HomeMy WebLinkAbout07-15-19576 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., July 1-5, 195T • Minutes of -an adjourned regular meeting of the Common Council of the City of Rochester., Minnesota, held in the Council Chambers, in -the City Hall, in said - City, on July 15th, - 1957• President Bach called the meeting to order at TOO o'clock P. M., the (following members being presents President Bach, Aldermen Haas, Morris, Schroeder, Tingley and Whiting. Absent: None. Upon motion by Haas, second by Whiting-, the minutes of .the meetings of (June 28th, July lot, July 2nd and July Sth were approved. President Bach stated this as the date set for a hearing on the construct - lion of a sanitary sewer in 13th Street Northwest from 2nd Avenue Northwest to a 1point approximately 300 feet West. There was no one present wishing to be heard. President Bach stated this as being the time and place set for a hearing on the construction of a trunk line sewer from the City system to Country Club Manor .First Addition. Mr. Prank Newhouse, Attorney for Rochester West Company, was present and requested that the Council adopt a resolution ordering bids for the construction of the said trunk line sewer. Mr. Prank Eaton, of the City Engineer's Department stated that the plans were not finished yet, but thought they would be in a week or so. It was decided that no action be taken until the plans were ready and approved. President Bach stated this as being the time and place -set for receiving and opening bids for the construction of a sanitary sewer, storm sewer, watermain and _service connections in Sunset Terrace Addition and in•19th Avenue Northwest north of 14th Street Northwest in-yalleyhigh Addition. The bid of Riverside Sand & Gravel Company -Carlton Penz for storm sewer in the .amount of $52,612.15, for sanitary sewer in the amount of $36.818.25, for watermain in the amount of $56,759.65 and sewer and water service connections in the amount of $34,720.00 and the bid of Carlisle G. Fraser, Inc. for watermain in the amount of $77,3980'30, for sanitary sewer in the amount of $49,330.60, for sewer and water service connect- ions in the amount of $36, 288.00 and for storm sewer in -the amount of $60, 490.60 lwere each received and opened. Upon motion by Morris, second by Whiting the bids were referred to the Sewer and Water Committees and the City Engineer for tabulation land report. The following recommendation from the Street & Alley and Sewer and Water Committees was reads- lRelative to Polwell Heights Addition Memo referred to us on July 8, from bids received, we will allow these credits: No. 1 Cost above normal_ 66 f t. street $2400.00 No. 2 None No, 3 Water across Highway 7760.00 Water Assessment to Others 1260.00 Sanitary Sewer Assessment to Others 6000.00- Total $IT,420.00 Before assessments are made, we will confer with owners of Folwell Heights Addition, for further credits if any." The recommendation of the Sewer & Water Committee and the* City Engineer for the construction of a sanitary sewer in 6th Street Southwest, Folwell Lane, Folwell Court in Folwell Heights Addition be accepted at theunit prices bid and checks be returned to the unsuccessful bidders was read and upon motion by Whiting second by Haas, the recommendation was approved.- Tb recommendation of the Street & Alley Committee and the Citj Engineer that the bid of ',Leon Joyce for the street grading and bituminous surfacing on 6th Street S.W.,.Folwell Lane and Folwell Court in Folwell Heights Addition be accepted at the unit prices bid and checks be returned to the unsuccessful bidders was read and upon motion 'by Schroeder, second by Whiting, the recommendation was approved. The following recommendation from the Street &, Alley Committee and the Sewer and Water Committee was -read: "Relative to Memorandum of Rolling Greens Addition of July g, 1957 referred to us, from the bids wereceived we recommend the following credits: Difference in cost from 12" to g" water, $5, 075• (33 St.) Difference in cost from 12" to SH water, 3,625. (21 Ave.) Water across highway 4 870, Grade * - 33 St. 4 000. .Grade S.P. 12 ft. (not lg ft. ) too, Omit 2 storm sewer stations 1.32 0. Total 23, 9O. I. B. M. agreed to participation of $4,680o "- A motion was then made by Whiting, second by Haas, that the recommendation be approved. Mr. Oscar Allerton of the Kruse Company was present and stated that they were opposed to the amount of the bids for sanitary sewer, watermain and grading and surfacing but suggested that the storm sewer be not constructed at 0 Record of Official Proceedings of the Common Council of the City of