President Bach called the meeting to order at 7:30 o'clock P. M., the foll.owing members being present; President Bach, Aldermen Anderson, bloody, m Schroeder, Schwanke, Tingley, Whiting. Upon motion by Moody, second by Anderson, the minutes of the meetings of.r Cn November 29th, December 3rd and December 7th, 1956 were approved. co Mr. G.' E. Dreblow of the U. S. Army Reserves was present and stated that U Rochester had been tentatively picked as the site for a new trailing base fora new a training base for approximately 200 men. He further stated that they had to -Dick Icc, a site of from 3',to 5 acres within the city limits and requ.ested the cooperation .� Upon inquiry by Alderman Moody, the Council was informed that they were not request - of the Council and other City officials in obtaining this site. / A motion was made by Alderman Schroeder that the minutes of the Common Council indicate that they heard Mr. Dreblow and extend their welcome to the Army Reserve Unit to establish their unit in Rochester and pledge our full support to the establishment of this unit. Alderman Whiting seconded the motion -and all voted in favor thereof. Mr. Fred Stocker of 1519 - 7th Avenue Northwest was again present in regard to his claim in the amount of $92.00 for damages to his car, which he claimed were due' to negligence in not.placing signs while working on the street at the Railroad crossing and 5th Avenue Northwest. (The claim had been referred to the City Attorney and he recommended to the Common Council that the claim be denied and at the meeting of December 3, 1956 the Council took action denying his claim), Mr. Stocker stated that he felt he had a just claim and requested the Council to reconsider their action in denying his claim. No action was taken. The following letter was read: "The Honorable Mayor The Common Council of the City 'of Rochester Rochester, Minnesota Gentlemen: The Rochester Methodist Hospital has been making studies for a future new hospital. In connection with these studies, we desire to construct a twelve bed Constant Care Unit adjoining our building. The only available space is across the alley west of our building. This building will be a circle approximately seventy feet in diameter with ,twelve beds on the level of our second floor., and with a high storage space below. In order to join the bedroom space with one of our existing bedroom floors, 'it will be necessary to construct a bridge acros's the alley. Our c:ontra;ctors, 0. A. Stocke and Company, have submitted plans to the Building Inspector to obt.ain.a building permit. He could not grant this permit without prior approval by the Mayor and the Common Council for the construction of a bridge across the alley. The clearance under this bridge will be approximately sixteen feet leaving the alley open to all normal traffic. We will assume any expenses involved because of the bridge in changes to utilities in this alley. 0 3 3 8 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., . December 17, 19 56 • We therefor, petition the Mayor and Common Council to permit the construction of an enclosed bridge across the alley west of the _ Methodist Hospital Building. The Street and Alley Committee is aware of our petition. Respectfully submitted, /s Fred If. Schuster, Chairman Building and Grounds Committee Rochester Methodist Hospital" Mr. Fred W. Schuster was present and explained the use and need of the bridge and requested that the Council give -favorable action to their request. The recommend- ation of the Street & Alley Committee that a permit be granted to the Methodist Hospital to construct a. passage -way over the alley in Block 38,-Original Plat, to connect new addition to the Methodist Hospital, subject to the approval of the • Building Inspector, City Engineer and Utility Department, was then read. A motion was made by Alderman Tingley, second by Alderman Schroeder, that the recommendation of the Street & Alley Committee be approved. All voted in favor of the motion. A letter signed by Mrs. Henry G. Robinson, President of the Horace Mann P. T. A, that the Horace Mann P. T. A. wished to go on record as favoring that all non-commercial lots facing 12th Street S. E. Within the Horace Mann school area be left -residential, was read and President Bach ordered the same placed on file. The recommendation of the Zoning Board that the petition of 'Robert G. Bill, Chas. C. Passe and Frank 0. Schartau to have Lot 5, Block 3, Gorderman & Thiel's Addition changed from a residential to a commercial zone be granted was read. Mrs. Alton L. Page of 1215 - loth Avenue Southeast was present and stated that she was representing residents in that area and that they were opposed to the change of zoning of this lot. A protest signed by 13 residents in this area was also read. After hearing those present a motion was made by Alderman Schwarike, second by Alderman Tingley,- that the recommendation of the Board of Zoning.be accepted and a hearing be set for the first meeting in January, 1957 at 2:00 p. m. All voted in favor thereof. The following recommendation of the Zoning Board was read and upon motion by Alderman Schroeder, second by Alderman Schwanke, the recommendation was accepted • and the City Clerk was instmcted to have the petitions re -submitted: "To t-he Honorable Mayor and Members of the Common Council . City of Rochester, Minnesota Gentlemen: The Petition of Roy H. Nordbyy to have Lot 3, Block 5, Ireland's First Addition (1207-gth-Avenue S. E.) changed from a residential zone to a comze rcial 'zone was considered by the Board of Zoning at a meeting held on .December 13, 1956. - After hearing those present and discussing the matter, a motion was made and carried, recommending that the petitions of the people for and against