President Bach called the meeting to order at 2:00 o'clock P. M., the following members being present: President Bach, Aldermen Schroeder, Tingley, Whiting. Absent: Aldermen Anderson, Moody, Schwanke. Phe call of the special meeting was read and President Bach ordered the same placed on file, the said meeting being called for the purpose of considering methods of acquisition of property for the proposed new airport and any other business the said Common Council may deem proper. 'Mr. Fred Schuster and Mr. Don Swenson were present and a lengthy dis- cussion on the matter ensued. It was decided that Mr. Swenson and R. V. Ehrick, City Attorney, would consult further with State and Federal authorities on the question of acquisition and report back to the Council. Upon motion by Whiting, second by Tingley, the meeting was adjourned. City Clerk • 202 Record of Official Proceedings of the Common Council of the City. of Rochester, Minn., August 201 19 56 • Minutes of an adjourned regular meeting of -the Common Council of the Pity of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on August 20, 1956. President Bach called the meeting to order at 7:30 o'clock P. M., the following members being present: President Bach, Aldermen Anderson, Schroeder, Schwanke, Tingley, Whiting. *absent: Alderman Mood,T. Upon motion by Whiting, second by Schroeder, the minutes of the meeting of August 6, 1956 were approved. - President Bach stated this as being the time and'place set for the following hearings: • Second hearing on the construction of a section of NW -SW trunk line relief sewer from 14th Street N. W. to loth Street N..W. There was no one present wishing to be heard. Second hearing on'the construction of a sanitary sewer on 5th Avenue Northwest from llth Street Northwest to a point 176 feet south of the center line of 14th Street Northwest. There was no-one present wishing to be heard. Second hearing on surfacing of certain streets in Southwest Rochester with asphalt concrete as follows: - 6th Street S. W. from 7th to loth Avenue S. W.; 6th Street S. W. from Bdwy to 2nd Avenue S. W.; lot Avenue S. W. from 5th to 6th Street S. W.; 3rd Avenue S. W. from 6th Avenue to a block west of Sth Avenue S. _ W. ; 9th Avenue S. W. from 2nd to 4th Street S. W.; 9th Avenue S. W. from 7th to 9th Street S. W.; loth Avenue S. W. from 6th to 9th Street S. W.; 9th Avenue S. W. from 3rd to 7th Street S. W.; and - 8th Avenue S. W. from 9th to 9th Street S. W. Protests signed by 44 residents in that area stating that they were opposed to the plan to levy special assessments against their property and submitting that the streets are for the benefit of all the people and that resurfacing should be paid for out of general taxation were read. Drs. W. C. MacCarty, M. W. Anderson, B. E. Douglass, A. E. Hagedorn, Edward Litin and others were present in support of the said protests. Mr. George Leiferman was also present and stated that he felt the street program should. be completed. Alderman Schroeder stated that he thought the • policy lacked strength and continuity and recommended that the Council adopt an ordinance setting forth the provisions of the street improvement policy. After a len£thy discussion, President Bach declared a recess at 9:50 P. m. The meeting was called to order again at 9:10 p. m. Alderman Schroeder them made a motion that the City Attorney, In cooperation with. the City Engineer, be instructed to draft into an ordinance the policy now known as the "street improvement policy" as adopted on June 21, 1954, and that the policy be drafted complete in all its aspects in form of a. city ordinance. Alderman Whiting seconded the motion and upon roll call all voted in favor thereof. The construction of a sidewalk on the south side of loth Street N. E. from a. point east of North Broadway -to Silver Lake Drive was again discussed. C.A. Armstrong, City Engineer, stated that his department was preparing to start the project but because of the suggestions that the sidewalk line might be changed there was a temporary delay. Alderman Whiting, Chairman of the Street & Alley Committee, stated that a four foot eight inch boulevard was planned and he did not feel moving the sidewalk out a. foot as suggested, would.