 1956 showing.total criminal fines and costs collected $2,306.0o and civil fees received $.25 was read and having been approved by the City Attorney, President Bach ordered the same placed on file. The recommendation of the Street & Alley Committee.that the grading, base and bituminous surfacing be done on llth Avenue Southeast, 12th Avenue Southeast, 13th Avenue Southeast and 8'W Street Southeast in South.Home Addition and that 8j Street abutting the addition be constructed to full width of road- way and.the costs thereof be assessed to the lots on the north side and the City -owned park property on the south side, with the City°s share being paid from the General Fund, was read and upon motion by Schroeder, second by Moody, the recommendation was approved. The recommendation of the Sewer & Water Committee that a sanitary sewer and watermain be constructed in llth, 12th and 13th Avenues Southeast and 8* Street Southeast in South Home Addition was read and upon motion by Whiting, second by Schroeder, recommendation was approved. The recommendation of the Sewer and Water Committee that a sanitary sewer and water service connections be constructed in llth, 12th and 13th Avenues Southeast and 8* Street Southeast in South Home Addition was read and upon motion by Tingley, second by S,chwanke, the recommendation was approved. The recommendation of the Sewer and Water Committee that a sanitary sewer and watermain be constructed in 8th Avenue Northwest and 15th.Street Northwest in Washington Subdivision was read and upon motion by Schwanke, second by Schroeder, the recommendation was approved. The recommendation of the Street & Alley Committee that the grading, base construction and bituminous surfacing be done on 4th Avenue Northwest and 16th Street Northwest in Lemke Subdivision was read and upon motion by Schwanke, second by Schroeder, the recommendation was approved. The recommendation of the water Committee that a watermain be constructed in.15th Street Northeast in Qeisinger Talley Addition was read and upon motion by Schroeder, second.by Moody, the recommendation was approved. Mr. W. L. Wheeler, of 219 - 14th Street Northeast, was present and inquired if -.the Council had done any more on ordering the construction of a sidewalk on the south side of 14th Street Northeast from let Avenue to Silver Lake Drive. He stated he felt that the sidewalk was a safety measure for children coossing 14th Street to go to Silver Lake. James J. Macken, Jr., Chief pf Police, stated he thought perhaps a traffic signal should be installed on the corner of 14th Street and 3rd Avenue Northeast. Alderman Moody then moved that the matter of placing a crossing signal on 14th Street Northeast and 3rd. Avenue Northeast be referred to the Police Committee and the Chief of Police. Alderman Schroeder seconded the motion and all voted in favor thereof. A motion was than made by Alderman Schwanke, second by Alderman Whiting, that the matter of construction of a sidwalk on the south of 14th Street Natheaet from let Avenue to Silver Lake be deferred until the meeting to be held tonight at 7:30. All voted in favor of the motion. A resolution authorizing and instructing the Mayor and City Clerk to execute a contract between the City of Rochester and Mark Hurd Aerial Surveys, Inc. for making of certain topographlemaps of areas in and around Rochester., Minnesota was read. Upon motion by Schroeder, second by Schwanke, resolution, adopted. Mr. R. V. Ehrick, City .Attorney, presented a resolution appropriating $799.79 to be paid to the Public Utility Department for delinquent lights at the baseball park for last season. Mr. Robert Petersdorf, President of the Rochester Baseball Association, was present and stated that the Association was in a very bad financial status and anything the Council could do�would be appreciated. It was •suggested that the Council take on the obligation of lights at the ball field for the coming year and hold the old bill in abeyance until it can be seen how the association turns out financially. No action was taken and the resolution was referred to the City Attorney to report back at the next meeting. A letter from W. A. Walker of Walker Hardware expressing their sincere appreciation of a job well done by the Rochester Police Department in connection with the breakin at their store on April 12, 1956 was read and President Bach ordered the same placed on file. A letter from Clinton D. Waters, Captain of the Salvation Army, inquiri as to how the Noise Abatement Law,recently passed by the Council, affected the - services they had been conducting on the street meetings in the business district was read. R. V. Rhrick, City Attorney, read Sections 3B and I of Ordinance No. 9.17, and stated he did not think it should be construed to prohibit the street meetings ashkeiz was nothing loud, unnecessary or unusual about the said meetings, A motion was made by Schwanke, second by Schroeder, the City Clerk was instructed to write to the Salvation Army informing them that it was not the intent of the Council to have thit-ordinance apply to their organization. All voted in favor of the motion. Alderman Anderson arrived at 4:45 p. m. The proposed ordinance granting franchises to the Yellow Cab Company and the.Vets Cab Company were then presented by the City Attorney. Mr, Joe Kremer, Manager of. Yellow Cab Company and Mr. Carl F. Petersen, owner of Vets Cab Company, were also -present. After discussing the