President Weeks stated that this was the tine and Place fixed for a hearing on the arriard of damages made by the Commissioners in .t ha condemnation of the following described lands for use for street purposes, and asked if there was any one present vv o wished to be heard: Commencing at a point Four and One -hair (4-) feet 'v:+est of the Northwest corner of Block Six (F), in Elliott's Re -Subdivision of Cwnmings' Addition to the City of Rochester, Minnesota, for place of beginning; running thence due Northparallel with the East line of Sixth Avenue ' Nort hvvest in said City to a point Four and one- hdlf (42) feet west of a point where the South line of Eighth Street Northwest, if extended west in a straight line, would intersect said east line of Sixth Avenue Northwest, if ex- tended North, which is a point 510.4 feet west of Quarter Section line; running t hence west t i. rty-six (56) feet; running, 16hence southin, a, stra.i_.�-:ht to .a point four and 114 ,one-half (4-2) feet Fast of the Northeast corner of Block Eleven (11), in_ Elliott's Re -Subdivision; running thence East to place of, beginning. The City Clerk reported that tbere, had been no written. objections made and filed to the award of the Connissioners in the condemnatior. of the above described lands. The following estimate of cost for the taking of the above describ- ed lands was read, and motion by Case second by Erickson carried that the some be accepted and placed on file: "August 2nd, 19210 To the Ponorable Mayor, and Common Council. Gentlemen: - I hrrewith submit estimate of cost of opening of a 66 foot street known and designated as Sixt h Avenue Nort hwest from t he sout h line of Blocks Six and Eleven Elliott's Re -subdivision to the south line of Eighth Street Northwest to be Three thousand five hundred Dollars for the property taken, and that the cost of grading street will be One Thousand Dollars, making a total of Four Thousand Five Handred Dollars. Respectfully submitted, C. H. Armstrong, City Engineer." Alder±nan Olson came in at this time and took his Chair. The award of the Commissioners made in the condemnation . of the above described lands was read. AldeYraan Case introduced the following resolution wldc h was read: VIEEREAS, W. H. Hendricks, E. F. Weber and F. H. Gimbert, the Com- missioners appointed on July 25t4 A.D. 1921, in and by resolution of the Common Council of the City of Rochester, Minnesota, to view the lands and premises and to assess the damages occasioned by the condemna- tion and taking by said City of Rochester for use as public street the lands described in said resolution of appointment, to -wit: Cornimencing at. a point Four and One-half (42) feet West of the North west corner of Block Six (6), in Elliott's Re -Subdivision of Cimnings' Addition to the City of Rochester, Minnesota, .for place of beginning, running thence due North parallel wit h t he East line of Sixth Avenue Northwest in said City to a point Four and One- half (42) feet l'iest of a point where the South line of Eighth Street Northwest, if extended west in a straight line, would intersect said East line of Sixth Avenue Northwest, if extended North, which is a point Five Ilmdr. ed. Ten and Four -tenths (510.4) feet West of Quarter Section line; `running thence West Sixty-six (66) feet; running thence South in a straight line to a 115 point Four and one-half. (42) feet -Fast of the Northeast corner of Block Eleven (11), in Elliott's Re -Subdivision; running thence East to place of beginning. IIIIEREAS, the said City C1ePk on August 19t h, 19219 did publish a notice to all persons interested in said lands, in the Rochester Daily Bulletin, the official newspaper of said City, . to the effect that said report and award of damages had been made and filed as aforesaid, and that unless written objections were made thereto by persons interested in said lands, the said report and -award of damages would be con- firmed by the Common Council of said City of Rochester, at a meeting of said Common Council to be held at 2 o'clock P.M., on September 6t h, 1921, at the Council Chambers i in the City Hall of said City;, and the said notice was published in said newspaper for ten days prior to the date of the said meeting held on September 6t h, 1921;. And, WIEREAS, the said Common Council duly met at said time and place and heard and duly considered all objections offered and interposed by persons interested in the said lands and duly considered the said report a there- in y d p t and the award of damages there in made by said Commissioner's; AND, WI3EREAS, No written objection to the report of the Commissioners, or to the award of damages made by said Commissioners, as set forth in said report, were offered or filed by any person or party; NOW T HFREFORE, Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That the said report of said Commissioners made and filed as aforesaid, and the award of damages therein contained and set forth, be and the same are in all things } hereby approved and confirmed, and the said Common Council does hereby approve and confirm the said report and award of damages, as follows: For lands ,extending Nort h from t he Nort h end of Sixt h Avenue Nort hwest. This being the time and place set for the opening of bids for the furnish- ing of 300 barrels of Portland cement, the following bids were opened and read: IIAYES-LUCAS AND GREEN: t2.83 per barrel, which price includes 4 cloth bags to each barrel wbic h will be re -purchased at 10 cents each when returned in good ord- er to shippers at point of shipment, price f. o.b, cars Rochester, Minnesota. 'f f BOTSFORD LUMBER COMPANY: 03.00 per barrel, which price includes 4 cloth f f sacks to each barrel, which when returned prepaid to Cement Mill, Mason City, Iowa, drill be credited for at 10 cents for each sack, Mill count and inspection of sacks to govern, price f.o.b. cars, Rochester, Minnesota. KRUSE LUMBER AND COAL COMPANY: $2.93 per barrel, which price includes 4 cloth sacks which would be re -pure based at 10 cents per sack, City to do baling and prepay freight to mill and take mall count and check for all sacks returned, City to unload within required time or assume railroad demurrage, if any accrue, price f.o.b cars, "Rochester, Minnesota. Alderman Frank introduced the following resolution which was read: Be it resolved by the Common Council of the City of Rochester: That the I-Urley-Davidson Motorcycle purchased froca Leo. N. Herrick under contract dated August 29t h, 1921, be and the same is hereby accepted and that said motorcy6le be and it hereby is placed at the disposal of the Police Depart-: "Went of said City of Rochester: Motion by Miner second by Frank that said resolution be adopted as read: Roll Call: Ayes: Case, Erickson, Frank, Miner, Olson, Witzke. Hyman Lipschitz asked for a license to peddle ice cream and fruit from a wagon, and the Common Council expressed themselves as considering that there were enough of that class of licenses in effect now, but that if one of the present licens= es should quit the business another application might be favorably considered. 0. W. Schroeder asked if U.S. Liberty Loan bonds would be accepted at par in payment of special assessments for paving and curbing, and also asked if Pennan- ent Improvement Revolving Fund Bonds of the City of Rochester, iviinn., would be accept- 118 ed at par for the same purpose. In regard to the Pernenent Improvement Revolving Fund Bonds he was asked to submit t he bond nunber and amount at whit h the Common Council t,:-ould at once a9propriate to his order the par value and accrued interest of the said bond., and in the question of the Liberty Loan bonds the City Atto l,ney was asked to submit a ruling on the matter. Julius Snith asked for a refund of 22.00 on a. license to sell A 1000.00 worth of potatoes; the fee for said license being >25.00, on. the grounds that '-.e only sold eleven sacks of potatoes from the car and then sold the balance of the car to a farmer who took them to the country for storage. The City Attorney, after hearing the conditions in the case, rul- ed that there could be no refund ;nade.
