Minutes: of the annual meeting of the Common Council of the City of
r
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City, on April lot, 1957•
President Bach called the meeting to order at 2:00 o'clock P. M., the
following -members being present: President Bach, Aldermen Haas, Moody, Morris,
Schroeder, Tingley and Whiting.
- Upon motion by Moody, second by Schroeder the 'minutes of the meeting of
March 25th, 1957 ` were approved.
President Bach then gave the following address:
"On opening', this meeting, I feel I should preface it with a few remarks.
Today we begin the fiscal year for the City of Rochester with some new
faces at the Council table. You will note there are four Councilmen
who were here during the year just finished, namely Alderman Moody,
Alderman Schroeder, Alderman Tingley and Alderman Whiting. Mr. Moody
is the senior member in terms of service, having served some twelve
years on the City Council. Next in years of service is Mr. Schroeder
then Mr. Whiting and then Mr. Tingley. Mr. Morris is no stranger at
this table, having served as Councilman seven years prior to the term
now beginning. Mr. Haas, is the only neophyte on the present Council.
I have every reason to believe he will render an excellent account of
his stewardship. All in All, I am confident you will have for the
comining year, a Council that will be able to work well together and
should accomplish much..
Due to the phenominal growth and rapid expansion of Rochester, never
before .in the entire history of this• City, has there been such a
challenge presented to its City officials. You will be called on to
attend many meetings, to give much of your time and thought in carrying
out the duties of the office you have won. You will be confronted by
pressure groups, and individuals from time to time -to influence your
thinking in the decisions you will be called on to make. We must not
in the course of public life expect, immediate approbation and immediate
grateful acknowledgement of our service. The internal satisfaction of
a good conscience is always present and time will do.us justice in the
minds of the people.
I want every citizen of Rochester to feel they have the right to come
before this Council with any problem they may have that comes under
our jurisdiction. The Council needs citizens help and citizen groups
are proving grounds for new ideas, and while everyone may have as
much time as is necessary to present his problems,.we ask that you
make your statements brief, concise and compact, in that way much
valuable time can be saved. We do not wish to be look upon as a judge
and jury to your problems, but rather as your public servants, elected
to do the best job we know how to do, for you in administering to'the
needs of a 'fast growing City.
Therefore, we who are entrusted with the responsibility of handling the
affairs of the City government must be ever watchful that the things
we advocate, and the changes which we sponsor, will preserve these rights
of the individual, and thaty they will truly be for the best interests
of the people. All of the people. I would like to remind the Councilmen
that a spirit of harmony and unity should prevail at all times. Under
these conditions, more and better results are accomplished. In.con-
clusion, I would like to welcome the two new aldermen, May your service
to the City be ever valuable."
He then stated he took great pleasure in presenting a man who has the
signal honor of being the only person to be elected to the office of Mayor of
Rochester for the .fifth term.
Mayor McQuillan then addressed the Council giving a brief summary of problems
of which he felt the older members were award and extending greetings to the new
members of the official family. He 'stated that:
"One of the outstanding cities of the nation, Rochester, has entered
upon a cperiod of expansion -a period which can be ended, however if
we are not alert to the need to make -our city an even more attractive

