HomeMy WebLinkAbout07-23-195617 6 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., July 23, 1956 • Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on July 23, 1956. A motion was made by Moody, second by Schwanke, that Alderman Anderson act as President pro tem. All voted in favor of the motion. President pro tem Anderson called the meeting to order at 7:00 p.m., the following members being present: President pro tem Anderson, Aldermen Moody, Schwanke, Tingley, Whiting. Absent: President Bach and Alderman Schroeder. A petition signed by George Kerr, Attorney for William W. Dodge, Helen S. Dodge, Harold E. Whiting and Jessie P. Whiting requesting that the Council approve • and adopt "Dodge's Replat" of Lots 41, 42, 43, 44, 45, 46, 47 and 4s of Peck's Second Addition was read together with a recommendation of the Planning and Zoning Commission that this replat be approved. A plat of "Dodge's Replat° was also presented, Upon motion by Moody, second by Schwanke, thepetition and plat were referred to the Street & Alley Committee, the City Engineer and the Public Utility Department. A petition signed by A. J. Osman to have Lot 17,_Northgate Addition changed from a residential to a commercial zone and a petition signed by Charles R. Hutchinson to have Lot 16, Northgate Addition changed from a_residential to a commercial zone were each read and upon motion by Whiting, second by Tingley, the same were referred to the Board of Zoning. A petition signed by Edwin A. Rundell Jr. and Virginia M. Rundell to have the following desctibed property annexed to the City of Rochester was read and upon motion by Tingley, second by Moody, the same was referred to the Street & Alley Committee, the City Engineer and the Public Utility Department: "Beginning at a point on the east line of the northeast quarter of section three (3) in township one hundred six (106)'north, of range fourteen (14) west, Olmsted County, Minnesota, which is one hundred (100) feet north of the southeast corner thereof, thence west parallel with the south line of said northeast quarter a distance of one hundred four and five —tenths (104.5 feet, thence north parallel with the east line of said northeast quarter a distance of one hundred six and twenty five hundredths (106.25) • feet, thence east parallel with the south line of said northeast quarter a, distance of one hundred four and five tenths (104.5) feet, to the east.line of said northeast quarter, thence south along the east line of said northeast quarter a distance of one hundred six and twenty five hundredths (106. 25) feet tothe point of beginning." A notice of claim of injury signed by Elaine Miller of 1619 - 4th Street S. E. in the amount of $5,000.00 was read. A motion was made referring the said claim to the City Attorney, with authorization to settle the claim for $150.00 if possible. Alderman Schwanke made the motion, Alderman Whiting seconded it and all voted in favor thereof. A letter from Irving L. Eckholdt, Judge of Municipal Court, requesting permission to purchase an electric typewriter sold by the International Business Machines, Inc. for the amount of $400.00 was read and upon motion by Schwanke, secone, Record of Official Proceedings of the Common Council • of the City of Rochester, Minn., July 23 1956 177 by Tingley, the ,same was referred to the Purchasing Committee for recommendation. The recommendation of the Police Committee and Chief of Police that the two parking meters in front of the Olmsted County Bank & Trust Company be changed � from one (1) hour .to twelve (12) minute time limit was read and upon motion by Schwanke, the recommendation was approved and the City Attorney was instructed 60 . draft the necessary resolution to make this change. The following recommendation was read and upon motion by Tingley, second by the same wa.s :Moody, . approved; "To the Honorable Mayor and Members of the Common Council • City of Rochester, Minnesota Gentlemen: 'We, the undersigned members of the License Committee, having - met with representatives Of the Kahler Corporation in connection with their request for Council action to make dancing possible on their; premises even though licensed for the on -sale of intoxicating liquor, and having met jointly with all on -sale liquor licensees, do -hereby unanimously recommend to the Common Council -that the pro- visions in Ordinance No. -645 prohibiting dancing on premises licensed for on -sale of intoxicating liquor be retained and c o nt knue d. Respectfully submitted, LICENSE CO?MITTEE Leo C. Anderson - Thomas A. Moody Raymond C. Schroeder" The following resolutions were each introduced and read and