Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, on September 17, 1956.
President Bach called the meeting to order at 1: j0 P. m. , the followinj
members being present: President Bach, Aldermen Anderson, Moody, Schroeder,
Schwanke, Tingley, Whiting. Absent: None.
Upon motion by Anderson, second by Moody, the minutes of the meeting
of September 4,� 1956 were approved.
Mr. Phillip S. Davy of Davy Engineering Company of LaCrosse, QTisconsin,

was present in behalf of Mohn and Hodge Realtors. He presented a plan for means
to get water up, Geisinger Hill to speed development of a residential area in that
vicinity. He suggested a hillside reservoir with a booster pump to run water
into new mains in the new areas at pressure necessary to carry it to homes and
additional booster facilities as the area increases. A lengthy discussion was
held but no action was taken.
President Bach stated this as being the time and place set for the
following hearings:
Hea.r,ing on resurfacing of 5th Street Southwest from Sth to 9th Avenue
Southwest with asphalt concrete. There was no one present wishing to be heard.
Heading on the levying of special assessments for grading, base constr-
uction and bituminous surfacing in Lemke's Sub -Division. There was no one present
wishing to be heard.
Hearing on the levying of special assessments for construction of a
sanitary sewer and water main and service connections in Lemke's Sub -Division.
There was no one present wishing to be heard.
Hearing on the levying of special assessments for construction of a
sanitary sewer,!,water main and engineering casts in Harden's Replat of Outlot 1,
Stebbins Addition. There was no one present wishing to be heard.
Fearing on the levying of special assessments for grading, base constr-
bituminous

Hearing on the levying of special assessments for construction of a
sanitary sewer on 7th Street Northwest from a point 114 feet west of 13th Avenue
11. W. to 19th Avenue N. W. in Valleyhigh Addition. There was no one present
wishing to be heard.
Hearing on the levying of special assessments for grading, base constr-
uction and bituminous surfacing in Washington Sub -Division. There was no one
present wishing, to be heard.
Hearing on the levying of special assessments for construction of a
sanitary sewer, water main and service connections in Washington Sub -Division.
There was no one present wishing to be heard.

Hearing on the levying of special assessments for construction of a curb
and gutter on 13th Avenue Northwest from loth Street*Northwest to 14th Street
Northwest. There was no one present wishing to to heard.
Hearing 'on the levying of special assessments for construction of a curb
and gutter on Sth Avenue Northwest from 14ih Street Northwest to the south line of
Washington Sub -Division. There was no one present wishing to be heard.
Hearing on the levying of special assessments for grading, base constr-
uction and bituminous surfacing of the extension of 102 Street Southeast in front
of Lots 7, 8 and 9, Block 5 and Lots 4, 5 and 6, Block 6, Sla.nnyside Addition. There
was no one present wishing to be heard.

Hearing on the -proposed change of zoning of Lots 2 and 25, Block 2, Lots
2 and 25, Block 3 and approximately the north 460 feet of Block 4, all in' Bielenberg
& Giese Third Addition from a residential to a multiple dwelling zone. The
recommendation_ of the Board of Zoning that the petition be granted &as again read.
A protest,with 47 signatures, against the requested zoning change was also read.
Mr. Les Lien of 1416 - 152 Avenue Northwest was present and spoke in behalf of
other residents in that area and stated that they had purchased their homes with
the idea that this area was residential and asked if action on the petition could
not be postponed. After hearing those present a motion was made by Alderman Tingley
that this hearing be continued until 7:30 p. m. on October 1, 1956. Alderman
Whiting seconded the motion and all voted in favor thereof.
Hearing on the proposed change of zoning of Lots 16 and 17, Northgate
Addition from a residential zone to a commercial zone. The recommendation of the
Board of Zoning that the petition be granted was again read. A motion was made by
Alderman Schwanke, that the recommendation be approved and the City Attorney be
instructed to prepare an,ordinance making the requested change in zoning. Alderman
Moody seconded the motion and all voted in favor thereof.
Hearing on the proposed change of zoning of the South '60 feet, North
276 feet of Lot 22 and the West 82 feet of Lot 25, Auditor's Plat "Al' (420 - llth