place in which to live. It must be more attractive to live inside the
city than in some settlement outside our corporate limits and we must
encourage annexations within all practical and legal limitations.
Recently there have been unwarranted attacks on the so-called corridor
method of annexation. But I want to say that the corridor method is
not only legal but is the one method which can keep the surrounding so-
called vampire settlements from stifling our expansion. I repeat --the
corridor method must not be blocked and it should be remembered that
without this method, the City Council could not have annexed the I.O.I.
and the I.B.M. areas.
It would be folly indeed to bow to any pressure from any source which
would commit the city to a policy of permitting itself to be hemmed in
by surrounding small communities -communities whose residents find em-
ployment in our industries, offices and other institutions and who enjoy
every facility and service for which the residents of Rochester alone
must pay the taxes.
Gentlemen, the broaddning of our tax structure is our real need and we
can not anticipate such a structure if we do not act to keep open every
avenue of expansion. In spite of anything we may do to encourage people
to live in Rochester, there will be all too many -who commute and like
thousands of other cities we are going to used an enabling act to permit
us to levy a withholding tax on salaries'of those people who are employed
in Rochester.' How soon the will come depends on how disproportionately
large our suburban areas continue to grow.
Entering upon a new term of office, I want to make it particularly clear
that one of my major goals will be the orderly development of a Rochester
without a permanent increase in our tax levies. I think people.should
know that the 3 mill levy for our new airpmrt will only be made in 1957
and paid in 1959 and that next year a state refund of .gasoline tax and
car license money should replace the-4 mill levy which the City needed
this year for general fund and street purposes. -Temporarily, Utility
funds can not be available to replace tax levies because they are needed
for the expansion of our utilities.
I believe you will agree with•me that we must explain to our citizens
that, annexations are not responsible for much of this years 'added costs
to the taxpayer and that what little there is will be more than com
pensated for by the increased revenues from these new areas. I want to -
emphasize further that some persons are deliberately overlooking the
fact that this Council has notified developers that these now areas -must
bear the costs of' water towers, - storm and sanitary sewers as well as all
other improvements. I want to say that we must present facts to, offset
false impressions which are being fostered by irresponsible people..
There is one matter of such importance that I feel compelled to talk
about it -at this time --and that is the matter of salaries for our city
employees. I am afraid that we are not going to be able to keep competent
men and women on our pay rolls unless -we find the money to pay some de-
served pay increases., The demand for both male and female help at better
salaries than the city schedule calls for - has already resulted in the
loss of a number of our good employees. Now; I do not imply that the
only reason for increasing salaries is because we are forced to do it.
I believe that all too often, Municipal employers pay the demand price
for commodities without argument and then argue thatthe increased costs
have made it impossible for lack of finances to pay the demand price for
labor. In other words increased costs of supplies and equipment are paid
at the expense or loss of increased salaries for the employee. I do not
believe that this council would argue that the city has money enough for.
every purpose except to provide adequate increases in'aalaries. I think
that we are agreed that if we need services we will have to afford to pay
the going rate that private industry establishes for us. I certainly
agree with you that because there was little provision for increases in
salaries in this year's budget, it is going to be our most difficult
assignment".
He then made the following appointments to the various boards and stated
that the appointments to the Public Utility Board and the Board of Public Health &
Welfare would be made at next Mondays meeting:
ZONING BOARD: Mr. Dewane Evanson, five year term to expire the second Monday
in April, 1962.
MUSIC & BAND COMMITTEE: Mr. Tilman C. Hegge, three year term to expire the
second Monday in April 1960, 11
POLICE CIVIL SERVICE COMMISSION: Mr. Lloyd Koenig, three year term to expire
the second Monday in April 1960,
PLANNING COMMISSION: Mr. E. F. Hrabe, three-year term to expire the second
Monday in April 1960.

Alderman Haas introduced the following resolution which was read and upon
motion by Tingley, second by Morris, that the said resolution be adopted as read,
and all voting in -favor thereof, -President Bach declared the said resolution duly

"WHEREAS, it is deemed expedient and necessary that the Common
Council 'of the City of Rochester, Minnesota, adopt rules of order
for the conduct of its business, and
WHEREAS,',, a copy of Robert's Rules of Order (revised) of the 1915
Copyright, is before the Common Council,
SO THEREFORE, Be it resolved.by the Common Council of the City of
Rochester, Minnesota:
That the said Robert's Rules of Order be adopted by this Common
Council "as rules of order for the conduct of its business.
Alderman' Morris introduced the following resolution which was read and
upon -motion by Morris, second by Moody, that the said resolution be adopted as
read, and all voting in favor thereof, President Bach declared the said resolution
duly passed and adopted: .
"Be it resolved by the Common Council of the City of Rochester,
Minneso ta:
That the said Common Council of the City of Rochester, Minnesota
hereby adopts the following rules and regulations for the order of
business of said Common Council:
1. Roll Call,.The roll call of the Common Council
shall be had and taken in its alphabetical order according
to the names of the members, except that the name of the
President of the Common Council shall be called first at
the first roll call of each meeting and then after that,
at that meeting, his name shall be called and vote taken
after the expression of each of the other members of the

