Minnesota, held in the Council Chambers, in the City Hall in said City, on February 19, 1957- President Bach called the meeting to order at 7:30 o'clock p.m., the following members being present: President Bach, Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley, Whiting. Absent: None. Upon motion by Schroeder, second by Moody, the minutes of the meetings of February, 4th, 7th and Sth, 1957 were approved. President Bach stated this as being the time and place set for a hearing on the proposed change of zoning of Lots 1 and 2, Block 25, Northern Addition (1003 and 1007 North Broadway) and Lot 3, Block 25, Northern Addition (1011 North Broadway) from a residential to a commercial zone. A statement of acquiescence signed by five residents in that area was read. Mr. Emmet J. Hand, Trust Officer for the Olmsted County Bank & Trust Company, guardian of the estate of Margaret Phillips, owner of Lots I and 2, Mr. Paul Dornack the owner of Lot 3 and Mr. George Kerr, Attorney representing the petitioners, were present and each spoke urging the Council to give favorable. consideration to their'petition. After a short discussion on the matter President Bach called a short recess. After a five minute recess, President Bach called the meeting to order. A motion was made by Alderman Schroeder that the hearing be tabled for the present and that the Council proceed with other business. Alderman Schwanke seconded the motion and all voted In favor thereof. Mr. Stanley Mohn Presented a plat of the following described land to be known as Sunset Terrace: "The Easterly 1072 feet of the North half (Na) of the Southwest quarter (SWJ) and the easterly 1072 feet of the north half (Na) of the south half (S'*) of the Southwest quarter ( SWJ) , all in Section Twenty-seven (27), Township 107 North, Range 14 West of fifth principal meridian, excepting the easterly 100 feet of the northerly 531.3 feet thereof, also, the northerly 50 feet of that part of Valleyhigh Addition Lot Number 1 which lies east of Nineteenth Avenue N. W. " After viewing and discussing the plat a motion was made by Alderman Tingley, that the plat be referred to the City Engineer and the Planning Commission for their consideration and that the City Attorney be instructed to draft an ordinance annexing the land and prepare a resolution approving the said plat. Alderman Schwanke seconded the motion and all voted in favor thereof. A plat of land to be known as "Rumpus Addition" and described as follows waspresanted: "Lot 49 of Head & McMahon's Addition to Rochester, less the South 100.0 feet thereof and'the south 50.0 feet of vacated Sth Street Southwest (f.ormerly Minnesota Street) which lies north of said Block 49, and the East half of the south 424.5 feet of the East 5.72 acres of the south 36 113 acres of the Northeast quarter of Section 3, Township 106 North, Range 14 West." jMr. E. A. Rundell was present and urged that the Council approve this plat. Mr. LeRoy Prince of 2222 - 2nd Street S. W. was again present and inquired if some, decision had been reached on the petitions for and against annexation of land west of town in Highland Addition. R. V. Ehrick, City Attorney then reported that he had checked the petition submitted on January 7, 1957, which requested the annexation of (1) the West j of Block 6, Highland Addition (2) Block 5, Highland Addition (3) all of Outlots 1-and 2 Highland Addition, including) that portion of ,Outlot 1 known as Terryville Subdivision (4) Lots A and 1 through 22 in Hillcrest !Subdivision and found there was a total of 121 signatures with 60 petitioning f,or annexation. He further reiported four unrecorded contract for deed owners, which left a net result of 128 owners with 63 for annexation, there- fore, he reported that the petition was invalid as it did not have the required 50%- President 'Bach declared the matter closed as the petition was found invalid. A. notice of appeal. from the International Business Machines Corporation,. from the decision of the Building Inspector denying them a building permit on the grounds that the exterior walls of the Boiler House; Factory, and Administration Buildings do not meet the minimum requirements of Section 401 and 402 of Ordinance No. 599 (building code) and stating that this appeal to the Common Council from the decision of the Building Inspector As taken pursuant to Section 116 of said Ordinance No. 599, on the ground that.the mode of construction proposed is equally as good or better than the mode of construction contemplated by the Building Code, was read. A motion was made by Alderman Schroeder that the exception be granted and a permit be ',issued. Alderman Tingley seconded the motion and all voted in favor thereof. Mr. Jack Day , representing the Rochester Fire.Department, again inquired if any decision had been reached in the matter of time'off for the eleven holidays other city employees received.. Mayor McQuillan stated that he had met with the Fire Committee and representatives of the Fire Department and that the representa- tives of the Fire Department had agreed that they be given five 24 hr. holidays or that they receive time and one-half pay if they worked these holidays. After dis- cussing the matter a motion was made by Alderman Whiting that this matter be referred to the Council as a Committee of the whole for study. Alderman Moody y seconded the motion and upon roll call all voted in favor thereof, except Aldermen Schroeder and Tingley, who voted "no.u. ' Mr.. Charles Wallace, of the T. G. Evenson & Associates, Inc., was present and requested that the Council co-asider using their firm to act as fiscal agents in.handling the Permanent Improvement Revolving Fund bond issue-wh1ch is now under consideration. He cited numerous places where they had been the fiscal agent and= • II P_ 396 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., February 19. 