Minutes of an adjourned regular -meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall in
said City, on July 16, 1956.
A motion was made by Whiting, second by Moody, that Alderman Schroeder
aet as President, pro tem. All voted in favor of the motion.
President pro tem Schroeder called the meeting to order at 7:30 p.m.,
following members being present: Aldermen Anderson, Moody, Schroeder, Schwanke,
Tingley, Whiting,Absent: President Bach.
Upon motion by Moody, second by Tingley, the minutes of the meetings of
July 2nd and July 5th, 1956 were approved.
President pro tem Schroeder stated this as being the time and place set
for the following hearings:
Hearing on the petition for change of zoning of Lot 19 Block 33, R'orther
Addition (so4 North Broadway) from a residential to a commercial zone. The
recommendation of the Board of Zoning that the petition be granted was also read.
There. was no ones' present wishing to be heard. A motion was made' by -Whiting, second
by Schwanke, insl',tructing the City Attorney t•o prepare an amendment to the Zoning
Ordinance making the requested zone change. All voted in favor of the motion.
Hearing on the- petition for change of zoning- of- International- Business
Machines Corporation property from a residential to an- industrial zone. There was
no one present wishing to. be. heard. A motion was made-by-Schwanke, second by .
Moody, instructing the C-i•ty Attorney to prepare an amendment to the Zoning OrdinEwe
making the reque',sted zone. change. All voted in favor of the motion.
Hearing on requested change- of zoning of certain properties on 2nd Street
Southwest be.twes,n -7th and llth Avenues Southwest from a multiple dwelling -zone'to
commercial zone. The recommendation of the Board of Zoning that the petition for
change of zoningof the following properties from a multiple dwelling zone to a
commercial zone 'be rejected was again read:

.A motion was made by Schwanke, second by Tingley, that the recommendation of the
Board of Zoning ',be approved. All voted in favor of the motion.
Hearing on the requested change of zoning of Lots 1 and 2, Block 25,
Tdorthern Addition (1003 North Broadway). Mr. E. J. Hand, Guardian of the Estate
.of Margaret Phillips, was present and urged that the Council consider granting the
requested change;,. Mr. George Kerr, Attorney and Miss Etherl Smith, granddaughter.
of Mrs. Phillips;, were also present and urged that the Council grant the requested
change in zoning'. Mr. Oscar Ronken, Attorney representing the property owners
opposed to the change, was present and spoke against the request. President pro

tem Schroeder declared a 5 minute recess. After the 5 minute recess -the meeting
was again called to order. A motion was made by Whiting, second by Tingley, that
the proposed change in zoning be.granted and that the City Attorney be instructed
to draw an ordinance amending the zoning ordinance making the requested change,
which is in accordance ,with the recommendation of the Zoning Board. TTpon roll call
and.Aldermen Anderson, Tingley and Whiting voting "yes" and Aldermen Moody and
Schwanke and ,President pro tem .Schroeder voting "no", the motion was declared not
carried. -
First hearing on the construction of a curb and gutter on 8th. Avenue X. W.
from 14th Street N. W. to the south line -of Washington Sub -Division. There was no
one present wishing to be heard.
First hearing on the construction of a curb and gutter on the south side
of Graham Court Southeast, east of 15th Avenue Southeast. There was no one present
wishing to be heard.
First hearing on the construction of a curb and gutter on the north side
,of 6th Street S. VT. fronting Lots 1, 2., 3 and 4 of Krofchalk's First Addition. There
was no one present: wishing to be heard.
First hearing on surfacing the. following streets with asphalt concrete:
6th Street S. If. from 7th to loth Avenue S. W.;
6th Street S. W. from Broadway to 2nd Avenue S. W,;
1st Avenue S. W. from 5th to 6th Street S. W.;
3rd Street S. W. from 6th Avenue to a block west of Sth Ave. S.W. ;
9th Avenue S. W. from 2nd to 4th Street S. W.;
9th Avenue S. W. from 7th to 9th Street S. W,;
loth Avenue S. W. from 6th to Sth Street S. W.;
Sth Avenue S. W. from 3rd to 7th Street S. W.; and
Sth Avenue S. W. from Sth to 9th Street S. W.
Dr. F. R. Keating, Jr. of 620 - 10th Avenue S. W., Dr.-E. M. Litin of 609 - Sth
Avenue S. W., Dr. T. G. Rollins of 616 - Sth Avenue S. W. and Dr. C. IA. Blackburn
of 1005 - 7th Avenue S. W. were present and stated they did not feel that the
property owners should be assessed for these improvements. Alderman Whiting
explained the city's assessment policy and stated that this plan had been adopted
in 1954 but was just now being put into affect: After hearing those present a