The application of Elfreda Reiter for reappointment as City Clerk was
read and upon motion by Moody, second by Whiting, Elfreda.Reiter was appointed as
City Clerk for the ensuing official year.
The application of R. V. Ehrick for reappointment as City Attorney was
read and_upon motion by Morris, second by Schroeder, R. V. Ehrick was appointed
as City Attorney for the ensuing official year.
The application of Tom•0. Moore for reappointment as City Planning
Director was read and upon motion -by Moody, second by Schroeder, Tom 0. Moore

The application of Marvel Us Kyle for reappointment as Secretary to the

ing, Electrical and Heating Inspectors for the ensuing official year.
The application of Bonita Kelly for reappointment as Secretary to the

The applicatLon of Mark E. Blanchard for reappointment as City Painter
was read and upon motion by Morris, second by Moody, Mark E. Blanchard was appointed
as City Painter for the ensuing official year.
Alderman Tingley introduced .the following resolution which was read and
upon motion by Tingley, second by Moody, that the said resolution be adopted as
read, and all voting in favor thereof, President Bach declared the said resolution
duly passed and adopted; and the City Clerk was instructed to send copies of said
resolution to Mr. Anderson and Mr. Schwanke.
"RESOLVED: The Common Council of the City of Rochester takes this
opportunity by Resolution to express to Mr. Leo C. Anderson and Mr.
Paul J. Schwanke the gratitude of the City of Rochester and the
sincere appreciation of the individual Aldermen for the tireless and
devoted service which each has rendered to the people of the City
of Rochester as an Alderman for the past two years.
The numerous problems of City Government have .made exhasting demands
on their time and patience but each has responded and contributed
their time and energy unsparingly -and with considerable personal
sacrifice to himself and his family. -
The cause of Municipal government in the City of Rochester has been
ably advanced by the skill and judgment which Mr. Anderson and Mr.
Schwanke have exercised in the performance of their duties as
Aldermen.
The City of Rochester owes a substantial debt to these dedicated
public servants who have done so much to promote the public good.
For a job well done the Common Council thanks you on behalf of
itself and the people of the City of Rochester".
President Bach declared this was the time and place set for receiving.and
opening the following proposals and bids:
Proposals for being designated as City Depositories. The proposal of the
Northwestern National Bank to be designated as a depository for the funds of the
City of Rochester in the sum of $300,000.00; the First National Bank to•be desig-
nated as a depository for the funds of the City of Rochester in the sum of
$600,000.00 and of the Olmsted County Bank & Trust Company to be designated as
a depository for the funds of the City of Rochester in the sum of $400,000,00 were
each read together with the collateral for each bank.
Proposal for doing official printing and advertising for the City of
Rochester. A letter from the Post Bulletin Company submitting its proposal to
publish the official printing and advertising of the City of Rochester for the
official year, in the Rochester Post -Bulletin, a legal newspaper, published in
Rochester, Minnesota, at the rate established by the statutes of the State of
Minnesota for legal publications and stating that a bond in the amount of '$1,000.00
accompanied their proposal was read. Upon motion by 1�hiting, second by Morris
the bid of the' Rochester Post Bulletin was rejected. All voted in favor thereof.
Bids for furnishing One (1) 1/2 ton panel truck for use in the City
Engineer's Department. The bids of` Clement's Chevrolet Company in the amount of
$1,731.00; Allen Truck & Implement Company in the amount of $1,995.00 and Universal
Motors, Inc. in the amount of $1,941.92 were each received and opened and upon

