Minutes- of a regular meeting of the Common - Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on September 3, ',1956.
President Bach called the meeting to order at 2:00 P. M., the following
members being present: President Bach, Aldermen Moody, Schroeder, Schwanke,
Tingley, Whiting. Alderman Anderson arrived at 5:10 P. M.
Upon motion by Moody, second by Tingley, the minutes of the meetings of
August 16th and 'August 20th, 1956 were approved.
President Bach stated this as being the time and place set for the

following hearings:
First' hearing on the construction of a` curb and gutter on 12th Avenue
Southeast from gth Street Southeast to the south end of Armit's Replat. There was
no one present wishing to be heard.
First 'hearing on resurfacing with asphalt concrete, 5th Street Southwest
from Sth to 9th'Avenue Southwest. There was no one present wishing to be heard.
Hearing on the levying of special assessments for construction of a curb
and gutter on llth Avenue Northeast in Peck's 5th Addition. There was no one
present wishing to be heard.
Hearing on levying of special assessments for construction of a. curb and
gutter on 9th Avenue Northeast in Peck's 4th Addition. There was no one present
wishing to be heard.
Hearing on the levying of special assessments for construction of a
sanitary sewer, water main, storm sewer and service connections in Greenway Sub -
Division. There was no one present wishing to be heard.
Hearing on levying of Special assessments for grading and surfacing of
streets in Greenway Sub -Division. There was no one present wishing to be heard.
Hearing on levying of special assessments for construction of sanitary
sewer, water main and service connections in Jefferson Slopes 2nd Addition. There
was no one present wishing to be heard.

Hearing on levying of special assessments for grading and surfacing of
streets in Jefferson Slopes 2nd Addition. There was no one present wishing to be
.'Heard.
Hearing on the petition of Paul J. Kreter, G. M. Thompson and Oscar A.
Maass for vacation of the alleys in Block 18, 19, 22 and 23, Cummings Addition.
The re was no one ipresent wishing to be heard and no revised _pla,t.was presented.
Upon motion by Whiting, second by Moody, the hearing was continued until the.meetin�
of September 17, 19 56 at 7 : 30 P. m. All voted in favor of the motion.

Commencing at a point on the West line of Kutzky's Addition
to the City of Rochester, Minnesota 167 feet North of the center
line of Second Street Southwest for a place "of beginning, , and
running thence West parallel to said Second Street Southwest a
distance of 390.38 feet to the East Right-of-way line of .Trunk
Highway No. 52, running thence North along the East Right -Of -Way
line o_f said Trunk Highway No. '52 for a distance of 151.16 feet,
running thence East 389.5 feet ,to the West line of said Kutzky's
Addition, and running thence South along the West -line of said
Kutzky's Addition a distance of 151.16 feet to the place of
beginning, and being and lying within the SE4-SEI-Sec-3.4-Town-

The manager of Kennedy Cabins was present and inquired'if the papers had been
served on Mary Rinke and he was informed that they had been. A motion was then
made by Schroeder, second by Schwanke, instructing the City Attorney to prepare an
ordinance annexing the above two parcels of land.
President Bach stated this as being the time and place set for receiving
land opening bids for the following projects:
Bids for construction of a sanitary sewer on 5th Avenue Northwest from
llth Street Northwest to a point 176 feet south of the center line of 14th Street
Northwest. The bids of Carlisle G. Fraser in the amount of $3;872.30 and.Barbarossa
& Sons in the amount of $4,198.50 were each received and opened and upon motion by
Whiting, second by Moody, the same were referred to the -Sewer Committee and the
l City Engineer for tabulation and report.
Bids for construction of a section of the 'NW -SW Trunk line Relief Sewer
fro.m 14th Street to loth Street Northwest. The bids of Carlisle G. Fraser in the
amount of $22,954.60 and Barbarossa. & Sons in the amount of $24,440.00 were each
received. and opened and upon motion by Whiting, second by Tingley, the same were
referred to the Sewer Committee and the City -Engineer for tabulation and report.
Bids for surfacing of the following streets in Southwest Rochester with
asphalt concrete: 6th St. S.W. from 7th to loth Ave. S.W.; 6th St. S. W. from
Bdwy. to 2nd Ave. S.W.; 1st Ave. S.W. from 5th to 6th St. S.W.; 3rd St. S.W. from
6 th. Avenue to a block West of 8th Ave. S. W.; 9th Ave. S.W. from 2nd to 4th St.
S. W.; 9th Ave. S. W. from 7th to 9th St. S.W.; 10th Ave. S. W. from 6th to 8th
St. S. W.; Sth Ave. S.W. from 3rd to 7th St. S.W.; and ath Ave. S.W. from 8th to
9th St. S. W. The 'bid of Barton Contracting Company in the amount of $57,909.23
was received and opened and upon motion by Schroeder, second by Moody, the same
was referred to the Street & Alley Committee and the City Engineer for tabulation
and report.
A request was made that the Charter Commission be allowed to use the