Rochester, Minn.. July 15. - 1957 • at this time and that the water be drained off through.its natural course. He further stated that the developers would agree to keep certain lots as undevel- oped and off the market if the natural surface drainage arrangement was agreed to. The matter as to where this water would drain to and whose land would be affected was also discussed. .'President Bach called for a vote on the motion by Whiting and Haas that the above recommendation be accepted and all voting:.linos President Bach declared the motion not adopted. A motion was then made by Haas, second by Tingley, that the matter of construction in Rolling Greens again be referred to the Street & Alley, Sewer and Water Committees. All voted in favor of the motion. • Mr. Bill Ford,- Agent for Local 949, International Brotherhood of Elec- trical Workers, was present. and stated that he understood that salaries for the Public Utility Board had not been approved by the Council and the members of his organization were very anxious to get, their money.. Alderman Tingley informed Mr, Ford that the resolution had been previously approved by the Council and vetoed by the Mayor and that on July 2nd the same had been tabled to give the Mayor time to most with the Public Utility Board. Mayor McQuillan stated that he had conferred with the Board and his veto was because of dissatisfaction of four employees, however, he was in favor of the rest of the salaries and suggested that the Council approve those and act on the other four later. The resolution authorizing the Public Utility Board to pay salaries in the Public Utility De- partment"as set by resolution adopted May 28th, 1957 and vetoed by the Mayor on June 5th, 1957 was again read. President Bach then announced that if there was no further action to delay or table this matter it will be placed on vote at this time. Upon roll call and all voting in favor thereof, President Bach declared the resolution approved. The claim of Minnie A. Rommel for personal injury received by reasons of a defect in the sidewalk in front of premises known as 1515 3rd Street North- east in the amount of $10,000.00 was read and upon motion by Haas, second by • Whiting, the same was referred to the City Attorney. A letter from the Board of Public Health & Welfare requesting approval of the employment of Miss Charlotte Connelly effective July 16th, 1957 at the beginning salary of $175.00 per month as clerk -typist in the health department was read. 'Upon motion by Morris, second by Schroeder, the appointment was approved. A letter from the League of Minnesota Municipalities regarding the. University Institute on Minnesota Government and Politics to be held July 22nd through August 2nd, 1957 was read and the same was ordered placed on file. M. McGhie re: project number 5618• Northgate Addition was read and upon motion.by Schroeder, second by Haas, the same mas referred to the City Attorney; "Honorable Mayor,. Common Council, City Engineer, City of Rochester, Minnesota Gentlemen; Re; Project Number 56i8 This is to inform you that all construction of watermain, sanitary sewer,'service lines and storm sewer has been completed on the above proje ct. This project is in Northgate Addition and the prime contractor is Hutchinson and Sauer Inc.. Construction of the above listed utilities was done in the 1956 construction seaoon. The work has been checked over during the past two weeks and I hereby certify that the work is completed according to the Specifications of the City of Rochester. . If Ithe work is considered acceptable, on behalf of the above prime contractor, I request a release of that part of his bond which covers the. listed completed work. Respectfully, s/$. M. McGHIE Professional Civil Engineer" The application of Jake F. Wolf for a Master Plumber's License was read. Upon motion by Tingley, second by Whiting, the license was granted. The application of. C. H. Wobschall for a Journeyman Plumbers license was read and_upon motion by Tingley, second by Whiting, the license was granted. The license bond of Jake F. Wolf in the amount of $1,000#00 with, the Fidelity and Casualty Company of New York as surety was read, Upon motion by Schroeder, second by Whiting, the bond was approved, the surety thereon accepted and the same was ordered placed on file. The contract bonds of Leon Joyce in the amounts of $7,477.15, $179915.15 and $63,230.00 ,;with the Seaboard Surety Company of New York as surety; the contra bond of Quarve I!and Anderson Company in the amount of $73,470.00 with the. Seaboard) Surety Company of New York as surety; and the contract bonds of Carlisle G. Fraser in the amounts of $2,145. 