Avenue Southeast) from a residential to a multiple dwelling zone. The recommenda-
tion of the Zoning Board that the pet"ition be rejected was read. Upon motion
by Schwanke, second by Anderson, the recommendation was approved. All voted in
favor of the motion. (There was no one present wishing to be heard.)
Hearing on the application of Daniel M. Robbin's, Architect for the
Methodist Church, for a variance of the provisions of the Zoning Ordinance by
establishing building lines on 4th Street and 5th Avenue Southwest at 14 feet
respectively. There was no one present wishing to be heard. The recommendation
of the Zoning Board that his application be granted was again read. A motion was
made by Alderman Schroeder that the request be granted and the City Attorney be
instructed to prepare a resolution making the requested change. Alderman Whiting

seconded the motion and all voted in favor thereof, except Alderman Schwanke, who
voted "no".
Hearing on the request of Wm. F. McGoon to vary the terms of the Zoningl,
Ordinance to permit him to'build an addition to his house on less than the
required square', footage, a,t 1251 - 7th Avenue Southeast. The recommendation of
the Zoning Board that his request be granted was again read. Mr. McGoon was
present and urged that the Council grant his request. A motion was made by
Alderman Whiting to grant a variance in the terms of the ordinance, due to a
hardship and th'e City Attorney be instructed to prepare a resolution making the
requested change. Alderman Schroeder se-conded the motion.- Upon roll call and
Aldermen Moody,', Schroeder, Whiting and President Bach voting in favor, of the
motion and Aldermen Anderson, Schwa.nke and Tingley voting "not', President Bach
declared the motion denied.
Hearing on the request of Mrs. A. L. Herda for a variance of the
provisions of the Zoning Ordinance for permission to have an additional apartment
in her building, at 430 - 5th Street Southwest. The recommendation of the Board
of Zoning that the request be granted was again read. Mrs. A. L. Herda was
present and urged that the Council grant this request, as it would not be adding
to the size of the building but would house one more family. A motion was made
by Alderman Whiting that the recommendation of the Zoning Board be approved and
the City -Attorney be instructed to prepare a resolution making the requested
change. Alderman Moody seconded the motion. Upon roll call and Aldermen Moody,
Schroeder, Whiting and President Bach voting in favor of the motion and Aldermen
Anderson, Schwanke a.ud Tingley voting "no", President Bach declared the motion
denied.
President Bach stated this as being the time and place set for receivini�
and opening bids for the following projects:
Bids for resurfacing 5th Street Southwest from gth to 9th Avenue
Southwest with asphalt concrete. The bid of Barton Contracting Company in the
amount of $2,227.45 was receeved and opened and upon motion by Schroeder, second
by Moody, the same was referred to the Street & Alley Committee and City Engineer
for tabulation and report.
Bids for furnishing anhydrous ferric chloride for use at the Sewage
Treatment Plant. The bid of Lyon Chemicals Inc. in the amount of $1, 903. 44 was
received and opened and upon motion by Whiting, second by Tingley, the same was
referred" to the Sewer Committee and City Engineer for tabulation and report.
Mr. Emrold.Thiem, President of the Charter Commission, was present and
informed the Council that the Charter Commission_ was now on an actite basis and
receive any suggestions. They were to meet every first and third Wednesday of the
month beginning 'October 3, 1956.

Mr. Emrold Thiem also stated that he noticed than the State. Highway
Department had changed their stop and go signs on South Broadway and 12th Street,
to include yield to right-of-way, and recommended that the Council consider similar
ones in certain places in the City to speed up traffic.
A petition that proper protection be given -to school children who must
cross the intersection of 14th Street and 14th Avenue Northeast, signed by 43
residents in that area, was read. Mr. Kenneth Carlson of 1409 - 14th Avenue N. E.
was present and asked that the Council give this petition serious consideration, as
they had previously presented a similar petition and no action was taken. After
hearing those present a motion was made by Alderman Whiting, second by Alderman

Tingley, referring the said petition to t-.he Police Committee and the Chief of
Police. All voted in favor of the motion.
A motion was then made by Alderman Whiting, that if. the Police Committee
find that a hazard exists at the intersection of 14th Street and 14th Avenue N. E.
that they be given authority to act immediately. Alderman Schroeder seconded the
motion and all voted in favor thereof.
A'letter signed by John Silliman and Joe Robbins, Chairman of the Kiwanis
Peanut Sales'Day, requesting permission to hold its annual peanut sales day on
September 24, 1956 was read and upon motion by Schwanke, second by Whiting, the
-requested permission was granted.
A letter from the Fraternal Order of Eagles stating that they were
planning to conduct their Bingo games for.the }all -winter season on Wednesday,
September 5, 1956 was read and.the same was ordered placed on file.
A letter signed by Charles Moore, Manager of the W. T. Grant Company,
requesting the use of two parking stalls in front of their store at 218 South
Broadway from the period of October 18th to the 25th for the use of displaying old
time cars relating to the early days of the 1900's in connection with their
Golden Anniversary was read and upon motion by Schroeder, second by Whiting, their
request was rejected. All voted in favor of the motion.
The following letter from the Library Board was read and upon motion by

