City of Rochester, Minnesota, held in the Council Chambers in the -City Hall in said City, on March 25th, 1957. President Bach called the meeting to order -at 7:30 o'clock P..M., the following members being present: President Bach, Aldermen Anderson, Moody,. Schroeder, Schwanke, Tingley, Whiting.- Absent: None. The resignation of J. C. Haas -from the Firemen's Civil Service Commission effective March 31st, 1957 was -read.. Upon motion by Alderman Schroeder, second by -Alderman Whiting, the resignation was accepted. The. resignation of L. G.. Schroeder as Justice of the Peace of the Second • Ward, effective April 1st, 1957 was read. Upon motion by Tingley, second by Anderson, the resignation.was accepted. A letter from Marvin W: Price, City Assessor, stating that the personal property, class two, household assessment procedure would be essentially the same for the year 1957 as for the year 1956 and requesting permission to employ several deputies to assist -in canvassing the city, the date of employment to be April let, 1957 was read. Upon motion by Alderman Whiting, second by Alderman Schwanke, this request was granted. The following recommendation signed by Mayor Claude H. McQuillan and Alderman Schroeder was read and upon motion by Whiting, second by Moody, the same was approved: "To the Honorable Common Council: The undersigned special committee recommends that the City Council receive bids on the printing of 10,000 copies of a City of Rochester Report to the People for the fiscal year ending March 31, 1957. The committee recommends that the bids be on all printing and on photograph development and engraving work in the publication of 50 pictures more or less, and also on provision for distribution of the Report to all homes in the City of Rochester. Bids should be based on publication of a 24-page tabloid size report of pages approximately 11 by 13 inches or 1012 by 15 inches. Bids should include the cost per additional issues in amounts of 500 copies should the need for additional issues arise. Respectfully submitted, • s/CLAUDE H. McQUILLAN, Mayor s/R. SCHROEDER, Alderman" A letter from Mr. Frank G. Newhouse stating that his client, Mr. Harold J. Underwood, the owner of Silver Creek Sub -Division requesting authorization to furnish the said Sub -Division with a Sanitary Sewer at.his own expense was read. He further stated that Mr. Underwood agreed to meet all requirements of the Council and the Engineering Department and any prerequisites required. Upon motion by Schwanke, second -by Anderson, the.same was referred to the Sewer Committee and the City Engineer. The two following resolutions adopted by the Commissioners of the Sinking Fund were each read and upon motion'by Schwanke, second by Tingley, the action of Record of Official Proceedings of the Common Council 4 L • of the City of Rochester, Minn., March 2 5, 19 57 1 LI • 1 • 1 1 :the Sinking Fund;Commission was approved: "Be it reisolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnow to that the amount of $49, 400.00 be appropriated from the Steam Heat Depreciation Reserve Uninvested to the Water Department Extensions Reserve in payment of bonds nova held in that account ; same, being the book value .of those bonds as of April lot, 1957; and that the amount of $100,000,00 be paid from the Sinking Fund for Water Department Extensions -Not Invested to the Public Utility Fund -Water Department. Be it farther resolved that said funds be made available to pay for materials arriving for the current water works extension program." "WHEREAS,'; the sum in the amount of the budget set for the operation of 'the Sewage Disposal Plant for the -fiscal year ending March 31,,' 1957 is now available in the Sinking Fund for the collection of sewer service charges. SO THEREFORE, Be it resolved by the Commissioners of the Sinking Fund of ,the City of Rochester, Minnesota: l .That the ' -sum of $94,164. 99 be appropriated from the Sinking Fund and ordered paid to the Sewer Fund of the City of Rochester to cover operating expenses of the Sewage Disposal Plant for the fiscal year ending March 31, 1957." A letter signed by John A. Paulson, M.D. addressed to Claude H. McQuillan, Mayor of the Cityl'l of Rochester requesting,that his resignation as a Member of the Rochester Board of Public Health & Welfare be accepted was read.. Upon motion by Schwanke, second by Schroeder, his resignation was accepted. A letter addressed to Mayor Claude H. McQuillan from Harold H. Crawford requesting that his resignation as a Member of the Zoning Board be accepted was read. Upon motion by Schroeder, second by Tingley, his resignation was accepted.: The following letter from W. E. Chamberlain was read and upon motion by Schwanke, second by Schroeder, the same was referred to the Public Grounds Committee "The Honorable Mayor The City I Council Dear Sir: I am interested in renting, for cash, the land that is under cultivation on the old City Hog Farm'. I am renting the adjoining property ',which is the DeWitt farm. I believe that I can improve the appearance of this land as it has grown up to weeds and grass. I would want it