HomeMy WebLinkAbout03-13-19574 2 6 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 13, 19 57 • Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on March 13, 1957. President Bach called the meeting to order at 4:00 o'clock P. M., the following members being present: President Bach, Aldermen Moody, Schwanke,Tingley, Whiting. Absent: Aldermen Anderson and Schroeder. The Council then proceeded to the polling places in the various precincts of the City to inspect the register counters of the voting machines and to compare the number of votes shown by such voting machines with the returns submitted by the Judges at the Charter Election held on March 12, 1957. After making .the canvass of the voting machines the Council members returned to the City Hall at 7:30 P. m. and President Bach called the meeting to order, the following members being present: President Bach, Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley, Whiting._ Absent: None. Alderman Moody then introduced the following resolution which was read,* "Be it resolved'by the Common Council of the City of Rochester, Minnesota: That the following is a tabulated statement and list of the number of votes cast.for each person at the Charter Election held March 129 1957, in the City of Rochester, Minnesota, as determined by said Common Council on the canvass of the returns of said election made the 13th day of March, 1957, the said statement is hereby declared to show the result of said election. McQuillan is hereby declared' to be elected to the office of Mayor of said City, at the Charter Election held March 12, 1957, to hold office for two years and until his successor is elected and qualified: That Ross Browning is hereby declared to be elected to the office of City Treasurer of said City, at the Charter Election held March 12, 1957, to hold office for one year and until.his successor is elected and qualified; . That', Marvin W. Price is het eby declared to be elected to the office of City Assessor of said City, at the Charter Election held March 12,,1957, to hold office for two years and until his successor is elected and qualified; That'L. G. Morris is hereby declared to be elected to the office of Alderman of the Third Ward of said City, at the Charter Election held March,129 1951, to hold office for two years and until his successor is elected and qualified; That Fred Furlow is hereby declared to be elected to the' office of Constable of the First Ward 'of said City, at the Charter Election held March 12, 1957; to hold office for two years and until his successor is elected and qualified; That there is hereby declared to be a tie vote for the office of Constable for the Second Ward of said City; That Dr. Warren McGuckin is hereby declared to be elected to the office of Constable of the Third Ward of said City, at the Charter Election held March 32, 1957, to hold office for two years and until his successor is elected and qualified; That there is hereby declared to be a tie vote for the office of Justice of the Peae of the First Ward of said City." A motion was made by Alderm%n Anderson, second by Alderman Schroeder, that the said resolution be adopted as read,"and all voting in favor thereof, President T Bach declared the.said resolution duly passed and adopted. President Bach then stated this as being the time and place set for the consideration of the Commissioners$ report of assessments and award of damages in the proceedings 'to condemn land for municipal airport purposes. R. V. Ehrick then read the reportlfiled on`March let, 1957 by Theodore B. Franke, Andrew L. goehnen and Maitland B'. Little, the Commissioners, on the condemnation of certain lands and interests in land in Township 105 North, Range 14 West, Olmsted County, Minne- sota, for airport purposes. Gildner; Herman Bushman and Eleanora M. Bushman; Vincent S. Lilly; G. L., Gibbs and Elnora L. Gibbs, Edgar Jensen and Gertrude Jensen; Orlando E. Grove and Iona Grove; Albert P. Dahlke and Nora Dahlke and Demond Rowley and Evelyn Rowley the owners of the property being condemned. The City Attorney also read seven objections signed by Edgar Jensen, Gertrude C. Jensen, C. L. Gibbs, Elnora I. Gibbs; William S. LaPlan-te, Attorney for Albert. P. Dahlke, Nora Dahlke, Demond Rowley and Evelyn Rowley; John Me Sharp, Attorney for Herman Bushman and Eleanor M. Bushman; John M. Sharp, Attorney for Orlando E. Grove and Iona Grove; John M. Sharp, Attorney for -Joseph C. Gildner and Evelyne J. Gildner; John M. Sharp, Attorney for Vincent S. Lilly; John M. Sharp and • Manuel Stein, Attorneys for Vincent S. Lilly and John L. Von Peldt. - The Council then heard John M. Sharp, Attorney representing five of the land owners, who stated he did not feel that the Commissioners appointed were disinterested as required by law, that the report did not separately assess damages for buildings and land es required by Charter and.that the award and report was not fair and just compensation for the value of the land and -buildings. Mr. Manuel Stein, attorney representing John L. Von Peldt also objected to the report stating reasons similar to Attorney Sharp. Mr. Samuel Allen, Attorney - representing Edgar Jensen, Gertrude C. Jensen, C. L. Gibbs acid 31nora I. Gibbs objected to the damages awarded stating that they had had five expert appraisors to appraise their land. and did not feel the award was fair. Mr. William S. La Plante, Attorney representing Albert P. Dahlke, Nora Dahlke, Demond Rowley and Evelyn Rowley, also objected to the awards. Each of the Attorneys also requested that the Council meet with them and go over these awards which were submitted by the Commissioners. A motion was then made by Al-derman Schwanke that the hearing be closed and that the objections be taken under advisement until the meeting of March 18th, 1957. Alderman §chroeder seconded the motion and all voted in favor thereof. Mr. Stanley Mohn was again present and stated that he had made the re- visions on the plat of Sunset Terrace Addition as requested and would like to • have the same approved if possible. Mr. Co A. Armstrong, City Engineer stated that he had checked the plat and had penciled in a.few minor changes and recommended that if the Council so desired, the plat could be approved. An Ordinance entitled QAn Ordinance annexing to the -City of Rochester, Minnesota, a part of the Southwest Quarter of Section Twenty -;even, Township One Hundred Seven North, Range Pourteen West, in Olmsted,County, Minnesota, to be known and designated as Sunset Terraces was given its first reading. A .motion was then made by Aldermen Schwanke, that the said ordinance be adopted as read. Alderman Tingley seconded the motion and all voting in favor thereof, .President Bach declared the said ordinance duly passed and adopted. Alderman Whiting introduced a resolution accepting the plat of Sunset Terrace Addition which was read. A motion was made by Alderman.Tingley, second by Alderman Moody that the said.resolution be adopted. All voted in favor thereof .and President Bach declared the said resolution passed and adopted. A notice of claim of injury of Mrs. Mary L. Mears in the amount of $5,000,00 for injuries received from slipping and falling on the public sidewalk on the North side,: of 4th Street Southeast adjacent to Hentge's Glass Company, was read. Upon motion by Alderman Schroeder, second by Alderman-Schwanke, the same was referred to the City Attorney., _A letter signed by B. B. Comartin, Jr. stating that`a variance from the Zoning Ordinance which would allow him to build a garage on a piece of property which is 600 square feet short of requirements, said property being located in the middle of the 900iblock on 5th Street Southwest was read. Upon motion by Alderman Schroeder, second'. by Alderman Anderson the same was referred to the Zoning Board and the Building Inspector. The following letter was read and upon motion by Alderman Schroeder, second by Alderman.Schwanke, the same was ref erred to the Public Utility Board: "Common Council City Hall City of I Rochester, Minneso to Attention: Mr. A. Bach, President Gentlemeni We are in receipt of a copy of the Resolution approved on the 27th day of February, 1957 pertaining to a water tower to be located on the east side of ; lgth Avenue Northwest, approximately 1250 feet north of the present' city limits, together with the necessary trunk line to connect. said water tower with the city water system on lgth Avenue, Northwest. We have' reviewed the subject. matter contained in the Resolution, and find that the proposed improvement is entirely feasible and that it should be made in, connection with the proposed development -of the northwest area of the City. We know of no other programmed improvement with which this water tower and connecting main (trunk line) could be constructed. It is all a part of the development in this portion of the City. The application of Hovland Sheet Metal, Inc. for a_Hot Air Heating, Air Conditioning and Ventilating.Contractorls License was read. Upon motion by Schwanke second by Tingley, the license was granted. _ The application for. a transfer of "On Sales 3.2. beer license No..882 from Claude J. Bremer to Eldy Johnson & Edw. N. Hentges was read. Upon motion by Alderman Schroeder, second by Alderman Anderson, the transfer was granted.. The applications of Eldy Johnson and Edw, b'. Hentges for licensee to sell soft drinks, cigarettes and operate- a bowling alley (10 lanes) were each read. Upon motion by Alderman Schroeder, second by Alderman Anderson the licenses were granted. The recommendation of the Street & Alley Committee and the City Engineer that the bid of MorkrWitthauer Equipment .Company of Minneapolis, Minnesota for the furnishing of one 41) 5 to S ton Fergueon Boller,. with Torque Converter, for use in the City Engineer's Department be accepted at .the._ bid price of $4,900.00 and that the checks be returned to the unsuccessful bidders was read. Rochester, Minneso to for the furnishing of two 21 ton Ford Dump Trucks with H. D. The reports of the Clerk of Municipal Court for the week ended March lot, 1957 showing total criminal fines ,and costs collected, $2,218.97 and civil fees received, $4.25 and for the week ende$ March Sth, 1957 showing total criminal fines and costa .collected, $1,912,00 and civil fees received, $4.25 were each read and • having previously approved by the City Attorney, President Bach ordered the same placed on file. ,Alderman Schroeder stated that Mr. Bradley had contacted him in the matter of leasing the empty lot West of the Fire Hall. Upon motion by Alderman Schwanke, the matter was referred to the public grounds committee. All voted in favor thereof. Mr. iaFond of the Southgate Shopping Center was present and inquired if he could be given any date as to when sewer would be constructed in that vicinity. L� 1 1 He.was informed that the Council was presently working'on the bond issue which would include the said -sewer. Mayor:McOuillan stated that he had received a call requesting that either a stop and go signal or a stop sign be placed at the intersection of loth Street and Sth Avenue -Southwest where the fatal accident of Mr. E. Beunger took place. Upon motion by -Alderman- Schwanke, second by Alderman Schroeder, the same was referred to the Police Committee. All voted in favor thereof: President Bach referred the matter of a defect in the.sidewalk and drive- way in the Dr. Hargraves property on 4th Street Southwest to the City Engineer for inspection. Upon motion by Alderman Schroeder, -second by Alderman Schwanke, the meeting was adjourned until 7:30 o'clock P. M. on March lSth, 19576 Ci y Clerk 0