motion by Morris, second by Moody, the same were referred to the Street & Alley
Committee and -the City Engineer for tabulation and report.
Bids for furnishing One (1) 1600 gallon tank for street flusher for use
in the City Engineer's Department. No.bids were received.
Bids for furnishing two (2) patrol cars for use in the Police Department.
The bid of Clements Chevrolet Company in the amountsof $19347.00 and $1,397.00;
Universal Motors, Inc. in the amounts of $1,-423981 and $1,493.91; and Adamson
Motor Company in the amounts, of $1, 583.44 and $1, 798.44 were each received and
opened and upon motion by Schroeder, second by Tingley, the same were referred
to the Police Committee and the Chief of Police for tabulation and report.
Air. D. J. Thomas again presented a plat of a portion of his property
north of llth Avenue;Northwest and east of Highway 52 together with a petition
giving the description of the said land, which is only a portion of the land
owned by Mr. Thomas. Mr. Thomas was told that the Council was opposed -to annex-
ing only portions of areas. After studying the petition, R. Y. Shriek, City
Attorney, stated that the petition was not a valid petition, so the petition and
plat were referred back.to Mr. Thomas.
A motion was then made by Alderman Whiting that it be the concensus of
this Council that it would be unwise to annex a platted portion only and should
not consider the approval of the annexation without t-he entire tract. Alderman
Tingley seconded the motion and all voted in favor thereof.
Mr. Frank Newhouse was present and inquired if and when further action
would be taken on the Ordinance annexing the Judd farm,
The Ordinance to the City of Rochester, Minnesota, parts of Sections
Thirty -Two, Thrrty-Three and Thirty -Four, Township One Hundred Seven North, Range
Fourteen West, -Olmsted County, Minnesota (Judd farm and land between Judd farm
and the City limits) was given its 2nd reading.
Mayor McQuillan then stated that he felt the Council should consider
annexing these pieces of property during April if possible, which would be in
time to get the ,properties on the tax rolls for this year. He felt delay in
annexing the properties would cost the City money. Alderman Tingley stated he
did not feel they should suspend the rules and perhaps annexing too hastily would
cost the City money.
An Ordinance annexing to the City of Rochester, Minnesota parts of the
XW} and the NEi,I' Section 25, Township 107 North, Range 14 West in Olmsted County,
Minnesota (Battersby & Sehl) was given its 2nd reading.
An Ordinance changing the zoning of Lot.5, Block 3, Gonderman & Thiel's
Subdivision from a residential to a commercial zone was given its third and final
reading. A motion was made by Schroeder, that the said Ordinance be rejected.
Alderman Morris seconded the motion and upon roll call and Alderman Haas, Morris,

Schroeder and Bach voting in favor thereof and Alderman Tingley 4nd Whiting voting
'non (Alderman Moody was out of the- room at the time the vote was taken), President
Bach declared the said Ordinance rejected.
An Ordinance annexing to the City of Rochester, Minnesota a part of the
South one-half of the Northeast one -quarter of Section Twenty-two, Township One
Hundred Seven North, Range Fourteen West, Olmsted County, Minnesota (Kruse Company)
was given its third.and,final reading.
The following letter was read:
°To The Honorable Mayor and
Member of the Common Council
Of the City of Rochester
Rochester, Minnesota
Gentlemen:
Concerning the pending proposed ordinance for annexation of the
following described land in Cascade Township to -wit:
That part of the South One-half (Sa) of the Northwest Quarter
(NWI) of Section No. Twenty-two (22), Township No. One Hundred
Seven (107) North, of Range No. Fourteen (14) West, which lies
East and North of Trunk Highway No. 52, formerly the St. Paul
Road;
we are writing to express the interest of Hutchinson -Sauer Company
in an aspect of this annexation which may bear upon their ability
to make a substantial contribution to the availability of low-cost
housing in the City of Rochester.
Hutchinson -Sauer Company contemplate the intensive development
of 78 acres of land almost adjacent to that proposed to be annexed,
if their 78 acres may be brought into the City of Rochester. The
-petitioners seeking annexation of the land described in the proposed
ordinance on additional land to the North thereof which is contiguous
with the Hutchinson -Sauer Companyls 78 acres. We are writing,
therefore, to propose that your honorable body give consideration
to requesting _the inclusion of a sufficient amount of additional
land to the North of that which the petitioners presently propose
to annex so as to enable Hutchinson -Sauer Company to annex their
78 acres and commence the development of this low-cost housing..
As an aid to consideration of this matter, we are enclosing a
diagram outling the boundaries involved and a legal description
of the Hutchinson -Sauer Companyls 78 acres.