for only one season. I will pay the same cash rent of ten dollars an acre which I am paying for the DeWitt land. Sincerely yours, s` W. E. CHAMBERLAIN. " Alderman Whiting introduced a resolution ordering bids for the printing of 109000 copies of a City of Rochester report to the People for the fiscal year ending March 31, 1957 was read. A motion was made by Schwanke, second by Anderson, that the resolution be adopted as read and all voted in favor thereof and President Bach declared the �said resolution duly passed and adopted. The following claims were each read and upon motion by -Schroeder, second by Moody, the same were approved and the Mayor and City Clerk were authorized and directed to draw warrants upon the City Treasurer and make payments accordingly: From the (General Fund; Minnesota Box and Lumber Company, $194.95; Bemel Auto Parts, $5.40;, Chicago Great Western R. Robertson, Commissioner of Taxation, stating that the annual county seat instruction.meeting for the assessors and a member of each of the local Boards of the county to be held at the County Court House at 10:00 o'-clock A. M. on April 4th, 1957 and urging that the Council appoint a member to attend the meeting as an official representative of the Council was read. A motion was made by Schwanke;, second by Schroeder, that the Chair appoint someone to attend this meeting. President Bach then appointed Alderman Moody as the official representative lof the Council to attend this meeting. A notice from Frank W. Everett, Fire Chief, of the suspension of Mr. Rosa Bosshard from the Rochester Fire Department for a period of thirty days without pay, that the dates of this suspension to be from April 1st to April 30th, 11957 inclusive, the suspension being'foi disciplinary reasons was read. President l Bach ordered the same placed on file. A motion was made by Alderman Schroeder that the Members of the Council land the two newly elected Councilmen be authorized to attend the meetings conducted lby the League of Minnesota Municipalities in Minneapolis on March 27th and 28th, 11957 at City Expense. Alderman Tingley seconded the motion and all voted in favor thereof. The applications for "On Saleu Liquor Licenses for DeLoris D. Hoy, Harry H. Drosos & Harry R. Drosos, Erwin A. Glasenapp, Edna M. McCoy Post #92-American Legion and Veterans of Foreign Wars -Whitlock Sonnenberg Post #1215 were each read and upon motion by Anderson, second by Schroeder, the licenses were granted except the application of Morey's Bar, Inc. subject to the clearance of the check for their sewage service charges. Vpon (motion by Schroeder, second by Moody, the bonds were approved, the surety thereon accepted and the same were ordered placed on files The recommendation of the Planning Commission that they had examined the plat of Rolling Glreens Addition as to street pattern and lot lay -out and recommender it be accepted upon the receipt of a letter from John J. Krier that a 33 foot roadway be dedicated along the south edge of Rolling Greenes Addition, and -,a letter from the platters, of Rolling Greenes Addition that they will extend' the 100 foot right-of-way fromHighway 52 to the Sings Park upon a request of the Common Council of the City of Rochester, was read. A letter"f rom C. A. Armstrong, City Engineer, stating that the plat of Rolling Greens appears to meet the requirements of Ordinance No: 704. was read. He further stated that he noted that the ssnitary sewer easement runs thru the probable building site on several lots and assumed that the City's rights on the easement will'control future buildings. A letter signed by 0. J. Allerton, President of the Kruse Company and O ,J:.c.Allerton as President and Joe'Gores as Secretary pf the Hayden -Miller Company, confirming their agreement to dedicate.1001 of right-of-way for the new proposed highway, extending from U. S. Highway 52, east to lgth Avenue Northwest, in line with the proposed overpass aspindicated on that portion of Rolling Greens Addition which had been platted was also 'read. The proposed plat of Rolling Greens Addition was also - present`ed to the Council by Mr. Allerton and Mr. Gores. A motion was then made by Alderman Schwanke that the the City Attorney be instructed to prepare a resolution approving the plat of Rolling Greens Addition, subject to the changes indicated. Alderman Schroeder seconded the motion and ali voted in favor thereof. An Ordinance annexing to the City of Rochester, Minnesota a part of the 0 450 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 25, 19 57 0. South One -Half of the Northwest One -Quarter of Section Twenty-two, Township One hundred seven North, Range Fourteen West, Olmsted County, Minnesota (Hayden -Miller Company & The Kruse Company property) was given its first reading. Upon motion by Schwanke, second by Moody and upon roll call and all voting in favor -thereof the rules were suspended and the ordinance was given its second reading. A petition for annexation of lands to the City of Rochester signed by Andrew L. Towey, Vice President & Aselt Secretary & Treasurer of the Rochester West Company; S. Eugene Haylett, Mgr.