HomeMy WebLinkAbout06-03-1957552 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., June 3. 1957 • Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on June 3, 1957. President Bach called the meeting to order at 2:00 o'clock P.M., the following members being present: President Bach, Aldermen Haas, Morris, Tingley, Whiting. Absent: Aldermen Moody and Schroeder. Upon motion by Morris, second by Haas, the members of the meetings of May 20th,,, May 24th and May 27th, 1957, were approved. President Bach stated this as being the time and place set for the following hearings: • Hearing on the construction of a sanitary sewer, water main, -service i connections, storm sewer, street grading and bituminous surfacing on 91 Avenue. Northwest and 9th Avenue Northwest,in Kreter's Replat. Mr. W. L. Wyatt of 920 Fifth Street Northwest was present and inquired if all the lots in. Kreter's Replat would be assessed for this work, he.stated his lot faced on 5th Street Northwest and would not be benefited by this construction. He was told that if his property was not benefited he would not be assessed. Hearing on the construction of a sanitary sewer, water main and grading and surfacing in 19th Avenue Northeast in Miner's Heights 4th Addition. There was no one present wishing to be heard. Hearing on the construction of a sanitary sewer, water main, service connections and street grading and bituminous surfacing on._6th Street Southwest, Folwell Lane and Folwell Court in Folwell Heights Addition. There was no one present wishing to be heard. Hearing on the construction of a curb and gutter on 15th Avenue North- east from 9th Street Northeast to loth Street Northeast. There was no one present wishing to be heard. I Hearing on the construction of a water tower to be located on the east side of lSth Avenue Northwest, approximately 1250 feet north of the present City • limits together with the necessary trunk line to connect said water tower with the City water system on 18th Avenue Northwest. There was no one present wishing to be heard. Hearing on.proposed assessment for construction of a curb and gutter on, 6th Street Southeast from loth Avenue Southeast to Bear.Creek bridge. There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiv- ing and opening bids for removal and disposal of certain buildings located at the new municipal airport site in High Forest Township, Olmsted County, Minnesota. The bids of Frank Hielscher and Sam Rueb were each received and opened and upon motion by Tingley, second by Haas, the same were referred to the Airport Record of Official Proceedings of the Common Council 5 5:3 • of the City of Rochester, Minn., __ June 3. 1957 1 it • 1 CJ L 1 Commission for tabulation and report. The Mayor's veto message in regard to five resolutions, with his veto inscribed -there ! on, establishing salaries of the City Treasurer, Members of the Fire Department, Members of the Health and Welfare Department, the City Engineer's Department and the Park Department, was again read. Also the follow- ing letter from; the Board of Park Commissioners was read: 'Hon.Claude H. Mcquillan, Mayor and The Common Council of Rochester Re: Salary Schedules for Park Department Employees Gentlemen: At our last Park Board meeting, which followed your Council meeting of .May 6th, we discussed the resolution setting out the salaries for the various personnel in the department under our jurisdiction. We do not fully understand what your thinking was when determining the raises for the various people in the department, but do feel that after discussing it with our Superintendent, under whom these pebple work, that we are in a better position to make a distribution of the increases within the amount of money that you have allocated as an increase for our permanent staff personnel. The payroll of `the permanent staff as set out by you would amount to $105,O90.00, and the payroll as altered by us (see list attahhed) would amount to $104,360.00, which would mean a saving to the taxpayers of $720.00 per year. We did not alter these increases to produce a savings, but to produce a more nearly equitable payroll, which will promote better feeling between the people on the staff, and we must have harmony amongst these people if we are to continue to get the quality and quantity of work that we have had in the past. As in the past, we must have some seasonal employees, by the rDur, through the summer to augment the permanent staff." These employees receive from 900 per hour for the Bathroom help, up to and including laboring m6n at $1.65 per hour. We ask your sanction in giving these people a 10¢ per hour increase which will average out slightly under 10% of the amount expended for our hourly help. A motion.was made :by Haas, second by Morris, that the said resolution be adopted as read, and upon roll call and all voting in favor thereof, President Bach declared' the said resolution duly passed and adopted and the Mayor's veto overridden. A motion was made by Tingley, second by Whiting, that the said resolution be adopted as .read, and upon roll call and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted and the Mayor's veto overridden. A resolution fixing salaries of the men in the City Engineer's Department ( Street & Alley) for the year 1957-1959 vetoed by the Mayor on May 11, 1957, was again read. A motion was made by Whiting, second by Haas, that the said resolution be adopted as read, and upon roll call and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted and the • Mayor's veto overridden. A resolution fixing salaries in the Park Department for the year 1957- 1959, vetoed by the Mayor on May 11, 1957, was again read. A motion was made by Haas, second by Morris, that the said resolution be adopted as read, and upon roll call and all voting in favor thereof, President Bach declared the said resolution duly passed and ad.opied and the Mayor's veto overridden. .A letter from the State of Minnesota, Department ' of Conservation,_ request- ing that the City of Rochester make a donation in the amount of $450.00 to _the Commissioner of Conservation for the operation of the gaging station in the. Zumbro River near Rochester was read and upon motion by Morris, second by Tingley,_ their .request was granted. The claim of `Kenneth Wallace in the amount of $50.00 for damage to his car caused by a loose manhole cover was read and upon motion by Morris, second by Tingley, the same was referred to the City attorney. A letter from the Mayor of Duluth, addressed to"Mayor McQuillan, giving an itinerary of the annual League of Minnesota Municipalities Convention to be held in Duluth on June 12-14, 1957 was read and President Bach ordered the same placed on file. _ A notice from the Railraod and Varehouse Commission of a hearing in the • matter of the application of Witte Transportation Company asking for a certificate for transportation of freight over various routes between Faribault and Rochester, said hearing to be held in the City Hall in Rochester on Tuesday, June 1rth,_ 1957 at 10:00 o'clock A. M. was read and President Bach ordered the same placed on file. A notice from the Railroad and Warehouse Commission of a hearing in the matter of the application of Monson Dray Line, Inc. asking for a certificate for transportation of freight over various routes in the State of Minnesota, said hearing to be held in the City Hall in Rochester on June 19 and 20, 1957 at 10:00 A. M. was read and President Bach ordered the .same placed on file. A letter from L. P. Zimmerman r'e laws prohibiting use of trunk highways for local celebrations was read and Presiddnt Bach ordered the same placed on file. • Record of Official Proceedings of the Common Council 5551 • of the City of Rochester, Minn., June 3. 1957 1 • 1 CJ 1 A letter from the State of Minnesota, Department of Health, enclosing a copy of their, report on Municipal Water Supply Section covering an examination of plans and specifications on water main extensions in the City of Rochester(16th, 17th and 18th Avenue from 7th Street tortorth line of Sauer's First Addition and 7th Street from west line of Sauer's First Addition to east line of Sauer's lst Addition) was read and President Bach ordered the same placed on file. A .lett'er from the State of iinnesota, Water Pollution Control Commission, stating that plans recently submitted for sanitary sewer extensions on 16th Avenue N. E., 17th Avenue N. E. and 7th Street N. E. were approved and a permit for con- centration was granted was read and President Bach ordered the same placed on file. The request of RochesterILks Lodge No. 1091, Inc. for authorization to . STAGE a parade on the evening of June 14, 1957 was read and upon motion by Whiting second by Morris, the requested authorization was granted. Alette-r from Walter H. Van Lith requesting an off sale liquor license in the •City of Roche<ster was read anA President Bach ordered the same placed on file. - A letter from -Frank W. Everett,, Fire Chief, requesting permission for himse]f •and two firemen to attend the- 92nd Annual Convention held by the Minnesota Fire Department Association -at Albert Lea, Minnesota on June 9, 10, 11 and 12, 195� the expense of their attendance at this 'convention to be paid by the City of Rochester, was read and upon motion by Morris, second by Haas, his request was granted: A letter from the -Board of -Public Health & Welfare requesting approval of the employment of,Roger Bergan of•213�Third Avenue Northwest as a vacation relief garbage collector.was read. Upon motion by Tingley, second by Morris, the appointment was approved. A letter from the -Board of'Public Health & Welfare requesting approval of the employment of•Miss Meryl A. Gilman as psychiatric social worker at the salary of $420.00 per month -effective July 1st, 19.57 was read and upon motion by Haas, second by Morris, the appointment was approved and the City.Clerk was instructed to prepare a resolution setting the said salary. "Be it and it is hereby further resolved by the said Board that hourly labor, full or part time, necessary for utility operation be paid at such a rate not:;.to exceed that adopted by the Common Council, but said labor not to participate in :EmAoyee's Retirement Plan. I( A letter, from the Kruse Company,requesting permission to.do.the street grading, base construction and bituminous surfacing in Lots 3, 4, 5, 6 and 7 in Block 9 Homestead'Addition was read. Upon.motion by Haas, second -by Whiting, the same was -referred: to the Street & Alley Committee and the City Engineer. The City�IEngineer's preliminary estimates in Miner's Heights Fourth Addition for Rough Grading in the amount of $3,360.00; Finish Grading $1,338.75; Base Construction' $2,102.50; Road -Mixed Bituminous Surface $6,235.65; Sanitary Sewer $4,204.00; Watermain $5,046.00 and Service Connections $1,990.00 were read and ordered placed on file. The recommendation of the -Board of Zoning that the petition of .Hayden Miller Company to ''have two parcels of land in Rolling Greens `Addition changed from a residential to a commercial zone be granted was read, and upon motion by Whiting, second by Tingley,; the recommendation was accepted and the City Clerk was instructei to publish a notice of a hearing on the requested zoning change, the said hearing to be held at 7:30 o' clo.ck P. M. on June 17th, 1957. The recommendation of the Street &. Alley Committee -that the Kruse Company be permitted to grade and surface Granger Court abutting Lots 3, 4, 5, "6 and 7 in Block 9 Homestead Addition and that a contract be executed with the City for this work was read. Upson motion by Tingley, second by Morris, the recommendation was approved. The recommendation of the Street & Alley Committee that the receiving of bids on the three following projects which is advertised for June 17th, 1957 be cancelled an'd that) they be re --advertised for bids on July 1st, 1957 was read; 1. E. Bridge. Upon motion by Tingley, 'second by Haas, the recommendation was approved. The request:=of . the. City' Engineer that` the following street names in the City of Rochester be changed was read: 1. Rename E1ton,Hilla Drive N.W. in Elton Hills First Sub- division between 18th Ave. N.W. and the east line of Elton Hills First Subdivision to 22nd St. N.W. 2: Rename lSth St. N.E. • in Greenway Addition to 19th St. N.E. 3. Rename 20th- St. N.W.. as platted in, Sunset Terrace to 19th St, N.W. 14. Rename 19th St. N.W..as platted in. Sunset Terrace to 192 St. N.W. 5. Name the street in the Plat of Southgate which abutts the east side of Lot 2 in Southgate (which is not named in the Plat) to 17th Ave. S.E. Also the recommendation of the Street & Alley Committee that the above request be granted was read. Upon motion -by -Tingley, second by Haas, the recommendation was approved and the City Attorney was instructed to prepare an Ordinance making the requested change. The recommendation of the S-treet & Alley Committee making the following recommendations in regard to the request of the Isaac Welton League "to place rubbii5h barrels at the major filling stations for collecting rubbish from outgoing and incoming carg° was read: (1) That no City maintained rubbish barrels be placed on the privately owned property of filling stations or other businesses. (2) That additional rubbish barrels^ be placed on the boulevards and sidewalks downtown where their need is indicated. Upon motion by Morris, second by Haas, the recommendation was approved. The recommendation of the Street & Alley Committee that Home Opportunities, Inc. be permitted to do the rough grading of streets in Sunset Terrace Addition at their expense, and that a contract be executed between the owners and the City to this effect was read and upon motion by Whiting, second by Haas, the recommendation was approved. Mr. Stanley Mohn was present in regard to doing his own rough grading in Sunset Terrace and requested that the Council take some action to get the plans completed as soon as possible so he could start the grading. He was .informed that the department was doing everything possible and hopped to have same ready, by June 17th. President Bach declared a fifteen minute recess. President Bach again called the meeting to order at 3:15 P. M. The statement .of i'No access. to lot "A" as it appears on the final plat should be changed to read "No access to Lot "A" from Lots 1-27 Block 1, and Lots 9-11 and 16-19 Block 2." d.`Lot "A".to be_deeded to the city for street purposes only e. Building.permits shall be withheld on lots 8 and 9, block 2 until the final location of the circumferential highway is. • established. f. The final alignment of the circumferential highway, as shown as Zot'A on this plat, is approved only to a point 280 ft. south of the east -west 1/4 line of section 33 T 107 N R 14 W. g. That part of 36th Ave. N.W. from TH No 14 to the south line of Section 33 T 107 N .R 14 W be deeded to the City of Rochester for street purposes only. The following_letter from the Rochester West Company was e,lso read: ['To the Mayor and the Common Council City of Rochester Rochester;Minnesota Gentlemen: We, the Rochester West Company, Contract for Deed holders of the land contained in Country Club manor Addition to the City of Rochester will give to the City of Rochaster a deed to Lot A, Country C17ub Manor First Addition for the express purpose and this purpose only, of the development of a future by-pass highway.` We further agree to give to the City of Rochester a deed to a strip of land eighty (80) feet wide to connect 36 Ave., N.W. as platted in Country Club Manor, First Addition, to the northerly right of way of state Trunk Highway #14 as it now exists. We further agree_that we will give to the City of Rochester the right'to refuse to issue building permits on lots 15 and 16, Block 3, lots 18 and 19, block 4, and lot 9, block 6 until the street abutting said lot is extended'to the West thereof. We further agree to give to the City of Rochester the right to refuse 'to issue building permit son lots 8 and 9 block 2 of said plat until such a time as a decision has been made on the course of the by- pass highway. The recommend ation of the Survey Committee that the final plat of Country Club Manor First Adait ion be gran'�ted final approval subject to the conditions as set forth by the Planning and Zoning Commission and receipt of the City Engineer's report was read. Upon motion by Haas, second by Morris, the recommendation of the Survey Committee was approved and' the City Attorney was instructed to prepare a resolution approving the said plat. -Upon motion by Tingley, seconded by Whiting, the meeting was adjourned until' 7: 30 P. Absent: Aldermen Moody and Schroeder. • The two following resolutions adopted by the Sinking Fund Commission were each read and upon motion by Morris, second by Whiting,,,the action of the Sinking Fund was approved: 11WHEREAS, the Public Utility Board of the City of Rochester, Minnesota, has adopted the following quoted resolution: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, 14:inneso to that the Sinking' Fund Commission of the said City be and is hereby requested to appropriate the amount of TWO HUNDRED THOUSAND DOLLARS ($200,000.00) from Uninvested Funds = Sinking,Fund for Electric Department Depreciation Reserve to the Public Utility .Fund - Electric Department; said funds being necessary for contract payments due on Dairyland Interconnection and I.B. M. .Circuit and Substations.1= SO THEREFORE, Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $200,000.00 be appr-opriated from the Sinking Fund for Electric Department Depreciation Reserve and paid to the Public Utility Fund". (Principal-$50,000.00; Interest $831.25). 11 A letter from Schmidt Awning & Siding Company requesting the Council to remove the parking meter directly in front of their place of business at 414 South Broadway was read. Upon motion by Haas, second by Morris, the same was referred to the Police Committee and the Chief of Police. The report of the City Engineer that a certain petition -requesting the construction of a sanitary s ewer on 6th Street Southwest from a point 1.90 feet west of 15th Avenue Southwest to a point 450 feet west which had been referred to his office on February 18th,. 1957 had been examined, checked and found to be in proper form and was signed by all of the owners of record, which represented 100 per cent in frontage of property affected by the making of the improvement which was so petitioned; the said report further stating that the improvement is feasible only after the sanitary sewer is extended from its present terminus at the west end of lla Street S. W. in Ba.ihleys Addition along the East side of T.H. 52 to 6th St. S.W. and that he recommended that this petition be incorporated with the above construct- ion which .had been previously petitioned was read. Upon motion by Tingley, second by Morris the recommend- ation of the Sewer Committee was approved. _The report of the City Engineer that a certain petition requesting the street grading, base construction and `surfacing, sanitary_sewer, watermain and service connections iri Graham's Second Addition which had been referred to his office on May 13, 11957 had been examined, checked and found to be in proper form, and was signed by'' all of the owners of record, representing 100% in frontage of property affected'by the making of the improvement which was so petitioned and further reporting,, that the improvement is feasible and should be constructed as petitioned but that separaie contracts be let for the different types of construct- ion and that the estimated cost, made without surveys or plans would bd $4o,000.00 was read. Upon motion by Tingley, second by Morris, the recommendatiox was approved. Mr. Glenn Murray of the Rochester West Company was present and stated that as long as the Council could not adopt a resolution approving the plat of Country Club Manor First Addition until they received a report from the City Engineer, they would like to request that they be granted seven additional temporary permits to construct houses so as to keep their employees at work. Alderman Whiting then moved that the request of the Rochester West Company for seven additional building permit I covering Lots 1, 2, 37, 39 and 141 in Block 5; Lot 1 in Block 7 and Lot 41 in Block 4 of the proposed ',Country Club Manor First Addition be granted on the condition tha' the Rochester West Company first file wfth the City Clerk an agreement to:,make�,the-_;;l residences on thelsaid lots so constructed to comply in all respects with the City 1 Building Code,.Zoning Regulations, street grades and the approved plat of Country Club Manor First Addition upon demand of the Common Counci-1. Alderman Whiting furt er moved that upon filing such an agreement, the Building Inspector is authorized to issue said permits;. Alderman Haas seconded the motion and all voted in favor there- of'. The recommendati on of the Fire Committee that the Rochester Fire Department be instructed to draw up specifications and advertise for bids to be opened August 5, 1957 for an Aerial Ladder Truck for use in the Rochester Fire Department was read. Upon motion by Whiting, second by Haas, the recommendation was approved and the City Clerk was; instructed to prepare a resolution ordering bids for the said fire truck. The application of Sidney Ellstrom for a Journeyman Plumber's License was read. Upon motion by Haas, second by Morris, the license was granted. Wiesener in the amount,of $500.00 with the Fidelity and Casualty Company of New York as surety was.read and upon motion:by Tingley, second by Whiting, the bond was approved, the surety thereon accepted and the same was ordered placed on file. The reports of the Clerk of Municipal Court for -the week ending May 17th, 1957 showing total criminal fines and costs collected $1,659.00 and civil fees received $23.30 and for the week ending May• 24th, �1957 showing total criminal fines and costs collected $1,203.43 and civil fees received $22.75 were each read and having been approved by the City Attorney, President Bach ordered the same placed on file. An ordinance providing for the acquistion of school, park and public ground site in lands being annexed to the City of Roches$er was given its second reading. Alderman Whiting introduced a revised ordinance providing for the acquisit— ion of school, park and public ground sites in lands being annexed to ,the City of Rochester which was given its first reading. A motion was then made by Tingley instructing the City Clerk to refer to the Planning and Zoning Commission all annexations which have been made subject to the adoption of Ordinance No. 963, with instructions to the Planning and Zoning Commission to consult with the Board of Education of School District 08, the Board of Park Commissioners and the Public Utility Board to determine whether desired school, park or public ground sites are located in such newly annexed areas and to report their findings to the Common Council with all convenient speed. Alderman Haas stated that he felt some action should be taken to secure the services of some concern to make the valuation of jobs and to get some des- • _ cription of all jobs before the setting of the budget for 1959-1959• R. V. Ehrick, City Attorney, suggested that possibly they could get Griffenhagen & Associates to bring the report they submitted in 1950 up to,date, and he felt there was some valuable information in the report that could possibly be used. A motion was then made by Alderman Haas that the President of the Council appoint a committee of three to investigate the job evaluation as set up by the.Grifferhagen report. Rochester, Minn., June 3 , 19 57 569 Bach then appointed Aldermen Haas, as Chairman, and Aldermen'Tingley and Whiting on this committee!, they to report back to the Council. Alderman' Whiting stated that he felt the Council should take some definite stand on the ebcton for the bond issue, as to amcunt, date of election, etc. After discussing the matter', a motion was made by Tingley, second by Morris, instructing the City Attorney and the City Clerk to prepare a resolution providing for this bond issue and calling for an election to be held thereon on July 16, 1957. All voted in favor t h'ereof. President Bach appointed Alderman Morris as acting chairman of the Lighting Committee' and the Purchasing Committee.
