Minutes of a special meeting of the Common Council of t 1-B City of Rochester,
Minnesota, held in the Council C %embers, in the City Hall, in said City, on August 8t h,
1921, at 2 o'clock, P.M. _
Meeting called to order by President Weeks.
Roll Call: Present:TWeeks, Erickson, Frank, Miner, Olson, Witzke. Absent:
Case. '
The call for the special meeting was read; said meeting being called for the
purpose of considering ways and means of construction of a trunk sanitary sewer system,
which is necessary to relieve the present sanitary sewer system, and any other business
that the said Common Council ,might deem proper.
The following petitio4 was read, and motion by 61son second by Erickson
carried that the same be placed 'on file:

Charles H. Armstrong, City Engineer, when called on for reconmenda_
' tions in the matter, said that he lad nothing to add to the recommendations
whit h were made 'in his last annual report, except that a branch should be
taken from the proposed new trunk system and carried as far up town as the
intersection of Third Street Northwest and Second Avenue Nort hNest in order
to out over the Second Avenue Sewer and thus divert 't he new Kabler sewage
into the new trunk system and there -by relieve the old trunk line sewer.
H. J. Barwick said that he did not realize how serious the aitua-
tion is until a day or two previous he had the opportunity, at the request
of t he City Engineer, to view how badly t be present trunk system is over, -
loaded, and
that

system will not handle the added demand upon it
He further said that the present sewer system was designed for a
village and now has to be used for a City, and urged speed' in making addit-
ions to our facilities in that line; he stating that be thought the Charter
Commission would be favorable to such amendments as would be necessary to

promote this project, if any are. to be required,
J. H. KaAer said for the past three years. the present system 'Ins not been
adequate to take care of the Colonial hospital and that every Council has" passed the
buck" on relieving conditions until now this one must take action at once.
Alderman Olson said consideration must first be given to the question as to
bow the project is to be financed, lies whether it is to be a bond issue or by a tax
levy to be paid next year, how much t he cost will be and where and how t he assessments
will be spread.
Alderman Frank favored a bond issue running, say, for five years to defray
the cost of such as may have to be paid by general taxation, and also to get proper
amendments to t he C barter in effect, so t hat t he City can do t he job and be in a posi-
tion to employ home labor in the construction.
George B. Knowlton favored a system planned so that it will be big enough
to carry all possible extensions for the future, and that, home labor be used in its
construction.
Alderman Witzke reported that be had that day viewed the outlet of the
present sewer system and found it to be flowing wit Un two or three . inc hps of its full
capacity.
Win. C. Fraser took exceptions to t hie reference that the present trunk sys-
tern was not planned large enough when it was built and explained that it could not
have been laid out on larger lines, as there was great opposition at that time to
even laying the main trunk as large as it is# he saying that the common tendency to
pacify public opposition has caused this same trouble in many places to sue h an ex-
tent that many times only a ten inch sewer is laid for the trunk lines
He further said that the present City Engineer' is better qualified to lay
out this new trunk system than any of her person who could be secured, as be is famil-
iar with local conditions and needs.
H. S. Adams said that in circulating the above petitions, he found only a
few who objected to signing it and that the result was the work of only a few hours.
C. W. Blakely asserted that every live man in the City appreciates the
urgent need of a greater system, and t hat should the cost be 5$1001,000.00 be was sure
the people would vote for it, and also urged that the necessary resolution to pur-
chase the pipe be passed and that home labor be used in immediately commencing the
work.
E. C. I3ackett, when called on by President Weeks, said that he had nothing
to say in the matter under discussion.
Alderman Olson agreed that the down -town section needs relief from the
congested condition of the present system and said that the Southwest part of t be
City must have consideration at the 66me time in that the financing, etc. shall be
large enough to provide funds for a sewer system and disposal plant for them also.

