Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall in
said City on March lgth, 1957•
President Bach called the.meeting to order at 7:30 o'clock P. M. the
following members being present: President Bach, Aldermen Anderson, Moody,
Schroeder, Schwanke, Tingley, Whiting. Absent: None.
Upon motion.by Moody, second by Tingley, the minutes of the meetings of
March 4th and March 13th, 1957 were approved.
President Bach -stated this as being the time and place set for receiving
and opening bids for the furnishing of the seasonls supply of crushed rock, sand,
gravel, pea gravel, ready -mixed concrete and plant mixed bituminous mixture for
use in the City Engineer's Department. -The following bids were received and open-
ed and upon motion by Alderman Schroeder, second by Alderman Tingley the same were
referred to the Street & Alley Committee and the City Engineer for tabulation and
report:

President Bach stated this as being the time and place set for receiving

A letter' from the, Board of Park Commissioners requesting permission to
purchase a tract ',of land 45.641 by 1000 in northeast Rochester, immediately adjoin -
of
ing a piece/currently owned Park property, which is for sale by,the State Deed
method the total --,cost of the land to be $53.25 was read. A plat showing the locat-
ion of the property was also presented. Upon motion by -Schroeder, second by Schwan
the matter was referred to the Public Grounds Committee.
Alderman Schwanke, Chairman of the Public Grounds Committee inquired when
the land was to.b'e purchased and if the said Committee was given authority to
purchase same. A motion was then made by Schroeder, second by Tingley that the Cit
purchase this tax free land for the Park Department, total cost of $53.25, and that
the Chairman of the Public Grounds Committee be authorized to execute the purchase.
All voted in favor thereof.
A' le tter, from Garnet Spring, Building Inspector, requesting permission forll
himself and the Plumbing Inspector to attend an Institute for Municipal Building
Inspectors to be held at the University of Minnesota Center for Continuation Study,
on April 15th and 16th, 1957, was read., Upon motion by Schwanke, second by
Schroeder, the request was granted. All voted in favor thereof.
A letter, ,from Ross Browning, City Treasurer, requesting permission to
attend the courses offered for Pinance Officers by the League of Minnesota Munici-
palities on March 27th and 28th, 195T was read. Upon motion by Schwanke, second
by Schroeder, the request was granted.
An announcement from the United States Conference of Mayors that the 1957
annual conference to be held at the Waldorf Astoria in New York City on September

9th thru llth, 1957 and urging that all interested officials make plans to attend
was read. A motion was -then made by Schroeder that the Mayor and any eligible
Council member be authorized to attend at City expense. Alderman Schwanke.seconded
the motion and upon roll call and Alderman Anderson and Schwanke voting in favor
thereof and Aldermen Moody, Schroeder, Tingley, Whiting and President Bach voting
"no", President Bach declared the motion not carried. -
A motion was then made by Alderman Tingley that the City:Clerk be instructed
to again present this communication from the tUnited States Conference of Mayors at
the first meeting ,of May, 1957. Alderman Whiting seconded the motion and all voted
in -favor thereof,
A letter signed by Overton Brooks, M.C., President of the National Rivers
and Harbors Congress addressed to Claude H. Mcquillan stating that the 44th Annual
National Convention of the National Rivers and Harbors Congress would be held on
May 16th .. lgth at the Mayflower Hotel at Washington, D. -C. was read. President
Bach ordered the -same placed on file.
The folLowing letter from Draper and Kramer, Inc. -was -read and upon motion
- by Whiting, second by Moody, the City Clerk was instructed to place the same in the
file relating to the construction of proposed Highway No. 52:

Gentlemen: 'RE: Additional opening in the
proposed Highway #52 as it
runs past Miracle -Mile,
Rochester, Minnesota.
On March 13, 1957, Mr. Rocheford, of our office, had -a discussion
with Mr. Swanson, the head of the local office of the Minnesota
State Highway Department at Rochester, Minnesota. At this time he
advised Mr. Swanson.that we, as representatives of Corrigan Proper-
ties, Inc., would insist upon an additional opening in the proposed
Highway as it runs past Miracle Mile, and said opening could be at
First Street Southwest, or possibly at a point 250 feet North of
First Street Southwest. By an opening I mean a break in the Island
so that prospective patrons -of Miracle Mile can turn left into the
Mile when they are driving South.
As you know, we have a very substantial financial interest in this
property and in our experience with Shopping Centers, we are sure
that without an additional opening in the Highway, that Miracle Mile,
Rochester can well become stagnant.
This letter is just to advise you of our feeling in this matter. I
trust than in view of what was said by the various Council Members
at the recent meeting with the Merdhants, and Mr. Rochesord, that
the City Council will not give clearance to the Highway Department
for this project without advising us prior to such approval,
If there -be further information which we can furnish you which will
strengthen or clarify our position,.would you kindly advise.