00, $5,153.90, $4,198.90. $5, 064.00, $5, 229.05 and $4,536.50 with the Federal Insurance Company of the State of New Jersey as surety were each read. Upon motion by Schroeder, second by Whiting, the bonds were.referred to the Mayor for his approval. The report of the Clerk of Municipal Court for the week ending July 5th, 1957 showing total criminal fines and costs collected in the amount of $1,185.00 and Civil Fees received in the amount of $12.70 was ready and having been approvei by the City Attorney, the same was grdered placed on file. The following recommendation from the Street & Alley Committee .and the Sewer and Water!Committee was read; nwe recommend that Edwin A. Rundell, Jr. be granted permission to do his own rough grading, sanitary sewer, watermain and service connections in 2nd Avenue Southwest and loth Street Southwest in Grahams Second Addition under the supervision of the City Engineer, and in; compliances to bond, etc. But first, the request of the Park Board for a Park in this area should be determined. Attorney was instructed to prepare the necessary papers allowing Mr. Rundell to do his own work. The recommendation of the Police Committee that the request of the First National Bank to have the Bast -West alley, South of 2nd Street S.W., between let Avenue and 2nd Avenue S.W. designated for one way travel from Mast to West be granted was read. Upon motion by Tingley, second by Whiting, the recommendation was tabled until the next meeting. The recommendation of the Sewer & Water Committee and the City Engineer that the bid of Carlton Penz-Riverside Sand- & Gravel for construction of a water main in Sunset Terrace Addition and in 19th Avenue T.W. in Yalleyhigh Addition north of 14th Street N.W. be accepted at the unit prices bid and checks be returned to the unsuccessful bidders was read. Upon motion by Haas, second by Morris, the recommendation was_ approved. The following letter from the Rochester Airport Committee was read: nAt a meeting of the Rochester Airport Committee on Tuesday, July 9, 1957, the Committee voted to recommend to the Common Council, subject to approval of -the City Attorney, Mr. Bhrick, that the City advertise for bids for the removal of all the buildings on the Edgar Jensen and the Grace Lilly farms, excepting the house on the Grace Lilly farm, which could be used for construction shelter.n Mr. R. Y. Ehrick reported that there was a lease on the Grace Lilly farm which did not expire until April let, 1958. A motion was then made by Haas referring the letter back to the Airport -.Commission for further consideration.in view of the fact that there is an existing lease on the Grace Lilly property until 1 1 • 1 1, - April 1, 1959. Alderman Tingley seconded the motion and all voted' in favor thereof. V, Ehrick, City Attorney,'reported that the Mayo -Association had given $250',,000 to the City last September to help defray condemnation costs at the Rochester Airport and that since the checks were being held, they would like to have part of their money back to invest in short term investments and also that there seemed to be excessive funds in -the City Treasury which probably could also be invested. A motion was made by Alderman Whiting that the finance committee be instructed to investigate this matter and report back to the Council, Alderman Haas seconded the motion and all voting in favor thereof, Alderman Morris reported that Harold Blazing of the Electric Department had recommended to him that the City consider putting lights on standards at the end of each island on the 12th Street Southeast beltline, and that the State Highway Department would -probably pay 90 % of the cost, 'Upon motion by Haas' second by Morris, the same was referred to the lighting committee and -the police committee. All voted in favor of the motion, Alderman Morris stated that he had received numerous:.calls about the creek on. 5th Avenue Northwest in the 1200 block, being clogged with brush and debris and suggested the possible dredging of same. An Ordinance entitled "An Ordinance amending an Ordinance entitled, "An Ordinance regulating the sale of intoxicating liquor within the City of Rochester, providing fo such sales by duly licensed persons, establishing regulations for the operation of places where such intoxicating liwbr is sold, providing regula- tions for the granting of such licenses, setting license fees, providing penalties for the violation thereof, and repealing all inconsistent ordinances. (1) (2) No dancing is permitted within • .twenty feety of any standing or serving bar." be amended to read as follower "Section 12..