motion was made by Whiting, second by Tingley, that the hearing be closed but that
no` vote' be taken at this .tine and that_ the attitude and requests of the people at
the hearing tonite be taken under advisement by the Council. (A letter from Daniel
J. Dinneen of 619 - 3rd Street S. W. opposing the assessments was also read).
Second hearings on grading, base construction and bituminous surfacing and
construction of a sanitary sewer and water main in Plummer's Lane in Belmont Slopes
2nd Addition. Dr. T. J. Kirby was present and stated that he did not know that the
cost of the projects was going to be so high and would like to go over the costs
with the Sewer Committee. The preliminary estimates submitted by the City Engineer
in the amount of $1,435.42 for water main installation and material, $1,275.90 for
construction of sanitary sewer and grading, base construction and bituminous sur-
facing in the amount of $1,159.00 were each read and C. A. Armstrong, City Engineer,

reviewed the same with Dr. Kirby. A motion was then made by Whiting, second by
Adderson,`that the hearing be continued and the matter referred to the Sewer
Committee; All voted in favor of the motion.
'Second,hearing on the construction of a sanitary sewer in 3rd Avenue
N.• W. from a point 76 feet north �of the south line of Outlot 4, Northern Addition
to the north line of, Outiot 4, Northern Addition. -There was no one present wishi
for be heard.
-President-pro tem Schroeder declared this as being the time and place
set for receiving and opening bids for the following projects:
-Bids for construction of a storm sewer from 14th Street Northeast to
Silver Lake along the west line of Leitzen' s Second Addition. The bids of Kasson
Well Drilling Company in the amount of $26,528.00 and Carlisle G. Fraser in the
amount of $24,263.00 were each received and opened and upon motion by Whiting,
second by Moody,' the -same were referred to the Sewer Committee and City Engineer
fo-r tabulation and report.
•Bids for i-nstallati'on of seven (7) sirens in seven (7) given locations.
The bids of Adair Electric Co. in the amount of $977,00, H & H Electric Co. in the
amount of •$1, 575,.00,` Nietz Electric Company in the amount of $1, 495.00 and Foster
Electric Go. In the -.mount of, $3,'536.00 were each received and opened and upon
motion by Whiting, second by Tingley., the same were referred to the Police Committ(
and the Civil Defense Director for -tabulation and report.,
Mr. Earl Wolf, Chairman of the Building Committee of the Library Board,
was present and ,read a request from the Library Board that the Council appropriate
$3, 430.00 from the General Fund for replacement of the roof on the library building,
He stated that this request was of emergency importance since the work would have
to be done when ,the weather is favorable. A motion was made by Whiting, second by
Schwanke, authorizing the Mayor to issue an emergency order to repair the said
library roof. All voted in favor of the motion.
The following resolution adopted by the Public Utility Board was read:
"Beit and it is hereby resolved by the Public Utility Board of
the City of Rochester, Minnesota, that the Honorable Common Council
of the_said City be and is hereby requested to authorize the said
board to pay the following amounts of salary for the positions here-
inafter mentioned beginning as of April 1, 1956:

The following resolution adopted by the Sinking Fund Commission was read
and upon motion by -Whiting, second by Moody, the action of the Sinking Fund was
approved:-
flBe it resolved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of $101,119.95 be and the said sum is hereby
appropriated from the Sinking Fund of the City of Rochester,
Minnesota, and ordered paid to the First National Bank of Rochester,
Minnesota, for the purchase of $100, 000, 00 2 5/9% U. S. Treasury
Certificates of Indebtedness maturing February 15, 1957 (Principal-
$100, 000.00; Premium- $156. 25; Interest- $963. 70) .

corner of Lot 10, Block 31, Northern Addition to the City of Rochester, running
thence in a straight- line to the northeast corner of Lot 14, Block 31, was read
and upon motion by Schwanke, second by :Moody,, the same was referred to the Public
Grounds Committee, the Street & Alley Committee and the City Engineer.
A letter from the Minnesota Department of. Health, Division of Environ-
mental Sanitation, enclosing a copy of the report of their Municipal Water Supply
Section covering an examination of plans and specifications on reconstruction of
water main at pr,ioposed storm sewer crossing(14th Street Northeast to Silver Lake)
was read a.nd.ordered placed on file.
The claim of Gus to Stephan in the amount of $26. 00 for fractured wrist
she sustained when she fell -on the sidewalk adjoining Williams Estate Parking Lot
was read and upon motion by Schwanke, second by -Anderson, the same was referred to
the City Attorney, witlr- authorization to settle for $26.00.
A letter from the Planning and Zoning Commission requesting the Council
to attend a noon luncheon meeting, on Wednesday, July 19, at 12:00 noon at the
Chamber of Comme,.rce (Mr. Hugh Barber to speak on municipal financing) was read and
the same was ordered placed on file.
The following Order No. 25942 from the Commissioner of Highways was read
and President pro tem Schroeder ordered the same placed on file:

$stablishment of Detours hhat the following route is designated
as a ,detour for Trunk Highway No. 63 in the City of Rochester,
C ount'y of OLMS TED :
Beginning at the junction of Second Street Northwest and State
Trunk Highway No. 63 (Broadway) in the City of Rochester; thence
continuing westerly approximately 0,06 mile on said Second Street
Northwest to its junction with First Avenue Northwest; thenc4
continuing northerly approximately 0.19 mile on said First Avenue

Northwest to its junction with Fifth Street Northwest; thence con-
tinuing easterly approximately 0.06 mile on said Fifth Street

in the City of Rochester and there terminating. This detour com-
prises approximately.0.31 mile of city streets.
During construction operations it will become necessary to route
trunk highway traffic over a detour and consequently the above.
described roads will be taken'over temporarily by the State of
Minnesota, Department of Highways.
The use of this detour.will become effective on.the date that the
trunk highway markers are erected on the.above designation and will
remain in effect until markers are removed. 1'
The City Engineer's preliminary estimate for construction of a sanitary
sewer in 3rd Avenue N. W. from a point 76 feet north of the south line of Outlot 4,
Northern Addition to the north line of Outlot 4, Northern Addition in the amount

of $2, 544:30 was read and ordered placed on file.
-The following letter from the Board of Park Commissioners was read and
ordered placed on file:
"Ron. Claude H. McQuillan, Mayor
and the Common Council of Rochester
Gentlemen:
Re: Proposed Storm Sewer Easement
alignment from 14th St. N. E.
to Silver Lake.
At a Park Board meeting held on July llth, we reviewed the plan
furnished Mr. Van Hook by the engineer's department, in which you
proposed to run a tile from 14th St. to Silver Lake. The south 220
feet of this line is across 'Park property.
According to the plan;, the work will entail the rebuilding of
the roadway, the resoding of the trench area, and the building of
an outlet structure at the lake edge. With these things being
done in a satisfactory manner under the Engineer's direction, and
if it is the.most practical solution to the, surface water problem
of that area, although we do not like outlet structures to dot the
lack shore, we see no other alternative, and feel that we must
sacrifice that much toward the improvement program. Consequently
we offer no objection to the going across the park, but do hope
that the work can be scheduled to be done after November lst so
as not to deprive park visitors the use of that drive during the
early fall season.

