Minutes of an adjourned regular meeting of the Common Council of the City
lof Rochester; Minnesota, held in the Council Chambers in the City Hall, in said
City, on June 19,1956.
President Bach called the meeting to order at TOO p* m., the following
[members being present: President Bach, Aldermen Anderson, Moody, Schroeder,
ISchwanke, Tingley, Whiting. Absent: None.
Upon motion by Moody, second by Tingley. -the minutes of the meetings of
l June 4th and June 6th, 1956 were approved.
Mr. 0. V.. Habberstad, President of Industrial Opportunities Inc., was
1present and expressed appreciation for the action taken by the Council in
lexpiditing the utility projects into the Industrial Opportunities, Inc. site.
Chief James Barrow of the United States Navy Recruiting ,office was present
and requested permission to use the north hall of the Mayo Civic Ai4ditorium for a
mass enlistment induction of Southeastern Minnesota between the hours of two
and five o'clock on June 27, 1956. A motion was made by Alderman Schroeder that
the permission bye granted, and the General Fund reimburse the Park Department for
the expense incurred. Alderman Tingley seconded the motion and all voted in favor
thereof,
President Bach stated this as being the time and place set for the follow-
ing hearings:
Hearing on the change of zoning of Lots 1 and 2, Block 25, .Northern
Addition (1003 North Broadway) from a residential to a commercial zone. Mr. Paul
Dornack and Mr. John Marsh were each present and protested this change in zoning.
Mr. Emmett Hand, representing Mrs. Maggie Phillips owner of the property in
question, was also present and urged that the Council make the requested zoning
change. Miss Ethel Smith, granddaughter of Mrs. Phillips, also spoke in favor of
the .zoning change. After hearing those present, President Bach declared the hearing
closed and the matter was taken under advisement until later in the meeting.
Hearing on the change of zoning of Lot 3, Bilmar Addition and part of
Lot 33, Auditor's Plat °Au ( corner of 12th St. S. E. and .11th Avenue S. E. , new
shopping center) owned by Louis Golod, from a residential to a commercial zone.
There was no one present wishing to be heard. The recommendation of the Zoning
Board that the petition be granted was again read and.a mo,ti.on was made by Schroeder,
second by Moody,.that the recommendation of the Zoning Board be approved and instr-
ucting the City Attorney to amend the Zoning Ordinance to include the requested
zoning change. Alderman Moody seconded the motion and all voted in favor thereof.
Hearing on the change of zoning of Lot 5, Block 3 and Lots 5 and 6,
Block 2, in Gonderman & Thiel's•Sub= Division from a residential to a.commercial zone.
There was no one present wishing to be heard. The recommendation of the Zoning
Board that the petition be rejected was again read. A motion was made by Schroeder
that the recommendation of the Boning Board be approved and the petition be not

granted. Alderman Anderson seconded the motion and all voted in favor thereof.
Hearing '.on the change of zoning of Lots 1 and 2, Block 1, Dashow's Sub -
Division from a residential to a commercial zone and Lot 3, Block 1, Dashow's Sub -
'Division from a residential to a multiple dwelling zone. There was no one present
wishing to be heard. The recommendation of the Board of Zoning that the petition
be granted was read. A motion was made by Alderman Tingley that the recommendation
of .the Zoning Board be approved and the City Attorney be instrudted to amend ,the
Zoning Ordinance to include the requested zoning change. Alderman 11hiting seconded
the motion and all voted in favor thereof.
Hearing on the change of zoning of the following described property from
a multiple dwelling zone to a commercial zone;
Standard Oil Company, South 80 feet of Lot 2, Block 1, Elliott's
Sub -Division of W Z of Outlots .4 and 5, Cummings Addition;
E. J. Armit, Eatt 99 feet of South 133.5 feet of Outiot 4,
Cummings Addition;
Laura Braucht property, Lot 1, Block 1, Elliott's Sub -Division
of Westl of Outlots 4 and 5, Cummings Addition; and
Katherine Johnson, North 6o feet of Lot 2, Block 1, Elliott's
Sub -Division of West z of Outlots 4 and 5, Cummings Addition.
Mr. Paul McDermott, Mr. Fred Hartman, Rev. Tel. W. Bunge, Mrs. Hohenthaner and Mr.
B. H. Drummond were present and each spoke against the change of zoning. Al Clemens,
Attorney representing Mrs. Laura Brauch, urged the Council to make tue requested
change in zoning and also read a new petition signed by eleven property owners living
between 7th and lith Avenue Southwest on the south side of 2nd Street Southwest. Mr.
Brandt, representing Standard Oil Company, was also present and spoke. The
recommendation of,the Board of Zoning that the petition be rejected was again read.
After hearing those present a motion was made by Alderman Schroeder that the action
of the Board of Zoning be approved and the change in zoning be denied. Alderman
Moody seconded the motion and upon roll call all voted in favor thereof.
A petition signed by the following, to have their -property changed from a
multiple dwelling', zone to a commercial zone was read together with a statement of
acquiescence signed by 11 residents:

Also a protest signed by 65 residents in that area was presented. Upon motion by
Schwanke, second by Tingley, the same were referred to the Zoning Board. All voted
in favor thereof.
Second ,hearing on construction of a sanitary sewer in 7th Street N. W,.
from a point 114 feet west of 13th Avenue N. W. to 19th Avenue N. W. in Valle yhigh
Addition. There was no one present wishing to be heard.
Second hearing on grading, base construction and bituminous surfacing and

construction of a sanitary sewer and water main in Yalleyhigh Addition. 'there was
no-one present wishing to -be heard.
President Bach -stated this as being the time and place set for receiving
sand opening bids for the following projects:
Bids for construction_ of a 10" water main from 16th Street Northwest to
Elton Hills First Sub -Division, The bids of Carlisle G. Fraser in the amount of
and Barbarossa & Sons in the amount of $8,36s.50
$7,377.10/was received and upon motion by Whiting, second by Schroeder, the same
was referred to the Water Committee and the City Engineer for tabulation and report,
Bids for construction of a sanitary sewer in 7th Street Northwest from a
1point 114 feet west of 13th Avenue Northwest to 19th Avenue Northwest in Yalleyhigh
IAdditi.on. The bids of Carlisle G. Fraser in the amount of $27,669.00 and
Barbarossa & Sons in the amount of $29,694,50 were each received and opened and upon
motion by Schroeder; second by Schwanke, the same were referred to the Sewer
Committee and the City Engineer for tabulation and report.
A letter from Rochester Industrial Opportunities Inc. submitting the
following information was read and ordered placed on file:
"This letter is a confirmation of previous statements made
to the effect that Industrial Opportunities, Inc. will
assume the assessments levied against the permanent
improvements about to be made to and in Yalleyhigh Addition
namelyt The sanitary sewer ffom 13th Avenue, NW to I.B.N.
buildin on the I.O.I. site; 2) The extension of water
from 16 Avenue, NW, West to the I. b. M. building area; (3)
The construction of a street West from Highway 52 to a point
near the Great Western Railroad tracks.
It is the understanding of Industrial Opportunities, Inc.
that these assessments will be spread over a 10 year
amortization period in equal yearly payments at 5% Interest."
Bids for construction of sanitary sewer and water main in 19th Avenue
Northwest and 14th Street Northwest in Yalleyhigh Addition. The bids of Carlisle
G. Fraser in the amount of $8, 391.40 for water main and $9, 258.60 for sanitary
sewer and Barbarossa & Sons in the amount of $9.438.35 fro water main and
$10,990.50 for sanitary sewer were each received and opened and upon motion by
Schroeder, second by Moody, the same- were referred to the Sewer -and hater
Committees and the City Engineer .for- tabulation and report,
Bids for construction of s-anitary sewer and water mai-n i-n 1-st Street N.E,
from llth Avenue to 13th Avenue Northeast in Harden"s Replat. The bids of Carlisle
1G. Fraser in the amount of $1,%66,6o for water main and $2,223,10 for sanitary
sewer were each received and opened and upon motion by Tingley, second by Moody,
the same were referred to the Sewer and Water Committee for tabulation and report.
Bids for grading, base construction and bituminous surfacing on 14th
Street Northwest in Yalleyhigh Addition. The bid of Leon Joyce in the amount of
�$22,125.00 was received and opened and upon motion by Schroeder; second by Moody,
!the same was referred to the Street & Alley Committee and the City Engineer for
tabulation and report.