Mr. 0. J. Allerton of the Kruse Company was present and stated that the
above request of Hutchinson -Sauer to annex would involve a corridor method but
if the Council approved they would go along with it but did not feel Rolling
Greens should be held up because of it.
R. V. Ehrick, City Attorney, also read an agreement signed by the Kruse
Company and Hayden -Miller Company that they will agree to abide.by any uniform
ordinance adopted by the City of Rochester requiring the contribution of land or
its money equivalent for school and park purposes.

Bach declared the Ordinance passed and adopted.
A petition signed by John J. Brier and Anna 0. Krier to annex a strip of
land 33 feet wide which forms the South one-half of the road on the south side
of Rolling Greene Plat and described as follows was read;
"Beginning at the Northeast (NE) corner of said quarter (4) Section,
thence West along the quarter line a distance of 1626.7 feet, thence
Southerly at a deflection angle of 105 degrees 10 minutes to the left
a distance of 34.2 feet, thence East parallel to the quarter line a
distance of 1617.8 feet to the East line of the quarter section,
thence Borth 33.0 feet to the point of beginning."
Also a dedication of the said street by John & Anna Krier was read.
A motion was then made by Alderman Whiting that the City Attorney be
instructed.to draft an Ordinance annexing this 33' strip o$ land. Alderman.
Schroeder seconded the motion and all voted in favor thereof.
A motion was then made by Alderman Schroeder that the agreement signed
by the Kruse Company and the Hayden -Miller Company that they will abide by any
uniform ordinance adopted by the City of Rochester requiring the contribution
of land or its money, equivalent for school and park purposes be accepted. Alder
Tingley seconded the motion. and all voted in favor thereof. _
The two ,following resolutions adopted by the Public Utility Board were
each read and ordered placed on file;`
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester. Minnesota that the Common Council of the
said City be and is hereby requested to authorize the said Board'

1. Hugo- Sales Company for the furnishing of
50 Class 3 40 ft. Western Red Cedar Poles and
50 Class 2 ,50 ft. Western Red Cedar Poles at
prices of $ s.70. and $74- 70 each respectively,
making a total contract price of $6,170.00.
2. Oeser Cedar Company for the furnishing of
100 Class 2-65 ft. Western Red Cedar Poles
at a price of $125.9 5 each, making a total
,contract price of $12, 595.00,
the said' companies being the lowest responsible bidders."
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester. Minnesota that the. Common Council of the.
said City be and is hereby requested to authorize the said Board to
enter into a contract with C. C. PAGENHART. for the furnishing of
all labor, tools and' materials necessary for the proper construction
of FOUNDATIONS AND YARDWORK - Silver Lake and I.B.M. Substations
In accordance with Sargent and Lundy's Specifications No. R 1147;
the total amount of the said, contract to be TWENTY THREE THOUSAND

The reports of the Clerk of Municipal Court for the week ending March
15th, 1957 showing total criminal fines and costs collected $1,283.00 and Civil
Fees received $140 and for the week ending March 22, 1957 showing total criminal
fines and costs collected $1,9g4.00 and civil fees received $4,35 were each read
and having been.. ' approved` by the City Attorney, President Bach ordered the same
placed on file.
Alderman Schroeder stated that since they were remodeling Edison School
on 7th Street Southwest, with the temporary building and trucks and parking there
was no room left',for the children to play and was hard for them to cross the
street to school. 'Upon motion by Whiting, second by Schroeder the Police Denart—
ment was instructed to erect a barricade on the 7th Street Southwest side.of the
Edison School. All voted in favor of the motion.
President Bach declared a recess at 5:45 P• M.

