HomeMy WebLinkAbout05-21-1956Record- of Official Proceedings of the Common Council' 87 of the City of Rochester, Minn., May 21. 19 56 1 1 • 1 1 Minutes of an adjourned regular meeting -of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, -in the City Hall, in said City on May 21, 1956. President Bach called the meeting to order at 7:30 P. m. , the following members being present: President Bach, Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley, Whiting. Absent: -Drone. Upon motion by Moody, second by Tingley, the minutes of the meetings of May 7th and May loth, 1956 were approved. A letter signed. by E. L. LaFond, President of the E. L. LaFond Co. Inc. enclosing a mutual agreement between interested parties and a map showing minor alterations in the street plan, the said alterations being made,for the purpose of re -aligning and re-establishing the course and laying out of loth Street Southeast and extending llth Street Southeast to its intersection with loth Street Southeast and also for the purpose of designating the entire area lying to the south and southeast of said loth Street S. E. and llth Street S. E and extending x ing to the aforesaid trunk highway as a zone for commercial use, was read. Also a letter from the Planning and Zoning Commission agreeing to the minor change in the street] alignment as .it affects loth Street Southeast in the southeast area of the approvei plan, providing the two owners affected present a signed statement agreeing to such change was read. Mr. E..L. LaFond was present and urged that the Council approve.the plan. A motion was then made by Alderman Whiting that the recommend- ation of the Planning and Zoning Commission, approving the proposed changes in thel street layout of the Rochester City plan in Southeast area adopted by the Common Council on March 1, 1954, be approved. Alderman Anderson seconded the motion and all voted in favor thereof, except Alderman Tingley who voted "no". A petition with 69 signatures opposing the construction and operation of a ready -mix concrete factory at.106- 5th Street Southeast (Fullerton Lumber.Company; was read. Alderman Schroeder inquired if a permit had been issued, if the plant would be in an industrial zone and if the Council had any jurisdiction in the matter. He was informed that a permit had been issued as the property was in an industrial zone. R. V. Ehrick, City Attorney, stated that the Council could not take any specific action to bar the project.as long as it did not conflict with the zoning.requirements. Mayor McQuillan stated that until the operation of this plant becomes a nuisance nothing can be done and he felt that Fullerton Lumber Co. was well.aware of the risk they were taking. John Leiferman, Arthur Genz, Mrs, Carl Larson, Mrs, M. Schomburg and other residents in that area were present and protested the.construction and operation of the said plant. Mr, Geo. Pougiales, representing Fullerton Lumber Company, -stated that his clients did not feel that the construction and operation of this plant would be a nuisance. No action was taken. 0 78 Record of Official Proceedings of the Common Council 8 of the City of Rochester, Minn., May 2.1, 19 5 6 Mr. Bryan Rossi, Chairman of the Cascade Township Planning Commission, jwas present together with ten other Cascade residents. Mr. Rossi stated that their commission would like to meet with and work with the City Council and the City Planning Commission -in trying to solve.municipal and -township problems. He stated that one of the present problems -was the odor from the Sewage Disposal Plant which was very offensive to residents in that -area and hoped something could be -done to take care of this. Mr. Robert Badger and Mr. Robert McLean each spoke on the same matter. After hearing those present a•motion was made by Schwanks, second by Tingley, referring the matter of investigating the situation at the Sewage Dispaml ,Plant to=the Sewer Committee and the City Engineerto report back to the Council as soon as possible. All voted in favor of the motion. President Bach stated this as being the time and place set for a hearing on the construction of a sidewalk on the south side of 14th Street Northeast from let Avenue Northeast to the Silver Lake Drive. A letter signed by Cy and Elsie Hemshrot of 134 - 14th Street Northeast stating -that they felt a sidewalk should be constructed on both sides of the street from Broadway to llth Avenue if same was constructed as a safety measure. Mr. W. L. Wheeler, Mr. Clarence Klee and Mr. Raymond Wagoner residents in that area were each again heard and they urged I that a sidewalk be constructed on the south