The following communication was read, and motion by Erickson second by Case carried that the sum of $32500 be appropriated from the General Fund and paid to Oscar T. Giere, City Assessor, as balance on sal- ary due ,him, and that the sum of $125,00 be appropriated from the General Fund and paid to P. F. Donovan, Deputy City Assessor, as balance- on salary du a him: "Rochester, Minn., Sept., 26th, 1921, To The Mayor and Common Council, Of the City of Rochester, Minn. Gentlemen:- I hereby request that, you appropriate the sum of $125.00 171 payable to Mr. P. F. Donovan -salary as Deputy City Assessor and the sum of $325.00 to me as City Assessor: This being the balance of amount set by you: Yours respectfully, Oscar T, Giere, City Assessor-*-" The following post -script to the above communication was read, and -motion by Miner second by Case carried that the same be placed on file, and that no action be taken on the said -request except that the City Clerk be instructed to jaotify Mr. Giere that a statement for the extra clerk hire that he found nec"sary to employ would be considered: "P,34 As my Deputy Mr. P. F, Donovan has labored faithfully with me for four full months I feel that he is intitled to receive another S10000 extra and I feel that as I have had to put in six full months at the assessment that I ought to be intitled to receive the sum of $300 00 this appropriation. extra and sincerely request that you make In making this assessment we have not only put in the time stated above but we also worked all evenings four Six Weeks except Saturdays and also Three Sundays. I leave this absolute in your hands, as I know that you will do what is Just and right: You are of course well aware of, that there are more or less expenses also connected with taking the assessments and vdiich I have to pay. Motion by Witzke second by Frank carried that the City Attorney be request- ed for a ruling as to what vdll be the proper proceedings to provide for a City Asses- sor whose term of office will be from April first to April first, and who could re- ceive his record books at the beginning of his term of office for filing at the end of the term. The following communication was read, and motion by Case second by Erick- son carried that the same be referred to the City Attorney: "OBJECTIONS TO ASSESSMENT FOR PAVING AND CURB. TO THE CITY OF RO CHESTER AND THE HONORABLE THE COMMON COUNCIL THER DO F, AND TO PROM IT MAY CONCERN: . WHEREAS Property of the Chicago & Korth -Western Railway Company has been assessed in the matter of the paving of First Avenue Korthwest, between the south line of Sixth Street,Korthwest and the south tracks of said railway, in said city, as appears by the Resolution adopted by said Council in said matter on August 8, 1921, NOW THEREVORk, Said Chicago & Korth -Western Railway Company hereby objects to said .assessment' upon the grounds that the same, as to the property of this objector, is illegal, void, unequal, excessive, and, without limiting the fort 17 going general objections, upon the: special grounds following; 1. That there is no warrant in law for assessing said property of this objector in any sum, mat every . 2. That such assessment deprives this objector of its property without due process of law, denies to this objector the equal protection of the 1 aws$ and Impairs the obligation of contract as to this objector. • 1 awsi) 0 N That this objector is exempt from such assessment under the 4e That said assessment is not uniform upon the same class of property and that the said property of this objector is assessed in an amount greater in proportion than other property in the same. class. ` 50 That none of said prop erty of this objector is specially benefited by said improvement. 6 That said assessment exceeds any special benefit accruing to my of obj ector's said property by said assessment. 7;e That in the making, levying, and confirming of said assess- ment upon said property of this objectors .said Council proceeded arbitrar- ily, under mistake of fact and law and without exercising its discretion. 8. That no part of said improvement as constructed extends further south than the most northerly of the tracks -of this objector, and that Lots 7 and 8 in Block 60 and Lots 5 and 6 in Block .59 do not abut upon any part of said improvement and receive no benefit thereby. 9. That there is practically no curbing laid opposite Lots 11 and 12 of Block '65 and Lots 1, 2, 3, 40 5 , and 6 of Block 66, but said lots, although not benefited by any curbing provided by said improvement, are assessed for curbing to as great an amount as lots provided by said improvement with curbing along the entire front thereof.
