The report of the Building and Electrioal Inspector for the month
of Sept ember, 1921p shovring the sum of 011.25 as havintig been collected for

Electrical inspectio and the sum of'072.00 as having been collected for
Building inspection fees, was reads and motion by Case second by Erickson
carried that th6 some be referred to the Finance Connittee.
The report of the Milk, Inspector for the weeks ending September
24., 1921, said fictober 1p 1921, were each separately 'reads and motion by
Erickson second by Prank carried that the same be placed on file.
The following report of the City Justice was reads and motion by
Miner second by Olson carried that the same be referred to the City Attorney..

You are advised that, effective on this date, Charles H. Ellison was
removed from office as Patrolman of. said City.

Motion by 'i.tzke second by Frank carried that the City Clerk be
Instructed to submit the following as recommendations 'from they Common
Council of this City -to the Mayor of said City, with the request that he
give proper consideration of the same: ,
First, that each Patrolman be given a beat and that he be re-
quired to walk it;

Second, that the hours o f duty of the Patrolmen be apportioned
so that there shall be one on duty on Broadway Street at all hours;
Third, that all Patrolmen be specifically instructed to abate
all unnecessary noises between midnight and morning; this particular re-
ference applying to the boisterous conduct of those returnin4 to the City

from country dances, etc.
The petition of Oscar W. Hjerling and Petra Korshavn that a
sidewalk be constructed -on the west side of Lots S. 9 and 10, in Block 88,
Original Plat, was read, and motion by Miner second by Olson carried that
the same 'pe referred to the Street and Alley Committee. "
Copies of the answer to the simmone anal a demand for change of
venue made by James T. Spillane, City Attorney, in -the matter of Sarah
G-ollimore and Elisha M. Gallimore, vs the City of Rochester, Minnesota,
were each separately read, and Motion by Olson second by Case carried that
the same be placed on filei,'
• Motion by Miner second by Olson carried that the matter of
securing polling places for the Special Election to be held on Tu-boday,
October 18, 19219, and the fixing of .rentals therefor be referred to the
Public Grounds Committee with power to acts ,
• Motion by Miner second by Frank carried that the claim of W. Le
Eaton in the a -count of $10.00 for t a,ri service to Dodge Center, Minnesota,
be returned to him with the request that he file :the some with the County.
Auditor of Olmsted County for payment by the County of Olmated,.as the
officials of Dodge Center, Minnesota, called for the Sheriff here and
he could not be -reached as he was out of town, as was his Deputy, who was
at the Fair Grounds, consequentlyr, the . said officials called the Chief of
Police -of this City who responded .to their call for help; this Cojamon
Council feeling that although the Chief of Police made this trip, It is up
to Olmsted County or Dodge County to pay the said.eharges for services,
with the preference that the claim be first rendered to Olmsted County.

Fielding and Shepley, Inc., as payment of final estimate prepared by C. He -
Armstrong, City Engineer, for the paving and curbing of First Street Southwest
from' the center line of Twelfth Avenue Southwest to the East line of Sixteenth
Avenue Southwest, approved and allowed by said Common,Council..

Alderman Witzke introduced the following resolution which was read:
Whereas, the Common Council of the City of Rochester, Minnesota, at a
meeting thereof held on July 25th, 19219 after notice given and hearing had as
provided by law, did duly pass and adopt a resolution ordering that local public
improvementss the cost and expense of which, including the amount of money paid
or awarded as damages for all lands necessary for said improvements,' shall be
paid by special assessments levied as provided by lava_ be made in the City as
follows:
.That R public street be laid out and opened along and across the following
real-estate situate in,,the City of Rochester, Olmsted County, Minnesota, viz:
Commencing at a point Four and One-half (42-) feet West of the Northwest
corner of Block Six (6), in Elliott's Re -Subdivision of Cummings' Addition to the
City of Rochester, Minnesota, for place of beginning; running thence due North
parallel with the East line of Sixth Avenue Northwest in 'said City to a point
Four and One-half (4) feet West of a point where the South line of Eighth Street
Northwest, if extended West in a straight line, would intersect said East line of
Sixth Avenue northwest, if extended North, which is a point Five Hundred Ten and
Four -tenths (510:4) feet West of Quarter Section line; running thence West Sixty-
-six (Ei6) feet; running thence South in a straight line to a point Four and One-
_ half (4�) feet East of the Northeast corner of Block Eleven (11)9 in Elliott's
Re-►'ubdiv.ision; running thence East to place of beginning, in the City of Roch-
ester, Olmsted County, Minnesota:
And, Vhereas, said Common Council on July 25th, .19219 by resolution duly
passed and adopted, did condemn certain lands for said improvements, and did
appoint Commissioners to view said lands and award the damages that should be
occasioned by the condemnation and taking of said lands; and said Commissioners
having viewed the said lands and having made an award of the damages occasioned
- by the condemnation and taking of the said lands by said City of Rochester for
making said improvements, above described, did file their report of the assess-
ment and award of damages in the office of the City Clerk of said City, and said
report and award of damages aforesaid were duly confirmed by said Common Council
by resolution .adopted and passed on September 6th, 1921d