•a.chieve anything. Mr. Sy Hemshrot and,Mr. C. Berkins were present and recommended that the sidewalk line be moved. It was decided to proceed with the work as planned. Two preliminary plats to be known as "Southgate" and "Sonnenberg's Addition" were each presented and upon motion by Schwanke, second by Whiting, the same were referred to the City Engineer and the Public -Utility Department. President Bach stated this as -being the time and place set for receiving and opening bids 'for the following projects: Bids for construction of a sanitary sewer and water main in Plummer's Lane in Belmont Slopes Second Addition. The bids of Carlisle G. Fraser in the amount of $1, 402.80 for sanitary sewer and $698.30 for water main were each received and opened and upon motion by Whiting, second by Anderson, the same were referred to the Sewer and Water Committees and the City Engineer for tabulation and report. Bids for -grading, base construction and bituminous surfacing in Plummer' Lane in Belmont Slopes Second Addition. No bids were received. The Mayor's appointment of-Ilot-Klomstad to fill the existing vacancy in the Rochester Police Department was read and upon motion by Schwanke, second by Tingley, the appointment was approved. The Mayor s appointment of Mr. Dwight Thurber to the Board of Park Commissioners, from the First Ward, his term to expire on the second Monday in April, 1958 was read and upon motion by Schroeder, second by Whiting, the appointment was approved.. A letter signed by Mrs. John L. Becker of 516 - 10th Avenue Northeast stating that the water pipes leading to her property froze up every winter was read, and upon motion by Tingley, second by Whiting, the same was referred to the Water And Sewer Committee and the City Engineer. All voted in favor thereof, except Alderman Schroeder, uh o voted "no". A letter from Richard B. Ellingson, M D. requesting a reserved parking space near the First National Bank building was read- arid,upon motion by Schwanke, second by Whiting, the same was referred to the Police Committee and the Chief of Police. A letter signed by Glenn E. Miller requesting a loading zone adjacent to • his place of business at the corner of First Avenue and Third Street Southwest was 204 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., .August 20 ,. 1956 read and upon motion by Schwanke, second by Schroeder, the same was referred to the Police Committee and the Chief of Police. A letter from the State of Minnesota., Department of. Highways, re Laws Prohibiting Use of Trunk Highways for Local Celebrations was read and President Bach ordered the same placed on file. A letter from the State of Minnesota, Department of Health, enclosing a report on examination of water main in Plummer Lane in Belmont Slopes Second Addition was read and President Bach ordered the same placed on file. A letter from the League of Minnesota Municipalities addressed to Mayor Mcquillan thanking the Council for agreeing to act as host to a regional meeting of the League on Thursday, October 18th was read and President Bach ordered the same. placed on file. A letter from J. C. Haas, Secretary of the Firements Civil Service (Commission, certifying, the name- of Walter D. Roeder for appointment to the Fire Department was read and upon motion by Whiting, second by Anderson, Walter D. Roeder was appointed to the Fire Department. A letter signed by George P. Leiferman requesting permission to install the water and sewer mains, grading and finish grading in 161 and 161 Street N. E. both in Sonnenberg Addition, and also the short sewer line necessary in 17th Street N. E. all under the direct specifications and supervision of the City Engineer, was read and upon motion by Schwanke, second by Anderson, the same was referred to the Street & Alley, Sewer and Water Committees and the City Engineer. A letter signed by John deJ Pemberton, Jr., representing the Hutchinson - Sauer Company,.and a letter signed by George F. Pougiales, representing the developers of Elton Hills First Subdivision, requesting the Council to adopt regulations under the Northern Natural Gas Company's franchise requiring it to make i the extension of services within the time necessary to provide service to Elton Hills Subdivision and the Hutchinson Sauer Company, were each read. Upon motion by Schwanke, second by Schroeder, the same were referred to the Mayor and City Attorney and they were to report back to the Council at the first meeting in September. A request signed by Wm. F. McGoon for an addition to the rear of his