Council Chambers for their annual meeting to be held on Monday evening,
September 10, 1956 at 7t30 P. m. Upo4 motion by Schroeder, second by Moody,
their request was granted.
A letter signed by R. W. Fleming, President of the Board of Directors
of the Rochester Mustang Hockey Association, Inc., asking for financial assistant
from the City of Rochester in.operating the hockey team was read. Mr. Fleming
was present and urged that the Council consider their request. A motion was made
by Schroeder, second by Tingley, referring the matter to the Finance Committee a.ne
the City Attorney, All present voted in favor thereof.
Mrs. A. L. Herda was present and inquired if anything had been done
about tier request to build an additional apartment in her building at 430-5th
Street S. W. The recommendation of .the Board of Zoning that the request of Mrs.
A. L. Herda to build an.additional apartment in her building at 430 - 5th Street
S. W. be granted was read and upon motion by Schroeder, second by Whiting, the
recommendation was accepted and a hearing on the matter was set for 7.;30 P. m.on
September 17, 1956.
A petition requesting enforcement of the nuisance and noise ordinance
in the vicinity of 4th Avenue and 4th Street Southeast, signed by 84 residents in
that area, was read. Upon motion by Schwanke, second by Tingley, the matter was
referred to the 'Mayor, the Chief, of Police, the Hire Chief, the City Attorney and
the Police Committee. All voted in favor of the motion.
A letter from the Rochester -Olmsted County Safety Council .requesting
that the Common 'Council make a donation for this worthy cause and also enclosing
a brief rundown on what is done with the money donated was read. A motion was
made by Schwanke', second by -Tingley, that the -City of Rochester contribute $300.00.
for use of the Rochester -Olmsted County .Safety Council. All voted in favor of
the motion.
A letter from the Chicago and North Western Railway System in respect to
the _crossing protection being provided at the crossings at Broadway, 1st Avenue
Northwest and 2nd Avenue Northwest with their tracks was read. Upon motion by
Schroeder, second by Moody, the same was referred to the. Mayor to take up the
matter with the Chicago and North Western Railway System. All voted in favor of
the motion.
A letter from the Northwestern National Bank of Rochester requesting two
twelve minute parking meters on the north side of their bank building was read and
President Bach referred the same to the Police Committee.
The.recommendation of the Police Committee that the requests of the
Northwestern National Bank and the First National Bank for 12 minute parking meters
adjacent to their businesses be approved and that the City Attorney draw the
necessary resolution to make this change effective, was read and upon motion by