Alderman Erickson expressed himself as in accord with t he proposed
plan for the new trunk sewer provided that the funds, etc. be • arranged suf-
ficient to also cover sewer facilities for the southwest portion of the City.
George B. Knowlton asked if the new trunk system could be laid deep
enough so that the system. mentioned for the southwest portion of the City,
could be carried into it in order not, to have a sewer disposal plant in the
south part of the City and eventually another in the northern part to take
care of the present system and the proposed new trunk system, , to which
Charles H. Armstrong, City Engineer, replied that the excavations in making
the cross town runs would be too great to make that a feasible plan, and that
t he only alternative over the disposal plant would be the construction and
operation of a sewage pumping Station to carry from that district over the
grades and into the present or proposed system.
George B. Knowlton requested that the Charter amendments providing
for the levying of assessments for the cost and expense of laying water mains
be again submitted to the voters, providing that it is necessary to hold a
special election to authorize the financing of the proposed sewer extensions,
in order that those who can then get sewer service will also be sure of gett-
ing water with which to use it.
Alderman Miner suggested that Amendment No: 1 be again submitted to
the voters, and for the reason that home labor could be used in this project,
he thought that it would carry, to which J. H. Ka filer replied that he did not
think this Amendment could, be voted on again just at this time as his under-
standing was that no amendment could again be submitted within six months
after its rejection.
President Weeks urged that the voters be made familiar with the
issue in all its phases if an election is to be held to provide funds, etc*,
as rus opinion is that unless that is done, they will reject every amendment
:that is put up for their ratification as they are afraid of the unexplained
provisions.
George W. Haney stated that the amendment providing for the assess-
ing of the cost and expense of laying water mains will never carry until the
Common Council and Public Utility Board fix a policy which they will both
abide by, and then say to the public in general that there will be no more
water mains laid with the entire cost to be paid by the City, and then only
will the voters adopt an amendment of that sort, and' cited, as a lack of
policy, the cases where water mains were laid at once in former West Fourth
Street and West Sixth Street as soon as they were opened as streets, while
other localities have waited for years and can not get water service.
Motion by Olson second by Erickson carried that the Charter Com-

' mission be requested to q prepare and submit two proposed amendments to the Charter
of the City of Rochester, Minnesota; one to allow the City of Rochester to make its
own public improvements, and one to authorize the levying of assessments for the
cost and expense of laying water mains.
Motion by Olson second by Miner carried that the City Engineer be instruct-
ed to prepare' plans, specifications and estimates of cost for the construction of

the proposed trunk sewer system and for sewer facilities and a disposal plant for
the southwest, portion of said City.

Motion by Miner second by �'rickson carried that this Common Council recom-
mends that Doctor Charles H. Mayo and Doctor V'J:. F. Bleifuss be reimbursed from the
City Farm Fund for the amounts advanced by them into that fund as shown by the above
mentioned report.
The application of Howard Paul Campbell for a driver's license was read,
and motion by Miner second by Erickson carried that the same be referred to the Lic-
ense Committee.
The application of J. A. Stellmac her for a license asMmrailk producer and
milk distributor,of raw milk, was read, and motion by Olson second by Erickson carri-
ed that the said license be granted.
The application of B. L. Johnson for a license to conduct an auction sale
of the stock, fixtures and' other equipment formerly owned by the Olmsted County
Co-operative Association, which auction is to be conducted in the Olmsted County
Realty Building at the corner of Broadway Street South and Fourth Street Southeast,
and that the said sale stall commence on August llt'h, 1921, and continue for a period
of thirty days thereafter, was read, and motion by Olson second by Erickson carried
that the said license be granted.
The auction sale` license bond of B. L. Johnson, in the amount of Five

At a recent visit of a State Dairy and Food Commission inspector
several grocerymen were found to be selling milk aAd cream without a state
license. Grocers are not required to have such licenses by city ordinance,
this being a state law only and the enforcement of the law has always been
left with the State Dairy and. Food Commission. The local health office has
taken no steps to enforce it, partly because the question of sanitation is
not involved and partly because it appears to be. the policy of the Food Com-
mission to work independently of local health departments. We have tried to
,secure their cooperation and have asked that their inspectors call at the
office when in town, but so far without success. We allow :grocers to sell
milk (which of course comes only from licensed dealers) on condition that
they have suitable places for storing it and providing that no unsold milk
is held over for sale on day following delivery from dairy.
Relative to a report of the inspector that several food establish-
ments were unsereened, this was later denied by the inspectors Our inspect-
ions showed that there were no unsereened food stores in the city.
Ye are supplying a guaranteed rat poison, at cost, to those who are
troubled with these pests and are ready to cooperate with property owners in
getting rid of rate.