President pro tam Anderson -declared the same duly passed and adopted: Resolution ordering first hearing -on the construction of =a sanitary sewer to service the following locations -in S. W. *fro-m 14th Avenue S. W. to. the east line of Parkin's Subdivision (5) t-runk line sewer along the .eas.t side of U. S. Highway #52 from •112 Street S•. W.1 from llth Street- Northwest to a point 1-76 feet south of the center, line of 14th Street Y. W. and a section of the NW -SW 'trunk line relief sewer from 14th Street N. W. to loth Strest N5 W. Upon motion by Schwanke, second 'by Tingley, resolution 'adopted., Resolution appropriating $710-.28 from the General Fund, $634.59 from the S & A Fund, $516. 29 from the Fire Protection Fund, $957. 96 • from• the Sewer Fund and $99. 54 from the ,Parking• Meter Fund and ordering payment made to City of, Rochester, .$2,664.65 and Federated 'Mutual Insurance Company $253.00. Upon motion by Tingley, second by Whiting, resolution adopted. Resolution appropriating .$30,000.00 from the- Permanent Improvement Fund Record of Official Proceedings of the Common Council of the City of Rochester, Minn., July 23, 19 56 Land ordering payment made to Rochester Cemetery Association. Upon motion by lWhiting, second by Moody, resolution adopted. Resolution authorizing and directing the Mayor and City Clerk to execute the agreement with the Rochester Baseball Association for lights. Upon motion by .Moody, second by Schwa.nke, resolution adopted. Pagenhart for license to construct sidewalk, curb, gutter a'ndldriveways was read and upon motion by Schwanke, second by Tingley, the license was granted. The applications of Robert Clark for "on" and "off" sale non- intoxicatine malt liquors at the corner of 3rd Avenue and hth Street Southeast were each read and upon motion by Whiting, second by Sch.wanke, the same were :referred to the License Committee and the Chief of Police. President pro tem Anderson stated this as being the time and place set fora hearing on'the condemnation of easements through certain lands in the Southeast Quarter (SEX) of Section Twenty -Seven (27), Township One Hundred Seven (107) North, Range Fourteen (14) West in Olmsted County, Minnesota. There was no one present wishing to be heard. The City Attorney then read the following report: To the Common Council of the City of Rochester, Minnesota City Hall. Rochester, Minnesota REPORT OF COMMISSIONERS ON CONDEMNATION OF EASEMENTS THROUGH CERTAIN LANDS IN THE SOLTTHEAST QLTARTER (SEX) OF SECTION TTTENTY-SEVEN (27) , TOWNSHIP ONE HUNDRED - SEVEN (107)NORTH, RANGE FOTJRTEE2Y (14-) WEST IN OLMSTED COUNTY, MINNESOTA We, Theodore Franke, of the First Ward of the City of Rochester, Minnesota, Lynn Duncanson of the Second Ward of said City and Maitland Little of the Third Ward of said City, the Commissioners appointed by resolution of the Common Council adopted on.June 29th, 1956 to view the -property described in the resolution and to assess any damages occasioned by the condemning and taking of the easements herein after described, do hereby report to the Common Council our actions and conclusions in said condemnation proceedings. The easements condemned and taken pursuant to the aforesaid resolution are described as follows: (a) A permanent trunk line watermain easement over and through: a strip of land Eight (g) feet wide in the Southeast Quarter (SEX) of Section Twenty Seven (27), Township One Hundred Seven (107) north, Range Fourteen (14) West in Olmsted County, Minnesota, lying Four (4) feet on each side of a line which is Eleven (11) feet West of and parallel with the following described line: I 180 0 Record of Official Proceedings of the Common Council of the'City of Rochester, Minn., July 23. 1956 • Commending at the Northwest corner of the Southeast Quarter (SEI) of Section Twenty -Seven (27), Township One Hundred Seven (107) North, Range Fourteen (14) West, thence due east along the north line of said Quarter (I) section for a distance of Five Hundred Thirty -Nine '. and one tenth: ( 539.1) feet to the centerline of Seventeenth,Avenue Northwest as platted in Elton Hills First Subdivision for a point of beginning: thence.deflect to the right 89 degrees and 40 minutes j for a distance of Your Hundred Twenty -Two and Forty -One Hundredths (422,41) feet, thence deflect -to the right in a southwesterly dir- ection on a 57 degree, 18-minute curve (arc definition, central angle of 68 degrees - 2 minutes) southwesterly for a distance of One Hundred Eighteen and Seventy -Three Hundredths (118.13) feet, more or less; to the northerly right-of-way line ,of County Aid Road "U;' and there terminatisig. (b)A