Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on June 28, 1956. President Bach called the meeting to order at 1:00 p. m., the following members being present: President Bach, Aldermen Moody, Schroeder, Tingley, Whiting. Absent: Aldermen Anderson and Schwanke-. The call of the special meeting was read and President Bach ordered the same placed on file, the said meeting having been called for the purpose of con- sidering the condemnation of an easement through the D. J. Thomas property and any other business the said Common Council may deem proper. Aldermen Whiting introduced the following resolution which was read: "WHEREAS, the construction of a trunk line water main from the intersection of.Sixteenth Street and Sixteen and one-half Avenue Northwest in the City of Rochester to Elton Hills Addition to Rochester, necessarily requires the use of the following described land to wit: A strip of land Eight (8) feet wide in the Southeast quarter (SEg) of Section Twenty -Seven (27), Township One Hundred Seven (107) North, Range Fourteen (14) West in Olmsted County, Minnesota, lying Four (4) feet on each side of a line which is Eleven (11) feet.West of and parallel with.the following described line: Commencing at the Northwest corner of the Southeast Quarter (SEJ) of Section Twenty -Seven (27), Township One Hundred Seven (107) North, Range Fourteen (14) West, thence due east along the north line of said Quarter section for a distance of Five Hundred Thirty -Nine and one tenth (539.1) feet to the centerline of Seventeenth Avenue Northwest as platted in Elton Hills First Subdivision for a oint .of beginning; thence deflect to the right 88 degrees and 0 minutes for a distance of Your Hundred Twenty -Two and Forty -One Hundredths (422.41) feet, thence deflect to the right in a southwesterly direction on a 57 degree, 18 minute curve (are definition, central angle of 68 degrees - 2-minutes) southwesterly for a*distance of One Hundred Eighteen and Seventy -Three Hundredths (118.73) feet, more or less, to the northerly right-of-way line of County Aid Road "Uu, and there terminating. NOW THEREFORE, be itresolved by the Common Council of the City of Rochester that a permanent easement for the purpose of constructing, maintaining, repairing and reconstructing a trunk line water main be and it hereby is condemned over and throught the above described land. BE IT FURTHER RESOLVED, that an easement for a period ending Decem- ber 31, 1956 for the purpose of initial construction of said trunk line water main also be and it hereby is condemned over a strip of land fifty (50) feet on each side of the water main easement described above. BE IT FURTHER RESOLVED, that so much of the right, title and interest of each and every person in and to said land as is necessary to give the City of Rochester the permanent water main easement above described, is hereby taken and condemned. BE IT FURTHER RESOLVED, that Theodore Franke of the First Ward of the City of Rochester, Lynn ftncanson of the Second Ward of said City and Maitland Littleof the Third Ward of said City, three disinterested freeholders and qualified voters of said City are hereby appointed to view the premises and assess any damages which may be occasioned by the condemning and taking of the easement in the above described land, all in accordance with the provisions of the Charter of the City of Rochester. The City Clerk is hereby directed to notify the said Commissioners appointed herein to be and appear in the office of said City Clerk in the City Hall at such time as she may designate for the purpose of qualifying and entering upon the duties of their office as such Commissioner. u A motion was made by Alderman Schroeder that the said resolution be dopted as read.