Whiting, second by Moody, their request was granted:
HTO THE HONORABLE MAYOR AND COMMON COUNCIL:
The Library Board meeting in regular session on September 7th
passed the following resolution: -
We respectfully request the sum of $947.62 from the unspent
balance granted us as an emergency measure by the Council in
July.
The bonded roof and painting of the ceiling will cost $2205.98-,
instead of the $3430.00 requested by us. Painting and repairs
necessitated by installing the air conditioning amount to $947.62.
This sum was not budgeted by us last year because we could not
estimate what would be entailed.

A letter from the American Municipal Association extending an invitatio
to attend the 33rd annual American Municipal Congress in St. Louis, November 25
through 29, was read. A motion was made by Alderman Schwanke that any Alderman
or the Mayor be authorized to attend at City expense. Alderman Schroeder seconded
the motion and all voted in favor thereof.
A letter from Mr. W. A. Swenberg of Comfortrol Supply thanking the Polic
Department for the services rendered when they found the rear door to their
warehouse unlocked was read and President Bach ordered the same placed on file.
A letter addressed to Mayor Mcquillan from H. T. Fleischer, Asst. Chief
Engineer of Communications and Signals, of the Chicago IT. W. Railway System,
setting the date' of October 2, 1956 at 9:30 a.. m. , to meet in the Mayor's office
to discuss all -the matters concerning crossing protection and other considerations
was read and ordered placed on file.
A letter from Carl Slight, Secretary of the` American War Dads, requesting
permission to hold their annual tag day sale on the streets of Rochester on
October 13,' 1956, was read and upon motion by Anderson, second by Tingley, their
request was granted.
An invitation to the Common Council from the Sisters of the Third Order
Regular of Saint Francis of the Congregation of Our Lady of Lourdes to be present
at the dedication of the Domitilla Unit of St. Mary s Hospital in St. Mary' s
Auditorium at 2:30 on Sunday, September 30, 1956 was read and President Bach
ordered the same' placed on -file.
A letter from Tom 0. :Moore, Planning Director, expressing appreciation.
for the opportunity to attend the school on "City and Regional Planning" at
Massachusetts Institute of Technology was read and President Bach ordered the same
placed on file.
The following resolution adopted by -the Public Utility Board was read and
President Bach ordered the same placed on file:
"Befit and it is hereby resolved by the Public Utility Beard
of the City of Rochester, Minnesota that the Common Council of
the said City be and is hereby requested to authorize the said
Board 'Ito enter into a contract with CONTROL CORPORATION for the
furnishing, in accordance with specifications, of
SYSTEM IMETERING AND TIE LINE CONTROL EgUIPMENT
the total amount of the said contract to be Twenty Two Thousand
Five Hundred and Four Dollars ($22, 504.00)and the said Control
Corporation being the lowest responsible bidder."
The petition of Obert Mestad to have Lot 11, Block 3, Rochester Addition
(503-4th Avenue S. E. ). changed from a residential zone to a commercial zone was
read together with a statement of acquiescence .signed by 4 residents in that area.
Upon motion by Schroeder, second ,by Whiting, the same was referred to the Zoning
Board.
The following letter signed by C. A. Armstrong, City Engineer, was read

and upon motion by Schroeder, second by Whiting, the rate and appointment were
approved. All voted in favor thereof.
"Honorable'Mayor & Common Council
Of the City of Rochester, Minnesota
Gentlemen:
On May 25, 1956, appointement was made of Ernest C. Thorsen
as Acting Mechanic and Chief Operator at the Sewage Treatment Plant
at the annual rate of $4500 for a period of three months, with
provision for permanent appointment of the .JBull base rate of $4500
at the end of three months if his work was satisfactory.
Mr. Hogenson and myself find his work satisfactory and
recommend his appointment and full base salary effective
September 1, 1956.
We also recommend the appointment of Alvin Koch from Acting
Relief Operator to Relief Operator. This action does not require
any change in his salary rate.

