Minutes of an adjourned regular meeting of the Common Council of the
(City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
(said City, on July g, 19 5T.
President Bach called the meeting to order at T:30 o'clock P. M., the
following members being present: President Bach, Aldermen Haas, Schroeder, Tingley,
Whiting.
A petition signed by E. A. Rundell of Rundell Lumber & Fuel Company
requesting that they be allowed to hire the construction of the rough grading and
base construction for Second Avenue Southwest in Grahams 2nd Addition and also the
installation of the sanitary sewer, water mains, and service connections necessary
for the addition was read and upon motion by Haas, second by Schroeder, the same
was referred to the Street & Alley, Sewer and Water Committees and the City
Engineer.
A letter from Michael Collins making application for an "off sale"
liquor license in the City of Rochester was read and upon motion by Schroeder,
second by Tingley, the same was ordered placed on file.
The request of . th-e Board of Public Health & Welfare for approval of the
employment of Miss Joyce Savage, R. N. effective June 15th, 1957 at a beginning
salary of $340,00 per month was read and upon motion by Schroeder, second by Haas,
the appointment was approved.•
A letter from the Board of Public Health requesting that the Council
authorize execution of a lease covering rental space in the Public Health Center
to the Division of Vocational Rehabilitation, Minnesota Department, was read and
upon motion by Whiting, second by Schroeder, the same was approved and the City
Attorney was instructed to prepare a resolution authorizing execution of the
said contract.
The following preliminary estimates for construction in Graham's 2nd
Addition were each read and President Bach ordered the same placed on file:
Sanitary sewer, $6,490.25; Water main, $9,160.00; service connections, $5,445.00;
grading, $1,847.00; base construction, $3,219.00; reshaping base for surfacing,
$964.25 and road -mixed bituminous surface, $4, 792.00.
A petition signed by Gerhard and Dorothy Botcher to have the following
described property annexed to the City was read and upon motion by Schroeder,
second by Haas, the same was referred to the Planning Commission:
"That part of the Southwest Quarter (SWJ) of the Southeast
Quarter (SEJ) of Section No. twenty-five (25) in Township
No. one hundred seven (107) North, of Range No. fourteen
(14) West, lging south and _east of the center line of State
Aid Road No. "2n, also known as the,Wabasha Road as the same
now crosses said Southwest Quarter (SWJ) of the Southeast
Quarter (SEi), containing about 89/100-(.89) of an acre,
in the County of Olmsted and State of Minnesota. " _

Rochester Fire Department., on his property at 1606 - 3rd Street Northeast, was
read and upon motion by Haas, second by Whiting, the same was referrQd to the
Finance Committlee.
The recommendation of the Finance Committee that the Fire Department
Relief Association grant a loan to Richard Toogod on his residence at 16o6 -.3rd
Street N. E. in the amount of $9,000.00 was,read and upon motion by Haas, second
by Tingley, the, recommendation was approved.
The report of the Clerk of Municipal Court for the week ending June 28,
1957 showing total criminal fines and costs collected $1,41j.59 and civil fees
received $20.801was read and having been approved by the City Attorney, President
Bach ordered the same placed on file.
The reports for the month of June, 1957 of the Building Inspector
showing.fees collected for building permits issued $994.00; of the Electrical
Inspector showing fees collected for electrical permits issued $277.25; of the
Plumbing Inspector showing fees collected for plumbing ,permits .issued $808. 50;
of the Heating Inspector showing fees collected for heating permits issued $375.7!
and fees collected for sign permits issued $59.45 were. each read.and President
Bach ordered the same placed on file'
The recommendation of the Street & Alley Committee and the City Engineer
that the bid of, luarve & Anderson Company for base construction and surfacing of
streets in Sunset Terrace Addition and in l9th Avenue N. W. in Valleyhigh Addition
north of 14th Street Northwest be accepted at the unit prices bid was -read and
upon motion by Tingley, second by Whiting, the recommendation was approved.
The recommendation of the Sewer and Water Committees and the City
Engineer that the bid of Carlisle G. Fraser for construction of a sanitary sewer
In 19th Avenue Northeast in Miner's Heights 4th Additioh be accepted at the unit
prices bid was read and upon motion by Tingley, second -by Whiting, the recommend-
ation was approved.
The recommendation of the Sewer and Water Committees and the City
Engineer that the bid of Carlisle G. Fraser for construction of a water main in
19th Avenue Northeast in Miner's Heights 4th Addition be accepted at the unit
prices bid was read and upon motion by Haas; second by Schroeder, the recommendati
was approved.
The recommendation of the Street & Alley Committee and the City Engineer
that the bid of 'Leon Joyce for grading and surfacing in 19th Avenue Northeast in
Miner's Heights 4th.Addtion be accepted at the unit prices bid was read and upon
motion by Tingley, second by Schroeder, the recommendation was approved.
The recommendation of the Sewer and Water Committees and the City
Engineer that the bid of Carlisle G. Fraser for construction of a sanitary sewer
in 8j Avenue N. :We and 9th Avenue N. W. in $reter's Replat be accepted at the unit