The following cotmnunication was read, and motion by Miner second by
Erickson carried that the appointment mentioned therein be confirmed for the
period, August lst, 1921, to September 30tN 1921, inclusive, and that the
said Wilbert Mc Henery be paid the salary of a Fireman, as heretofore provid-
ed, for that period:

Fireman in the Fire Department of said City.

Alderman Witzke requested the permission of the Common Council to advertise
t Yee intended action against such taxi owners and drivers as may not comply with the
local ordinances governing, and motion by Miner second. by Erickson carried that Fred
R . Witzke, as Chairman of the License Committee of said City, be granted the permis-
sion as requested.
Motion by Miner second by Witzke carried that the City Clerk be instructed
to notify the Chief of the Fire Department to remove the shed on the south end of the
Central Fire Station.
Motion by Miner second by Olson carried that the sum of 058*50 be appropri-
ated from the Fire Protection Fund and paid to George H. Nettleton, State Fire Marsh-.
al., for expenses in re -treading fire hose couplings of said City, as per the state -
went contained in his letter of August 4t h, 1921, addressed to the City Clerk of said
City.
Alderman Olson introduced t be following resolution whie h was read:
Whereas, the City of Rochester has entered into contracts for the construc-
tion of local public improvements in said City, the cost and expense of which
shall be paid by special assessments, levied as provided by law, said improve-
ments consisting of the construction of a sanitary sewer in the following named
Avenue:
In Fourt h Avenue Sout beast from t he center of Sixt h Street Sout beast to a
point 80 feet North of the North line of Seventh Street Southeast, and from the
center of Seventh Street Southeast to the center of Eighth Street Southeast.
Therefore, Be it and it is hereby resolved by the Common Council of the
City of Rochester:.
That said Common Council will meet at 8 o'clock P.M. on August 29th, 1921,
at the Council Chambers in the City Pall of said City, and will then and there
levy special assessments for the cost and expense of the above named improve-
ment, according to -the resolution heretofore adopted by said Common Council
detemining the mode of said assessments for said improvement*
Be it further resolved by said Common Council:
That the City Clerk of said City be and he is hereby directed to cause
notice of the time and place of said meeting and the purpose and object thereof

and cause the same to be published once in the official paper of said
City, not. less than ten days prior to the dateof said meeting.
Motion by Vpitzke second.by Erickson that said resolution be adopted.

President Weeks declared said resolution passed and adopted.
Alderman Erickson introduced the following resolution which was read
Whereas, the City of Rochester has entered into contracts for the
construction of local public improve
ments in said City, the cost and
expense pf which shall be paid by special assessments, levied as provided
by law, said improvements consisting of paving and curbing the following
n%ied streets and avenues:
For paving and curbing Second Avenue Southeast from the Nort hline
of Second Street Southeast to the South line of Center Street East;
For paving and curbing First Street Southeast froln the East line
of First Avenue Southeast to the East line of Second Avenue. Sout beast;
For paving and curbing First Street Northwest from the �7est line of
Seventh Avenue Northwest to the East line of Eleventh Avenue Northwest;
For paving and curbing First Street Northwest from the West line of
Second Avenue Northwest to the East line of Seventh Avenue Nort Yrvest;
For paving and curbing Eleventh Avenue Northwest from the North
line of Center Street West` to the North line of. Second Street Northwest.

