Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall in
said City on April 15th; 1957.
President Bach called the meeting to order at 7:30 P. M. the following
members being present: President Bach, Aldermen, Moody, -Morris, Schroeder,
Tingley and -Whiting: Absent: Alderman Haas.
Upon motion by -Moody, seconded•by Morris, the minutes of the meeting
of April 8th, 1957 were approved.
President Bach stated this, as being the time and place set for receiving
and opening bids for the sale of $495,000.00 Improvement -Bonds for the City of
• Rochester. The City_ Clerk then presented affidavits showing publication of
notice of sale of $495,000.00 Improvement Bonds authorized by the resolution
dated -January 7, 1957, and directed to be sold by the resolution adopted February
18, 1957, bids'for which were to be, received at this meeting. Said affidavits
were examined and found satisfactory and upon motion by Alderman Schroeder,
second by Alderman Tingley, the same were directed to be placed on file -in the
office of the City Clerk, The Clerk then reported that eight sealed bids had
been received at her office -prior to the time of this meeting, which bids were
thereupon opened and publicly read. Upon motion by Alderman Morris, second by
Alderman Tingley, .the same were reFerred-to the Finance Committee.and the City
Clerk who considered and verified same as complying -with the published advertise-
ment for bids, 'and were found to be as -follows:

"RESOLUTION AWARDING SALE OF $495,000
_IMPROVEMENT BONDS, SERIES A AND DIRECTING
THE PREPARATION, EXECUTION AND DELIVERY
THEREOF.
BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota as:follows:
1. It is hereby found and determined that the highest and
best bid "received pursuant to the notice heretofore duly published
of sale of the $495,000 Improvement Bonds, Series A, to be dated as
of January 1, 1957, is that of the American National Bank of St. Paul,
Minnesota and associates named therein, to purchase said bonds at a
price of par and accrued intere.st plus a premium of $334.00, the bonds
maturing in the years set forth below to bear interest at the respect-
ive rates per annum set forth opposite said maturity years:

2. The contract of sale of said bonds is hereby awarded to
said bidder in accordance with said proposal. The Mayor and City Clerk
are hereby authorized and directed to endorse the acceptance of the
City upon duplicate copies of said proposal, returning one to said
bidder and filing the other in the office of the City Clerk. The
good faith check furnished by the successful bidder shall be retained
by the City Treasurer pending delivery of the bonds and payment of the
purchase price, and the checks of other bidder shall be returned to
them forthwith.
3. In accordance with the request of the pruchaser of said
bonds, the principal thereof and the interest thereon shall be payable
at The American National Bank in St. Paul, Minnesota.
4. It is hereby found, determined and declared that all acts,
conditions and things required to exist, to happen and to be performed
precedent to theissuance and delivery of said bonds, under the pro-
visions of the Constitution and laws of the State of Minnesota and the
ordinances and resolutions of the City of Rochester, including the
resolution adopted January 7, 1957, entitled "Resolution Authorizing
and Directing the Issuance of Improvement Bonds to Finance Improvements
Heretofore Charged to the Permanent Improvement Revolving Fund", and
including Chapters 429 and 475, Minnesota Statutes, and including
Chapter 27, Laws 1955, authorizing the issuance of said bonds in
accordance with the procedure prescribed in said Chapter 429 for the
financing of improvements instituted both under said Chapter 429 and
under the Charter of the City of Rochester, do exist, have happened
and have been performed in regular and due form, time and manner as
so required; and said bonds shall forthwith •be prepared for execution,
..executed and delivered to said.purchaser in accordance with the pro-
visions of said resolution of January 7; -1957•
Passed and adopted by the Common Council of the City of '
Rochester, Minnesota this. 15th day of April, 1957.

A motion was then made by Alderman Schroeder, seconded by Alderman Moody,
that the said resolution be adopted -as read.and upon roll call Aldermen Moody,
Morris, Schroeder, Tingley and Whiting and President Bach voting in favor thereof,
the said resolution was declared duly passed and adopted and was signed by the
President of the Council and attested by the City Clerk.

and opening bids, for the furnishing of one (1). 1600 gallon tank for, street flusher
for use in the City Engineer's Department. The bid of Ruffridge-Johnson Equipment
Company, Inc. in the amount of $2,838.00 was received and opened and upon motion
by Schroeder, second by Moody, the same was referred to the Street & Alley Comm-
ittee -and the City Engineer for report.
President Bach stated this as being the time and place set for, the hearing
on the proposed change- of zoning of Lot 10, Block 5, gutzky! s First Addition
(1242 First Street Southwest) from a residential to a multiple dwelling zone.
There was no one'!present wishing to be heard. Upon motion by Schroeder, second by
Morris, the Cityl,Attorney was instructed to_draft an ordinance making the requested
zoning change. All voted in favor of the motion.
President Bach stated this as being the time and place set for the hearing
on the variance of the provisions of.the Zoning Ordinance for permission as re -
to build a house
quested -by E, E. Comartin, Jr./on the lot next to his property, which said lot
falls short of the requirements by 600 sq.-ft., (800 block on 5th Street Southwest).
Upon motion by -Schroeder, second by Tingley, the matter was tabled until the next
meeting.
The following letter from the Rochester. Post -Bulletin Company was read:

Gentlemen:
Concerning your advertisement in the Post -Bulletin for
bids on,printing the city report: we hereby submit this bid:
For printing, including all charges for engraving,
labor,, paper cost and distribution of a 24 page

In addition, we 'will not only print and distribute the
10,000 copies you advertised for, but will print and
distribute a total of 21, 500 to cover our entire
citcu1ation.

charge. If additional papers are wanted, a slight
extra charge will be made.

Upon moiion by Schroeder, second by Tingley the same was referred to the Committee

A letter from Norbert Huiting submitting his application to be put on the /-
regular pay roll for machine operator at the City Dump effective May 1st, 1957 was -
read and upon motion by Schroeder, second by Moody, the same was referred to the
Street and Alley Committee and the City Engineer.
The following letter from Daniel M, Robbins & Associates was read and
upon motion by Schroeder, second by Moody, the same was referred.to the Survey
Committee:

City Hall RE: First Methodist Church of
Rochest or.
Gentlemen:
On August 14th, 1956 a request was submitted to the City Council
to change the. building lines from the existing zone requirements for
the reference structure. Set backs granted by the City Council were
14,01, on Fourth Street Southwest and 14,01, on Fifth Avenue Southwest.
At this date the plans for the structure had been completed. The
plan calls for an entrance vestibule off Fifth Avenue Southwest which
outside building line is 41 nearer the property line than -the set back
granted, and columns supporting a canopy over this -'same entrance are
located 121 nearer the property line than the set back granted, -
The church now requests an approval to build according to the com-
pleted plans. A sketch of the building outline is attached hereto.

Gentlemen:
It is with extreme pleasure that, we start a new year as the Board of
Park Commissioners, operating a department under your jurisdiction.
One of our first duties as a Board is to arrange for suitable personnel
to operate.this important department of the city, and to. request your
approval of salaries which we feel are, as near as possible, equitable
for the said personnel.
We are enclosing a list of our personnel in their.varlous categories
of employment, with.their present monthly salaries and the amount of
the proposed salaries with the 20% increase. In establishing our
budget in the fall of 1956 all of our figures were projected -on the
basis of this increase in salaries. We feel that our employees have
done a creditable job and if we are to retain these trained employees
we must prevail upon you to approve this increase, as private employers
and other city departments are paying as much -or more, and we are
positive that you,do•not wish the quality of workmanship to degenerate
in -our department,
We respectfully request that you refer back to our budget and the
accompanying letter for our thinkin& as to how this ;can be accomplished.

Upon motion by Tingley, second by Schroeder the same was referred to the Committee
to study salaries.
The following letter from the Public Health & Welfare Board was read
together with the salary recommendation as submitted:
"The Honorable Mayor and Members
of the Common Council
Rochester, Minnesota
Gentlemen:
Enclosed herewith we are forwarding the salary recommendations for the
1957-59 Year of the Board of Public Health & Welfare which met today for
this purpose. Your attention is particularly directed to the fact that
the total cost of recommended salaries is less than the amount budgeted in
the City Health Department, Mental Health and State funds.
In the garbage collection service we have based our salary requests on
the recommendations of the Fact Finding - Panel appointed to study salaries
paid to employees of the S-treet and Alley Department. As in the past, we
consider 'our garbage collector -drivers to be, doing comparable work to thos,
in the truck driver -laborer classification of the Street and Alley Depart-
ment. We believe that these' -men need and are entitled to the increase in
salary recommended by the Panel which amounts to $350.00 per man for the
year. This increase in salaries.necessitates an increase in the garbage
collection fees which are barely sufficient to support the residential .
collection and in the case "of the commercial collection, the fee is alread;
insufficient by_ about $2, 000 per year. The Board's recommendation for in-
creasing'the fees is transmitted in a separate letter.
The enclosed material shows a list of positions for which salaries are
to be set' and the names of the individuals to be appointed as well as the
names of !other incumbents during the past year and the amount of salary
paid each! individual during the past year. Also shown at annual rates are
the proposed increases, the total salary recommended for each individual
to be appointed and the difference between the proposed salary and the
amount budgeted last fall. This material and copies of this letter are
provided in sufficient number for the use of the Mayor, each member of the
Common Council and the City Clerk,
The Board urgesyour favorable action on these recommendations'and it
will be available and happy'. -to meet with the Mayor and the Common Council
to discus's these recommendations.

- The recommendation of the Police Committee that the first parking meter -
south of the alley on the West side of 1st Avenue S,W., between Second and Third
Street be removed and that this space be made a No Parking Zone and further recommend-
ing that -the City Attorney be instructed to draw up the necessary resolution to
make this change effective was read. Upon motion by Schroeder, second by Moody, the

recommendation was approved and the City Attorney was instructed to -prepare the
necessary resolution. -
The recommendation of the -Street & Alley Committee and the City Engineer
that the bid of Ruffridge-Johnson Equipment Company, Inc. for furnishing One (1)

The report of the 'City Treasurer for the month of March, 1957 was read and
President Bach ordered the same placed on file.
The application of the Vet's Blue & White Cab Company for.a transfer of
taxicab license 036 from a 1955 Ford with Minnesota License No. 1H3397 to a 1955
Ford with Minnesota License No._-5J250.7. was read. Upon motion by Schroeder, second .
by Morris, the transfer was granted. _
The application of Doyle Conner for a Cement Contractor's license was read.
Upon motion by Morris, second by Schroeder, the license was.granted.
The applications .of Raymond. DeV.ogel & Clifford -A. Aaby for J-ourneyman Warm
Air Heating,.Vent.ilating and Air Conditioning -Workers license were each read and upon
motion by Schroeder,_second by Moody,.the licenses were granted.
The application of Louis C. Wegner for a Journeyman Plumber's license was
read and upon motion by Morris, second by Schroeder, the license was granted.
The -applications of Dale Martin, Bergis Beltline Mobile, Herman Koebke and
Edward Lutz fora -license to sell cigarettes were each read and upon motion by
Schroeder, second by Morris, the licenses were granted.

Herman Koebke for a license to sell soft -drinks were each read and upon motion by
Schroeder, second by Morris, the licenses were granted.
The official bonds of Garnet Spring in the amount of $1,000,00 with -.the
Fidelity & Casualty Company -of New York as surety; Richard V: Ehriak, Henry T.
Mewhorter, Raymond Wagoner, Lee E.-Graham and Robert N. Radam each in the amount
of $500.00 with the St. Paul Fire & Marine Insurance Company as surety were each
read and upon motion by Schroeder, second by Tingley, the bonds were approved, the
Surety thereon accepted and the same were ordered placed on file.
The license bond of A. D. Mills in the amount of $1,000,00 with the Fidelity

were each read and.the same were referred to the MAyor for his approval.

Engineer and the Public Utility Department for study and report. Upon motion by
Moody, second by Morris, resolution adopted.

Council to give further consideration in the matter of granting alicense to Mr.
Harold Blakeslee to operate his popcorn stand was read and the same was ordered
placed on file.
A letter signed by Ray Ranfranz requesting an information meeting with the
Common Council before the wage setting was read. President Bach ordered the same
placed on file.
A resolution adopted by the Public Utility Board on February lSth, 1957
relative to watermains and' water tower: facilities hereafter constructed to service
areas in the City not now being serviced was again discussed. Upon motion by
,
Schroeder, seconded by Whiting, the City Attorney was instructed to incorporate
this procedure in the assessment policy ordinance being developed.

The matter of the recommendation of the Street & Alley Committee that the
,
land for sale by Mr. Frank Eckert, which is located just northwest of the Sewage
Treatment Plant and immediately west of the Rochester Sand & Gravel Company which
was referred to the Publ-ic Grounds Committee for further investigation was again
discussed. Alderman Morris, Chairman of the Public Grounds Committee, reported that
the land was suitable but that they needed more time forfurther negotiaf to.n-sandtstudy.
A resolution amending a resolution establishing parking.and parking meter
regulations and provisions pursuant to Ordinance No. $71 making the following changes
was read:

117. On the North side of Second Street Southwest between Broadway -
and.First Avenue Southwest, twenty-five feet, more or less,
immediately west of the alley in front of the premises of the -
Northwestern National Bank."
(2) Subsection g of Section (3) SPECIAL PARKING ZONES, is hereby
amended so as to read in its entirety as follows:
"g. On Third Street Southwest between. Broadway and First Avenue
Southwest, on the South side., of - the street, twenty-five feet,
more or less, on each side of the alley, parking restricted to
vehicles of the Olmsted County Sheriff's Office.!
(3) Section (2) NO PARKING ZONES is amended by adding thereto
Subsection bg to read as follows: _
l . ""bg. On both sides of Nineteenth -Avenue Northwest from Fourteenth
Street Northwest north to the end of the avenue, a distance of
three hundred• feet, more or less."
A motion was made by Alderman Schroeder, seconded by Alderman Moody, that the
said resolution be adopted as read and all voting in favor thereof, President Bach
declared the- said resolution duly passed and adopted:.
Alderman Schroeder introduced the following -resolution which was read:
"WHEREAS, the firm of Johnson, Drake & Piper, Inc. have offered
and_ agreed to pay the cost of hiring an -independent engineering firm
to make certain engineering studies with respect to sanitary sewer
system, requirements for servicing the "Judd Farmn in the event of its
annexation to the City of Rochester pursuant to petition and annexation
heretofore filed with the City Clerk, and _
WHEREAS, the Common Council of the City of Rochester is willing
to hire an engineering firm to undertake such studies on the basis of the
offer and agreement of Johnson, Drake and Piper to pay the entire cost
of such studies,
NOW THEREFORE, BE IT RESOLVED by the Common Council of the. City of
Rochester that the firm of . Toltz, King, Duval, Anderson and Associates
is hereby hired and retained to make the following engineering study
with respect to sanitary sewer facilities for the so -called -"Judd Farm":
(1) The total drainage area to be served by a proposed
westerly -trunk line extending from -the Highway #52 connection.
(2) The reasonable acreage in the drainage area that might
be expected to desire such facilities. _ -
(3) The possible need for an absolute limit on the number and
location of acres that would be permitted to hook-up to
such sanitary sewer.
(4) The size of such westerly extension of trunk sewer beyond
highway #52, and
(5) The size differential between reviously arranged for relief -
lines from highway #52 to the U11 sewer as compared with. the
-needed capacity for such distance with the addition of the
westerly extension beyond highway #52.
BE IT FURTHER RESOLVED, that.Toltz, King, Duval, Anderson and Assoc-
iates is authorized to perform this work on the basis of the standard
fees established for such work, and are requested to submit -a specific
fee schedule for this work which, if not rejected by the Common Council,
within ten days after receipt, shall constitute the fee -agreement between
the parties.
Passed and adopted by the Common Council of the City of Rochester,
Minnesota, this 15th day of April A.D. 1957•"
A motion was made, by Alderman Tingley, second by Alderman Schroeder that the said
resolution be adopted as read and all voting in favor thereof, President Bach
declared the said', resolution duly passed and adopted.
An ordinance annexing to the City of Rochester, Minnesota a part of the
southwest quarter. of section twentyrtwo, township one hundred.seven north, range
fourteeen west, Olmsted County, Minnesota 031 strip of land owned by Krier which
is adjacent to Rolling Greens) was given its lot reading. Upon motion by Schroeder
seconded by Tingley, and upon roll call and all voting in favor thereof, the rules
were suspended and the ordinance was given its second reading. Upon motion by

Tingley., seconded by Schroeder- and upon roll call and all voting in favor thereof
the rules were suspended and the ordinance was given its third and final reading. -
A motion was then made by Schroeder, second by Tingley, that the said ordinance be
adopted as read and all voting in favor thereof, President Bach declared the said
ordinance duly passed and adopted.
A motion was then made -by Alderman Schroeder, that_the rules be suspended
and an Ordinance annexing to the City of Rochester, Minnesota, a part -of Section
Eleven, Township One Hundred Six North, Range Fourteen West, Olmsted County, Minne—
sota (Graham Second Addition) be given its second reading. Alderman Moody seconded
the motion and.upon roll call and all voting in favor thereof the said Ordinance
was given its second reading.
Mr. E. A. Rundell presented a plat of Graham Second Addition.a Upon motion
by Schroeder, second by Moody,. the same was referred to the Planning Commission.
Mr. Robert Petersdorf, representing Mark Blanchard, the City Painter, was
present and requested that the Council consider raising the salary of the painter
according to salaries being paid to other painters and stated that he would send
the Council a copy of comparisons and figures -on same.
Mayor Mcquillan read a letter from the State of Minnesota, Fire Marshall
Department, advising that an inspection had been made of the property owned by Mrs..
Leon Grothe at 224 Sth Street Northwest and that condemnation proceedings would be
started in the Attorney General's office sometime after the Legislature adjourns.
Upon motion by Schroeder, seconded by Moody, the meeting
was adjourned.