Bids for grading, base construction and bituminous cuff acing on 1st
Street Southeast'f rom llth to 13th Avenue Northeast in Harden's Replat. The bid
of Leon Joyce in: the amount of $3,l 0.66 was received and opened and upon motion
by Moody, second,,, by Schroeder, the same was referred to the Street & Alley
Committee and the City Engineer for tabulation and ,report.
The matter of the zoning change of Lots 1 and 2, Block 25, Northern_
Addition (1003 North Broadwgy) from a residential to a commercial zone was again
brought up. The recommendation of the Board of Zoning that the petition be grante!
was again read. IA motion was made by Alderman Schwanke, second by Alderman Moody,
that the recommendation of the Board of Zoning . be denied and no -change be made in
the zoning, and upon roll call all voted in favor of the motion, except Alderman
Whiting, who voted "nos.
President Bach appointed Aldermen Anderson, Schroeder, and Schwanke to
act on the Board',of Equalization for the year 1956.
The recommendation of the Street .& Alley Committee that Charles R.
Hutchinson be granted persmission to do his own construction in Northeate Addition
upon the execution of a contract agreement with the City of Rochester was read and
upon motion by Whiting, second by Anderson, the recommendation was approvod.
The following resolution adopted by the Public Utility Board was read
and President Bach ordered the same placed on file;
sBe it, and it is hereby resolved by the PUBLIC UTILITY BOARD
of the ;CITY OF ROCHESTER, MINNESOTA, that the COMMON COUNCIL of
the said Citybe and is hereby requested to authorize the said
Board to enter into a contract with the ALLIS-CHALMERS MANUFAOMMING
COMPANY for the furnishing of;
Two (2) 10,000/12,500 kva, three Phase
power Transformers
The total amount of the contract to be ONE HUNDRED AND ONE THOUSAND
SEVEN HUNDRED AND SE#ENTY-EIGHT DOLLARS ($101, 778..00)., subject to
a price adjustment ciause 'of 10%. The said Allis-Chalmers Manufacturing
Company being the lowest responsible bidder and the said contract
subject to cancellation within ninety days at no_ cost to the
City of Rochester. s
A petition signed by 25 residents on Plummer Lane and Plummer Circle
to have stop signs placed at the junction of Plummer Circle and Plummer Lane to
alleviate the fast and careless driving on the circle was read and upon motion by
Schwanke, second 'by Tingley, the same was referred to the Police Committee and the
Chief of Police. _
A petition to have the alleys in the property between 5th and Sth Street
Northwest and 8th and'9th Avenue Northwest signed by Paul J. Kreter, G. M. Thompson
and Oscar A. Maass vacated was read and upon motion by Schroeder, second by Moody,
the same was referred to the Street & Alley Committee.
A letter signed by Tony Herold for permission to install curb and gutter
on the north side of his property located at 1302 - 14th Street Northwest was
read and upon motion by Schroeder, second by Moody, the same was referred to the
Street & Alley Committee and the City Engineer.

A letter signed by Thomas J. Kirby, M. D. requesting that the assessments
for utilities and streets in Belmont Slopes Second Addition be rendered on a front
footage basis was read and upon motion by Schwanke, second by Schroeder, the same
was referred to the Street & Alley Committee and the City Engineer.
The request of -Lyle W. Gardner fora military leave, wit)x pay for two
weeks, this leave to begin on July 15, 1956 and ending on July 29, 1956 was read
and upon motion by Schroeder, second by Moody, his request was granted.
A letter from the League of Women Voters expressing appreication for the
cooperation in granting permission to have a trailer on the downtom•street corner u
in otservance of Minnesota Constitution Day was read and President Bach ordered the
same placed on file.
A letter -from the Firemen's Civil Service Commission submitting the names
of Orville Mertz and Robert Laack as being the two highest on the Captain's
eligibility list was read and upon motion by Schroeder, second by Schwanke, the
same was referred to the Fire Committee.
The following letter for the City Engineer was read and President Bach
ordered the same placed on file:

Gentlemen:
I request that you consider surfacing with asphalt concrete
the following streets: These are all old concrete pavements
which are badly in need of surfacing.