side of 14th Street Northeast. After hearing those present a motion was made by Alderman Anderson that the matter be deferred until the neat regular meeting and taken under further advisement. Alderman Whiting seconded the motion and upon roll call all voted in favor thereof except Aldermen Moody and Schroeder who voted "no". President Bach stated this as being the time and place set for the follow- ing hearings: First hearing on the construction of a sanitary sewer, water main and sewer and water service connections in Sth Avenue Northwest and 15th Street INorthwest in Washington Sub -Division. There was no one present wishing to be heard. First hearing on grading, base construction and bituminous surfacing on 8th Avenue Northwest and 15th Street.Northwest in Washington Sub -Division. There was no one present wishing to be heard. First hearing on the construction of a sanitary sewer, water main and sewer and water service connections in 4th Avenue Northwest and 16th Street North- west in Lemke Sub -Division. There was -no one present wishing to be heard. First hearing on grading, base construction and bituminous surfacing on 4th Avenue.Northwe$t and 16th Street Northwest in Lemke Sub -Division. There was no one present wishing to be heard. First hearing on the construction of a.water main in 15th Street North- east in Geisinger Valley Addition. The following.seven resolutions adopted by the Public Utility Board we each read and President Bach ordered the same placed on files "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the said City, beard is hereby requested to authorise the said Board to enter into an agreement with SARGENT & LUNDY for the furnishing of engineering services for: 1. Installation of 2 - 12,500 gva transformers for the 34.5 gv loop to the IBM properties. This work includes the preparation of speci- ficiations, drawings, and the design of tranif ormer foundations, fire wall and 13.8 kv leads and ducts to the transformers. . 2. Installation of load and frequency control equipment for the tie line and the generators at Silver Lake, 3. Installation of load totalizing and recording equipment for the generators at Broadway and Silver Lake and for the tie line. An estimate cost of said'service to be SIXTEEN THOUSAND DOLLARS ($16,000)." "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that -the COMMON COUNCIL of the said City, be and is hereby requested to"authorize the said Board- to enter into a contract -with the SOUTHERN MINNESOTA SUPPLY COMPANY for the furnishing of; 3 - 100 KVA Distribution Transformers the total amount of the contract to -be TWO THOUSAND SEVEN HUNDRED NINETY SIX DOLLARS ($2,796.00). The proposal of the said General Cable Corporation being identical with that of all others submitted." The report of the Railroad and Warehouse Commission in the matter of the application of the Rochester Yellow Cab Corporation for a certificate ofpublic convenience and necessity as an auto transportation company was read and President Bach ordered the same placed on file. A letter from the State of Minnesota, Department of Health, by the Water Pollution Control Commission returning plans and granting a permit for construction of sewers in 14th Avenue N. E., 3rd Avenue N. W., 3rd Avenue N. E. and 4th Avenue N. E. was read and President Bach ordered the same placed on file. A letter from Clayton A. Swanson, District Engineer for the State of Minnesota, Department of Highways, transmitting four copies of a cooperative agreement between the Department of Highways and the City of Rochester relative to the improvements to be made on T. H. 63 within the City of Rochester was read. Also a change in the agreement, which would place a center island on the street between 2nd Street and 4th Street Northwest was presented. A motion was made by Alderman Schroeder instructing the City Attorney to prepare a resolution to enter into an agreement with the Minnesota Highway Department with the original contract as presented to the Council and specifically state that the Council does not want • the center island as the proposed amendment requested. Alderman Schwanke seconded the motion and all voted in favor thereof. The summons and complant of George L. Spoo Margaret C. Spoo, and Plaintiffs vs. The City of Rochester was read and upon motion by Schroeder, second by Whiting, the same was referred to the City Attorney and the City Engineer. All voted in favor thereof. A plat of "Northgate kddition" and 'a petition signed by A. J. and Irene Osman and Charles R. and Elsa Hutchinson to hate same annexed were presented. Alderman Moody seconded the motion and all voted in favor