Gentlemen:
We the employees of the Parking Lot, Engineer's Department,
allege that the council of the City of Rochester, Minnesota, has
failed to fairly and justly compensate us, and by reason therein
a grievance and controversy exists between the employees, whose
signatures appear below, and the City of Rochester.'
In accordance with the provisions of Chapter 146, Section 7,
of the 1951 sessions laws of the State of Minnesota, we request
that an a.rbritation panel be appointed to conduct an inquiry
into our salaries.

A motion was made by Whiting, second by Schwanke, instructing the City Attorney
to prepare a resolution appointing Mr. Jim Claydon as the panel member appointed
by the Council. All voted in favor of the motion.
A letter signed by Ed Davis of 1209 - 10th Avenue Southeast for per-

mission to maintain and operate a popcorn establishment on the boulevard of their
property was read. •A motion was made by Schwanke, second by Schroeder, that his
request be denied. All voted in favor of the motion.
A letter from.N. Carman for permission to use two public sound systems
in connection with the Cub -Scout Pushmobile races to be held on Sunday, Sept. 4,
1956 on the 4th Street Southwest hill was read and upon motioA by Schwanke, second
by Whiting, his request was granted. All voted in favor of the motion.
A petition for the vacation and abandonment of certain easements on, in,
under and adjacent to a private drive formerly known as Peck's Drive Northeast on
the Plat of Peck's Addition,*signed by Harold E. Whiting, Jessie Peck Whiting,

Tingley, the same was referred to the Street & Alley Committee, the City Engineer

A plat of land to be known as Henke's Replat was presented and upon
motion by Schroeder, second by Moody, the same was referred to the Street & Alley
Committee, the ',City Engineer .and the Planning Director. All voted in favor of
the motion.
A letter from the State of Minnesota, Department of Taxation, advising
the Council of a change of time for a hearing on the application of Mayo Assn.
(4155234) to October 2, 1956 at 2:00 P. M. was read and President Bach ordered the
same placed on file.
A letter- from the State of Minnesota, Department of Taxation, stating
that a hearing had been set for September 21, 1956 at 2:00 p. m. pro-posi.ng to
decrease the value of Class 3 property was read and President Bach ordered the
same placed on file.
The license bond of Ilot Klomstad i-n the amount of $500.00 with the
Western Sure.ty Company as surety was read and upon motion by Schroeder, second by
Tingley, the band was approved, the surety thereon accepted and the same was
ordered placed on file.
The Indemnity Bond for Lost order or warrant of Leo C. Anderson in the
amount of $62.50 was read and upon mot-io-n by Schroeder, second by Tingley, the
bond was approved.
The contract bonds of Doyle Conner in the amount of $1,211.96 with the
Western Surety Company as surety; Barton Contracting Company in the amount of
$57,909.23 with the General Casualty Company of America as surety; and Carlisle
G. Fraser i.n the -amount of $5,972.30 and $22,954.60 with the Federal Insurance
Company as surety were each read and the same were referred to the- Mayor.
The report of the City Treasurer for the month of August, 1956 was read
and President Bach ordered the same placed on file. -
The reports of the Clerk of Municipal Court for the week ending
August 31, 1956'showing total criminal fines and.costs collected $1,701.00 and
civil fees received 83. j0 and for the week ending September 7, 1956 showing total
criminal fines and costs collected $1,992.00 and civil fees received $4.45 were
each read and havtng been approved by the City Attorney, President Bach ordered
the same placed ;on file.
The recommendation of the Sewer Committee and the City Engineer that
the bid of Lyon Chemicals, Inc. of St. Paul, Minnesota for furnishing Anhydrous
Ferric Chloride for use at the Sewage Treatment Plant be accepted was read. Upon
motion by Schroeder, second by Tingley, the recommendation was approved.

