IvTinutes of an adjourned regular meeting of the Common Council of
the City of Rochester, Minnesota, held in the Council Chambers, In the
City Rall, in said City, on October 10, 19211gat 8 o'clock, P.M.
Meeting called to order by President Weeks.
Roll Call: Present: Weeks, Case, E�ricksr�n, Frank, Witzka.
Absent: Miner, Olson.
President Weeks announced that this was the time and place fixed
for a hearing on the opening ofa public street described as follows, and
asked if there was any one present mho wished to be heard in regard to the
said improvement:
That a public street be laid out and opened along and across the
following real esta-6e, situate in -the City of Rochester, County of OlListeo
Minnesota, viz: Commencing at a point which is %- feet west of the South-
west corner of Lot 1, Block 89, in the Original Plat, of the Town, now
City, of Rochester, and running thence southerly in a straight line paral-
lel with the east line Of �uurth Avenue Southwest, if the same were extend.
ed in a straight line to the intersection with the north line of Rinth
Street Southwest, if the some were extended easterly in a straight line,
thence w,(.ut 60 feet; thence northerly parallel with the west line of FourhN
Avenue Southwest, if the same were extended, to a point 60 feet west of
point o- beginning, thence east to place of beginning.
There we:,> no one present who wished to be heard in any ;matter
concerning the opening of the above described street.

Northwest where the south line of Sixth Street Northwest mould intersect
said west line of Fifth Avenue Northwest, if same were extended in a
straight line; end running west in a straight line with the south line of '
Sixth Street Northwest to the east line of Sixth Avenue Northwest; thence
north sixty-six feet; th6Yice east in a straight line along the north line
of Sixth Street Northwest, if the same were extended, to -the west line of
Fifth Avenue Northwest; thence south sixty-six feet to the place of begin-

There was no one present vrho wished to be heard in any matter
concerning the opening of the above described street.
President Weeks announced that this was the time and place fixed

there was any one present who wished to be heard in any waiter concerring the said
improvement:
That a public street be laid out and opened along and across the follovving
real estate, situate ,in the City of Rochester, County of Olmsted, State of Minnesota,
viz: Commencing at a point 75 feet east and 12-,,'s feet north of the Northeast corner of
Lot 109 in Block 2_', in 'lilliams, Healy and Cornforth's Addition to.the City of Rochest
er, and running easterly on a line parallel to the south line of Ninth Street Southwest,
if the sage were extended in a straight line, for a distance of 648.5 feet, thence
north 50 feet, tlxence westerly along a line parallel with the north line of Ninth Street
Southwest, If the same -were extended in . a straight line, a distance of 848.5 feet to
the fast line of Sixth Avenue Southwest, thence south 50 feet to place of beginning.
There was no one present who vdshed to be heard in any matter concerning the
opening' of the above described street.
President Weeks announced that this was the time and place fixed for a hear-
ing on the proposed construction of sanitary sewers described as follows, and asked
if there was,any one present -who wished to be heard in any natter concerning either or,
any of them:
Commencing at a point in the center of Second Avenue northwest six feet north
of the center of Third Street Northwest and ruining southwesterly to a point 20 feet
west of :the center line of Second Avenue SortAhwest and 20 feet south of the center line
of Third Street Northwest, thence along a line 20 feet west of the center line of
Second Avenue Northwest and Southwest to a point 2.0 feet south of the center line of
Sixth Street Southwest, thence west along a line 20 feet south of the center line of
Sixth Street Southwest to the center line of North and South Alley in Block 689 Orig-
inal Plat, thence south along center line of. alley to a point in the center of Seventh'
Street Southwest, if the same were opened and extended in a straight line, thence

concerning the construction of eithar or any of the above described sanit-
ary sewers.
Thomas Fraser, as Attorney_ for the Township of Oronoco, asked for
a part settlement on the recent stipulation end settlement of damages
entered in judgment against_ the City of Rochester, Minnesota, and said that
his client would be satisfied with a part payment of about 83,500.0Q at
• this time) and would
allow the balance tto run until in
the
spring of 1922.
Motion by
Witzke second by Erickson carried
that
this matter be
referred to the Public Utility Board for their consideration with the
recommendation of the Common Council that the sum specified in the said
stipulation and settlement be paid from Public Utility Funds-,