thereof. A petition,signed by 17 res.idents in that area, to have'the alley in Block 1, Dashow's Sub -Division vacated was read and upon motion by Schwanke, second by Schroeder, the same was referred to the Street & Alley Committee and the City Engineer. A petition for cone -rote paving of the alley running north and south in Block 21, Northern Addition was read and upon motion by Whiting, second by Sohro-, eder, the same was referred to the Street & Alley Committee and the City Engineer' A petition for construction of a sanitary sewer in 3rd AvenueN. W. from a point 76 ft. north of the south line of Outlot 4, Northern Addition to a point approtimately 100 ft. north of the south line of Outlot 5, Northern Addition was read. Mr. Wm.. Rubow, owner of property abutting on the requested sewer, was present and urged that the sewer be constructed. Upon motion by Schroeder, seconi by Whiting, the same was referred to the Sewer Committee and the City'Engineer. A protest against the rezoning of the property located at'1017 - 2nd' Street Southwest was read and upon motion by Schroeder, second'by Anderson, the samd was referred to the Board of Zoning. A letter from C. A. Armstrong, City Engineer, transmitting an applica- tion for a permit to construct a water main across trunk hgihway 52 at 14th Ste- N. W. for the Industrial Opportunities Site was read and upon motion by .Schroeder, second by Moody, the City Engineer was authorized to sign the said application. The preliminary estimates of the City Engineer for grading, base constr- uction and bituminous surfacing in the amount of $1,336.50; sanitary sewer in the amount -of $1, 335, 70; service connections in tie amount of $1, 4g5.00 `and water maix in the amount of $1,380.40, all in 15th-Strest Northeast in. Geisinger Valley Addition, were each read and President Bach ordered the same placed on file. The recommendation of the Survey Committee that the City Planning - Director be authorized to enroll in the Correspondence Course PLocal Planning Administration", given by the Institute For Training In Municipal Administration in an estimate of expense of $57.50 was read, and upon motion by Tingley, second by Whiting, the recommendation was approved. The recommendation of.the Survey Committee that the City Planning Director be authorized to join the sAmerican Society of Planning Officialss was read, and upon motion by Whiting, 'second by Tingley, the recommendation was approved. The recommendation of the Survey Committee that the City Planning Director be authorized to attend the two week Special Summer Session'Course on "City and Regional Plannings,'to be held at the Massachusetts Institute of Technology, August 20th - 31st at an estimated cost of $412.00 4as read, scud Upon motion by Whiting, second by Schroeder, the recommendation was -approve . d 2 Record of Official Proceedings of the Common Council of the City May of Rochester, Minn., -� y 21,. 19 56 • The recommendation of the -Survey Committee that the "Policy Regarding Topo— graphic Mapping Service from City of Rochester's Aerial Photographs" be adopted was (read and -upon motion by Schroeder, second by Whiting, the recommendation was approved• The recommendation of the Street & Alley and Sewer Committees that the grading, base construction, and bituminous surfacing, sanitary sewer and watermain Ion 19th Avenue Northwest and 14th Street Northwest in Valley high Addition be done was read and upon motion by Moody, second by Anderson, the recommendation was j approved. The recommendation of the Street & Alley Committee that the 8.51 wide strip of City owned property lying south of 14th Street Northwest and west of 4th Avenue Northwest as platted, be offered for sale, and one of the councilmen authorised to contact Mr. Floyd Bly, who has requested to buy it, was read.: and'.upgn�.motion.-b$► Schwanke, second by Moody the recommendation was approved. It..was further recommend- ed that the 101 alley and that part of 13th Street Northwest lying west.of the west line of 4th Avenue Northwest be vacated, if and when properly petitioned. Upon motion 1by Schwanke, second by Whiting, Alderman Whiting was authorised to negotiate with jMr. Floyd Bly. The recommendation of the Street & Alley Committee that the Minnesota Highway Department be requested to provide a Crossing at 5th Street Southwest as well as at 6th Street Southwest on the proposed improvement of the Belt Line 0-5- 52-14) in Southwest Rochester was read, and upon motion by Schroeder, second 1by Whiting, the recommendation was approved. The recommendation of the Street & Alley Committee that the claim of Mr, I. 8. Peterson for lawn damage