Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Halll, in said City, on November 19, 1956. President Bach called the meeting to order at 7:30 o'clock P. M., the following members being present: President Bach, Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley, Whiting. Upon motion by Moody, second by Tingley,, the minutes of the meetings of November 5th, 6th and 12th, 1956 were approved. Mr. Arthur Swan, Chairman of the Juvenile Problems Committee of the Olmsted County Community Council, was present and presented a proposed curfew ordinance. The 'proposed ordinance would regulate the presence of minors under the age of 18 years on public streets and alleys or in public places in the City of Rochester between the hours of 10: 30 p.m. and 5:00 a.m. ; define the duties of parents, guardians or others in care of minors; regulate the presence of minors _in places of amusement, entertainment or refreshment; and providing for arrest and penalties for violation thereof. Mr. Cakl J. Briese, Juvenile Officer of the Rochester Police; Department, was also present and urged that the Council study and consider.this ordinance. After hearing those present a motion was made by Alderman Schroeder, second by Alderman Whiting, referring the proposed Ordinance to the Police Committee and the City Attorney. All voted in favor of the motion. Mr. Fred Stocker was present and .stated that his car had been damaged on November 5, 1956 when his son was driving home from school on 5th Ave. N. W. He stated there were no signs where a resurfacing job was being done and that the car bounced over: the tracks and damaged the rear end of the car. He,presented a bill in the amount of $92.80. Upon motion by Whiting, second by Anderson, the claim was referred to the City Attorney, All voted in favor of the motion. Mr. Oscar Allerton of the Kruse Company presented preliminary plats of two pieces of property they were interested in bringing into the City. One-piece located west of the City (6th St. S.W.-17a and lgth Ave. S.W.) to be.'known as Folwell Heights Addition, and the other north of the City north of the Fullerton development and to be known as the Gillespie Plat. After viewing the preliminary sketch of the Gillespie Plat a motion was made by Schroeder, second by Tingley, referring the said plat to the Planning and Zoning Commission, the Street& Alley Committee and the City Engineer. All voted in favor of the motion. After viewing the proposed plat of Folwell Heights Addition and hearing the recommendation of the Planning & Zoning Commission that the plat be given preliminary approval as to street pattern and lot layout, a motion was made -by Schroeder, second by Schwanke, that the preliminary plat of Folwell Heights Additi All voted in favor of the motion. )n 0 Record of Official Proceedings of the Common Council. 304 of the City of Rochester, Minn., November 19, 1956 Mr. George Lemke was present in regard to the assessments on 4th Avenue Northwest in Lemke's Addition. He stated that.he objected to the Crenlo Company not bearing any of the cost of the grading assessment. `A motion was made by Moody, second -by Schwanke, that the matt.er be referred to*the Street & Alley Committee and the City Engineer to report at the next meeting. All voted in favor of the motion, President Bach stated this as being the time and place set for the (following hearings: Hearing on the proposed change of zoning of Lots 5 and 6. Block 2, in IGonerman & Thiel's Addition (corner of 101 Avenue and 12th Street Southeast) from Ja residential to a commercial zone. A protest against the change in zoning signed by 69 residents in that area was read. Mr. W. E.. Chamberlain of 1139 - 921 Avenue Southeast, representing residents in that area, was present and protested the requested change in zoning. Mr. Lawrence Lyke, Manager of the National Farm Loan Association, was present and showed a sketch of the building they proposed to con- struct on this lot. Members of the Jefferson-P.T.A. were also present and protested the requested change .of zoning. The recommendation of the Board of Zoning that the request signed by Prank and Susan Schartau, Robert G. and Beverly Gill and Charles and Leone Passe to have Lots 5 and 6, Block 2, Gonderman and Thiel's Addition changed from a residential -to a commercial zone be granted was again read. After further discussion on the matter a motion was made by Schwanke, second by Tingley, -that the recommendation of the Zoning Board be approved and the City Attorney was instructed to prepare an ordinance making the requested zoning change. Upon roll cell and -Alderman Schwanke, Tingley and President Bach voting in favor of the motion, and Aldermen Anderson, Moody, Schroeder and -Whiting voting "noel, President Bach declared the motion lost. Hearing on the proposed change of zoning of Lot 1, Block 4,' A. W. Kutzky's Addition (1302 - 1st Street S.W.) from a residential to a multiple dwelling zone. There - was no one present Yishing to be heard. The