Schwanke, second by Schroeder, the recommendation of the Police Committee was
approved. All voted in favor of the motion..
The claim of Mrs. Harry Pederson for injury sustained when she fell
on the sidewalk at the intersection of Broadway.and Center on Saturday, Sept. 1,
1956 was read and upon motion by.Schwanke, second by Tingley, the same was
referred to.the City Attorney and the City Engineer. All voted in favor of the
motion.
A letter from the Jefferson F.T.A. expressing thanks and appreciation
for the stop signs now placed at Third Avenue and 14th Street Northeast was read
and President Bach ordered the same placed on file.
Mrs. Lyle Hetzel was present and inquired if the Council was interested
in selling the buildings at the City Hog Farm. She stated that her husband was
interested in buying one or two of the small buildings. She' was referred to
Alderman Schwanke, Chairman of the Public Grounds Committee.
Mr. Stanley Drips, Secretary of the Parking and Traffic' Committee, again
requested that the Council purchase the Bailey property on the -southwest corner
of 1st Street and tad Avenue Southeast for parking purposes, which -had been
previously recommended. A.motion was made by Whiting, second by -Moody, that the
matter be discussed at an informal meeting to be held within the next 12. days and
that the President of the Council call the meeting. All v'ot•ed in favor thereof.
A letter from John deJ Pemberton, Jr., Attorney representing Hutchinson -
Sauer Company, requesting that they be permitted to withdraw their request for
adoption of regulations on the Northern Natural Gas Company's franchise, requiring
it to make extensi.on of its services into Northgate Residential Addition, was read
together with a letter from George F. Pougialea, Attorney representing Elton Hills
First Subdivision, stating that a satisfactory arrangement had been arrived at
between Northern Natural Gas Company and the owners of Elton Hills First Sub
Division. A motion was made by Whiting, second by Schroeder,* that.their requests
be withdrawn. All voted in favor of the motion.
The following letter from C. A. Armstrong re the plat of Southgate
Addition was read and. upon motion by Schroeder, second by Moody, the same was ref-
erred to the Street & Alley Committee and the Sewer Committee:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Re: Plat of So.u'th•gate
Gentlemen:
The proposed plat of Southgate submitted on August 20, has been
checked against the requirements of Ordinance No. 704.
It complies with the requirements of the ordinance on street
width, lot width, street grades and alignment of streets.
The area is not served by sanitary sewer at this time: Extension
of the trunk line sewer in loth Street Southeast from 5th Avenue
Southeast is necessary to serve the proposed lots. Development of
this addition is not feasible without sanitary sewerage, and the
proposed plat should not -be approved without also taking positive
steps -to extend the sanitary sewer system to serve it.
On matters not covered by the ordinance there are several
conflicts between the dimensions on the drawing and in the description

which, sould be clarif ied. I also note, that part of this addition
overlaps parts of previously platted lots, one of which has a
residence built on it*.
These practices are not prohibited by the platting ordinance,
but are known to often constitute violation of zoning requirements
and building setback lines, as well as confusion in abstracting
and title examination of the lots involved.

The following letter from the City Engineer re Plat of Sonnenberg's
Addition was read and upon motion by Schwanke, second by Schroeder, the plat was
returned to the surveyor to complete the plat plan as suggested by the City

Engineer:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Re: Plat of Sonnenberg's Addition
Gentlemen:
The proposed plat•of Sonnenberg's Addition submitted on August 20,
has'been checked against the requirements of Ordinance No. 704.
It complies with the requirements of the ordinance regarding
street widths, lot widths, streets grades, sanitary.sewer and
alignment of streets.
The Plat meets all the requirements of the ordinance, but
there are two omissions in the deimensioning that should be
shown, "the dimension of the west line of Lot 4-Block 1- is
omitted; and the central points of 50 foot radius circles are
not ,tied in to the street lines".
With these dimensions provided, the plat qualifies for
approval.

A letter from Raymond B. Vecellio, Public Examiner, transmitting a copy
of the report on examination of the financial affairs of the City of Rochester,
Olmsted County, covering the year ended March 31, 1955 was read and upon motion by
Moody, second by',Whiting, the report was ordered placed on file.
A letter from the State of Minnesota, Department of Health, stating that
an investigation had been made by their District No'. III office of a site which
is proposed for the location for a new municipal well, described as Lot No. 5 of
the Industrial Opportunities Incorporated Addition a.nd giveing recommentdations

for future wells was read and upon motion by Schwanke, second by Schroeder, the
.
same was referred to the Public Utility Board.
A letter from the State of Minnesota., Department of Taxation, regarding
application +155234 of the Mayo Association for a reduction in assessed valuation,
and stating that,'a hearing had been scheduled on same for Thursday, September 13,
1956 at 2:00 p. m. was read. A motion was made by Whiting, second by Schwanke,
that the letter be referred to the Mayor for study and If he feels it is necessary,
that he be authorized to appear. All voted in favor of the motion.
Letters; from the State of Minnesota, Department of Health, enclosing
report on.examinatiori of plans oii water main in 5th Avenue iv. W. from llth Street
to 14th Street and a. report on: -,plans for sanitary sewer on 3rd Avenue N. W. from