The following application for license was. read, as was an accomp-
anying petition signed by many residents of the locality concerned, and
motion by Case second by Erickson carried that the said application and
petition be referred to the License Committee for their consideration:

business under the firm name of Rochester Bus Diner in operating certain
buses and jitneys within the City of Rochester, hereby petition and request
that a, license be granted. to us to operate a bus within said city, known as
Acme Model F, Truck No.; 7052, Engine No.- 87569 K, License Ko;; 80349 and
that ve may be permitted by you to ,operate the same as a jitney running
every half hour each way, from 6:30 o' clocX A.M , to 10:30 o'clock P.M0 on
each day of the week, over the following route within said city, to -wit:
Beginning at the K.V1,. Corne; of 1st Ave: S-*—%. and 1st St. S.W.
thence on 1st Ave. S.% to 2nd Street S.W;, thence on 2nd Street S,Wj to
2nd Ave. S.W,, thence on 2nd Avenue S;W; to 2nd Street N.W., thence on 2nd
Street K. W. to llth Avenue K. W* thencd on llth Avenue K. % to Center Street,
thence on Center Street West to 14th Avenue, thence on 14th Avenue S.;K4 to

further rights and privileges to detour on any other street only in case the above
mentioned route may be impassable,9 and then only during such times. And on receiving
such permission we agree to operate -such jitney over such route on each day at the
times above mentioned for the carriage of passengers for hire at five cents per. pass-
enger. We present herewith petition from residents along the line of such proposed
jitney route for your consideration.

,In thQ discussion of the above mentioned application for a license and
petition, ,Aldermen Case and Erickson said they would oppose the granting of this
license, as the parties concerned have agreed on a division of the territory within the
City, ,and .,suggested that the above petition be turned over to Mr. L. Van Tassel.
;Alderman Witzke said there is much demand fqr service from the locality
concerned .in ,this application for license, aid that mile Mr. Van Tassel was operating
on it he did not have a regular schedule which consequently rriade his service very un-
satisfactory. ,
Alderman Olson said that while Mr. Van Tassel was operating on this territory
thcre was one week he had only four or five passengers, and that he felt that Mr. Van
Tassel would operate in. this territory if it was profitable to him.
Alderman Frank stated that he favored, neither. of, the jitney bus line owners,
and only expected Jr. Van Tassel to give service where required, ` in his territory, and
if he would not,teen some one else should be licensed who would give service there:

The. application of Edwin A. Mohlke for a license as milk pro
ducer and milk distributor of raw milk, was read,, and motion by Case
second by Olson carried that the,said license be granted..
The report of the City- Weighmaster for the month of September,
1921, showing fees collected in the amount of $29'.20 was read, and motion
by Olson second by Frank carried that the same be referred to the Finance
Committeee,
The following report of the Health Officer for the month of September

Whooping cough - - - - - - 5
The whooping cough was the result of an out-of-to--m exposure. The typhoid
cases include one -non-resident. Of the other:, five were in one family, two in another.
Source of infection could not be determined with certainty.
deo. F. Strifert has taken over the office df sanitary inspector made vacant
by the resignation of Edward :Fanning.- Two warrants were sworn out during September
against property owners for failing to correct insanitary conditions.
Ko cases of contagious diseases were contracted in the schools during Sept-
ember, with the exception of colds, and possibly infantile paralysis: With the latter
disease it is usually impossible to determine the source.