recommendation of the Board of Zoning that the petition of Louis and Caterina Tenti to have Lot 1, Block 4, of A. W. Kutzky's Addition changed from a residential to a multiple dwelling zone be granted was again read. A motion was made by Whiting, second by Schroeder, that the recommendation of the Board of Zoning be approved and the City Attorney was instructed to draw an ordinance making the requested zone change. All voted in favor of the motion. Hearing on the proposed change of -zoning of.the property located on 3rd venue Southeast from a residential to a multiple dwelling zone and described as follows: "Commencing at -a point of the Southeast corner of Auditor's Plat "A°; thence in a northerly direction along the east line of said property to a point 75 feet north of the Southeast. corner of Auditor's Plat "A"; thence west 209 feet; thence south 75 feet to a point located on the"south line of Auditor's Plat "A"; thence East 209 feet along the south line of Auditor's Plat "At' to place of beginning.'' 1 1 • 1 1 0 Record of Official Proceedings of the Common Council '30 5 of the City. of Rochester, Minn., November 19,_ 1956 There was no one'presjent wishing to be heard. The recommendation of the Board of Zoning that the request of Mrs. Blanche B. Graham to have the above described property changedlf rom a residential to a multiple dwelling zone be granted was again read. A motion was made by Whiting, second by Schwanke, that the recommend- ation -of the Zoning Board be approved and the City Attorney be instructed to prepare an ordinance making the requested zone change. All voted in favor of the motion. Secondli hearing on construction of a sanitary, sewer and water main on 13, Street Northwest''f rom Broadway to 2nd Avenue Northwest. Mr. Harvey Miller,of23 - • 13th Street Northwest, representing residents in,that area was present and stated that they had no objection to the improvement but did not:feel that they should be assessed for more than there share. After hearing those present a motion war. made by Alderman'Whiting that the hearing be.terminated and the matter taken ender advisement. Alderman Schwanke seconded the' motion and all voted in favor thereof. Second I j,hearing on grading, base construction and bituminous surfacing on 131Z Street Northwest from Broadway to 2nd Avenue Northwest. A motion was made by Alderman Whiting that the hearing be terminated and the matter taken under advisement. Alderman Schwanke seconded the motion and all voted in favor thereof. Hearing on the levying of special assessments for construction of a san- itary sewer on 5th Avenue Northwest from lit h Street Northwest to a point 176 feet south of the center line of loth Street Northwest. There was no one present wishing to be heard. Hearing on the Zevying of special assessments for construction of a section of the NW -SW trunk line relief sewer from 14th Street to loth Street N.W. Mr, and Mrs. George Keefe,_ owners of Lot 2, Block 9, Manley.'s Sub -division, were :present and inquired as to how the assessment had been figured. C. A. Armstrong, City Engineer, informed them that the assessment had been figured the same as the sewer on 5th Avenue N.W. on the petition for the vacation and abandonment of all easements • .Hearing for sewer, gas and water maines in Peck's Drive Northeast and an easement for snow removal adjacent.,to Peck's Drive N. E. There was no one present wishing to be heard. A letter from Carl F. Patterson,` d/b/a Vets Taxi Company, requesting that the Council transfer and assign his ten taxicabs, the licenses to operate them and any and all rights now owned by him under the franchise 4eretofore granted to him by the City of Rochester to Rocabco, Inc. was read togetie r with a statement signed by J. Scott Stevens Jr., President of Rocabo Inc. agreeing to abide by the rules and regulations of Ordinance" No. 921 as amended. Air. Al:Clemens, Attorney, Mr. J. Scott Stevens . Jr.* President of Rocabco, Inc. and Mr. Carl F. After hearing those present Alderman Schwanke moved that the matter of•the transfer of the Carl F. Peterson taxicab franchise to the Rocabco, Inc. be referred to the Police Committee for study and recommendation with instruction to the Police Committee to call a special meeting of the Common Council at such time as their recommend- ation is ready. Alderman Tingley seconded the motion and all voted in favor thereof, Mr. Vernon Clark, President of the Hillside P.T.A., was present and inquired if anything had been done about their petition for bus service west of Highway #52 in Highland Addition. The following recommendation of the Police Committee was then read: "Honorable Mayor and Common Council City of Rochester, Minnesota Gentlemen: On November 16, 1956 a meeting was held with represeatativet of the Rochester Bus Company reltative to a petition received by the Council from certain residents of the Highland Addition requesting bus service. It was agreed that some service be given to•this arsa on a trial basis, however, in