14th Street North a distance of 264 feet were each read and President Bach
ordered the same placed on file.
The following recommendation of the Parking and Traffic Committee was
read Ind upon motion by Schwanke, second by j,Ihiting, the same was referred to the
Council as a Committee of the whole:

Alderman at Large A. M. Bach, and
Members of the Common Council_
City of Rochester, Minnesota
Gentlemen:
- The Steering Committee on"Parking and Traffic respectfully
recommends that the City Attorney be instructed to prepare a

revision of Ordinance #805 establishing truck routes in the
City of Rochester and providing weight restrictions on City
streets.. The truck routes as set forth in Section 3 should be
'omitted and those established in the Street Classification
System as accepted by the City Council at a meeting on
March 19, 1956 should be substituted.
The Committee recommends that further revision of Ordinance
#805 be as follows:
1. In Section 1, Definitions: Truck -gross weight should
be 9000 pounds instead of 7000 pounds as specified.
2. In Section 2, garaging of vehicles should be permitted.
3. A provision requiring the proper signing of streets
similar to Section 4 of Ordinance 784 should be included.

The two following resolutions adopted by the Public Utility Board were
each read and President Bach ordered the same placed on file:
"Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester, Minnesota that the Common Council of the said
City be and is hereby requested to authorize the said Board to enter
into a contract with WESTIITGHOUSE ELECTRIC CORPORATION for the furnishing
in accordance with specifications on file No,., R1139, of
TIE LINE TAKE OFF STRUCTURE AND ASSOCIATED EQUIPMENT
SILVER LAKE PLANT SUBSTATION,
the total amount of the said contract to be TWENTY THREE THOUSAND ONE
HUNDRED DOLLARS ($23,100.00) and the said Westinghouse Electric
Corporation being the lowest responsible bidder-:."
"Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester, Minnesota that the Common Council of the said
City be and is hereby requested to authorize the said Board to enter
into a contract with the GENERAL ELECTRIC COMPANY for the furnishing,

in accordance with spebif ications on file No. R1138, of
MAIN CONTROL BOARD FOR SILVER LAKE SUBSTATION
the total amount of the said contract to be FOURTEEN THOUSAND TWO
HUNDRED NINETY FIVE DOLLARS ($14,295.00) andthe said General Electric
Company being the lowest responsible bidder."
The following resolution adopted by the Sinking Fund Commission was read
and upon motion'by Schroeder, second by Schwanke, the action of the Sinking Fund
Commission was approved:
"Be it resolved by -the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of $101,359.39 be and the said sum is hereby
appropriated from the Sinking Fund of the City of Rochester,
Minnesota, and ordered paid to the First National. Bank of Rochester,
Minnesota, for the purchase of $100,.000.00 2 7/9% U. S.. Treasury
- Notes - Maturing March 15, 1957 (Principal $100,000.00; Interest-
$1, 359.39) •.
Be it further resolved: That the said $100,000.00 2 7/9p U. S.
Treasury Notes be purchased for the Electric Department Depreciation
Reserve."

A letter signed by R. A. Miller, Secretary of Local 520 of the Rochester
Fire Department requesting a meeting with the Fire Committee to discuss wages and
also a letter from Robert D. Miller, President of the Rochester Police Benevolent
Association, requesting a. meeting with the Council to discuss wages, were each read
'Upon motion by Schroeder, second by Whiting, the same were referred to the Council
as a Committee of the Whole for consideration before the setting of the budget. All
voted in favor of the motion.
The following letter from. the Street & Alley Department Employees was
read together with 37 signatures of employees represented;
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
We the employees of the Street and Alley Department allege
that the Council of the City of Rochester has failed to .fairly
and justly compensate us, and by reason 'therein a grievance and
controversy exists between the employees whose signatures appear
below'and the City of Rochester.
In accordance with the provisions of Chapter 146, Section 7,
of the 1951 Sessions Laws of the State of Minnesota., we request
that an arbitration panel be appointed to conduct an .inquiry into
our personnel status and salaries.