The recommendation of the Street & Alley Committee and the City Engineer
that the bid of Barton Contracting Company for the resurfacing with asphaltic
concrete - 5th Street Southwest from 9th.to 9th Avenue Southwest be accepted at the
unit prices bid, and checks returned to the unsuccessful bidders was read. Upon
motion by Schroeder, second by Anderson, the recommendation was approved.
The recommendation of the Police Committee that parking be prohibited at
all times adjacent to Hawthorne -School, as follows: On the South side of 7th Street
between 4th and 5th Avenues Southeast; the west side of 5th Avenues, between 7 and
S Streets Southeas; North side of 9 Street, between4 and 5 Avenues Southeast and on
the East side of 4 Avenue from 9 Street to a point 100 'feet North, more or less.
It was further recommended that the City Attorney prepare a resolution to make this
change effective.- Upon motion by Schroeder, second by Whiting, the recommendation
was approved.
The recommendation of the Police Committee that parking be prohibited on
14th Street N. W., from Highway 52 North West -to the West City limits on both sides
of the street at all times was read. It was further recommended that the City
Attorney draw the necessary resolution to make this change effective. Upon motion
by Schwanke, second by Schroeder, the recommendation was approved.
The recommendation of the Water Committee that the former recommendation
denying any liability on the part of the City in connection with the freezing of
the water service at 516 - 10th Avenue P1.E. ,(i�Ir. Becker) be affirmed and'that Mr. -
Becker be notified was read: Upon motion by Tingley, second by. Schroeder, the
recommendation was approved.
The recommendation of the Public -Grounds Committee that the buildings at
the City Hog Farm be sold to Mr. Lyle Hetzel for the sum of $100.00, with. the,

exception of -the northern most building which will be sold to Tor. Phil DeWitt for
,
the sum of $10.00 was read. It was further recommended that the said buildings will
be sold with the provisions that the buyers clean up the grounds following the
removal of the said buildings. Upon motion by Schroeder, second by Tingley, the
recommendation was approved.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:

Fund, $5,247.65 from the Lighting Fund and $7.20 from the Parking Meter Fund and
ordering payment made to City of Rochester, Public Utilities. Upon motion by
Anderson, second by Moody, resolution adopted.
Resolution appropriating $791.41 from the General. Fund, $11.30 from the
Street & Alley Fund, $257.07 from the Fire Protection Fund, $360.04 from the Sewer
Fund and $353.4o from the Police Protection Fund and ordering payment made to
N. W. Bell Telephone Company, $693.36; Municipal Equipment Company, $327.46; R. L.
Polk Company, $490.00 and H. Dornack & Son, $252, 40. Upon motion by Moody,
second by Schroeder, resolution adopted._

Alderman Tingley stated that he felt Mr. Davy should be given some answer
on his plan for getting water up to Geisinger Hill to aid in developing a
residential areal. After discussing the matter a motion was made by Alderman
Tingley that the,matte-r be referred to the Public Utility Board and the Council
for. discussion at an informal meeting to be held at 7:30 p. m. on September 24,
1956. Alderman Schroeder seconded the motion and all voted in favor thereof.
Alderman Schwanke stated that he had received complaints on the condition
of the streets in Bielenberg & Giese Third Addition and felt something should be
done to take care of the situtation. A motion was made by Alderman Moody that
the matter be referred to the Street & Alley Committee, theCity Engineer and the
City Attorney to contact the owners to try and get some action. Alderman Schroeder
seconded the motion and all voted in'favor thereof.
President Bach inquired if anything had been done about the request of
the Hockey Association for financial aid for their program. Alderman Moody,
Chairman of the Finance Committee, stated that he would report at the next meeting.
Alderman Whiting moved that the Public Grounds Committee be authorized
to negotiate to purchase the Bailey property, located at the corner of 1st Street
and 2nd Avenue Southeast, the purchase price to be $50,000.00 and the Bailey estat�
to retain the house. President Bach declared the motion lost for want of a second.
Alderman Whiting requested that the Common Council take some action on
the recommendation of the Sewer Committee in regard to the request of Libby,P•4cNei1
and Libby for permission to connect their sanitary sewer line to the City sewer
oystem. A motion was made by Alderman Tingley, that the request of Libby, McNeil
& Libby be denied: and the City Clerk be instructed to notify them of the action
taken. Alderman Moody seconded the motion and all voted in favor thereof.
A motion was made by Alderman Anderson, second by Alderman Schroeder, that
each department be instructed to submit their budgets for the coming year not later
than October 1, 1956 and that they be requested to furnish a copy for each Alderman
and the Mayor. All voted in favor of the motion except Alderman Whiting, who voted

Alderman Anderson inquired as to ghat had been done to regard to the
peti.tion from the people in the vicinity bf 4th Street and 4th Avenue Southeast
protesting the noise and nuisance at the Sizer Grain Company.• Mayor McQuillan
stated -that Mr. Sizer had notified him that 'he -had purchased property outside of
the City and was moving his terminal there in the near future..
Upon motion by Schwanke, second by 'Schroeder, the meeting was adjourned.