The recommendation of,the Fire Committee that approval be granted to the

Alderman Morris introduced the following resolution which was read
"RESOLUTION AUTHORIZING-AND,DIRECTING
THE ISSUANCE AND SALE OF IMPROVEMENT
BONDS, SERIES B; TO FINANCE THE TRUNK
LINE SANITARY SEWER SERVING ELTON HILLS
FIRST AND SECOND ADDITIONS, AND PROVID—
ING FOR THE LEVY OF SPECIAL ASSESSMENTS
FOR TAXES THEREFOR.
BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota,
as follows:
1. Pursuant to and in accordance with the provisions of Minnesota Statutes
Chapter 429, And''upon public hearing and advertisement for bids as therein required
the City has heretofore ordered and contracted for the construction of an improvemei
designated as Project No. 3249, consisting of a trunk line sanitary sewer to serve
the new Elton Hills First and Second Additions, which construction has been com-
pleted and ascertained to cost approximately $51,250, of which $10,000 is to be
financed by the issuance of the Improvement 3onds, Series A authorized by the
resolution adopted January 7, 1957; and it is deemed desirable and for the best
interests- of the ';City that the remainder of such cost, in the amount of $41,25) ,
be financed by the issuance and sale of the Improvement Bonds herein authorized to
the Fullerton Lumber'Company of Mipnneaolis Minnesota, in accordance with said
Company s offer to purchase the same subject to the terms set forth in this
resolution and in the agreement with said Company made and executed on December 19,i
1955, which agreement is by reference incorporated herein and made a part hereof.
2: It is hereby directed that special assessments shall be levied forth—
with, in accordance with said Chapter 429, for the purpose ef'f paying a portion of
the cost of said ',improvement, upon all such properties within the Elton Hills
First and Second!Additions, being the properties described in Ordinance No. 907,
adopted_September 6; 1955� annexing said properties to the City, .and in the notice
of hearing on said improvement published September 21 and September 28, 1955•

Said assessments shall be levied in the aggregate principal amount of $20,500,
which sum is approximately $114 per acre for -the 100 acres of property comprised
in said additions. Said assessments, if not prepaid, shall be spread upon the
tax rolls of the City for the years 1957 to 1973, inclusive, in equal annual
Installments to be collected in the respective ensuing years, with interest on
the balance thereof unpaid from time to time at the rate of 5% per annum. For
the purpose of paying the remaining cost of said improvement and of producing,
with the estimated collections of said special assessments, sums not less than
5% in excess of the amounts required to make all payments becoming due each year
on the bonds herein authorized, -there is hereby levied a direct annual ad valorem
tax upon all taxable property in the City of Rochester, to be spread upon the tax
rolls for the years and in the amounts set forth below, and collected in the
respective ensuing years:

Said tax levies shall be irrepealable so long as any of said bonds are outstanding
and unpaid, provided that the City reserves the right and power to reduce said
levies by the amount of any moneys hereafter irrevocably appropriated to the
payment of said bonds, other than the taxes and special assessments herein levied
and referred to, in accordance with the provisions of Minnesota Statutes, Section
47 5.61.
3. Pursuant to Minnesota Statutes, Sections 429.091, Subdivision 4 and
475,61, Subdivision 2, a separate and special account designated as the'I'Project
No. 3249 Improvement Bond Account" is hereby created and shall be maintained with-
in the Sinking Fund of the City; to be used solely for the payment of the bonds
herein authorized when due, or to prepay and redeem such bonds when and as they
become prepayable according to their terms. Each and all of the taxes and special
assessments herein levied and referred to, when collected, shall be credited and
paid into said account. The full f 4ith and credit of the City shall also be and is
hereby irrevocably pledged for the payment of said bonds, and if at any time the
moneyrs in said account should be insufficient to make all bond payments then due,
the Common Council shall provide sufficient moneys therefor from any other funds
in the City Treasury, and such funds may be reimbursed from the proceeds of said
special assessments and taxes when collected. The City further covenants and
agrees that it will levy additional taxes to any extent required to meet dekicis-
ncies in said account for the payment of said bonds, which levies may be made
without limitation as to rate or amount.
4. The bonds herein authorized, in the princi al amount of $41,250, shall
be designated as Improvement Bonds, Series B, shall be t1 in number and numbered
from 1 to 41, Inclusive, each in the denomination of $1,000, except bond No. 41.
which shall be in the denomination of $1,250, shall be dated as of January 1, 1957,
and shall mature serially, on January 1, in the amount of $1,000 in each of the
years 1959 through 1974, $2,000 in*each of the years i975 through 1995 end $2,250
in 1986. Said bonds shall each be subject to redemption and prepayment at any
time upon notice given in writing, not less than 10 days prior to the date
specified for such redemption, to the First National Bank of Rochester, Rochester,
Minnesota, as agent for said purchaser. Said bonds shall be payable at the office
of said First National Bank of Rochester.