A motion was made by Alderman Schroeder that the Council, as soon as possible,
appoint the requested man to the panel as designated by law. Alderman Moody
seconded the motion and all voted in favor thereof.
A, letter from James J. Macken, Jr., Chief of Police, recommending that
Marga.reth A. M. Hoch be appointed as Assistant General Stenographer in the Police
Department was read and upon motion by Schroeder, second by Schwanke, the
appointment was approved.
A letter signed by C. A. Armstrong, City Engineer, requesting approval
of the appointment of Robert Butlin as Engineering Aide II(rodman) at the base wage
of $3600 a year, 'effective September 1, 1956, was read and upon motion by -
Schroeder, second,by Moody, the appointment was approved.
A letter from Frank W. Everett, Fire Chief, requesting clarification
ofthe amount of time to be allowed off to members of the Rochester Fire Department
for the 11 legal holidays and also a letter signed by R. A. Miller, Secretary of
Local No. 520 of the Rochester Fire Department, inquiring as to how many days off
the Fire Department members were allowed, were each read and upon motion by
Schroeder, secand,by Whiting, the same were referred to the Fire Committee.
A letter signed by Frank W._Everett, Fire Chief, opposing entering
into a maintenance radio contract with the Motorola, Inc. was read and upon motion
by Schwanke, second by Tingley, the same was filed until a report on the matter
from the Fire Committee.
The recommendation of the Police Committee that the request of Richard
B. Ellingson, N. D., 402 First National Bank Building, for a reserved pwking space

on the street, be denied, was read and upon motion by Schwanke, second by
Schroeder, the recommendation was approved.
The recommendation of the Police Committee that parking be prohibited at
all times on the south side of 4th Street Northeast, from llth Avenue to 15th
Avenue and that the City Attorney draw the necessary resolution to make this
change effective, was read and upon motion by Schroeder, second by Moody the
recommendation was approved.
The recommendation of the Police Committee that parking be prohibited
for a distance of 30 feet, more or less, in front of the Employees entrance at
St. Maryls Hospital on Second Street S.W., and that the street be marked to desig-
crosswalk
nate a pedestrian/and that the City Attorney draw the necessary resolution to make
this change effective, was read and upon motion by Schroeder,'second by Moody,
the recommendation was approved.
The recommendation of the Police Committee that one officer be sent
to The'Traffic Institute of Northwestern University, to attend a course entitled:
Accident Investigation - Administration and Techniques, to be conducted from
October 22nd to November 9th, 1956 was read and upon motion by Schwanke, second
by Whiting, the recommendation was approved.
The recommendation cf the Police Committee and the Chief of Police that
no action be taken at this time on the request for stop signs at 7th Street and
llth Avenue Northeast, was read.' The recommendation further stated that this
location willbe re -studied and a recommendation will be made in the future based
on the completion of the construction of 7th.Street Northeast; if this construction
is not completed by the time when children will be using Silver Lake Park, some
type of sign will be erected to assist them in crossing safely. Upon motion by
Moody, second by Schroeder, the recommendation wab approved.
The recommendation of the Sewer Committee that the City advertise for
bids to be received September 17th, 1956 for"66 drums of Anhydrous Ferric Chloride
for use at the Sewage Treatment Plant, was read and upon motion by Tingley, second
by Moody, the recommendation was approved.
The recommendation of the Sewer Committee and the City Engineer that the
bid of Carlisle G. Fraset fbr the .construction of a sanitary sewer on 5th Avenue
Northwest, from llth Street Northwest to a Point.176 feet South of the Center line
of 14th Street Northwest be accepted at the unit prices bid and checks be returned
to the unsuccessful bidders was rea°d and upon motion by. Whiting, second bps Schroeder,
the recommendation was approved.
The recommendation of the Sewer Committee and the City Engineer that the
bid of Carlisle G. Fraser for the construction of a section of the NIT -SW Trunk Line
Relief Sewer from 14th Street N.W. to 10th Street N.W. be accepted at the unit
prices bid and checks be returned to the unsuccessful bidders, was read and upon
motion by Moody, second by Tingley, the recommendation was approved.