The report of the City Treasurer for the month of July, 1921s, showing the
sum of $429,629.24 as being on hand, and the report of the City Treasurer for the month
of August, 1921, showing the sum of $3709203.05 as being can band, were each separately
read, and motion by Case second by Erickson carried that the same be placed on file:
Alderman Erickson, as Chairman of the Public Grounds Committees orally re-
commended that the bid of Olaf WeibBrg for the paintir_g and papering of the City Hall
be accepted, and motion by Olson second by Frank carried that the said recommendation
be accepted;
The following report of the Street and Alley Committee was read, and motion
by Erickson second by Olson carried that the same be accepted and placed on file:

In the matter of laying sidewalk beginning at the Southeast
corner of the intersection of Sixth Street and Third Avenue Southwest
along the west Bide of the abutting property of Mrs, William Easton's, the
Street and Alley Committee recommends that the City Engineer be instructed
to put in this walk -it his earliest convenience, providing the weather
permits.

and motion by Olson second by Erickson carried that the same be accepted
and placed on file, and that each of the reports of the City Engineer men-
tioned therein be accepted and placed on file:

Alderman Erickson introduced the following resolution which was
read: Be it resolved by the Common Council of the City of Rochester:

That the bid of Olaf Weiberg for the furnishing of all labor and
materials necessary for the painting and papering of the entire ,
interior of both upper and lower floors and all outside doors and
windows, frames, sash doors and metal work, gutters, grills and rail-

ings of the City Hall of the City of Rochester, Minnesota, in accord-
ance with the specifications now on file in the office of the City
Clerk of said City, et the following prices:
The painting and papering of the City Hall according to
specifications for the sum of $540.00

be, and the same is hereby accept ed -
The Mayor and City Clerk of said City • are hereby authorized and directed
to execute in behalf of the City of Rochester, a contract with said Contractor fbr
+she furnishing of the above mentioned labor and Tr, Pterials;
The amount of the bond to be given by said contractor is hereby fixed at
the sum of $600 00 Dollars.
Motion by Erickson second by Frank that said resolution be adopted as read:

Motion by Witzke second by Erickson carried that the certified checks of
the unsuccessful bidders on the painting and papering of the City Hall be' each re-
turned to them.
Alderman Erickson introduced the following resolution which was read:
• Whereas, the Common Council of the City of Rochester, Minnesota, at a meet-
ing thereof held on September 26th, 19^l, duly passed and adopted a resolution
declaring it expedient and necessary that local public improvements, the cost and
expense of which shall be paid by assessments, levied as provided by law, be made
in said City, said improvements consisting of laying out and opening a certain
street, as in said resolution described; and said Common Council in and by said
resolution ordered that a public hearing of all persons interested in the said
improvements be held at 8 o'clock P.M„ do October loth, 1921, at the Council
Chambers in the City Hall in said City, and directed the City Clerk of said City
to give notice, as provided by laws of the said hearing to all persons interested;
and said resolution was duly approved and signed by the Mayor of said City; and
Whereas, said City Clerk, as ordered in said resolution, did duly and
in due time publish a notice of the time end place of said public hearing and
the purposes for which, the same was to be held, in +,", a Rochester Daily. Bulletin,
the official paper of said City, on September 28th, 1921, and

That the City Engineer of said City of Rochester pis hereby dir-
ected to make a survey and plat of the said street herein ordered laid
out and opened, and to prepare all `necessary plans, profiles and spec-
ifications for said improvement and file same in the office of the
City Clerk, and also to make an estimate of the cost ar..d expense of
said improvement and report sane to the Common Coundil,
Motion by Erickson second by Frank that said resolution be adopt-

lel with the Korth line of Ninth Street Southwest, if the same were extended in a

west, thence South 50 feet to place of beginning,
Be it further resolved by said Common Council:
That said improvement herein above described be made and done, and the same
is hereby ordered made and done in the manner herein descri bed, end that the cost
and expense of said improvement, including the cost of all lands necessary there-
for, shall be paid by special assessments.9 levied as provided by law;
Be it further resolved:

Alderman Olson introduced the following resolution which was read:
Whereas, the Common Council of the City Of Rochester, Minnesota, at a meet-
ing thereof held on September 26th, 19219 duly passed and adopted a resolution
declaring it expedient and necessary that local public improvements,
the cost and expense of thich shall be paid by' assessments, levied
as provided by law, be made in said City, said improvements consist-
ing of laying out and opening a certain street, as in sAid resolution

that a public hearing of all persons interested in the said improve-
ments be held at 8 o'clock P.M, on October loth, 19219 at the Council
Chambers in the City Hall in said City, and directed the City Clerk
of said City to give notice, as provided by law, of the said hearing