�Industrial•Opportunities, Inc.; Arthur J. Hall and Lillian E.• Hall; Elizabeth G. Lowry, Co -Trustee of the Christopher Graham.Trust; W. F. Judd and Josephine A. Judd;-B. R. Harris, Vice President of the.Chicago Great Western Railway Company and P. J. Klein as Land Commissioner for the Chicago and Northwestern Railway Company, was read. This petition described by metes and bounds the property known as the Judd farm and land between the Judd farm and the City limits which would make it contiguous to the City. The following letter from the Cascade Township Board, was also read: "Honorable Mayor & Common Council City of Rochester Subject: Annexation of land in Cascade Township by the so-called Corridor Method, Gentlemen: The board of .supervisiors respectivly request that you give the following problems your very careful consideration before annexing land to the city by the Corridor Method. A large highly populated area adjacent to the city. commonly known as the West Zumbro Addition, will be left in the Township. This is an area that is badly in need of City Utilities, Police, and Fire Protection. We believe that if this area is passed and lands further out is the township are annexed, much confusion as to where City responsibilities stop and county and township _ services begin. Also that City Police and Fire Vehicles will have to travel rural areas to get to parts of the city. The problems of maintaining and'policing the roads and streets in this area are such that it is very hard for a township to control. We feel that our community problems could best be solved, if only the lands contiguous to the city in all directions be - considered for annexation. If after due cons iderat ion of these and many more problems you are convinced that you must use the Corridor Method, we respect- fully -request that the corridor be wide enough to include all of the public road right-of-way lying west of highway 52, .which would be an extension of 7t,h Street N.W. The normal maintenance on this road is high by township standards and with added city use it would become quite costly for -the township. Mr. Carl Elford, Chairman of the Cascade Township Board, was present and stated he felt some solution should be reached in.care of the roads in this area before the land was annexed, as their funds were limited and this road had always lbeen a problem. He also stated he felt the Council should take some action to adopt a resolution that a portion of land annexed should be dedicated for schoo] parks or public purposes. Mr. D, P. Jesson, secretary -treasurer of Johnson, Drake & Piper was also heard, stating that whatever solution was decided on that they were willing to pay at their own expense for building a new road or resurfacing the road in their addition when they were annexed and gave every assurance of their cooperation, which in this instance would be financial. He also stated that -they proposed to dedicate approximately 13% of the Judd area for park, school and play area purpose A motion was then made by Alderman Schroeder, thatthe City Attorney be instructed to prepare an ordinance annexing the property (the Judd farm and other land making the area contiguous to the City) as described in the petition. Alder- man Moody seconded the motion and upon roll call and Aldermen Anderson, Moody, Schroeder, Whiting and President Bach voting in favor thereof, and Aldermen Schwan and Tingley voting «non, President Bach declared the motion carried- Mr. D. P. Jesson then stated that they realized that a lot of engineering services had to be done for surveys on sewer service and water sheds in this area and that they were prepared to pay the expense of this engineering service, and if the Council so desired they would hire their own engineer or would pay the expenses of an engineer the Council wished to provide. A motion was made by Alderman Whitir second by Alderman Schroeder, authorizing the Sewer Committee and City Engineer to provide engineering services in regard to sewer and water shed'surveys in this area. All voted ''in favor of the motion. A letter, signed by Claude H. McQuillan, Chairman of the A irport Commissiol, requesting the Council to take the necessary action to acquire approximately 250 acres of additional land for runway extensions, as requested by the State Depart - went of,Aeronautics, was read. The land to be acquired is located in Olmsted i County and described as follows: "#l. S.E,i of Sec. 16, Township 105, N, Range, 14 W. (Ringey) #2. S.E. of S.W,t Sec. 4, Township 105, N. Range, 14 W. (Doty) #3. S.W. of S.W. i Sec. 4, Township 105, N. Range, 14 W. (Spencer) 4. A part of N. W,i of S. W.i of Sec. 14, Township 105, N. Range 14 W, described as follows; Beginning at the N.W. corner of said', quarter Sec.; thence E. on the N. line of the quarter section a distance of 3501, thence Southwesterly to a point on the W, line of Sec. 14 which is 400' S, of the point of beginning, thence N. on the Sec. line to the oint of be- ginning, also a part of the N,E,4 of the S.E.f of Sec.15, 105 N., Range 14 W, described as -follows: Beginning at the N.E.