caused by street grading at 905 14th Avenue Southwest In 1955 recommending that the City Clerk advise Mr. Peterson of the Council's action of October 10, 1955 denying his claim was read, and upon motion by Tingley, second by Moody, the recommendation was approved. The recommendation of the Sewer Committee that the sum of $37,275.00 be acceptable as the assessment for a sanitary sewer trunk line for the. I. Be M. property in view of the fact that it is very unlikely that the 75 acres of I. The recommendation of the Police Committee and the Chief of Police that stop signs be erected on loth Street Northeast at, cc near, the entrance to Silver Lake Park, and that appropriate advisory signs be erected to supplement the stop signs was read, and upon motion by Schwanke, second by Moody, the recommendation was approved. The recommendation�of the Police Committee and the Chief of Police that seven men, 2 delegates and a five man pistol team, be authorized to attend the Minnesota -Police and Peace Officers' Association Annual Meeting at St. Paul Minnesota, June 17, 18 and 19. at City expense was read, and upon motion by Schwanke, second by Whiting, the -recommendation vas approved. The recommendation of the Planning & Zoning Commission that the Rundell Plat was again considered by their Board and that it was their decision to follow -along with the recommendations of the Street and'Alley Committee was read. The same was referred to)the Street & Alley Committee. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution authorising the Public Utility Board to enter into contract with the Oeser Cedar Company. Upon motion by Anderson, second by Moody, resolution adopted. Resolution authorizing the Public Utility Board to enter into contract with the Southern Minnesota Supply Company. Upon motion'by Moody, second by Schroeder, resolution adopted. Resolution authorizing the Public Utility Borad to enter into contract with Sargent and Lundy. Upon motion by Schroeder, second by.Schwanke, resolution adopted. Resolution authorizing the Public Utility Borad to enter into contract with the Westinghouse Electric Corporation. Upon motion by Schwanke, second by Tingley, resolution adopted. Resolution ahtorizing the Public Utility Board to enter into contract with the Westinghouse Electric Corporation. Alderman Anderson brought up the matter of purchasing office equipment for the Planning Director and upon motion by Anderson, second by Sch wanks, the Purchasing Committee was authorized to purchase the necessary office equipment fdr the office of the Planning Director. All voted in favor of themotion, Alderman Schwanke reported that he did not feel the house of the Dog Catcher was worth moving and presented a plan of a new house. No action was taken but the Public Grounds Committee was to get preliminary estimates of cost for replacing a new house for the dog datcher. Mayor McQuillan stated that the Peoples Natural Gas Company would like to have an informal meeting with the Council on Wednesday. May 23, 1956' at 7:30p. Mayor McQuillan stated that he had been requested to find.out how many of the Alderman could ride in the Memorial Day Parade. He was told everyone would ride, if possible. Alderman Whiting introduced the following resolution which was read: "WHEREAS, the Department of Highways of the State of Minnesota has submitted a "COOPERATI.VE AGREEMENT"in connection with the resurfacing of a portion of Trunk Highway No. 63 within the corporate limits of the City.of Rochester, and WHEREAS, the Common Council of the City of Rochester deem it to be in the best interests of the City -to an into this cooperative agreement with the State of Minnesota, NOW THEREFORE, be it and it is hereby resolved by the Common Council of the City of Rochester that the said cooperative :agreement is hereby accepted and approved as originally submitted without provisions for concrete center island and the Mayor and City Clerk are hereby authorized and directed to execute the same.' A motion was made by Schroeder, second by Tingley, that the said resolution be adopted as read,_ and all voting in favor thereof., President Bach declared the said resolution duly passed and adopted. Alderman Tingley introduced a resolution accepting plans and specific- ations for local improvements in Geisinger Valley Addition to Rochester, Minnesota and authorizing the execution of a contract with Haven H. Hodge,, Jeanne M. Hodge and Stanley C. Mohn to construct improvement therein, whichmas read. Upon motion by Ichwanke., second by Tingley, that the said resolution be adopted as read and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted.