order to give. this trial service it will be necessary for the Rochester Bus Company to curtail certain existing service. It is hereby recommended that the Rochester Bus Company be given Council support to the extent of a letter to the Minnesota Railroad & Warehouse Commission to support their request for changes in service. Anderson, Member " upon motion by Whiting, second by Schroeder, the` recommendation of the Police Committee was approved. All -voted in favor of the motion. The following letter' from the' Peoples Natural Gas Company was presented: "Honorable Mayor & City Council Rochester, Minnesota On May 23, 1956 we mailed for filing with you revised rate schedules for firm and interruptible gas service in the City of Rochester and re- quested your consideration and approval of such rate schedules. Since .that date you have carefully s-tud•ied this request and it has been fully reviewed by outside independent auditors. While the foregoing rates are considerably below the cost of service which we must have in order to continue to provide efficient service and adequately serve the expanding requirements of the City of Rochester, the revised rates will comply with the thoughts expressed by the Council in recent discussions, thereby permitting a prompt disposition of this matter. Accordingly, these revised rates are being filed and we respectf ully and urgently request that they be made effective at the'earliest possible date. Joe Robbins, District Manager, was present together with other representatives of the Peoples Natural Gas Company. He re -Viewed the rate for the Council and stated that the new rate proposed would amount to an over-all increase -of 5.9 percent. Afte discussing the matter, President Bach declared a short recess at 10:20 P.M. President Bach called the meeting to order again at 10:35 p. m. Alderman',Whiting then introduced an ordinance amending an ordinance enti:tled_, H-An Ordinance grant&ng to the Northern Natural Gas Company, a corporation, (operating 'as Peoples Natural Gas Division), its successors and assigns. a non- exclusive franchise to produce and. mahufac"ture and to use the streets, alleys, and other public places for the transmission,' distribution and sale of gas and prescrib- ing the terms and conditions of such fra`nch'ise(amending' Section 4 to include the above quoted rates)", was given its first reading. A motionliwas• then' made by Alderman" Whiting.that 'the rules be suspended and the ordinance givens its second reading. President Bach declared the motion lost for grant of a. second. Alderman'iSchroeder, Chairman of the Sewer Committee, informed the Council that he' felt Rochester could qualify for federal assistance for improvements at the Sewage -Disposal Plant and recommended that T61tz,'$ing & Day be employed to aid in preparing the application which had to'be filed by December 15tn with the Minnesota Water Pollution Control Commidsion; Alderman Whiting moved`that the Sewer Committef be instructed to•take whatever'steps n6cessary to file this application. Alderman Moody ;seconded the ',motion and ell voted in favor thereof. Resolution levying special assessments for the construction of a sanitary sewer and watermain and the engineering costs on l9th Avenue Northwest and 14th Street Northwest in Valleyh-igh Addition. Upon motion by Moody, second by Schroeder, resolution adopted. ` Resolution levying special assessments for the construction of a section • of the NW SW Trunk Line Relief Sewer from 14th Street Northwest to iOth Street Northwest. Upon motion by Schroeder, second by Schwanke, resolution adopted. Resolution levying special assessments for the construction of a sanitary sewer on 5th Avenue Northwest from llth Street Northwest to a point 1761 South of the Center line of 14th Street Northwest. Upon motion by Schwanke, second by Tingley, resolution adopted. Johnson salesman for school and office supplies was present and informed the Council that he did not feel that the school was following regulations in buying certain office supplies, mainly auditorium chairs. He stated that they sere not accepting the lowest bids and were buying most of their things from.just one company and felt some action should be taken to correct this matter. No actiox ,.-:as taken. Mayor, McQuillan presented a letter from the Peoples Power Association inviting the Council to join them in a luncheon at the Kahler Hotel on November 21, 19 56 - at 11 :1 5 a.m. Alderman Whiting brought up the matter of the Public Utility Department discontinuing paying the 10% gross income. tax to the general fund and stated that he felt some effort should be made to try and get them to pay -at least until the end of the present fiscal year. Upon motion by Schwanke, second by Tingley, Alderman Whiting was appointed to meet with the Public Utility Board and discuss the matter further; Upon motion by Schraeder, second by Whiting, the meeting was adjourned until 4: 30 P. m. on Tuesday, November 20, 1956. • Cit Clerk