Re: Property acquired from Cem®tery
Association for street and park
purposes.
Although we know from conversations and newspaper articles that,
the property recently acquired from the Oakwood Cem®tery Association
is to be used for right-of-way for 7th St. N. E. and the telauce for
parks, we feel that it would be better if we had an official communi-
cation from the Common Council for our files, stating that this
property. was acquired for park purposes.
We should also appreciate very much having a legal description
of the property coming under park jurisdiction for our files.

The following letter from the Board of Park Commissioners was read and
ordered placed on file:
"Hon. Claude H. McQuillan, Mayor
and the Common Council of Rochester
Gentle'>men:
- Re : Private Property at 850, 902 and
9o4 7th , St, N. E.
At' a Park Board meeting held on July llth, we fully considered the
matter of how to develop the property south of 7th St..N. E. - A0 00W. -
recently acquired from the Cemetery Association. After discussion and
viewing of tentative plans, we are fully convinced that to get the
maximum use out of that area in conjunction with the playground area'
east of the private property, that .we must havela minimum of 200 feet
off of the south portion of those properties, lying between the
recently acquired property and our playground area. Knowing that the

street development program will require so much off of the north -side
of these that these houses have
properties will to be moved, we feel
that it is advisable that all of the property be acquired for public
us e.
A1'so we feel that this small isle of houses, completely surrounded
by public property, is not.practical to service, and certainly will
detract greatly from the looks of the park area.
So, -again, on that -basis, we ask that you acquire these properties
in their entirety, turning over the portion not needed for street
right=of-way to the Park Department for Park purposes.

The following recommendation of the Street & Alley Committee was read:
"Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersigned, recommend that the balance of the Right -
Of -flay necessary for the proposed 7th Street Northeast project between
2 Avenue and 11 Avenue Northeast be acquired,'
We, further recommend, that the Council consider acquiring all
the privately owned property on the south side of the proposed 7th
Street Northeast which lies north of Silver Creek for park.purposes,
rather than just enough to provide right-of-way for the street.
The street construction would require only the north 34 feet
of the,,private property to be acquired, but would necessitate the.
moving of 2 residences, 2 garages, and would leave the 3rd residence
only 20 feet from the south right-of-way line of 7th Street.
The private property is composed of 4 separate parcels as
shown ''an the .accompanying Right -Of -Way, containing 3 residences. -
The private property is bounded both on the east and west by Park
Property.

A motion was made by -Whiting, second by Tingley, that the recommendation of the
Street & Alley Committee regarding considering the acquisition of land be approved
and the Public Grounds Committee be empowered to initiate the steps to consider
the procurement of the land involved. All voted in favor of the motion.
The recommendation of the Sewer Committee that the bid of Carlisle G.
Fraser for construction of a storm sewer from loth Street Northeast to Silver Lake
along the west line of Leitzen's 2nd Addition be accepted at the unit prices bid
and checks be returned to the ,unsuccessf ul bidders was read and upon motion by
Whiting, secondiby Moody, the recommendation was approved.
The recommendation of the Street & Alley Committee that the Council
pass

a resolution requesting the Board of County Commissioners to budget the maximum
amount of County Aid avai]able as the County's contribution for the proposed paving
of 7th Street Northwest from Broadway to U. S. 452 (State Aid Road #I) was read.
Upon motion by Anderson, second by Tingley, the recommendation•was approved and
the City Attorney -was instructed to draft such a resolution. All voted in favor of
the .motion.
The following recommendation of the Sewer Committee was read and upon
motion by Tingley, second by Schwanke, the same was accepted:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
Re: L. A. Kepp letter objecting to Sanitary Sewer•
Assessment on 3 Avenue N.W.; referred to the
Sewer Committee July 2, 1956.
We, the undersigned, wish to reaffirm our assessment policy as
recommended and accepted on March 19, 1956 as a fair and reasonable
manner of distributing the cost of this construction according to
benefitd received on the above project.

