January 21, 1957 3.5 1 • 1 • 1 1 • Minutes of an adjourned regular meeting of the Common Council of the City.of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on January 21, 1957- President Bach called the meeting to order at 7:30 p. m., the following members being pr;e:sent: President Bach., Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley, Whiting. Absent: None. Upon motion by Moody, second by Schwanke, the minutes of the meeting of Janvey 7, 1957 were approved. A letter from Robert P. Gage, Clerk of the Board of Education, stating that the annual ,election for School District No. S would be held on Tuesday, March 12, 1957, same day as the City Charter Election and requesting that the City Clerk include the names of the ca.ndida.tes with the City offices was read and the same was ordered placed on file. A noti;'ce of claim of injury in the amount of $10,000:00 against the City of Rochester by IHuldah Jean Kalass, for injury sustained from a fall .in front of 802 Fourth Street Southwest was read and upon motion by Schroeder, second by Moody' the same was referred to the City Attorney. A letter from Stanley F. Drips, Manager of the Rochester Central Area Improvement Association, Inc. thanking the Council for the cooperation given him while Manager was read and President Bach ordered the same placed on file. M.D. A letter from Viktor 0. Wilson, City Health Officer, requesting approval of the appointment of Miss Helen Popovich, R.N. as a public health nurse,effective January 14, 195T, was read. A motion was:made by Alderman Schroeder, second by Alderman Anderson, that the appointment be approved. All voted in favor thereof. A letter from Viktor 0. Wilson, M.D. , City Health Officer, requesting approval of the appointment of Mr. Robert E. Overton as a replacement or, the garbage collection service, effective Wednesday, January 23, 1957,. was read. A motion was made by Alderman Schroeder, second by Alderman Anderson, that the appointment be approved. All voted in favor of the motion. A letter from Sam DeFosse of 306 - 12th Street Southeast stating that he would like to file an application for an "on sale" ligtkor license for such time as additional licenses might be issued was read and President Bach ordered thl same placed on file. The Mayor's appointment of Mr. Donald F. Perry as Civil Defense Director, to fill the unexpired term of Stanley F. Drips, effective February 1, 1957, was read. A motion ;was made by Alderman Tingley, second by Alderman Schwanke, that the appointment e approved. All voted in favor thereof. The petition of Edwin Albert Rundell and Virginia M. Rundell to have the following described property annexed to the City of Rochester, was read and upon motion by Alderman Schroeder, second by Alderman Schwanke, the same was referred to the Planning _Commission: IA h 6 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., January 21, 19 57 • "The Last One-half (E2) of the South 424.5 feet of. the East 5.72 acres of the South 36 113 acres of the Northeast One - quarter (NE4)of Section Three (3), Township One Hundred Six (106) North, Range Fourteen (14) palest. Less that part of the above described land which was annexed to the City of Rochester by Ordinance No. 934 adopted by the Common Council of the City of Rochester, Minnesota on August 20, 1956.I1 The following -letter signed by Mr.. Roy Ekberg was read: "Dear Mayor McQuillan and City Council: < I am writing you in regards to annexing into the City 126 acres which I bought from Albert Fenske. I have it surveyed and topoged and am ready to plat it. I left one of .the maps with your planning commissioner Tom Moore. I also have the Hanen Berger farm which is 240 acres joining the Fenske farm on the east, which we will develop after developing the Fenske farm. Yours truly, /s Roy Ekberg" Mr. Tom Moore, Planning Director, stated that he had received a tentative plat of this land and exulained that it was located north of Marvale Addition. A motion was then made by Alderman Schwanke, second by Alderman Schroeder, that the request be referred to the Planning Commission. All voted in favor of the motion. The following letter was read and President Bach.ordered the same placed .on file: "The Honorable Claude H. McQuillan, Mayor And the Common Council of the City of' Rochester Rochester, Minnesota Gentlemen: _ The Highways and Traf# is Committee of the Rochester Chamber of Commerce has had an opportunity to review with Mr. Clayton Swanson, the District Highway Engineer, current pian.ning for development of Highway #52 north of Second Street, Southwest and the development of the Beltline