construction easement until December 31st, 1956 over a strip of land 50' on each side of the watermain easement described above. Pursuant to notice of our appointment, the undersigned appeared in the office of the City Clerk in Room 100 *in the City Hall at 4:00 o'clock P. M. • on June 28th, 1956 and each qualified by taking and subscribing his oath of office as provided by Charter and entered upon the duties as such Commissioners. Thereafter, on the afternoon of June 28th, 1956 a survey and plat of .the proposed -wat-ermain easements was filed in the office of the City Clerk. We thereupon gave notice that such survey and plat had been filed and that we, as such Commissioners, would meet at -the-office of the City Clerk at 10:00 o'clock A. Tie on the loth day of July, 1556 and thence proceed to view the property -hereinbefore described and assess any damages occasioned by the condemning and taking of the easements described above, and that we would hear any evidence or proof offered by or in behalf of the- pa•rties interested in said lands, The aforesaid notice was published in the Rochester Post Bulletin, the official newspaper of said City on June 29th, 1956, more than ten days prior to the date set for said meeting. That at 10:00 o'clock A.M. on July loth, 1956 your Commissioners met' pursuant to said notice and then proceeded to view the premises and property described above and were available to hear any evidence or proof offered by interested parties. A discussion was held•with Mr. D; J. Thomas on or near the premises being condemned. After viewingthe premises and hearing evidence and proof offered we have assessed the damages occasioned by the taking of a permanent trunk line watermain easement and a temporary construction easement until December 31st, 1956 as follows: To D. J. Thomas and Cecil M. Thomas, husband and wife, who own as joint tenants the property through which the easements stre condemned and to the Northwestern National Bank who holds a First Mortgage an said land; For'the permanent trunk line watermain easement . . . . . . . $250.00 For the construction easement until December 31st, 1956 . . . . 0.00 Total . . . . . 300.00 The cost of this proceedings is: Theodore Franke . . . . . . . . . . . . . . . . $25.00 Lynn Duncans on . . . . . . . . . . . . . . . . 25.00 Maitland Little . . . . . . . . .. . . . . . . . 25.00 75.00 Dated at Rochester, Minnesota, this loth day of July, 1976. /s Theodore Franke /s Lynn Duncanson /s Maitland Little • Commissioners" Alderman Whiting introduced a resolution ratifying the condemnation and taking of the easements on the above described property and that the report of the Commissioners made and filed as aforesaid and the assessment and award of damages therein set forth be confirmed and approved, which was read. Upon motion by Whiting, second by Moody, the resolution was adopted. Alderman Tingley stated that the Police Department had angated an add- itional employee as secretary and that they were in need of another desk. which they could purchase for $50,00, and also an additional chair. He made a verbal recommend- ation as.Chairman of the Police Committee, that they be authorized to purchase the said desk and chair. Upon motion by Schwanke, second by Whiting, the recommendation of the Police Committee was approved,. Record of Official Proceedings of the Common Council • of the City of Rochester, Minn., July 23, 1956 1 0 1 • 1 Alderman Schwanke stated that the Survey Committee had received a request for office equipment needed by the Planning Director, estimated to cost approximately $514- 50 (for 10 drawer file, cap and base; metal in -out basket and metal bookcase with glass windows). A motion Haas made by Whiting, second by Moody, the Survey Committee was authorized to Purchase what equipment they thought necessary for the Planning Director. All present voted in favor of the motion. Alderman Moody stated that he had receeved complaints about the dust and dirt caused by the traffic of trucks to and from.the Leitzen Plant on loth Street Northeast and recommended that they be ordered'to take care of this. Upon motion by Whiting, second by Schwanke, Mayor McQuillan and Alderman Moody were authorized and directed to contact Tor. Leitzen and try to abate this nuisance. All present voted in favor of the motion. Mr. Gus Glinke of 907 - 14th Avenue Southwest was present and asked the Council to consider extending the proposed sewer on loth Avenue Southwest from 9th Street to the Highway. He was informed to report to the City Engineer and tell him exactly what he wanted, and the Sewer Committee would then consider same.