The cost of the above work is estimated at $60,000. If this
work is undertaken under the provisions of the Assessment Policy,
the abutting,property owners would be assessed for the cost of the
center 36 feet. This would be equivalent to an assessment of approxi-
mately, $3.00 per front foot. On this basis, the assessed amount would
be approximately $30,000, and the City Funds amount would be $30,000.
It is very adviseable to do this resurfacing this summer because
of the serious condition of these streets and the probable availability
of a high-grade asphalt plant in town this summer.

The recommendation of the Street & Alley Committee that the resurfacing
of concrete streets as listed by the City Engineer be ordered as local improvement
assessment projects was read and upon motion by Schroeder, second by Moody, the
recommendation was approved.

These streets have all been formerly resurfaced with asphaltic
material over the original brick or concrete pavement. The proposed

The estimated cost of the above maintenance program is - $40,000,
which can be met from available surplus of last year and current main-
tenance funds. It is proposed that the work will be done by a; combina-
tion of the City forces and some rented equipment,

The recommendation of the Street & Alley Committee that the City
Engineer's requested bituminous maintenance program for 1956 on primary and
secondary streets be approved and the work authorized, was read and upon motion
by Anderson, second by Schroeder, the recommendation was approved.
The following letter from the City Engineer was read and President Each
ordered the same, placed on file:
"Honorable Mayor & Common Council
City of, Rochester, Minn.
Sidewalk - 14 St. N.E.
Gentlemen:
I am submitting for consideration and requesting your
approval the location of the sidewalk recently ordered built on
the south side of 14th St. Northeast from Lot 1 - Lakeside
Addition to Silver Lake Drive.
The proposed location: one foot from the property line,
is the standard design on 66 foot right-of-way. In this case,
it will',provide a 41 - 2" wide boulevard, which is the very minimum
which can be peirmitted and provide for satisfactory driveway approaches.
Your attention is called to this project and approval requested
becauselof the serious objection raised by property owners last year,
•
and thelinsistence by some owners that the sidewalks be moved out
nearer to the curb line. The proposed location will, of course,
require removal of trees along the property line, but this department
feels that the requirement of driveways that will not cause a step -
off in the sidewalk and will not be too steep must be given preference,
In;some instances in the past, the City funds have borne the
cost of tree removal and rough grading where sidewalks were ordered
by the Council. Will you please advise if this is your wish on this
project; or if the property owner should bear the cost?

The recommendation of the Street & Alley Committee that the sidewalk
on the south side of 14th Street Northeast from Lot 1, Lakeside Addition to Silver
Lake Drive be located one foot from the property line, and that the City bear
the cost of clearing and grubbing trees and rough grading of the sidewalk area,
but no costs of sodding, retaining walls, landscaping or other costs was read.
Upon motion by Schroeder, second by Tingley, the recommendation

was approved.

The recommendation of the Street & Alley Committee recommending the appoint -
meat of Leo D. Herrick to the position of Engineering Aide II (Sidewalk Inspector)
in the' City Engineer's Office Sction - employment to begin June 18, 1956 at 90% of
$3,900.00 per year. Upon motion by Whiting;-, second by Schwanke, the recommendation
was approved.
The recommendation of the Street & •Alley and Sewer & Water Committees
that all bids for street. grading, base construction and bituminous -surfacing,
sanitary sewer and .water- main and sewer- connections fo-r streets in South Home
Addition be rejected and the const-ruction abandoned because of high costs was read.
Upon motion by Anderson, second by Schroeder, the recommendation was approved.

