HomeMy WebLinkAbout03-29-1957Record of Official Proceedings of the Common Council 4 5 3 • of,the City of Rochester, Minn., March 29, 1957 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on March 29, 1957• President Bach called the meeting to order at 5:00 o'clock P. M.,.the following members being present: President Bach, Aldermen Moody, Schroeder, Schwanke, Tingley and Whiting. Absent: Alderman Anderson. The call of the special meeting was read and President Bach ordered the same placed on file, the said meeting having been called for the purpose of con- sidering the passage of the ordinance annexing property we at of the. City (Judd • farm and other property) and any other business the said Common Council may deem proper. Mayor,McQuillan stated that at the last meeting of the Council instr- uctions had been given that an ordinance be prepared annexing the Judd farm and *he lands between it and the city limits to the City of Rochester and he had called this meeting solthe Council would have an opportunity to take action on it if they so desired: Alderman Whiting then introduced an ordinance annexing to the City of Rochester, Minnesota, parts of Sections Thirty-two,.Thirty-three and Thirty-four, Township One Hundred Seven North, Range Fourteen West, Olmsted County, Minnesota (Judd farm and lands between it and the city limits) which was given its first reading. R. V.'IEh$iak, City Attorney, inquired if the Council wished to have included in this ordinance the provision that in addition to the usual, assessments that it was the'Oouncil's intention to assess the cost of all or a portion of sanitary and 9tr'om sewer and water tower construction hereafter undertaken. He was informed that this should be a provision in all annexation ordinance hereafter. A motion was then made by Alderman Whiting that the proposed ordinance be amended by renumbering Section 3 as Section 4 and inserting as Section 3 the following: Section 3. That present and future owners of the area annexed by this • ordinance are hereby notified that by such annexation the City, of Rochester does not commit -itself to extend its service and make local improvements in the area annexed on an assessment basis; and that the City of Rochester, through its Common Council,I•specifically .reserves the right. to annex additional areas to the City of Rochester and extend Cityservices and make local improvements to such other later annexed areas in advance of improvements to the area hereby annexed if the.same appears more reasonable and economical. 'Alderman Schroeder seconded the motion and upon roll call all voted in favor thereof. A motion was then made by Alderman Whiting that the .Council consider other business than the call, Alderman Schroeder seconded the motion and upon roll call all voted in favor thereof. Alderman Whiting stated that the proposed annexation is something.we are I 5 4 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 29, 1957 • all interested in and probably have varied opinions as to its value to the good of Rochester but he felt that the area was going to be improved and developed and he felt it was better to have it developed as part of the City rather than as a sub- urba urban area., He further stated that the corridor method was rather unusual and new, and that costs would be more than•for property immediately adjacent to the City but these costs are to be borne entirely by the developers, He then asked Mr., D. P. Jesson, secretary-treas. of Johnson, Drake & Piper to make a statement. Mr. Jesson then stated that they would bear any responsiblities they were supposed to and that they have definite plans to dedicate ample acreage for parks, playgrounds and schools. He stated that they intended to sell lotsto other builders • and then listed the following points (1) that they proposed to dedicate approximate- ly 13 % of their acreage for public purposes (2) that they are anxious for annex- ation and opposted to developments on the edge of the City (3) that they intend to, give as much business as possible to local sub -contractors (4) that they intend to use local labor as far as possible (5) that they are going toD sell lots to local builders because they would like to see in the development variety'and individual tase in homes above the varitles they have to offer (6) that a road maintenance cost question rasied by the Cascade Township Board has. caused'them to offer to pay for any additional cost to the City of a joint City -Township road. He further stated that they would assume any reasonable costs and expenses that would be allocated to them, that they were informally committed to pay their share of storm and sanitary sewer costs and that they were prepared to pay ,for a water tower. Mr. Bob Neill was present and objected to the Council annexing land by the corridor method and requested that the Council wait to annex this land until they ( the builders) had a chance to employ an expert land use planner to give them some &deice. He further inquired as to what the cost would be to the taxpayer through these annexations and did not feel that they should burdened further by 'addi.tional costs caused by lands being not adjacent to the City. Mr. David Qimbert also stated that he felt the corridor method would add a burden to taxpayers, as a • sult of increased costs of fire and police p p�+otection and schools and school . transportation. Mayor McQuillan stated that the regular procedure was being follow- ed and he felt the City officials were aware of all the plans for development. Alderman Schwanke introduced a resolution appropriating $1',000.00 from (the General Fund and ordering payment made to R. V. Ehrick. A motion was made by Alderman Moody that the said resolution be adopted as read. Alderman Schwanke seconded the motion and all voting in favor thereof$ President Bach declared the said resolution duly passed and adopted. Upon motion by Tingley, second by Whiting, the meeting was adjourned. CAIty Clerk i