ome at 1251 Seventh Avenue S. E., special permission being requested as the lot alls short of the required six thousand feet by Three hundred forty five square eet, was read together with a statement of acquiescent signed by two adjacent roperty owners. Upon motion by Anderson, second by Whiting, the same was referred to the Board of Zoning. The request of Mrs. A. L. Herda of 315 - 6th Street Southwest for per- ission to complete an apartment in their apartment building at 430 - 5th Street S. A le.tte'r.f rom Motorola Communications & Electronics Inc. addressed to Mayor McQuillan; ',submitting a proposal to provide the communications maintenance for the Police and Fire Departments of the City of Rochester was read and upon motion by Schwanke, second by Schroeder, the same was referred to the Mayor, tle Chief of Police and the Fire Chief. A petition for finish grading, base construction and bituminous surfac- on 17th Avenue Northeast between 3rd and 5th Street Northeast was read and upon motion by Whiting, second by Tingley, the same was referred to the Street & Alley Committee and the City Engineer. The three following resolutions adopted by the Public Utility Board were each read and the same were ordered placed on file; "Beit and it is hereby resolved by the Public Utility Board of the ',City of Rochester, Minnesota that the Common Council of the City be and is hereby requested to authorize the said Board to enter into a contract with the S. M. Supply Company of this City for the furnishing, in accordance with specifications on file, of — 60 Class 2, 65 ft. WRC Poles 150 Class 3, 35 ft. .WRC Poles 50 Class 3, 40 ft. WRC Poles at prices of $124- 75-$39- 50-$47.30 each respectively for said poles; the total contract price to be FIFTEEN THOUSAND .SIX HUNDRED TWENTY FIVE DOLLARS ($15,625.00) and the said S. M. Supply Company being one of the low responsible bidders." "Be it and it is hereby resolved by the Public Utility Board of the 'City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with UNIVERSAL MOTORS of this City for the furnishing, in accordance with specifications on f ile, of ONE (1)Ford F-500 13 ton platform truck, the contract price to be NINETEEN HUNDRED SEVENTY EIGHT DOLLARS AND FORTY CENTS ($1,979.40) and the said Universal Motors being the lowest responsible bidder." "Be it and it is hereby resolved by the Public Utility Board of the''City of Rochester, Minnesota. that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the BLACK & VEATCH of Kansas ',City, Missouri for making a survey and recommendations, together with estimates, on the future development of our water system; the maximum amount of the said contract to be TWO THOUSAND FIVE HUNDRED DOLLARS ( $2, 500.00) and the said Black & Veatch being the lowest responsible bidder." The City Engineers preliminary estimatesfor resurfacing of certain streets in Southwest Rochester with asphalt concrete in the amount of $58,553.95; preliminary estimate for construction of A section of the NW -SW trunk line relief sewer from 14th Street N. W. to 1.Oth Street N. W. in the amount of $20,017.10 and ?preliminary estimate for construction of a sanitary sewer on 5th Avenue N. W. from llth Street N. W; to a point 176 feet south of the center line of 14th Street N.W. in the amount of $3,4A.80 were each read and President Bach ordered the same placed on file. The recommendation of the Water Committee that the bid of Carlisle G. 0 206 Record of Official Proceedings of the Common Council of the City of Rochester, Minn.; August 20, 1956 Fraser for the construction of a water main in Plummers Lane in Belmont Slopes 2nd Addition be accepted at the unit prices bid and checks be returned to the un- successful bidders was read and upon motion by Whiting, second by Tingley, the recommendation was approved. The recommendation of the Sewer Committee that the bid of Carlisle G. Fraser for construction of a sanitary -sewer in Plummers Lane in' Belmont Slopes 2nd Addition be accepted at the unit prices bid and'checks be returned to the un- successful bidders was read and upon motion by Anderson, second by Schwanke, the recommendation was approved. The recommendation of the Street & Alley Committee that the City Engineer be authorized to perform the construction of grading, base construction and bitum- inous -surfacing in Plummers Lane in Belmont Slopes 2nd Addition on a day labor basis, as