1957 Ll said their fees would be 1% on the first $300,000.00; of 1% on the next $300,000.00 and 1/8 of 1% on anything above $600,000.00. A motion was then made by Alderman Schroeder that the offer of Mr. Wallace be given to the Finance for study and consideration. Committee, the Mayor, President of the Common Council and City Attorney` Alderman Moody seconded the motion and all voted' in favor thereof. Mr. Ernest Clark, of the firm of . Moody & Springsted, was also present and requested that the Council consider using them as bond consultants or fiscal agents in .connection with the Permanent Improvement Revolving Fund bond issue now j under consideration by the Council. He stated that they were handling the. recent $2,000,000 District No. 8 school bond issue and stated that their fees were also 1% on the first $300,000.00; of 1% on the next $300,000.00 and 1/8 of 1% on anything above $600.000.00. After hearing Mr. Clark. a motion was made by Alderman Schroeder that the offer of this firm be given to the Finance Committee, the Mayor, President of the Common Council and the City Attorney for study and consideration. lAlderman Schwanke seconded the motion and all voted in favor thereof. A letter addressed to Mayor McQuillan and signed by Harold B. Vasey, City Manager of Mankato, Minnesota, requesting that the City of Rochester consider. supporting legislation to establish control by municipalities over gasoline tax revenue allocated under State Constitutional Amendment No. 2 adopted in November, 1956 was read together with a copy of a resolution adopted by the Council of the City of Mankato in which they requested that the legislature provide by appropriate action for a distribution of said highway funds to the citi4s of.over.5.000 popul- ation for the exclusive use of highways and streets in each municipality without restrictions as to what streets are to be improved with said funds, but that the streets to be improved with said funds shall be left to the.discretion of the governing body of each municipality. -Mayor McQuillan stated that he.was very much in favor of passing such a resolution and felt the City should control their own streets. After a lengthy discussion on the matter, President Bach requested �Alderman`Schroeder to contact our State -Senator (Mr..Brudick) and Our State Representative (Mr. Franke) and arrange an informal meeting to discuss the tax { distribution amendment. A letter from the League of Minnesota Municipalities giving the dates for the municipal short courses for the various ,departments to be held at the lUniversity of Minnesota through its Center for Continuation Study was read and President Bach ordered the same placed on file. A letter from the State of Minnesota, Department of. Highways. trans - witting six copies of an agreement for traffic control signals at the .intersection l of T. H. #14 and T. H. #52 as& on 3rd Avenue S. E. and the intersection of T.H.#63 and 6th Street S. E. was read and President Bach ordered the same placed on file. 1 1 • 1 r� U 1 1 The claim of Mrs. L. B. The reports of the Public Examiner for the year ended March 31, 1956 for the financial affairs of the City of Rochester, the Police Relief Association- and the Firemen's Relief Association were each presented and.President Bach ordered the same placed on file. The recommendation of the Street & Alley Committee that the City advertise for bids to be opened March 19, 1957 for the season's supply of crushed rock, sand, gravel and pea gravel; ready mixed concrete; road oils and cutback asphalts; asphalt emulsion and plant mixed bituminous mixture for use in the City Engineer's Department was read and upon motion by Schroeder, second by Tingley, the recommendation was approved. A letter from the State of Minnesota, Department of Public Health & Welfare, granting approval for the following remodeling in the City Lockup was read: (1) Erection of steel partitions, floor to ceiling, in the center of corridors behind the main cells blocks on both first and second floors to prevent passage of prisoners and contraband from one side of the cell block to' the other. (2) Erection of security doors on the right and left ends of the corridor in front of the main cell blocks, on both the first and second floors,. to permit prisoners' use of the side cor- ridors without access to the front of the cell block, and to provide for visiting between prisoners and visitors, with maximum security for both. The question of the angle fo these grill partitions and security doors.at the front corners, ofi, the cell blocks is left to your discretion. They will be securely fastened on all sides, will extend from floor to ceiling and will be so constructed that contraband cannot be passed between prisoners and visitors. (3) Provision of a vision panel in the door to the juvenile detention dormitory. (4) The present food slots in the cell doors may be widened by removing a portion of the bar on each side of the present food slots, as