The recommendation of the- Sewer Committee that bids fie• taken for construct-
ion of a storm sewer from 14th Street Northeast to Silver Lake, along the west line
of- Leitzen's 2nd Addition was read. Upon motion by Anderson, second by Moody, the
recommendation was -approved,
The recommendation of the Sewer Committee that a sanitary sewer be con-
structed in 3rd Avenue Northwest from a point 76' north of the south line of Outlot
4 Northern Addition to the north line of Outlot 4 Northern Addition was read. Upon
motion by Schroeder, second by Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that street grading,
base construction, bituminous surfacing; sanitary sewer and watermain construction
be done on Plummer's Lane in Belmont Slopes 2nd Addition. Upon motion by Tingley,
second by Whiting, the recommendation was approved.
The recommendation of the Police Committee and the Chief of Police that
Cab Stands as presently in existence be kept in effect until this Committee submits
another recommendation was read. Upon motion by Schwanke, second by Anderson,, the
recommendation was approved.
The,recommendation of the Police Committee and the Chief of Police that
the police department be authorized to send three (3)�Men, for training on Radar
equipment, to another Police Department, which is now using this equipment, and
the expenses of these men be authorized, for a period not to exceed three days,
•
was read. Upon motion by Schwanke, second by Whiting, the recommendation was
approved.
The recommendation of the Police Committee and the Chief of Police that the
request of residents west of Highway 52, for bus service, be tabled until October
First, at which time it will be reconsidered, was read. Upon motion by Whiting,
second by Schwanke, the recommendation was approved.
The recommendation of the Police Committee and the Chief of Police that
the request of Franklin D. Mathias of Mathias East Center Street Locker, 107 East
Center Street, for a loading zone, be not granted was read. Upon motion by
Schroeder, second by Schwank®, the recommendation was approved.
A letter from the State of Minnesota, Water Pollution ^ontrol Commission,
transmitting a report on the plans for sewerage facilities in Elton Hills Sub..:

A request from the Board of Park Commissioners for permission to enter
into contract with Universal Motors, Inc. for the purchase of one Tudor Sedan
was read and upon motion by Whiting, second by Anderson, their request was
granted. All voted in favor of the motion.
A letter from the Rochester Lions Club addressed to Mayor Claude H.
McQuillan commending the Council for their recent favorable action in regard to
"State Financial Aid -for Junior Colleges" was read and President Bach ordered the
same placed on file*
A letter from Mayor Claude H. Rcquillan submitting the following names -
to the -Higher Educational Survey Committee for approval was read and upon motion
by Schroeder, second by Schwanke, the same were approved:

The claim of Richard Daly in the amount .of $26.00 for removing oil and
tar from his car was read and upon motion by Whiting, second by Schroeder, the
same was referred to the City Attorney.
The following letter was read and ordered placed on file:

Dear Mayor McQuillan: Re: Resurfacing of Broadway
(Trunk Highway No. 63)
In keeping with the agreement reached with you and the
group which accompanied you from Rochester when you called at the
Highway Department office here on June 5th, with reference to the
above :noted project, bids tendered this morning in response to our
advertisement were not read and will be returned to the respective
bidders. This action was necessary due to the refusal of the City
Council of Rochester to approve plans for the -.work as advertised.
Mr. C.. A. Swanson, District Engineer, was in the office
yesterday and after carefully reviewing the circumstances we have con-
cluded'to readvertise the Broadway resurfacing work as planned, except
for elimination of the center island* It is our understanding that the
City of Rochester will officially approve plans on this basis, subject
-to the requirement that upon completion of the work parallel parking
will be substituted in place of the present angle parking,
I want to say that I appreciated much the opportunity to
personally discuss with your delagation their avowed opposition to
the center island and I am sure we all feel that we have had an
opportunity to express our honest and sincere convictions in the
matter. We are hopeful that with the Council's vigilant and continued
efforts in your local traffic safety problem that developments will
jastify elimination of the center island which, as we have endeavored to
explain to you, was incorporated in our plans for the one specific
purpose of providing greater protection to pedestrians and motor
vehicle operators alike..
In furtherance of our change of plans Mr, Swanson will con-
tact your Council with reference to .obtaining necessary approval of

plans for the improvement of T. H, 63 on Broadway in the City of Rochester was

each read and President Bach ordered the same placed on Pile:

The license bonds of Emil Scheid in the amount of $1,000.00 with the
Travelers Indemnity Company as surety and Emil J. Nietz in the amount of $1,000.00
with Western Surety Company as surety were each read and upon motion by Schwanke,
second by Whiting, the bonds were approved, the surety thereon accepted and the

Alderman Anderson stated that, Ivan Boyd, custodian at the City Hall, had
requested permission •to .empl,oy one additional custodian for the time while he
would tie in .the hospital and for vacation time. Upon motion by Schroeder, second
by Moody, the matter was referred to the Public Grounds Committee with power to
act.
Mayor McQuillan stated that he had received complaints from various
sections of the City about mosugitoes "and `recommended that the Council take some
action ontrying to combat same; possibly by city wide spraying. Alderman Whiting
moved that $500,00 be'appropriated from the General Fudd to be used toward
extermination of mosquitoes"and the Mayor to confer with the'Park Board and Board
of Public Iealth & Welfare as to how to combat same as soon as possibleg Alderman
'Schwanke, seconded the 'motion and all voted in favor thereof, 'except 'President
Bach, who voted "non.

Mayor McQuillan stated that he'had received complaints about the island
boulevard on loth"Avdnue Northwedt between loth and'12th Street (east of Washington
School) not being kept up. and questioned under what department the care of these
boulevards should'come. A motion was made by Alderman Schwanke referring°the matter
to'the Street & Alley Committee and"City`Engineer, and a list to be made of such
other island in the City which could be turned over'to the Park Department.
Alderman Tingley seconded the motion and all voted in favor thereof,
Alderman Whiting introduced a resolution establishing taxicab stands of
Rochester Yellow Cab Company and Vet's Cab Company on a temporary basis; which
was --read. Upon motion by Schwanke, second by Schroeder, resolution adopted.

Alderman WhiVAng introduced a resolution directing the Mayor and City
Clerk to execute a contract between the City of Rochester and Leigh Fisher &
Associates of South Bend, Indiana experts in the field of Airport Planning, which
was read. Upon', motion. by Schwanke, second by Tingley, resolution adopted.
An Ordinance providing for the formation and government of the Fire
Departmentof the City of Rochester, Minnesota, was given its first reading.
Upon motion by Schwanke, second by Anderson, and upon roll call and all
voting in favor' thereof, the rules were suspended and the ordinance was given its
second reading.,
Upon motion by Schroeder, second by Whiting, and upon.roll call and all
voting in favor, thereof, the rules were suspended and the ordinance was given its
third and final', reading.
Upon motion by Anderson, second by Schroeder, that the ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the
said .ordinance duly passed and adoptede
Ehrick, City Attorney, stated that he was still working on
getting water easements through the D. J. Thomas property. Alderman Schwanke
moved that in the event that the Thomas's do not convey or grant such an easement
to the City by July 2, 1956, that the City Attorney. be instructed to prepare the
necessary resolution to commence condemnation proceedings. Alderman -Whiting
seconded the motion and all voted in favor thereof.
Alderman Anderson stated that the application of ?eonard Johnson for a
popcorn license,,at the corner of Broadway and 2nd Street Southeast had been
referred to the'';License Committee and it was the unanimous decision of the Licenso
Committee that the popcorn wagon be removed from this sport. Upon motion by
Schroeder, second by Anderson, the verabl recommendation of the License Committee
was approved and the license was denied. All voted in favor of the motion.
Alderman Schwanke stated that he had received a complaint from Roy
Clark about his 'curb and gutter on loth Avenue Northeast not having proper drainage.
Upon motion by Schroeder, second by Whiting, the matter was referred to the
Street & Alley Committee with power to act.
Garnet Spring, Building Inspector, stated that Dr. Jacobs Ind Dr.
Lovestedt had requested permission to move an apple shed out of Washington Sub —
Division over the following route: on 14th Street N. W. to Broadway, then north
on Bmadway to 14th Street Northeast and then east on 14th Street Northeast to
outside the City limits, the said house to be moved by Lysne Construction Company.
Upon motion by ,Anderson, second by Whiting, the same was referred to the Building
Inspector with power to act.
Upon motion by Anderson, second by Moody, the meeting was adjourned
until 5:00 po m. cn Thursday, June 21, 1956.