A letter from Ray Ranfranz, representative of the employees of the Street
and Alley Committee, requesting a meeting with the Common Council and City Engineer
before the wage setting of the 1957 - 1958 fiscal year was read and President Bach
ordered the same placed on file.

stating that Mr.'Gerald Bo Fitzgerald, Director of Recreation Training at the
University of Minnesota, had been selected by the Board of Directors to make a
survey of the recreational facilities and activities of this community and that he
planned to begin',th;s survey the -last week in March and hoped to have the report
available not later than July 15th was read and President Bach ordered the same
placed . on file. -
The recommendation of the Police Committee that the following cars,
Car #11, 1955 Ford, Serial No. P5PG 183121, and Car #21, 1955 Ford, Serial No.
P5PG 1831220 presently in service in the Police Department, be traded off, and
that bids be accepted for two new patrol care, was read. Upon motion by Schwanke,

second by Whiting, the recommendation was approved.
The following recommendation from the Street & Alley Committee was read
and upon motion by Schwanke, second by Whiting, the same was approved:
"Honorable Mayor & Common Oouncil
City 04 Rochester, Minnesota
Gentlemen:
Mr. i Frank -Eckert, Route 1, Cascade Township, has approached
this committee with an offer -to sell- a portion of his farm in Sec..
14 Cascade Township. The land offered is approximately, '73 acres
and is described as Othat part of E. * SWj and SEJ-MWJ Sec. 14 which
lies east of the township road." _
This land is situated just northwest of the Sewage Treatment
Plant and immediately west of the Rochester Sand & Gravel Company pit,
We recommend that this matter be referred to the Public Grounds'
Committse for further investigation. The land is well located and
would be suitable for extension of the Cityts•land - fill dump after
1961 when the present site is expected to be f illed.

to do their own construction of Public Improvements in Elton
Hills 2nd Addition was referred to this committee.
We recommend that (1) the Builders" Land Co. be permitted
to engage a registered Engineer to develops the plans and
specifications for the proposed work in accords ce with the
Specifications for Public Improvements of the City of Rochester,
and the; requirements of the City Engineer.
(2) Upon approval of said plans by the City Council, the
City contract with the`Buildersl Land Co. for the latter to construct
the improvements at its expense under the supervision of .the City
Engineer or some other Engineer appointed by the City Council.
The improvements will consist of street grading -and surfacing,
sanitary and storm sewers, service connections from sewer and water
main to boulevard,

President Bach declared a short recess at 9:45 P. m. President Bach
called the meeting to order at 10:00 p. m.
President Bach announced that this was the time set for further consider-
. _
ation of the Report of Commissioners on condemnation of certain lands and interests
in land in Town'shiip 105 North, Range 14 West, Olmsted County, Minnesota for
Airport purposes and the written objections thereto which had been filed with the
Ciiy Clerk. President Bach then requested R. V. Ehrick, City Attorney, to
sufimarize the commissioners report. The City Attorney thereupon summaried the
commissioners report describing briefly the various parcels of land and interests

and read the names of the persons interested in each parcel and the amount of the