discussed. Upon motion by Whiting, second by Schwanke, the same was approved. A letter from the State of Minnesota, Water Pollution Control Commission, advising that the application for Federal Grant for Sewage Treatment Works under Public Law 660 from the City of Rochester is being held in this office as requested by the Regional Office of the United States Public Health Service because the priority rating allocated to the project was not sufficiently high to.participate In the fundsavailable to Minnesota this fiscal year was read and Upon motion by Schroeder,'second by Moody, the same was referred to the Sewer Committee. A, petition for annexation of Ihnd signed by Andrew E. Towey to have a part of the Furlow farm, which abuts Hillcreat Addition (approximately 62.acres ) was read. Mr. Towey was present and stated that as long as Hillcreset Addition was not going to,be annexed this land did not abut the City so he would withdraw the petition. The following resolution adopted by the Public Utility Board was read and President Bach ordered the same placed on file "Be it and ii is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the -said Board to enter Into a contract with UNIVERSAL, MOTORS, INC., for the furnishing, in accordance with specifications on file, of - ONE (1) 1957 Model F. 600 Two Ton Truck with Utility Body; the total amount of the said contract to be EIGHT THOUSAND SEVENTY TWO DOLLARS AND SIXTY THREE CENTS ($9,072.63) and the said Universal Motors being the lowest responsible.bidder." A resolution adopted by the Public Utility Board on February 18, 1957 relative to water mains and water tower facilities hereafter constructed to service areas in theCity not now being serviced was read. The City Clerk was requested to make copies of the said resolution and mail to each Alderman for their study and consi derati on. The applications of Edgar and Geneva Nelson, Wilbur Terrell and Mrs. Richard Hyde for license to sell cigarettes were each read and upon motion by Schroeder, second by Moody, the licenses were granted. The applications of Edgar and Geneva Nelson, Wilbur Terrell and Mrs. Richard Hyde for license to sell soft drinks were each read and upon motion by Moody, second by Schroeder, the licenses were granted. The application of Joe Zemek for license to connect with sewers and drains was read and upon motion by Moody, second by Anderson, the license was granted.. The application of Donald F. Meindel for Journeyman Warm Air Heating, jVentilating and Air Conditioning Worker's license was read and upon motion by 'Anderson, second by Moody, the license was granted. The license bonds of Joseph J. Zemek in the amount of $1,000.00 with the Travelers Indemnity Company as surety and Elmer C. Johnson in the amount of $1,000,00 with the Aetna Casualty and Surety Company as surety were each read and upon motion by Moody, second by Schwanke, the bonds were approved, the surety (thereon accepted and the same were ordered placed on file. The contract bond of George P. •Leiferman in the amount of $15,630.00 with National Surety Corporation as surety was read and upon motion by Moody, second by Schwanke, the same was referred to the Mayor for his approval. The Public Library Statistical Report for the fiscal year ending December 31, 1956 was presented and President Bach ordered the same placed on file. Upon motion by Schroeder, secondby Schwanke, resolution adopted. Resolution authorizing City Clerk to advertise for bids for the purchase of 2 -2* ion dump trucks with one-way snow plows for use in the City Engineer's Department,' Upon motion by Schwanke, second by Tingley, resolution adopted. Resoltuion authorizing City Clerk to advertise for bids for the purchase of 1 - Street Sweeper for use in the City Engineer's Department. An informal meeting was set, to be held at Donaldson's, on Wednesday, February 27, 1957 at 7:30 P. R. V.I Shriek, City Attorney, m, stated that he had met with the Plumbing Inspector and that they suggested that the provision in'the Plumbing Ordinance which required a six month residence before qualifying for plumbing licenses be deleted and also other sections of' the ordinance -which pertained to this qualifi- cation be rewritten or deleted. A motion was made by Alderman Schroeder that the City Attorney be instructed to prepare an amendment to the plumbing ordinance to eliminate specifically the clause relating to the six month residence and other clauses deemed,proper by the City Attorney and Plumbing Inspector. Alderman Schwanke seconded the motion and all voted in favor thereof. The matter of the proposed change of zoning of the property located at 1003, 1007 and 1011 North Broadway from a residential to a commercial zone was again discussed. A motion was made by Alderman-Schwanke that the hearing on the proposed change of zoning be continued until the next meeting. Alderman Schroeder seconded the motion and all voted in favor thereof. Alderman Schwanke stated that Mr. Howard Smith, Secretary and Business Representative Of the Rochester Building and Construction Trades Council had presented a request to meet with the Council to discuss problems and ways and means of bringing about a solution to them but so far not meeting had been held and the letter had been read at the meeting on November 5, 1956. President Bach was requested to' inform him that the Council would meet informally with them at 7 : 30 P. m. on March 5, 1957.