the zoning be re -submitted with proper signatures and property descriptions and that Mr. Nordby be requested to re -submit his petition and that he have attached thereto a draw-ing showing the layout of his lot and the building to be remodeled, and the said Board would then submit their recommendation to the Council. Respectfully submitted Elfreda Reiter Secretary of Board of Zoning". • Record of Official Proceedings of the Common Council 339 • of the City of Rochester, Minn., D e c e mb e r 17 .19 56 Alderman Tingley then introduced an- Ordinance amending an Ordinance entitled, "An Ordinance for the purpose of promoting health, safety, order, con- venience and general welfare by reg.ulating the use of land, the location, size, use and height of buildings, and the arrangement of buildings on lots, and the density of population within the City of Rochester, Minnesota, all in accordance with a comprehensive plan-'�(changing Lots 5 and 6. Block 2, Gonerman and Thiel's Sub -Division to, a commercial zone) , which was given its first reading. A motion was made by Alderman Schwanke, second by Alderman Whiting, that the rules be suspended and the ordinance given its second reading., Upon roll call Alderman Anderson voted "no". • President Bach stated this as being the time and place set for the following hearings: First' hearing on the construction of a sanitary sewer in 13th Avenue Northwest from 2nd Avenue Northwest to a point approximately 300 feet west. There was no one present wishing to be heard. First; hearing on the construction of a curb and gutter on the south side of 1st Street Northwest between 13th and 16th Avenue Northwest. There was no one present wishing to be heard. Hearing on the proposed change of zoning of Lots 1 and 2 and the East ML Feet of Lot, 3, Block 93, Original Plat (703-3rd Avenue Southeast) from a residential zone to a multiple dwelling zone. There was no one present wishing to be heard. The recommendation of the Board of. Zoning that the petition to have Lots 1 and' 2 and the East 201 feet of Lot 3, Block 93, Original Plat be granted was again read. A motion was made by Alderman Schwanke that the recommendation I�of the Board of Zoning be approved and the City Attorney was instructed to draft an ordinance making the requested zone 'change. Alderman Schroeder seconded the motion and all voted in favor thereof. The Mayor's appointment of Mr. Robert B. Morris of 9.08 - 18th Avenue Northeast to the Parking and Traffic Committee in the capacity of advisor to the • committee, his ,term of office to be until the 2nd Monday of April, 1957, was read and upon motion by Schwanke, second by Schroeder, the appointment was approved. All voted in favor thereof. A letter from Mrs. T. R. Lindquist of 1201 Silver Lake Drive, addressed to Alderman Tingley, recommending the removal of the present type of stop signs and the installation of hand operated signal .lights at the corner of 3rd Avenue and 14th Street Northeast was read. A motion was made by Schroeder, second by Whiting, referring the request to the Police Committee and •the Chief of Police. All voted in favor of the motion. A letter from A. An announc'ement from the League of Minnesota Municipalities of a one -day l institute to be held' on' Saturday, January 12, 1957 for Mayors and Councilmen was read. A motion was'made by Alderman Schroeder, second by Alderman Schwanke, that the Mayor and members of the Council be authorized to attend at City expense. All voted in favor thereof, except Alderman Whiting who voted "no". A petition signed by the Olmsted County Bank & Trust Company by E. J. Hand its Trust Officer, Guardian of the estate of Margaret Phillips, also known as Maggie Phillips, Incompetent, to have Lots 1 and 2, Block 25, Northern Addition changed from a residential zone to a commercial zone (1003 and 1007 North Broadway) was -read. A motion was made by Alderman Schwanke, second by Alderman Tingley, referring the petition" to the Board of Zoning. All voted in favor of the motion. A letter from the State of Minnesota, Department of Aeronautics, trans- mitting an order amending certificate of approval for an airport site at the City of Rochester, Minnesota, was read and upon motion by Schroeder, second'by Anderson, the same was referred to the Mayor. All voted in favor thereof. The recommendation of the Police Committee that a truck loading zone be established in front of the premises known as 11 - 4th Street Southeast and that the City Attorney be instructed to draw the necessary, resolution to make this change effective was read and upon motion by Schroeder, second by Tingley, the said recommendation was approved and the City Attorney was instructed to prepare the necessary resolution. All voted in favor of the motion. The recommendation of the Street & Alley Committee and City Engineer that the alleys in Blocks 16, 19, 22-and 23 in Cumming's Addition be vacated was read. A motion was made by Schroeder, second by Anderson, that action be deferred until the Council had a chance to view the plat. All voted in favor of the motion. The recommendation of -the Sewer'Committee that the accompanying proposal of Toltz, King,Dutal, Anderson and Associates, Inc. be accepted for preparation of plans for additional digesters at the Sewage Treatment Plant was read. 