south of 'Second Street, Southwest, and east to the junction of U. S. #63. It is the unaerstanding of the Committee ` that engineering on the first of these.projects has been completed that the second will be complete in the near future and that copies of the plans have been made .ava.ilable .to the City Engineer, the Planning Director and the members of the Council for preliminary study. The Highways and Traffic Committee is a subcommittee of the Transportation Committee. Acting,on the recommendation of the sub- committee, the entire Transportation Committee strongly recommends that all city, officialsconcerned with planning of improvements on Highway #52 north complete their studies as rapidly as possible; and assuming no presently unforeseen difficulties develop, we urge that present plans be approved to permith the beginning of constr- uction early in the spring. All members of the Committee recognize that severe traffic problems will exist in northwest Rochester, particularly on Highway #52 and that theseimprovements must go forward as rapidly as possible. The Committee members are aware of differences of, opinion con- cerning the location of grade crossings on the imrroved,�widened Beltline south of Second Street,Southwest. After studying the major street system previously adopted by the Common Council, the plats recently submitted to the .Planning Commission of the property west of the Beltline, and.long range thinking of the Planning Commission, the Commission .respectfully recommends that this grade. crossing be at Sixth Street Southwest. Eugene Haylett, for the Highways & Traffic Sub- Committee -of they; Rochester Chamber of Commerce, urging the Countil not to adopt an ordinance specifically limiting .the future developments of Rochester to any one type of street pattern was read and President Bach ordered'the same, placed on f ile. Order No. 26369 iss zed by 114. J. Hoffman, Commissioner of Highways, ordering that the route designated as a detour for Trunk Highway No. 63 in the County of Olmsted, by Order No. 23 599 , was released December 5, 1956 and therefore said route will revert to its original status, was read and President Bach ordered the same: placed on file. A prot',est against the annexation of Russells Subdivision to the City of Rochester signed by two property owners and a, protest against the annexation of Terryville Subdivision to the City of Rochester 'signed by seven property owners, were each read. Upon motion by Schroeder, second by Schwa.nke, the same were referred to'the ,Planning Commission. A petition for construction of a sanitary sewer in 6th Street S,. W. fron a point 190 feet west of 15th Avenue S. W.-to 440 feet west of 15th Avenue S. W. was read and upon motion by Schroeder, second by Whiting, the same was referred to the Sewer. Commit',tee, and the- City Engineer. . Petitions signed by Paul. J. Kreter for construction of a storm sewer, sanitary sewer, water .main and. sewer and water service connections and grading and bituminous surfacing on g2 Avenue N. W. and 9th Avenue Northwest in Kreter!s Replat were each read and upon motion by Schroeder, second by Whiting, the same were referred to, the Sewer Committee, Water Committee, Street B.Alley Committee and the City Engineer. .Petitions signed by Joe -Gores, -Secretary of the Kruse Company for construction of 'a sanitary- sewer, watermain, se%,,er and rater service . connections and grading and bituminous surfacing on 6th Street Southwest, Folwell Lane and Folwell Court in, Folwell Heights Addition were each read and upon motion by Schroeder, seconld by Whiting, the same were referred to the Sewer Committee, Water Committee, Street & Alley -Committee and the City Engineer. The reports of the Clerk of Municipal Court for the week ending December 11, 1957 showing -total criminal fines and costs collected•$972:00 and civil fees received $g. 50 and for . the week ending December 18, 1957 shoeing -total criminal fines and costs collected $1,608.00 .and civil •fees.received-$3.15 were each read and having been approved by the City Attorney, President Bach declared the same placed on file. Resolution appropriating $34,300.90 from the General -Fund; $36,909.59 from the Sewer Fund; $3,104.94 from the Police Relief Fund; $10,249.49 from the Firemen's Relief Fund and ordering payment made to Public Health & I•lelfare Fund, $34,3004,90; Ross Browning, Treasurer Police.Relief Fund, $3,105.94; George Davis, Treasurer Firemen's Relief Fund, $10,249.49 and Sinking Fund of the City of (Rochester, $36,080.58. Resolution appropriating $2,091.37 from the Park Improvement Fund and ordering