The recommendation of the Board of Zoning that the request of Daniel
M. Robbins, Architect for the Methodist Church, for a variance of the provisions
of the Zoning Ordinance by establishing building lines on 4th Street Southwest
and 5th Avenue Southwest at 14 feet respectively, be granted, was read and upon
motion by Tingley, second by Whiting the recommendation of the Board of Zoning
was accepted and a hearing was set on the said matter for September 17th, 1956
at 7:30 P. 1•1.
The recommendation of the Board of Zoning that the request of Wm. F.
Mc Goon for variance of the provisions of the Zoning Ordinance for permission
to build an addition on less than the required 6,000 feet, be granted, was read.
Upon motion by Tingley, second by Whiting, the recommendation was accepted and
a hearing' was set on' the said matter for September 17th, 1956 at 7:30' o' clock
P. M.
The recommendation of the Board of Zoning that the petition of Henry
` J. Giese, John Bielenberg and William Bielenberg to have the following described
property changed from a residential zone to a multiple dwelling zone, be granted,
was read:
Lot 2, Block 2, Bielenberg & Giese 3rd Addition

In re: Airport Commission's Recommendation Concerning Land Acquisition -
for ,the. New Rochester Public Airport.
Gentlemen:
The Airport Commission recommends the following procedure for the
acquisition of all lands and interest in land required for the new airport:
(1) That, the acquisition of all lands to be acquired in fee simple be
commenced immediately upon receipt of State and Federal site approval.
(2) That the appraisers heretofore retained be instructed to meet
jointly and discuss their separate valuations of the parcels of land under
consideration and agree, if possible, on a single appraisal for each parcel.
(3) That immediately upon receipt of final State and Federal site app-
roval, the City of Rochester through its Common Council and the City
Clerk advise the ownersof each parcel land of the appraised value of his
or her respective parcel and offer to purchase the same at that appraised
value for a period of lien (10) days.
(4) That upon the completion of the ten (10) days period, the Common
Council should institute condemnation proceedings to acquire the lands
of those owners who have not accepted the City's offer to buy.
(5) That necessary air easements be acquired through the same
procedure at such time as the exact nature and extent of such easements
are determined.

The application of John.& David Bach, d/b/a Bell Vending Company for a
license to sell cigarettes, was read, and upon motion by Moody, second by Whiting,
the license was granted.
The application for transfer of °On & Off Sale" 3.2 beer license from
Sig Aaal & Marcella Lynch to Marcella Lynch and Mary Lynch, and applications to -
cigarettes and soft drinks, were each read and upon motion by Tingley, second by
Moody, the transfer and licenses were granted.
The application of Marcella Lynch and Mary Lynch for a pool hall license
was read. Upon motion by Tingley, second by Moody, the license was granted.
The reports of- the Clerk of Municipal Court for the week ending August
17th, 1956 showing total Criminal Fines and Costs Collected $1,563.00 and Civil
Fees $10,40; for the week ending August 24th, 1956 showing total Criminal Fines
and Costs collected $1,993.65 and Civil Fees received $7.40 were each read, and
having been approved by the City Attorney, President Bach ordered the same placed
on file.
The report of the City Weighmaster for the month of August, 1956 showing
fees in the amount of $94.90 for loads weighed was read and President Bach ordered

showing fees collected for building permits issued $3, 909.00; of the Electrical
Inspector for electrical permits issued $292.00; of the Plumbing Inspector,for