was approved.
'The recommendation of the Sewer and Water Committees and the City Engineer
that the' 'bid of Carlisle G. Fraser for construction of a' water main in 91 Avenue
N. W. and 9th Avenue N. W. in Kreter's Replat be accepted at the unit prices bid
was read -and upon motion by Schroeder, second bye Whiting, the recommendation
was approved.
The recommendation of the Sewer and Water Committees and the City Engineer
that the bid of'Carlisle=G. Fraser for construction of a storm sewer in 81 Avenue
N. W. and 9th Avenue N. W. in Kreter's Replat be accepted at the unit prices bid
was read and upon motion by Tingley, second by Haas, the recommendation was
approved, -
The recommendation of the Sewer and Water Committees and the City Engineer
that the bid of Carlisle G. Fraser for construction of sewer and water service
connections in SJ Avenue N, W. and 9th Avenue N. W. in Kreter's Replat be accepted
at the unit prices bid was read and upon motion by Haas, second by Tingley, the
recommendation was approved.
The recommendation of the Street & .Alley Committee and the City Engineer
that the bid of Leon Joyce for the street grading and bituminous surfacing on St
Avenue N. W. and 9th Avenue N. W. in Kreter's Replat be accepted at the unit prices
bid was read and upon motion by Tingley, second by Schroeder, the recommendation
was approved.
A letter addressed to Alderman: Tingley and signed by Roy Watson, Jr. as
President of the Kahler Corporation listing the two following things as possible
changes in the proposed dance permit ordinance. was read:
First, that, if possible, it should be amended to read
"Dancing is permitted within 15 feet of any standing, or
serving, bar." Actuallay in our case unless we cover
Y feet of the dance floor, we could not qualify under the
20 foot provision.
Second, I feel that the $1,000 fee is a little too high.
We do not want anyone to. feel that The Kaldler Corporation
is seeking a dance license for, itself, only, and I am
Inclined to think that if the fee is set at that price
many people will think that the dance license is set
at that rate to be out of range of anybody but ourselves.
Frankly, I think $750 would be adequate but if the Council
wishes to keep it.at $1,000 there would be no objection
from us. I am thinking merely in terms of others.
President Bach ordered the above letter tabled until the next meeting.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted
Resolution accepting the bid of Quarve & Anderson for the base constr-
notion and -surfacing of streets in Sunset Terrace Addition and in 19th Avenue
Northwest in Valleyhigh Addition north of loth Street Northwest. Upon motion by
Haas, second by Schroeder, resolution adopted.'

Resolution accepting the bid of.Carlisle G. Fraser for construction of
a sanitary sewer and water main in 19th Avenue Northeast in Miner's Heights 4th
Addition. Upon motion by Schroeder, second by Tingley, resolution adopted.
Re sol;uti on accepting the bid of Leon Joyce for the grading and surfac-
ing in 19th Avenue Northeast in Miner's Heights Fourth Addition. Upon motion by
Tingley, second by Whiting, resolution adopted.
Resolution accepting the bid of Carlisle G. Fraser for the construction
of a sanitary sewer, water main,. service connections and storm sewer in 8j Avenue
Northwest and 9th Avenue Northwest is 8reter's Replat. Upon motion by Whiting,

second by Haas,,. resolution adopted.
Resolution accepting bid of Leon Joyce for the street grading and bit-
uminous surfacing on Sa Avenue N. W. and 9th.Avenue N. W. in 8reter's Replat.
Upon motion by Haas, second by Schroeder, resolution adopted.
Resolution approving the following quoted resolution adopted by the
-Board of Park Commissioners on June 59 1957:
pIBE IT AND IT IS HEREBY RESOLVED by the Board of Park
Commissioners of the City of Rochester. Minnesota, that
the Honorable Mayor and the Common Council of said City
be, and is hereby requested to authorize the said Board
to pay the seasonal hourly workers, classified below, a
100 an hour increase, such increase to be effective as of
April 9, 1957•
All General Parks hourly employees to $1.70 - $1.75.
All Mayo Civic Auditorium hourly employees, except
the stagehands, 100 per hour,
Pool hourly workers to be paid $1.00, $1.0 5 and $1.10 . n
Upon motion by Schroeder, second by Whiting, resolution adopted.
Resolution authrmizing execution of lease between the City of Rochester
and State of Minnesota for space in public health center building. Upon motion
by Tingley, second by Whiting, resolution adopted..
Mr. Os. J. Allerton of The Kruse Company was again present in regard to.
the bids recieved for construction work in Rolling Greens Addition. He stated
that in regard to the water main, that the City Water Department was providing a
12" main on 33rd Street to supply I. B. M. and did not feel that they should be

charged for tapping into this main and that they noticed that specifications called
for a 12s water main in 21st Avenue and only 6" in 19th and 20th Avenue. and felt
that 21st Avenue did not need a larger main than l9th or 20th. Also in regard to
storm sewer the specifications call for a 601, storm sewer and he did not feel
that they needed more than a 12" or 18" and did not feel they should be charged
for more and also did not feel they should be charged for removal and installation
of a new culvert under Highway 52, the establishment of an open ditch with rip -rap
construction or approximately 100' . of 60" sewer on Highway 52 right of way.
Mr. Allerton also discussed the bids for construction work in Folwell
Heights Addition stating that he did notfeel they should be charged for more than
a 66 foot street just because 6th Street Southwest had been made wider than norm.

requirements and did not feel they should be charged in excess for utilities to
provide f uture'Southwest development. - Upon motion by Whiting, the matters brought
up by -Mr. Allerton were referred to the Sewer, Water and Street & Alley -Committees.
Haas seconded the motion and all voted in favor thereof.
Mr. John Chisholm was present and discussed the question of the City
helping to defray the coat of informing the problem of the nature of the proposed
bond issue.
Upon motion by Haas, second by Tingley, the meeting was adjourned until
Tt30 o'clock P. M. on Monday, July 15, 1957,