assessment of damages for land, buildings and the various other interest in land

condemned.
Mayor 'McQuillan then stated that a member of the Airport Commission
he was aware of !the very thorough appraisal which had been done by the Commission -
era appointed by the Common Council, that the Commissioners were men of ability
and honesty and ',that he felt the awards were very fair and liberal and he felt
that the Common„Council should go along with the awards of the commissioners.
Alderman Whiting then stated that each of the Aldermen had now had an
opportunity to study and analyze the report of the Airport Condemnation Commission
era and that f ro;m his own investigation and examination of the report he felt that
the awards were 'fair and generous. Alderman Whiting further stated that he agreed
with the Mayor concerning the ability and integrity of the appraisors and recog-
nized that they 'had spent many days in arriving at the final results and awards
set' forth in their report, and after due consideration he was satisfied beyond
any doubt that the appraisors appointed by the Common Council were disinterested
as required by the Charter.
President Bach then asked if any other members of the Common Council
desired to be heard further in the consideration of the Commissioners report and
the written objections filed. There were no further remarks and Alderman Schwanke
then introduced a resolution confirming the report of the Commissioners and
awarding damages!, in the condemnation proceedings for the new municipal airport,
which was read by the City Attorney. A motion was then made by Alderman Tingley,
seconded by Alderman Whiting, that the said resolution be adopted as read.
President Bach then asked for discussion of the resolution and there being none,
President Bach then aked if any one in the audience wished to be heard. Mr. Samue]
P. Allen, Attorney representing Edgar Jensen, Gertrude C. Jensen, C. L..Gibbs and
Ehnora I. ®ibbs,'stated that he felt that the feeling of the Council was.disclosed
and so did not think that they should enlarge at this time, that they have the
right to appeal and shall take it. Then upon roll call and Aldermen Anderson,
Moody, Schwanke, Tingley, Whiting and President Bach voting in favor of the motion
to adopted the said resolution, President Bach declared the said resolution con-
firming the report of the Commissioners and awarding damages in the condemnation
proceedings for the new municipal airport duly passed and adopted.
A petition signed by Hayden -Miller Company (by 0. J. Allerton its
President and Joe Gores its secretary) and Arthur C. and Fannie B. Gillespie to
have that part of the South one --half (Sz) of the Northwest Qtuarter (NWJ) of Section
No. twenty-two ( 22), Township One hundred seven (107) North of Range No. fourteen
(14) West, which; lies east and north of Trunk Highway No. 52, formerly the St. Paull
Road, annexted to the City of Rochester was read together with a petition signed
by 0. J. Allerton, President and Joe Gores, Secretary of The Kruse Company,. to have
the property to be known as Rolling Greens Addition annexted to the City of
• I) Rochester.

abstract of title of the two above parcels of land were read. A motion was then
made by Alderman Schwanke that.the•plat of Rolling Greens be referred to the
Plannin& Commission and the City Engineer for recommendation and that the City
Attorney be instructed to draft an ordinance annexing the requested property to
the City and to prepare a resolution accepting the plat. President Bach declared
the motion lost for want of a.second. A motion was then made by Alderman Whiting,
seconded by Alderman Moody that the.property described in the two above petition s
be annexed and that the City Attorney be instructed to draft an ordinance annexing
the property. After further discussion a motion was made by Alderman Schwanke to
amend the above motion, by adding thereto, that'the plat of Rolling Greens be
referred to the Planning Commission and the City Engineer for recommendation.

Alderman Tingley seconded the motion and upon roll call and all/voting in favor
thereof, except Alderman Whiting who voted HnoH, President Bach declared the
amendment to the motion passed. President Bach then asked for a roll call on the
motion of Alderman Whiting as amended and upon roll call and all voting in favor
thereof, President Bach declared the motion carried.
Mayor McQuillan stated that he felt that some definite action should be
taken on a proposed ordinance defining a policy governing required dedications of -
certain portions of lands for public purposes,(schools, parks, playgrounds) before
any further land is annexed to the City. R. V. Ehrick, City Attorney, stated that
an ordinance defining land dedications and various assessment policies was being
prepared' and would be ready for the consideration of the Council at their next
meeting.
An Ordinance annexing to the City of Rochester, Minnesota, parts of the
Northwest ono -quarter (NWJ) and the Northeast one -quarter (NEJ), Section Twenty-

construction. Alderman Whiting moved that Section 2 of the.proposed ordinance be
amended so as to•read in its entirety as follows: Section 2. That present and
future onwers of the -area annexed by this Ordinance are hereby notified that in
addition to the usual assessments, it is the intention of the Common Council to
assess against benefited property all or a portion of the cost of any storm sewer,
water tower and trunk line sanitary sewer construction hereafter undertaken to
serve the area annexed. Alderman Moody seconded.the motion and all voted in favor
thereof.
A motion -was made by; Alderman-Schwanke requesting the City Clerk' to'
notify the Rochester Airport Commission and the Mayo Association of the awards for

damages in the gIondemnation proceedings for the new municipal airport and to
notify the Rochester Airport Commission and the Mayo Association that they are

Alderman Whiting seconded the motion and all voted in favor thereof.