The license bond of Hovland Sheet Metal, Inc,, in the amount of $1,000.00
with the Travelers Indemnity Company as surety was read and upon motion by
Schroeder, second by .Anderson, the bond was approved, the surety thereon accepted

A letter from Mrs. -1I. Wetenkamp commending the Council for the action
taken in regard to granting a liquor license at 4th Street and 3rd Avenue S. E.
was read and President Bach ordered the same placed on file.
President Bach declared. a recess at 5: 45 P. m.
President Bach called the meeting to order at 9:00 p. m. All members were
present except Alderman Moody.
Mayor McQuillan presented a pgogram which the A. F. L. of Union had given
to him, which they were going to use during their convention here in October, and
requested that the Council purchase space for an ad in the said program. Alderman
Schroeder moved that the City of Rochester accept the invitation to buy a one page
ad in the said program, not to exceed $100.00. Alderman Schwanke seconded the
motion and all voted in favor thereof.
Mayor McQuillan stated that he had received calls on the popcorn wagon
located at'the corner of Goodings Jewelry Store (2nd Street and Broadway) and as
it was not being used and looked unsightly he felt it should be removed. The Chief

of Police was instructed to contact the owner and have same removed.
Alderman Whiting introduced a resolution appointing appraisors for
viewing the premises and assessing da.mares for condemning.a.nd taking of easements
for construction of a trunk line relief sewer from lhth• Street Northwest to loth
Street Northwest, which was read. Upon motion by Schroeder, second by Anderson,
resolution adopted.
An Ordinance annexing certain parcels of land in Olmsted County,
Minnesota which'are completely surrounded by land presently within the territorial
limits of the City -of Rochester, Minnesota,, all in accordance with the provisions
of Section 413.143 of the Minnesota Statutes, as amended tKennedy Cabins and'
Schultz property), was given its first reading.
Upon motion by Schwanke, second by Tingley, and upon roll call and all
voting in favor ',thereof, the rules were suspended and the -ordinance was given its
second reading.
Upon motion by Tingley, second by Schroeder, and upon roll call and all
voting in favor thereof, the rules were suspended and the ord-inance was given
its third and final reading.
A motion -was made by Anderson, second by Schwanke, that the said
ordinance be adopted as read, and all voting in .fa.vor thereof, President Bach
declared the said ordinance duly passed and adopted.
C. A. Armstrong, City Engineer, stated that the resurfacing on Broadway
was now to a point where if the Council -desired to put- in• stop and go signs at
any of the intersections, such as 1st Street North, 2nd Street North or 6th Streets'
South, it should, be done at this time. After discussing the matter a motion was
made by Anderson, second by Whiting, that the duct work for traffic signals at
6th Street and Broadway be installed. Upon roll call and Alderman Anderson,
Schroeder, Schwanke and Whiting, voting in favor of the motion and Alderman
Tingley and President Bach voting "no". President Bach declared the motion
carried.
A motion was then made by Anderson, second by Tingley, that the necessary
steps betaken to confer with the State of Minnesota in regards to installing and
financing the traffic signals at 6th Street and South Broadway. Upon roll call all
voted in favor thereof.
Alderman Schroeder was excused at 10:20 P.M.
Discussion was held on the matter of employing a man as Engineering
Aid IV in the City Engineer's Department and setting the salary -for same. No
action was taken.
C. A. .Armstrong, City Engineer, presented a plan for °pa.rking by Parallel
pairs" to replace the angle parking on Broadway.. The new plan would be two 18 foot
Stalls, a 10 foot .interval, two more 18 foot stalls, another 10 foot interval and

so on. A motion was made by Alderman Schwanke that the City Engineer be instructed
to lay out the perking on Broadway in "parallel pairs". Alderman Whiting seconded
the motion and all voted in favor thereof.
A motion was made by Schwanke, second by Whiting, that an informal
meeting of the Council be held on September 11, 1956 at 7:30 to study the
reports submitted by the City Engineer on a summary and cost estimate of street
and sewer needs. All voted in favor of the motion.
Upon motion by Whiting, second by Schwanke, the meeting was adjourned
until 7:30 P. M. on September 17, 1956.-