pursuant to and in full conformity with resolutions duly adopted by the
Common Council after hearing as required by law and pursuant to and in full
conformity with the Constitution and laws of the -State of -Minnesota thereunto
.enabling, including Minnesota Statutes, Chapter 429. This bond is payable
primarily from the Project No, 3249 Improvement Bond Account of the Sinking
Fund, but the Council is required to pay the principal thereof out. of, any
funds in the treasury in the event that the moneys on hand in said fund are
at any time insufficient to meet the payment of maturing principal.

6. Said;bonds shall be prepared in mimeographed form under the direction
of the City Clerk and shall be executed on behalf .of the City by the signature
of the Mayor and ,countersigned by the City Clerk, and .the corporate seal of the
City shall be affixed thereto. When said bonds have been so executed and authen-
icated, they shall be deposited by the City Treaswsr with the Trust Department
of the First National Bank of Rochester, Rochester, Minnesota, upon payment of
.the full .par value thereof by said bank as agent for the Fullerton Lumber Company.
Said purchaser shall not be obliged to see to the application of the purchase
price, but the entire bond proceeds, together with $10,000 of the proceeds of the
Improvement Bonds', Series A heretofore authorized and sold, shall be credited to
a special improvement fund for said Project No. 3249, and used solely to pay the
costs necessarily incurred in connection with said project.
7. Upon the delivery of said bonds said First National Bank of Rochester
shall 4old the same as Escrow Agent and in accordance with the provisions of
said agreement dated December 19, 1955, between the City of Rochester and the
Fullerton Lumber Company, and shall administer, expend and account for the funds
received by it from the City of Rochester in "payment of said bonds in the manner
provided in said agreement.
8. The City Clerk is hereby authorized: and directed to file a certified
copy of this resolution with the County Auditor of Olmsted County, together with
such other information as he shall' require, and to obtain from said County Auditor
a certificate that said bonds have been entered on his bond register.
9.- The officers . of the City and the County Auditor of Olmsted County are
hereby authorized,and directed to prepare and furnish to the purchaser of said bond
and to, the attorneysapproving the legality of the issuance thereof certified copies
of all proceedings and records relating to said bonds and to the financial affairs
of said City, and, such other affidavits, certificates and information as may be
required, to show the f act:s relating to the legality and marketability of said
bonds as the same' appear from the books and records under their custody and control
or as otherwise known to them, and such certificates, certified copies and affida-
vits, including any heretofore furnished, shall be deemed representations of the

A motion was then made by Alderman Schroeder, second by Alderman Tingley,
that the said resolution be adopted.as read and upon roll call Aldermen Haas,
Moody, Morris, Schroeder, Tingley, Whiting and President Bach voting in favor
thereof, the said resolution was declared duly passed and adopted and was signed
by the President of the Council and attested by the City Clerk.

Alderman Whiting introduced a resolution accepting the plat of "Rolling
Greene" Addition. Upon motion by Moody, second by Schroeder, and all voting in
favor thereof, the resolution was adopted.
An Ordinance annexing to the City of Rochester, Minnesota,'a part of'the
Northeast Quarter of Section Three, Township One Hundred Six Forth, Range Fourteen
West in Olmsted County, Minnesota, to be known and designated as "Bumpus Addition"
was given its 2nd reading. Xr. Franklin Michaels, Attorney, representing C. F.
Dixon and Or. C. S. MacCarty, protested the approval of the plat of Bumpus Addition
as he did not feel that it complied with the provisions ,of Ordinance No, 704. Dr,
C. S. Maccarty was also present. Mr. Michaels stated according to the Ordinance
all streets were to be 66 feet wide and this plat showed only a 50 foot wide
street; all corner lots shall be EO feet in width and here two corner lots are
only 54.4 feet and 55.6 feet and all interior lots should be 50 feet wide but
Lot 3 as shown on the plat was not 50 feet wide, he therefore felt the Oouncil
should consider further before approving the plat.
The recommendation of the Street & Alley Committee and the City Engineer
that bids for furnishing one (1) 1600 gallon tank for street flusher for use in
the City Engineer's Department be readvertised for the next meeting was read.and
upon motion by Schroeder', second by Morris, the recommendation was approved.
Alderman Tingley introduced a resolution ordering bids for the furnishing
of one (1) 1600 gallon tank for street flusher for use in the City Engineer's
Department. Upon motion by Schroeder, second by Whiting,'and all voting in favor
thereof, the resolution was adopted.
A petition signed by Elizabeth G. Lowry, co —trustee for the Christopher
Graham Trust, for the annexation of the following described land was read:

intersection of the West right of way line.of Trunk Highway No. 63
with the.South line of 14th Street S,W. as platted in said Graham
Addition, running -thence West along the South line of said 14th
Street 300 feet, running thence South at right angles with said
14th 300 feet, running thence East parallel with said 14th Street
224.2 feet to the West right of way line, of Trunk Highway No. 63,
running thence Northerly along said West right of way line to the
place of beginning, Olmsted County, Minnesota. n
Upon motion by Schroeder, gecond by Moody, the City Attorney was instructed to
prepare as Ordinance annexing the said land.

Minnesota, between the hours of 10:30 P. M. and 5:00 A. M.; defining duties of
parents, guardians or others in care of -minors; regulating the presence of minors
in places of amusement, entertainment or refreshment; providing penalties for
violation°thereof 'and repealing ordinances in conflict therewith, we,s given its
2nd reading.
R. V. Ehrick, City Attorney, requested that'the third reading on the
plumbing ordinance be deferrre3. Upon alotlon". by Schroeder, 'second by Whiting,
the third and final reading of"an Ordinance establishing the position of plumbing
inspector and prescribing his duties, providing for the licensing of plumbers,
providing for the 'issuance of permits for plumbing work and the fees for such
permits, providing for the approval and inspection of plumbing, establishing a
plumbing code for the City of Rochester and providing for its enforcement, and
providing penalties for the violation of the provisions of this ordinance" be
deferred and the same be referred to the License Committee and the City Attorney
for conference -with the affected parties.
The recommendation of the Street & Alley Committee that the purchase of
the land situated ',just northwest of the Sewage Treatment Plant and immediately
west of the Rochester Sand & Gravel Company pit, said land owned by Frank Eckert,
be referred to`the,Public Grounds Committee was read. Upon motion by Alderman
Schroeder, second,by Alderman Tingley, the recommendation of the Street & Alley
Committee was accepted.
Mayor McQuillan presented President Bach with a slide rule of Parlimentary
-Procedure.
An informal meeting was set for Wednesday, April 3rd, 1957 at 7:30 o'clock
P. M. to meet with' the contractors,. builders, and other interested people on the
question of providing land for schools, parks and public purposes in newly annexed
additions,' -
An informal meeting was set for Thursday, April 4th, 1957 at 7:30 o'clock