no bids were received:for this work when advertised, was read and upon motion by Anderson, second by Whiting, the recommendation was approved. The recommendation of the Street & Alley Committee that a curb and gutter be constructed on 12th Avenue Southeast from Sth Street S. E. to the south end of Armit's Replat was read and upon motion by Anderson, second by Tingley., the recommendation was approved. The recommendation of the Street & Alley Committee that-5th Street S. W. from Sth to 9th Avenue Southwest be resurfaced with asphalt concrete was read and upon motion by Whiting, second by Anderson, the recommendation was approved. The following recommendation was read but no a.ction.was taken: ('Honorable Mayor & Common Council Of the City of Rochester, Minnesota Gentlemen: In the matter of the request of August 6th by Libby, McNeil and Libby for permission to connect their sanitary sewer line to the City sewer system for limited use, the Sewer Committee recommends that the entire Council make a decision on the primary question of whether or not the City sewerage services will be made available to property not within the Corporate limits in this case. The entire plant of the Libby Company is outside the Corporate Limits. The long standing policy of the City has been not to serve property outside of the Corporate Limits with sewer or water. This Committee considers that it would not be advisable to take up the other details of the project until the first question is answered. The other points to be considered are: 1- The volume and characted of the sewage, and the ability of the City's facilities to treat it. 2- Sewerage Service charges. Respectfully, ( /s R. The report of the City Weighmaster for the month of July, 1956 showing fees -collected for loads weighed in the amount of $101.10 was read and President 1 • 1 • 1 1 Bach ordered the same placed on file. • Record of Official Proceedings of the Common Council • of the City of Rochester, Minn., August 20, 1956 2071 1 • • 1 1 • The report of the Clerk of Municipal Court for the week ending August 10, 1956 showing total criminal fines and costs collected $1,153.00 and civil fees received $9.20 was read and having been approved by the City Attorney, President Bach ordered the same placed on file. The applications of Mrs. Erma St. George for a license to sell soft drinks, cigarettes and "off sale" 3.2 beer were each read and upon motion by Anderson, second by Whiting, the licenses were granted. The applications of Robert Clark for a "on" and "off" sale 3.2 beer license were each read. A motion was made by Whiting, second by Anderson, that the licenses be '!denied. All voted in favor thereof, except Alderman Tingley, who voted "no". The application for transfer of "on sale" 3.2 beer license from Marian Hayes to Glenn Archer,_and applications of.Glenn Archer for a license to sell sof t drinks, cigarettes and "off sale" 3.2 beer were each read and upon motion by Anderson, second by Whiting, the transfer.and licenses were granted. Alderman Schroeder was excused at 10:30 P. m. The contract bonds of Carlisle G. Fraser in the amount of $2, 947. 25 wit the Federal Insurance Company as surety and C. M. Boutelle & Sons in the amounts of $2, 617. 50 and $1,62.5 with the West' ern Surety Company as surety were each read and the sane were referred,to the Mayor for his approval. _ The following resolutions were each introduced and read and President Bach declared th'e same duly passed and adopted: Resolution authorizing the Public Utility Board to enter into contract with Universal Motors. Upon motion by Anderson, second by Schwanke, resolution adopted. Resolution authorizing the Public Utility Board to enter into contract with the S. M. Supply Company. Upon motion by Schwanke, second by Tingley, resolution adopted. Resolution authorizing the Public Utility Board to enter into contract with Black & Veatch. Upon motion by Tingley, second by Whiting, resolution adopted. Resolution authorizing the Public Utility Board to pay salaries set by the Public Utility Board for certain employees by resolution adopted August 14, 1.956, a copy of which resolution marked exhibit "A" is attached hereto and made a part hereof. Upon motion by Tingley, second by Whiting, resolution adopted. Resolution ordering first hearing on resurfacing with asphalt concrete 5th Street Southwest from Sth to 9th Avenue Southwest.
