tion of thv receipts and sale and use of materials, and the results of labor expended,
in the Water Department of said City, and any of her business which the saiu Co�i.aon
Council -�1i.ght deem proper.

It was decided to submit the plans and explain the situation to the said
Board of health with the hope that they would waive the sli?ht difference in ,r;radi-
ent.
Motion by Witzke second by Case carried that the City li'ngineer personally
sul-)ntit the tentative _plans and specifications for the sewer systems in the Mort hvrest
;Iouu liAest parts of the City to the State Board of Health for their approval.

By the evidence submitted as exhibits "A -I r and lurt her corroborated by

^cater ,corks, Mir. '.u. G. Holmes, has exceeded his autivrity and ;Yawn a disregard of
the law in7 hi.s relations with one Mr. C. F. Dillon; and also -that he has failed to
-nuke proper and correct, reports to the Secretary of the Utility Board and to turn
over in proper tune, moneys collected by him•
Attention is called to the testimony of C. F. Dillon t i-at he paid Elr.
1161mes a certain po-apensation for his action in securing work for Mr. Dillon, and
also to the ;:pore serious charge that he sold material to the sane Mr. Dillon during
t he period under examination, to t ho mount of at least '?900.00, for wbic h no ac-
coluitinn seems to have been made.

C. F. Dillon stated before the Common Council that be paid
M. G. Holmes, Superintendent of the Water Department, a commission of
10%, during the year 1920son all the material, t IvA he used; t be said
Holmes having purchased :Vor..h4M everything, tb%t.,:was used during that
time, and when asked if t bat applied'also. to -,.tbe_ material that came from
the City stock Mrs Dillon said t hat be did .not knowingly pay any ccmmis-
sion on that, but t1at there was a question,' in, his mind as to whet ter or
not t here was not an addition made in t be billing of those items, which
when paid,, Mr. Holmes retained as commissionon them too.

Alderman Case introduced. the following resolution which was read:
Whereas,
at the request by.resolution passed by t he Common Council of the
City of "Rochester a special examination , on of t he books and records of the Water
Department of t be Public Utility,Poard of t be City of Rochester for the period
beginning April lst.' 19219 and,ending August 31st, 1921, was made by the State
Public Examinerts-office.on.September 9t 1921l and a written report and the
findings thereof have been .filed in. the office of. tbe City Clerk of said City of