Therefore, Be it and. it i s hereby. resolved by said Common Coun-
cil :
That
the
whole
cost
and expense of
making the said improvements,
including
the
amount
of
damages awarded
for the taking of lands
necessary therefor, shall be assessed against each piece and parcel
of land end against each lot benefited by said improvement to -wit:
Commencingat the Northeast corner of Lot 5 in Block 6 of Ell-
iott's Re -Subdivision of Blocks 6 and 11; thence Vest 140 feet, North
57 feet, Nest 551 feet, North to the Railroad; thence Southeast to
the West line of Hunter (now 5th Avenue Northwest) Street; thence
South to place of beginning, less piece to railroad.
The Chicago Great Western Railroad Company Right-of-W4;
The Chicago & Northwestern Railway Company Right -of -Way;
That part of the Northwest Quarter of Section 35 `South of the
Mantorvill a Road and North of the Railway less the East .91 acre of
the South 10-2/3 acres of the Northwest Quarter;
The Fast 87-1 acres of that part of the Northwest Quarter of
Section 35 North of the Mantorville Road, less pieces to Lenz, Schultz
Bennett, Frank, Sawinski, Clark, Riess, Brooks and Langton;
That part of Blocks 5 and 12 North of the Railway, less piece to

Vol z; all in the City of Ro chest er, Olmsted County, Minnesota, with-
out regard to cash valuation, ratably `and. in proportion 'to the spec-
ial benefits conferred upon each said piece, lot or parcel of land.
Be it further resolved by said Common Council:
That a meeting of sd d Common Council will be held. et 8 o'clock,
P. M. on October 19th, 1921, at the Council' Chambers in the Cit. Hall
in said City, at which meeting all persons interebted in said im-
provement may appear and be heard before said Common Council in re-
lation to or concerning the said improvement, or the mode of assess-
ment for the cost and expense thereof, or any other matter upon
which they may desire to be heard:
Be it further resolved by said Common Council:
That the City Clerk of said City be and he' is hereby ordered
and directed to prepare lists which shall contain a, description of
each and all of the properties to be affected by the .assessments for
the cost and expense of making the said improvement and which lists,
together with a notice of .the time and place. of the meeting and hear-
ing, above mentioned, he' shall cause to be published once in the
official paper of the City of Rochester at least ten days prior to
the date of said meetingi,

ed to order the Public Utility Board to make installation of street lights as follows:'
One at the intersection of Third Street Southeast and Eighth Avenue South-
east;

the alley runniW east and west in Block 18 in Head and McMahon' s Addition
be referred to the Street and Alley Committee with power to act. -
Motion by Case second by Erickson carried that the City Engineer

The following application was read, and upon the recommendation of
Alderman Witzke, as Chairman of the License Committee, who stated that inso-
far as there are three persons concerned in the ownership of this Skating
Rink, there is much doubt as to whether the local National Guard Company
would priQfit by its operation or not, '11410tion by Case second by Miner
carried that the license requested be not granted:

Gentlemen:
Application for licence, to operate a roller rink in the local
Armory, is hereby made,
Said licence to start` from October 17, 19219 This rink is to
.solve two problems, 13t to ,get new recruits, second to help fiance the
Company.
Have seen Mr. Sears, Mgr., Stanley Hotel the other day in regard
to this rink,, and was informed by him, thet there are no objections at this
date, as all pations are'to'be moved to the new Y.ahler by the 15th October. -
Please take in consideration that the rink only operated 15 days
in June and licence where paid for one month, also that the City only pays
lights now, up untill last fall a apropriation -of 025090C. has been made in
addition to this,&

turned to the proprietor v;ith th.e request that it be itemized and again
submitt ed to this Common Council, and further that the City Cl'erk be in-
structed to notify the Chief of Police that in the future he rill refer all
eases that -require food or other assistance to the County Commissioners bf
' Olmsted County as this Common' Council feels that the citizens` pay taxes into
County funds for the taking care of such, and ebns'equently such cases are
not to be handled as City of Rochester ehargesw
Alderman P+itzke again complained that the Chicago and Northwestern
Railway Company were not giving the proper protection to their crossing over
First Avenue Northwest, and motion by 17itzke second by Erickson carried that
the City Clerk be instructed to again notify Mr. H. T. Banks, Local Agent of

the Chicago and northwestern Railway Company, ,that his company is not complying with
the local ordinances governing the protection :of that crossing.
Char] es H. i'xmstrong, City Engineer, said that, due to not sufficient stor-
e,ge room for gravel coming over the screen and belt conveyor, there is much delay
among the ,hauling equipment which is working on the gravelling of the approaches to the
City, and motion by Case second by Frank carried that the Street and A11ey Committee
and City Fhginaer be instructed to confer with the State Highway officials with a
request that they build a larger storage bin, and that,.in the event that they wdll
not comply with the request, said Street and Alley Committee and City Engineer shall
cause a storage bin of sufficient size to be constructed:
