of the City of Rochester, Minn., June 17, 19 57. •
Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers in the City Hall in said City
on June 17th, 19 57•
President Bach called the meeting to order at 5100 o'clock P. M., the
following members being present: President Bach, Aldermen Haas, Morris, Whiting,
and Schroeder. Absent: Aldermen Moody and Tingley.
A petition signed by eight residents. living on 7th Street Northeast request—
ing that the Council take some action about the situation of the road opened on 7th
Street Northeast as dust created by traffic over this unfinished road was so bad
that they P had to keep their windows and doors closed was.read. Upon motion by
Schroeder, second by Morris, the same was referred to the Street & Alley Committee.
The claim of Emma Williams in the amount of #17, 000.00 for injuries to her
right leg caused by a fall on the public sidewalk on the south side of Third Street
Southwest between First Avenue Southwest and Second Avenue Southwest and near the
Brown Hotel was read. Upon motion by Haas, second by Whiting, the claim was referred
to the City Attorney!,
A letter from C. A. Armstrong, City Engineer, stating that he had reviewed
the plat of Country Club Manor First Addition and found that it complied with the
requirements of Ordinance No. 704 and recommending its acceptance upon compliance
with the recommendations of the Planning Director's report of June 3rd, 195T was
read and ordered placed an file.
The request of the Board of Public -Health & Welfare for the approval of
the employment of Mr. Alvin Wondrow as garbage collector effective June 17, 195T
at the .begi.nning salary of .$270.00 per. month which is 90% of base salary was read
and upon motion by Schroeder, second .by Haas, the employment of Alvin Wondrow was
approved.
The report of the Railroad and Warehouse Commission that effective at
12:01 A. X, on June 17th, 195T the Rochester Bus Lines, -Inc. be authorized to charge
adults a straight cash fare of 150 and students a cash fare of 100, provided that

the student fare shall not be effective between the hours of 5:00 o'clock P. M. and
6:30 o'clock P. M. Monday through Saturday but shall be effective at all other
times and that the company give adequate notice to the public of the date of the
increase shall go into effect was read and President Bach ordered the same placed
on file.
A notice from the Railroad and Warehouse Commission that the hearing in the
matter of the application of Monson Dray. Line, Inc, set for 10:00 o'clock A. M, on
June 19th and 20th in the City Hall had been reset for the same dates but the place
had been changed to the Court House at Rochester was read and President Bach ordered
the same placed on file.
The two following resolutions adopted by the Public Utility Board were each

the- total amount of the said contract to_ be TWENTY FOOR HUNDRED
FIFTY ONE DOLLARS ($2451.00) and the said K and K Electric Supply
being the lowest responsible bidder."

the total amount of. the said contract to be EIGHT THOMAND EIGHT
HUNDRED AND THIRTY FIVE DOLLARS ($s, 935.00) and the said Layne -
Minnesota Company being the lowest responsible bidder."
A letter from the Board of Park 'Commiss I oners transmitting the two follow-
ing resolution was read:
"WHEREAS, the Board of -Park Commissioners, at a -recent meetiiig,--
found, that because of extraordinary services, certain adjustments
were essential in the payrol resolution passed by the Common. Council.
NOW,`THEREFORE, be it resolved by the Board of Park Commissioners,
that the°Honorable Mayor and the Common Council, approve the following
payroll changes:
Marna: Durst, Bookkeeper -Secretary of the Mayo Civic
Auditorium, listed at $2,990.00 yr.
be approved at
Office Manager. M.C.A, at $3,.300.00 yr.
Ronald .Braun, Equipment Operator at $3, 900.00 yr.
Be listed as
areenskeeper for months of April, .May,
June, July, August and September with a
salary increase for these months of $25,00
per month, as below

"BE IT AND IT_ I S HEREBY RESOLVED by the Board of Park Commissioners_
of the City of Rochest er, Minnesota, that the Honorable Mayor and the
Common Council of said City be, and is hereby requested to authorize
the said!Board to pay the seasonal hourly workers, classified below, a
iq an hour increase, such increase to be effective as of April S, 19570
All General Parks hourly employees to $1.70 - $1.75.
All Mayo�Civic Auditorium hourly.employees,.except the stagehands, 100 per
Pool hourly workers to be paid $1,000, $1.05 and $1.10. hour.
Passed by the Board of Park Commissioners of the City of Rochester,

Upon motion by Schroeder, second by Haas, the same were referred -to the Council as
a Committee as a whole for further consideration.
The following resolution adopted by the Board of Park Commissioners was
read and upon motion by Schroeder, second by Morris, the same was referred to the
Planning Commission:
6WHEAEAS, the Board of Park Commissioners have been presented with
a petition, signed by 82 home .owners, relative, to the necessity for a park
and playground area in the addition known as Bielenberg and Giese, and
WHEREAS, the area which they have.designated as suitable and acceptable

for this park and playground area is described as follows:
Lots 19 2, 3, 4 and 5.1n Block 4, plus the right-of-way _
on 151 Avenue from 16* Street B.H. to llth Ave. N.W., plus
lots 9_, 10, 119 129 14 and 14 in Block 3, Blelenberg and
Gloss's 4th Addition,
- NOW THEREFORE. BE IT RESOLVED that the Common Council of the
City of Rochester, at the request of the Board of Park Commissioners,
take whatever steps are necessary, as provided -by Charter in Sections
132 and 133, for the procurement of this property for park and play-
ground purposes.a
- A petition signed by Carl -Hutchings to have the following described property
changed from a residential to a- multiple dwelling zone was read -together with a
statement of acquiescence -signed by six residents'in that area. Upon motion by
Schroeder, second by Morris., the same was referred to the Board of.Zoning.

The recommendation of the Sewer Committee that permission be granted to
Buttreys Store at 113 South Broadway to discharge condensing water from the cooling
system into .the sanitary sewer at the reduced rate in accordance with the provisions
of Ordinance No.. 762 and further recommending that the reduced rate for clear
condensing water be continued at 5¢ per 100 cubic feet was read. Upon motion by
Haas, second by Whiting, ,the recommendation was approved.
The recommendation of the Sever Committee and the City Engineer that the
previously submitted report of Toltz, King, Duval, Anderson & Associates, Inc.,
Engineers and Architects, St. Paul, Minnesota, entitled Study of Sludge Digestion
Facilities at the Sewage Treatment Plant, Rochester, Minnesota be approved and that
the said Engineers be authorized, in accordance with their Engineering contract,.
to proceed with detailed plans and specifications for two (2) 70 foot diameter '
digesters recommended in the report was read. Upon motion by Haas, second by Morris,

The application of the National Vea Company for a license to sell non -
intoxicating malt liquors was read and upon motion by Morris, second by Haas, the
license was granted, -
The applications of the.Natioual Tea Company, Bay Stevens and Robert P.
Delisle for a- license to sell cigarettes were each read and upon motion by Schroeder,
second by Morris, the licenses were granted.
The applications of Ray Stevens, Hobert P. Delisle and the National Tea
Company for a license to sell soft drinks -were each read and upon motion by Morris.

The application of Lysne Construction Company for permission to move a
:double garage 22 g 26 from 1011 North Broadway to 17 - 12th Street Northwest over
the following route .was read: North on Broadway to 12th .Street Northwest then west
to.17 - 22th Street Northwest..,Upon motion by Schroeder, second by Whiting, -the
said permission was granted, the moving of the building to be done under'the super-
vision of the Building Inspector and the Chief of Police.
The license bond of Yelie-Ryan. Inc. in the amount of $1,000.00 with the
Western Surety Company.as surety was read and upon motion by Schroeder,_second,by
Haas, the bond was approved and the surety thereon accepted and the same was ordered

placed on file..
The contract bond of .Sam Rueb in the amount of $29000.00 with the Fidelity
and Casualty Company of New York and the contract bond of C. M. Boutelle in the
amount of $5,750,00 with the Western Surety Company as. surety were -each read and
upon motion;by Schroeder, second by Haas, the bonds were referred to the Mayor.,

Alderman Morrie introduced a resolution providing .for special election on
,general obligation bonds to be set for July 169 1957 which was read. Upon motion

Alderman Whiting introduced a resolution continuing offices of the Justice
to the Peace which was read. Upon .motion by. Schroeder, second by Whiting, resolution
adopted.
Upon motion by Whiting,- second by Haas, the meeting was adjourned until
7:.45 P. M.
President Bach called the meeting- to. order, at 7:45 P. M: with the follow-
ing members being present: President Bach, Aldermen Haas, Morris, Schroeder,
Tingley and Whiting. Absents Moody.
President Bach stated this as being the time and place set for a hearing
,on the change of zoning from a residential to a commercial zone of the two following
described. parcels of land located in Rolling Greens Addition:
1. Beginning'at a point on the Bast line of said quarter section
which is T6592 feet North of the center of said section thence
West parallel to the South line of the Northwest quarter of
Section 22 a distance of 668.9 feet, thence Southwesterly at
a deflection &ogle: of 9 degrees, 36 minutes to the�left' from
the previous course for a distance of 123.3 feet, thence
Northwesterly at a deflo ction angle of 84 degrees, 26 minutes
to the right from the previous course for a distance of
201.9 feet, thence Northerly along a curve to the right of
1009*74 foot radius for a distance of 267.02 feet, thence
North on a tangent to the curve a distance of 102.83 feet,
thence Bast parallel to the South line of the Northwest
quarter of Section 22 to the Bast line of said quarter section,
thence South on the quarter line to the place .of beginning.
2. Beginning at the Northwest corner of Rolling Greens Addition,
thence Southerly along the West line of Twenty—first Avenue,
Northwest a distance of 370.0 feet, thence Southwesterly a
distance of 480 feet more or less to the Bast Right of way
line of Trunk Highway 52, thence Northerly along said *right—
of—way line a distance of 615.0 feet to the intersection of'
.right-of-way line with the North line of "Rolling Greens gddition
extended, thence Bast along said extended line to the point.of
beginning. .
Mr. Cscar Allerton, of the Kruse Company, was present and stated that they had. -
petitioned to have these pieces of property changed to a commercial zone at this
time so .that people buying lots out in this addition would know where the commercial
areas would be located and they also felt some provision should -be made for a small
shopping center if they so desired. A plat of the land was then viewed and it was
suggested that. a row of lots be platted along the West side of the Bast proposed
commercial area. Mr. Allerton agreed to this and stated that he would bring in a
revised plat and, description showing the said row of residential lots which would
be deleted from the requested commercial area.
- President Bach stated this as being the time and place set for a hearing
on the grading, base construction and surfacing and the construction 'of a sanitary

Mr. E. J.''Janah of 919 7th Street Northeast was present and stated that
i
due t'o the opening; of 7th Street Northeast the dust at their ham was s,o bad that they
could not even open their doors and windows and would like to have the Council take
some action to correct this. He also reported awash-out'in said 7th Street North-
east.due to the heavy rain earlier this evening. He was informed that the petition
read earlier at this meeting on the same subject had been.referred to the Street &
Alley Committee. Mr. C. A. Armstrong, City Rngineer, was instructed to put a flare
or notice at the wash -out, if the same warranted.
Mr. Norbert Hutting was present and stated that he was a machine operator
at the City Dump Grounds and that he was being paid $3,900.00 per year and other
machine operators were reoeiving $4,200.00 per year. Upon motion by Whiting, second
by Tingley the same was referred to the Street & Alley Committee,
Alderman Tingley introduced "An Ordinance amending an ordinance entitled,
'An ordinance regulating the sale of intoxicating liquor within the City of Rochester,
providing for such sales by duly licensed persons, establishing regulations for the
operation of places where such intoxicating liquor is sold, providing regulations
for the granting of.such licenses, setting license fees, providing penalties for the
violation thereof, and repealing all inconsistent ordinances.' This is an emergency
ordinance rendered] necessary for the preservation of the public peace, health and
safety." which was'` given its first reading. (Amending Section 11 - Hours of Sale;
Section 12 - (i)' permitting dancing in certain premises)
A motion was made by'Aiderman Schroeder that the City Planning Director be
authorized to hire' a Junior College student `as a part-time draf tsman for the summer
months at the rate' of $1.50 per hour. Alderman Haas seconded the motion and all
voted in favor thereof.
Alderman Whiting stated that he felt some action should be taken immediately
on the dust on 7th Street northeast. It was suggested that either the road be tem-
porarily oiled and bladed or that -the bridge be.again closed. A motion was then made
by Alderman Whiting that the ' Council instruct the City` engineer to attempt' to keep
jth Street Northeast passable and to sufficiently, lay the dust so as not to be a
hazard. Alderman Tingley seconded the motion and upon roll call and Alderman Morris,
Tingley and Whiting voting in favor thereof and Alderman Haas and Schroeder and
President Bach voting "no", President Bach declared the motion lost.
A motion ',was then made by Alderman Haas, that the City Engineer be instruct
to close 7th Street Northeast due to (1) the expense that would be involved in main-
taining and controlling the dust; (2)'the hazard of driving on it as it now is;
(3) the fact that 'it is going to be closed on .July lot for permanent improvements,
and (4) that it has been shown in the past week that it is hazardous to use in its
present condition.,

Alderman Schroeder, seconded the motion and upon roll call and Alderman Haas,
Schroeder and President Bach voting in favor thereof and Alderman Morris, Tingley
and Whiting voting Ono", President Bach declared the motion lost.
A motion was then made by Alderman Tingley that 7th Street Northeast be
closed until proper maintenance has been applied to the road. Alderman Morris
seconded the motion and upon roll call and all voting in favor thereof, President
Bach declared the motion carried.
The Recommendation of the Street &.Alley Committee and the City Engineer
that the street system shown on the accompanying map be approved by the Council
and submitted to the Commissioner of Highways as its requested Municipal State
Aid System was read. Upon motion by Haas, second by Morris, the recommendation
was approved and the City Attorney was instructed to prepare a resolution approving
the said street system as recommeded by the Street & Alley Committee and the
City Engineer,
Alderman Whiting introduced a resolution authorizing and directing the
Mayor and City Clerk to execute a contract between the City of Rochester and The
Kruse Company providing for the grading, base construction and bituminous surfac—
ing of Granger Court abutting Lots 3, 4, 5, 6 and 7 in Block 9, Homestead Addition
which was read. Upon motion by Schroeder, second by Morris, resolution adopted.
Alderman Whiting introduced a resolution authorizing and directing the.
City Clerk and Mayor to execute the contract between. the City of Rochester and
John B. Miner providing f orthe rough grading in Miner's Heights Pour th Addition,
which was read.. Upon motion by Whiting, second by Haas, resolution adopted.

Alderman Tingley reported that he had attended the League of .Minnesota
Municipalities Convention held in Duluth on June llth, 12th, 13th and 14th and
that. he had particularly enjoyed the speech made by our City Engineer, 0, A. Arm..
strong and also L. P. Zimmerman,_ Commissioner of Highways.
Upon motion by Morris, second by Tingley, the meeting was adjourned until
7330 P. M. on June 28th, 1957.