ordinance a motion wasp made by Schwanke, second by Tingley, th hat the City Attorney be instructed to prepare a new paragraph to substitute for Section 8, Additional Taxicabs -and upon roll call all voted in favor thereof. During the course on the discussion on the proposed ordinance other minor changes were made and incorporated in the.final form. President Bach declared a recess at 5:50 p. m. President Bach called the meeting to order at 7:30 P. m. President Bach stated this as being the time and place set for a hearing on the proposed change of zoning of Lot 1, Block 45, Morse. & Sargents Addition. There was no one present wishing to be heard. The recommendation of the Board of Zoning submitted on April 20, 1956 recommending that Lot 1, Block 45,_ Morse & Sargent's Addition be changed from residential to commercial was again read. A Motion was made by Schwanke, second by Tingley, approving the recommendation and Instructing the City Attorney to draft an ordinance making the -requested change in zoning. All voted in favor of the motion. Mr. Raymond Wagoner of 302 - 15th Street Northeast, representing the Jefferson P. T.-A, and also the Central P. T. A. Council,,was present and urged that the Council support the construction of a sidewalk on the south side of 1 4th Street Northeast from lot Avenue to Silver Lake Drive. Mr. Frank Stein and Mr. W. L. Wheeler were also present And urged that the sidewalk be, ordered constructed. James J. Macken, Shief of Police, stated that he supported the construction of thi+ sidewalk as a safety measure. After hearing those present a motion was made by Alderman Schroeder that the City Attorney be instructed to draft a resolution ordering that the sidewalk be constructed and that the resolution be acted on afte. a hearing at the next meeting, to be held on May 21, 1956 at 7430 P. m. Alderman Schwanke seconded the motion and upon roll call all voted in favor thereof. 6 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., May 7, .1956 • Mr. -Russ Lang, Resident Manager of the Kahler Hotel, was present and asked the consideration of the Council in granting them a dance license for the guests of the Kahler Hotel. He was informed that the application had been read and referred to the License Committee for recommendation. A letter Yrom Bert Leitzen requesting that he be -allowed -to -furnish nec- essary crushed rock and grade the street and lay and install sewer and water mains under the direction and supervision of the City Engineer in Leitzen'.s Fourth Addition was read and upon motion by Schwanke, second by Moody, the same was referred to the Street & Alley Committee and the City Engineer. The recommendation of the Street & Alley Committee that the plans and • specifications for street grading and surfacing, sanitary sewer, storm sewer, water main and service connections in Elton Hills First Addition was read, and upon motion by Moody, second by Tingley, the recommendation was approved. The recommendation of the Sewer Committee that the bid of Carlisle a. Fraser for the -construction -of a sanitary sewer in 3rd Avenue Northwest from 14th Street Northwest to a point 76 feet North of the South line of Outlet 4, Northern Addition be accepted at the unit prices bid and checks be returned to the unsuccess- ful bidders was read, and upon motion by Anderson, second by Whiting, the recommend- ation was approved. \ The recommendation of the Street & Alley Committee and the City Engineer that the bid of the L. M. Feller Company in* the amount of $9,320.00 for the Exten- sion of the Footbridge at llth Avenue Southeast over Bear Creek and the removal of the old Bridge on loth Street Southeast over Bear Creek be accepted and that the checks be returned to the unsuccessful bidders was read, and upon motion by Tingley, second by Moody, the recommendation was approved. Alderman Schwanke brought up the matter of compensating the City Dog Catcher for the use of his equipment and also the matter of repairs to the house and installation of sewer and water services. The same. was left in the hands of the Public Grounds Committee. Alderman Moody stated that he felt, due to the amount of work being done by the Dierk of Municipal Court, her salary should'be increased. A motion was made by Schwanke, second by Moody, instructing the City Clerk to prepare a resolution rescinding the resolution adopted on April 17, 1956 which.set the salaries of the Clerk of Municipal Court and Deputy Clerk of Municipal Court, and setting up a new salary for the Clerk of Municipal Courte Upon roll call and Aldermen Moody, Schwanke and Whiting voting in favor thereof, and Aldermen Anderson, Schroeder, Tingley and President Bach voting "no", the motion was lost.. The proposed ordinances granting franchises to the Yellow Cab Company and the Vets Cab Company were again discussed and a few changes were made, namely in Section S. An Ordinance granting to Carl P. Ald.er'man Whiting introduced a` resolution accepting plans and specifica- tions and authorizing Fullerton Lumber Company to make local -improvements in Elto Hills First -Subdivision, which was read.- Ald-erman Schroeder moved that the resolution be adopted as read, Alderman Whiting seconded the motion and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. A motion was made by Alderman Schwanke, second by Alderman Tingley, instructing the City Attorney and City Clerk to draft a letter of thanks, in behalf of the City of Rochester, to A. G.