Therefore, Be it and it is hereby resolved by the Common Council of
the City of Rochester:
That said Common Council will meet at 8 o'clock P.-M. on August 29tb
1921, at the Council Cumbers in the City Hall in said' City, and will than
and there levy special assessments for the cost and expense of the above
named improvements, according to the resolution , heretofore adopted by s
said Common Council, determining the mode of said assessments for said
improvements.
Be it further resolved by said Common Council:
That the City Clerk of said City be and he is hereby ordered and
directed to cause notice of the time and place of said meeting and the
purpose and object thereof and cause the same to be `published once in the
official paper of said City, not less than ten days prior to the date of
said meeting.
Motion by Erickson second by Miner that said resolution be adopted
as read: Roll Call: Ayes: Erickson, Frank, Miner, Olson, Witzke, Nays: None.
President Weeks declared said resolution passed and adopted.
Alderman Miner introduced the following resolution which was read:
Whereas, the City of Rochester has entered into contracts for the
construction of local public improvements in said City, the cost and

expense of which shall be paid by special assessments, levied as provided by +
law, said improvements consisting of grading to an established grade line the
following named street:
Ninth Street Northwest from the West line of Broadway Street North to the
East line of Second Avenue Northwest.
Therefore, Be it and it is hereby resolved by the Common Council of the
City of Roc nester: '

Alderman Case said that he favored making the paving repairs
needed at the cost of the abutting property and that in commencing these
i proceedings the Council, by their unanimous action, gave expression that
they were in full accord with the plan for the improvement.
John Behrens opposed the taking out of the raised crossings as

they were constructed as part of the paving plan as approved by the Common'
Council and are satisfactory to the property owners as it is felt that

I vehicles to the center of the street and thus control their rate of speed.

i ings would be about 475000 00 each and opposed the assessing of the cost to

not have them taken out even if the City at large would pay for the job.
He further. said that all of the property owners are in too poor
financial circumstances to stand this extra assessment for treating this
street and removing the raised crossings as most of them laves not yet paid

j Rasmus Larsen did not want to pay for ,the raised crossings in
! the first costs of the improvement and then heave to pay for taking them

out, and in regard to the treating of this street with a s-irface coat of
j Tarvia "B" made the assertion that t here . was not tar enough used in the

Alderman Witzke wanted the property owners to fully understand
t tat t he cost of repairs will increase the longer the paving is allowed

to go without them.
Thomas Moody asked what was the reason for removing the raised
crossings to wlnc h the City Engineer replied that they were to be removed
because of the exorbitant maintenance cost, and referred to the fact that
nine of them on that street bad to be repaired during the past winter and
spring.
Mr. Moodysuggested that possibly the trouble arises from this street

:� having to carry the surface water from intersecting avenues from which

volume water gets under the blocks and freezes t hzs causing the blocks to bulge up
and requiring that they be re-laid. i
Alderman 'Witzke confirmed Alderman Case's assertion as to the Council
starting these proceedings for the best interest of the property owners and caution-
ed t but if t hese plans are abandoned later on, it will cost twice as much to make the
repairs which will t han be absolutely necessary, and expressed himself as being fav-
orable to the repairs of the paving under the plan as proposed.

ing his claim upon the fact tbat the levy upon it was much in excess of what was
actually done along his lots, and further that the property owners could not have
been consulted as to their benefits or his would not have been so much,
He was informed that while there might not have been a great amount of

Alderman Frank introduced a resolution levying special assess-
ments for the cost and expense of laying out and opening of a public alley
through Block 52 in Morse and Sargent's Addition and Lot Five in Haggertts
-Subdivision of Lots Five and Six in State Subdivision of Seciion Thirty-
-Six Township One Hundred Seven Range Fourteen, which was read.

H. H. Crawford submitted a sketch for a proposed Comfort Station
to be built onCity property to face First Avenue Southwest and to be
alongside the Stebbins Building, . and stated that he estimated the cost
,,:would be less than Three Thousand Dollars, complete; Mr. Stebbins having
,,offered the use of Ids wall in connection, under such conditions as will
be set forth after he sees the plan for the building.
Alderman Eri d�son asked why,no report had been made on the
feasibility of constructing tits Comfort Station in the basement of the
:Public Library Building, to whic h no reply -was mades
Mr. Crawford was unofficially instructed to prepare complete
plans, specifications, etc. ,for the construction of a Comfort Station on
the location as above set forth.