'A motion was made by Alderman Schwanke, second by Alderman Tingley, that the recommendation of the Sewer Committee be approved and the City Attorney be instructed to prepare a contract for the said services and the Mayor and City Clerk be authorized to execute same. All voted in favor of the motion. A petition signed by George Kerr, Attorney for Rocabco, Inc. requesting the Council to pass and adopt an ordinance incorporating all of the provisions of Ordinance No. 921 as amended by Ordinance No. 937 except that the owner of the franchise be identified throughout said ordinance as Rocabco, Inc., and that the trade name of the business be identified as VET'S BLUE AND WHITE CABS throughout - said ordinance wherever there is a reference to the trade name of the business, was read. All voted in favor of the motion. The report of the City Treasurer for the month of November, 1956 was read and President Bach ordered the same placed on file. The report of the City Weighmaster for the month of November, 1956 shooing fees collected for loads weighed in'the amount of $92.20 was read and President -Bach o1;rdered- the same placed on file. The reports of the Clerk of Municipal Court for the week ending December 7, 1956' showing total criminal fines and costs collected $1,950.50 and civil fees received $2.70 and for the week ending December 14, 1956 showing total criminal fines and costs collected $1,346.00 and civil fees received $11.40 were each read and having been approved by the City Attorney, President Bach ordered ` the same placed :on file. Upon motion by Anderson, second by Moody, resolution adopted. Resolution appropriating $3,000.74 from the General Fund and ordering payment made to :Continental Oil Company, $2,310.14; 'I. B. M., $425.00 and Rochester Post Bulletin, $;265.50. Upon motion by Moody, second by Schroeder, resolution adopted. Resolution appropriating $749.91 from the General Fund, $66.97 from the Street & Alley Fund, $66.30 from the Fire Protection Fund, 1$1,483.39 from, the Sewer Fund and $6,716.24 from the Lighting Fund and ordering payment made to the City of .Roches -ter, P. U. Upon motion by Schroeder, second by Schwanke, resolution adopted. Resolution appropriating $1,933.33 from the Park Improvement Fund and $96.40'from the Lighting Fund and ordering payment made to City of Rochester, P. R. Fund, $2,973.00. Upon motion by Tingley, second by Whiting, resolution adopted. W. Bell Telephone Company. Mr. Stanley Mohn was present and presented a preliminary.sketch of land which he wished to have annexed to the City, said land lying west of Highway 1#52 and north of Industrial Opportunities, Inc. and requested the Council to give preliminary approval to theproposed plat. A motion was made by Alderman Tingley that the plat as, submitted by Mr. Mohn be given preliminary approval and the same be referred to the Planning Commission. Alderman Schroeder seconded the motion and all voted in,f avor thereof, except Aldermen Whiting and Schwanke, who voted "no", _ Alderman Whiting introduced a resolution appropriating $667.67 from the General Fund and,. ordering payment made to L. L. Schroeder, which was read. Upon motion by Schroeder,, second by Anderson, resolution adopted. Alderman Moody introduced a resolution ordering a public hearing to con- sider the financing of.the City's part of the cost -of improving State Trunk Highway -No. 63 ((State Project No. 5510-18) (63-59) by assesse_ing benefited property for all or a portion of the City's part of the. cost of said assessment pursuant to Sections 429.011 to 429.111 of Minnesota Statutes, as amended, which cost is estimated by the Common Council to be $12,737'.07. the Council will consider the assessment of all or a, portion of the_ City's part of the cost of said improve- !i ment against alli property abutting on State Trunk Highway No. 63 (Broadway) betweer kxxxxxK 4th Street North and 6th Street South, which was read. A motion was made by Alderman Schroeder, second by Alderman Schwanke., that the saiff resolution be adopted as read ''and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. An Ordinance amending an Ordinance entitled, °An Ordinance for the purpose of promoting health, safety, orcer, covenience and general welfare by regulating the use of land, the location, size, use and height of buildings, and the arrangement of buildings on lots, and the density of population within the City of Roehester,_all in accordance with a comprehensive plan .(changing Lot 1, Block 4, Kutzky's Addition and a. part of the NEQ of_ the SEJ of Section 2, Township 106, Range 14 West to::, multiple_ dwelling zone) , was given its first reading. A motion was made by Alderman Schroeder, second by7Alderman Tingley, that the said ordinance be adopted as read'and all voting in favor thereof, President Bach declared.the said ordinance duly passed and adopted. A motion was made by Alderman Tingley that the City Attorney be instructed to draft an ordinance amending Ordinance No. 704 establishing minimum standards' for plats so as to provide that hereafter wherever feasible, streets shall be laid out on plats submitted for Council approval on the rectangular so called "grid" pattern. Alderman Schwanke seconded the motion and upon roll call all voted in favor thereof, except Aldermen Whiting and President Bach who voted "no". Upon motion by Tingley, second by Schwanke, $199.00 was appropriated from the General Fund and ordered paid to the Mayors Contingent Fund. All voted in Ifavor thereof. Mayor McQuillan reported that he. had checked into the size of the "Golden Deed"'book which the Exchange Club wished to display in the City Hall and found that it was only one book which .could not take up to much room and (recommended that it be'put in the display case. Mayor McQuillan stated that he had received a call from Mrs. Harry Peterson inquiring if anything had been done about her claim for injury which she had previsously filed. R. V. Ehrick, City Attorney, stated that he felt that the claim could be settled for approximately $100.00. '•Apmotion was made by Alderman Schroeder that the City Attorneybe instructed and authorized to settle this claim for $100.00. Alderman Moddy'seconded the motion and all voted in favor thereof.