The recommendation of the Sewer Committee that a sanitary sewer be con -
strutted in 5th Avenue Northwest from llth Street Northwest. to a point 176 feet
south of the center line of 14 Street Northwest, and a section:of the Northwest -
Southwest Trunk Line Relief Sewer from 14 Street Northwest to 10 Street Northwest
was read and upon motion by -Tingley, second -by Moody, the recommendation was
Japproved.
The recommendation of the Street & Alley Committee that the responsibility
for street "Center Island." maintenance be assigned as follows, was read:

motion was made by Whiting, second by 'Moody, that the City Engineer be authorized-
to engage. Ellerbe & Company to complete. surveys and plans for the I. B. M. sever-
and that the said project be initiated. All voted to favor of the motion.
C. A. Armstrong, City Engineer, requested permission to engage Toltz, King
and Day to complete plans and surveys for the storm sewer north of 7th Street N. W.
to service the new high school and the Bielenberg & Giese and Gooding area. A
motion was made by Schwanke, second by Anderson, that the City Engineer be
authorized to engage Toltz, King and -Day to complete the said plans and that the
project be initiated. All voted in favor of the motion.
A motion was made by Whiting, second by Moody, that the engineering costs
(for the two above projects be charged to the cost of the project* All voted in
Ifavor of the motion.
Mayor Mcquillan stated that he did not think the care of the•"center
island' at loth Avenue W. W. from 10 to 12 Street N. W. should be assigned to the
School Board, as he felt maintenance of streets should be taken care of by the City.
After discussing the matter a motion was made by Anderson, second by Whiting, that
that part of
the motion made previously approving the recommendation of the Street & Alley
Committee that the School Board be assigned the maintenance of the "center island"
at loth Avenue-N. W. be rescinded and the Park Board be instructed to maintain
the "center island" on loth Avenue N. W. from 10 to 12 Street N. W. All voted in
favor of the motion.

Alderman Moody stated that he had been informed that the pavement on
First Avenue S. W. north of 2nd Street S. W. was deteriorating. •The City Engineer
was requested to check the said pavement.
Alderman Tingley stated that he had•received complaints on parking of
cars on 4th-Street N. E., east of llth.Avenue, the street -is very narrow and when
cars are parked 'on both sides, it is almost impossible for traffic to get through.
Upon motion by Whiting, second by Moody,. the matter was referred to the Police
Committee and the Chief of Police for recommendation. All voted in favor of the
motion,
Alderman Tingley stated that he had received a request from various ba
to_ have 12 minut''e meters in front of the banks. Upon motion by Whiting, second by
Schwanke, the matter was referred to the Police Committee and the Chief of Police
for recommendation as soon as possible. All voted in favor of the motion.
Alderman Tingley stated that he had received complaints that the sidewal3
at the Northeast, corner of 3rd Street and 1st Avenue Southeast was practically
under ground. Upon motion by Whiting, second by Moody, the matter was referred to
the Street & All'ey-Committee and the City Engineer.
Alderman Whiting suggested that the Council consider meeting every week
instead of trying to do so much work in so short a time.
President pro tem Schroeder stated that he would not be able to attend
the balance of the meetings of the Board -of. Equalization and appointed Alderman
Moody to take his place.
Alderman Anderson stated that traffic going east on 4th Street Southeast
parked so close to 3rd Avenue that traffic turning left from 3rd Avenue on to 4th
Street Southeast had trouble making the turn and suggested that yellow lines be
painted a little further back than the avenue. Upon motion by Schwanke, second by
Tingley, the matter was referred to the Police Committee and the Chief of Police.
All voted in favor of the motion.
Upon motion by Anderson, second by Moody, the meeting was adjourned unt13