payment made to J - M Sales Company, $327.88; X. W. Bell Telephone Co., $415.19; Rochester Post Bulletin, $524.95 and Weiberg Paint Store, $812.36. Upon motion by Anderson, second by Moody, resolution adopted. Resolution appropriating $375.05 from the Sewer Fund and $3,900.54 from the Park Improvement Fund and ordering payment made to Mayo Civic Auditoriu4i Revolving Fund, $3,900.54 and Peoples TTetura.l Gas Company, $375.05. Upon motion by Moody, second;, by Schroeder, resolution adopted. • Resolution appropriating $857.15 from the Bridge Fund and ordering 'pay- ment made -to Gilbert H. MacMillan. Upon motion by Schroeder, second by Schwanke, resolution adopted. Resolution appropriating $300.00 from the General Fund and ordering payment made to Oscar C. Ronken. Upon motion by Schwanke, second by Tingley, resolution adopted. The recommendation of the Police Committee that a passenger loading zone be established on the west side of Lath Avenue Southwest, between nest Center Stree and First Street, Southwest, for a, distance of 50 feet, more or less, in front of the premises known as St. Johns Catholic Church, and that the City Attorney be instructed to draw the necessary resolution to make this changeeffective was read. • FC7-F�' Record of Official Proceedings of the Common Council of the City of Rochester, Minn., January 21,, 1957 • IA motion was made by Schroeder, second by Sch.wanke, that the recommendation be approved .and the City Attorney was instructed to prepare the necessary resolution to make this change effective. All voted in favor of the motion. The following recommendation of the Police Committee was read and upon motion by Schroeder, second by Schwanke, the same was -approved and the City Attorney was instructed to prepare the necessary resolution to make the changes as requested: "Hon. Mayor and Common Council City of Rochester, Minnesota Gentlemen: We, the undersigned Members of the Police Committee of the Common Cosancil do hereby recommend that: (a) The first parking space immediately East of'the Alley on the North side of First Street Southwest in front' of the premises known as the Curie Building,,.which is presently designated as a Yellow Cab Stand, be vacated as a Cab. Stand and be returned to a metered space. (b) The two parking spaces immediately West'of:the Alley or, the North side of First Street Southwest between First and 'Second Avenues, which &re presently in the 90 Minute metered zone, shall be vacated and re -designated as Yellow Cab Stands. The third parking space West of the Alley, which is presently designated as a Yellow Cab Sta.r_d, be vacated and re -designated as a. Passenger Loading Zone. (c) The two parking spaces on the East side of the street immediately North of the intersection of First Street Southwest and Second Avenue Southwest should be designated Yellow Cab Stands. One of these"spaces is presently so designated. (d) That the three meters on the East side of Street on. Second Avenue Southwest, between First Street Southwest and West Center Street, immediately North of the Passenger Loading. 'Zone in front of the West ent.ra.nce to the Kahler Hotel, be vacated and re -designated as HNo Parking - Passenger Loading Zones at all times". ` (e) That the first metered space on the South side of West Center'Street ifnze diately East of the North entrance to the Kahler Hotel be vacated and re -designated as "No Parking - 'Passenger Loading Zone at all tunes". (f) That the present "No Parking - Loading Zone" space immediately West of the Alley bn the South side'of West Center Street between First Avenue Southwest and Second Avenue South- west be vacated and returned t o' a metered space. (g) That the present "No Parking - Yellow Cab Stand", immediately North of the intersection of Second Avenue South- west and First Street Southwest, on the West.side of the street, be vacated and returned to metered space. (h) That the present "No Parking -.Loading Zone" in front of the premises previously known as Esther's Flower Shop, on the North side of First Street Southwest between Second Avenue_, and Third Avenue Southwest, be Vacated and be returned to metered space. ` Respectfully submitted, POLICE COMMITTEE /s Albert J. Anderson" Alderman Moody introduced a resolution authorizing and directing the Mayor and City Clerk to execute an agreement between the City of Rochester and Clarence W. Klee as guardian of the estate of Wayne H. Klee relative to an easement for transmission of electricity over the land therein described, which was read. Upon motion by Schroeder, second by Schwa.nke, the said resolution s adopted. 1 1 • 1 • 1 1 WIN Record of Official Proceedings of the Common Council • of the City of Rochester, Minn., January 21, 1957 371 I 1 r� L Cm Mr. Rex Gregor presented the Council members with copies of a report on the need for State Aid for Minnesota Junior Colleges and urged that the Council pass a resolution requesting the House of Representatives and Senate of the Minnesota State ,,Legislature to give favorable support to'a program of State Aid to the Minnesota Junior Colleges. He stated that Rochester Junior College was supported wholly by local taxation and felt that some action should be taken to try to get assistance and the reason that he came to the Council was that Rocheste was one of the f„ew cities where the governing body has any control over the school budget. He was ',requested to prepare anli present a resolution as proposed. President Bach stated this as being the time and place set for a contin- ueA hearing on the proposed change of zoning.of Lot 5, Block 3, Gonderman & Thiel' s Sub-Divilsion. About 55 residents in that part of Southeast Rochester were present at the meeting. Oscar C. Ronken, Attorney representing these Southeast residents, stated that these owners were very much opposed to any change of zoning) in this area and!'would use every means available to blaock any zone change. He further stated that the ordinance contained specific requirements that had not been complied with. Mayor McQuillan stated that he agreed with Mr. Ronken and said the ordinan''ce requires a majority of the. people in the area to, petition for a. zone change before any action can be taken. A motion was then made by Alderman Schroeder that the hearing be closed. Alderman Schwanke seconded the motion and all voted -in favor thereof. President Bach then declared a short recess. President Bach called the meeting to order after a 10 minute recess. A motion was then made by Alderman Schwanke that the zoningchange be allowed and that the City Attorney be instructed to draft an ordinance making the requested change of Lot 5, Block 3, Gonderman & Thiel�s Sub -Division to a commercial zone. Alderman Whiting!' seconded the motion and upon roll call and Alderman Anderson, Moody and Schroeder voting "no", and Aldermen Schwanke, Tingley, Whiting and President Bach voting in favor of the motion, President Bach declared the said motion carried. Alderman Tingley then introduced the following resolution which was read: "Be it, resolved that the Common Council of the City of Rochester Minnesota,_ does hereby request the House of Representatives and Senate of the Minnesota. State Legislature to give favorable support 'to a -program of State'Aid to the Minnesota Junior Colleges. In view of the fact that the local school district supporting a Junior College also provides a. Community College for the.areas `surrounding the district without outside financial assistance this request is donsidered_fa.ir and just. In order to move toward the principle of equitable distribution of the tax burden involved in higher education''in the State we request that the State Legislature authorize and appropriate money for this program to accredited public Junior Colleges. Be it further resolved tkat the City Clerk be instructed to file a, copy of this'resolution duly signed and executed with the Chairman of the House and Senate Education Committees. A motion was made by Alderman Schroeder, second by Alderman Tingley, that the above -resolution be adopted as read, and all voting in favor thereof, President Bach declared the said resolution duty passed and a.d.opted, 372. Record of Official Proceedings of the Common Council of the City of Rochester, Minn., January 21, 1957 Alderman Schwanke, chairmen of the Public Grounds Committee, stated. that the committee had looked into the matter of purchasing the property owned by Marine Sales & Service at 9 - 2nd Avenue !Southeast and the committee -felt that they should have the services of a competent appraisor so as to know the value of the.property. A motion was then made by Alderman Sxhwanke that the Public Grounds Committee be authorized to obtain an expert appraisal of the property at S - 2nd Avenue Southeast and report their finding -to the Common Council. Alderman Schroeder seconded the motion and all voted in favor thereof. _ Alderman Anderson, a member of the Charter Commission, stated that the Charter Commission was now becoming active and_they.would need some financial assistance to, take 'odre of stenographic services, supplies, etc. A motion was made by Alderman Tingley that the amount of $199.00 be -appropriated for use of the Charter Commission.
